But the list of Black people, especially young Black men, murdered by the police only grew: Walter Scott, Freddy Gray, Jamar Clark, Laquan McDonald and on and on. It was only this spring that the fire next time arrived in full, when police brutally and unjustly killed Breonna Taylor and then George Floyd. Six years ago, Black Lives Matter was seen by most whites as a radical movement outside the mainstream. Police caught on video have been arrested, regulations protecting the po- lice are being repealed, polls reflect raised consciousness and shifting pub- lic opinions among white people as serious conversations about taking away money and responsibilities from police departments are underway in Minne- apolis, New York, Los Angeles and beyond. Black Lives Matter has been embraced by much of white America, both on the streets and in the halls of power. Some of this change is because the Black Lives Matter movement has spent years building and organizing; some of it is because the video of Officer Derek Chauvin’s cold-blooded behav- ior looks more ruthless than the Eric Garner (or even the Rodney King) foot- age; and some of it is because law enforcement has frequently responded to nonviolent and lawful protesters with arrogance and with barbaric violence. But there’s one other factor that has been overlooked: President Don- ald Trump deserves a perverse kind of credit for waking up white America to the devastating power of institutionalized racism and the need for systemic change. Trump has long been the most incompetent, self-serving and dishon- est president (a minority of) voters has ever elected. But he is also immoral and inhumane — not just a bully and a racist but a white supremacist and a fascist. And that has made all the difference. In 2014, it was possible for white citizens to say, “Well, that was terri- ble, but we can leave the push for change to those in charge.” This was not because Barack Obama was African-American but because he was honest, empathetic and competent, the sort of president you’d trust not to burn the country to the ground if you stopped watching the news for a day or two. Of course, that change never happened because of the entrenched racism (inves- tigations have revealed that many police officers are openly pro-Confeder- ate or white supremacist), the power of police unions and the reluctance of too many white politicians to lead beyond their constituents’ comfort zone. But Trump’s support of white supremacists at Charlottesville, his locking of children in cages, his constant belittling of minorities and immigrants (and the me- dia) and his utter mishandling of the coronavirus, revealed time and again his lack of care for anyone suffering anywhere. Finally, in the wake of George Floyd’s death, Americans realized this man not only could not be trusted to lead the way toward justice, he, along with henchmen like Attorney General William Barr, was a major obstacle. His reprehensible language — “dominate” the protesters with “real strength, with real power” and “when the looting starts, the shooting starts” — was ugly enough, but his unpatriotic clearing of Lafayette Square for his ill-ad- vised and pathetic photo op was just the finishing touch. But the silver lining — the horrifying behavior by law enforcement and Trump pushed more white Americans toward welcoming progressive chang- es — still exists in a large cloud, one that could unleash major damage come November. With Trump trailing badly in polls, it’s more likely he and fellow Republicans will stoop more readily to voter suppression and other illegal tactics. But there’s also a danger if Joe Biden wins and the Democrats take back the Senate. After all, the lesson from 2014 was that having another hon- est, empathetic and (hopefully) competent leader doesn’t guarantee anything. So it’ll be important to keep any celebrations short-lived and be ready to re- turn to the streets to make sure that change is finally going to come. FAILURE TO APPEAR LEADS TO DEFAULT JUDGMENT Appellate Division, Second Department In the Appellate Division, Second Department, defen­ dant Simone Bernard ap­ pealed from an order by Hon. Mark Partnow of Kings County Supreme Court, Civil Term. Bernard’s appeal stemmed from a mortgage foreclosure proceeding brought against her by LaSalle Bank, N.A. The complaint was marked disposed in November of 2013. Bernard’s counsel filed a notice of appearance dated Jan. 15, 2015. In an order dated Nov. 5, 2015, Justice Partnow granted LaSalles’s motion to restore the complaint to the court’s active cal­ endar. On Mar. 21, 2016, Bernard moved for leave to enter a de­ fault judgment and for an order of reference. In January of 2017, Bernard cross­moved to dismiss the complaint as asserted against her for lack of personal jurisdiction and to compel LaSalle to accept her untimely answer. Justice Partnow denied Bernard’s cross mo­ tion and she appealed. The justices of the Appellate Division, Sec­ ond Department affirmed the judgment of the Supreme Court. In their decision, the justices noted that the record reflected that Bernard did not oppose LaSalle’s motion to restore the complaint and, after that motion was granted in November of 2015,did not move to dismiss the complaint until some 14 months later, in Jan­ uary of 2017. They explained that even if Bernard’s jurisdictional argument had not previously been waived by the filing of the no­ tice of appearance, her subsequent inaction waived any claim that the court lacked personal jurisdiction over her. Additionally, the jus­ tices concluded that Bernard failed to establish a reasonable excuse for her default since she admittedly had knowledge of the complaint as early as January 2015 and offered no excuse for her 14­month delay in moving to compel LaSalle to accept an untimely answer after the complaint was restored to the Supreme Court’s active cal­ endar in November of 2015. As such, the justices agreed with the Supreme Court’s determination to deny those branches of Bernard’s cross motion which were to dismiss the complaint and to compel the bank to accept a late answer. —LaSalle Bank, NA v. Bernard, 2018‐06643, June 24, 2020 COMPLAINT OVER RENT OVERCHARGES RESTORED UPON APPEAL Appellate Division, Second Department Angel Santana resides in a rent­stabilized apartment owned by Maria Fernandez. In Queens County Supreme Court, Civil Term, San­ tana filed a complaint against Fernandez in an effort to recover dam­ ages for rent overcharged, based upon a rent reduction order imposed by the New York State Division of Housing and Community Renewal, effective May 1, 1986. In response, Fernandez moved for summary judgment dismissing that claim, contending that the statute of limita­ tions had expired. Santana cross­moved for leave to amend the com­ plaint so as to allege the applicability of a second rent reduction order issued by DHCR, effective Nov, 1, 1986 and to eliminate his second claim. In an order entered April 3, 2017, the Supreme Court granted Fernandez’s motion which was for summary judgment dismissing the first claim and denied Santana’s cross motion as academic. Santana appealed in the Appellate Division, Second Department where the order was reversed. In their decision, the appellate justices explained that Santana’s first claim to recover damages for rent overcharges based upon the May 1, 1986 rent reduction order was not barred by the then­applicable four­year statute of limitations and the “look­back rule” precluding the examination of the rental history prior to the four­ year period preceding commencement of the complaint. They noted that, since rent reduction orders impose a continuing obligation on landlords, tenants are entitled to recover for any rent overcharges oc­ curring during the applicable limitations period by reference to rent reduction orders that remain in effect during that period, even if the rent reduction order was initially issued outside the limitations period. Reviewing Fernandez’s contention that a prior DHCR proceeding barred the first claim, the justices determined that she waived that defense by failing to raise it properly. The justices concluded that the Supreme Court should have granted that branch of Santana’s cross motion which was for leave to amend the complaint, as the amend­ ment would not result in prejudice or surprise to Fernandez and was neither palpably insufficient nor patently devoid of merit. —Santana v.
