CHAPTER 1

EXECUTIVE SUMMARY

1.1 Project and public purpose

The proposed project is envisioned to construct APJ Abdul Kalam Technological University. For the implementation of the project an area of 39.61 hectares of land spread over Vilappil Village of Kattakkada Taluk in District needs to be acquired. After the establishment of the University in May 2014, the University functions inside the campus of College of Engineering Trivandrum (CET). The need for the project arises from the need for own campus for the University. As per the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 Section 2-(1)-(b)-(v), the project can be considered as a public purpose.

1.2 Location

The proposed land to be acquired is spread over an area of 39.61 hectares of land spread over Vilappil Village of Kattakkada Taluk in Thiruvananthapuram District.

1.3. Size and attributes of land acquisition

For the proposed project an extend of 39.61 hectares of land spread over 23 survey numbers in Vilappil Village of Kattakkada Taluk in Thiruvananthapuram District is to be acquired. The proposed area is located approximately 15 kms from Thiruvananthapuram Central Railway Station. The area is well connected through road facilities and frequent services is provided by KSRTC from all parts of the city to the proposed land.

1.4 Alternatives considered

The present location for the establishment of the University is located 15 kms from Thiruvananthapuram Central Railway Station and 18 kms from Thiruvananthapuram International Airport. Proposed location is well connected with road networks. The KSRTC regulates frequent bus services to the proposed location from various parts of the district. The proposed extend is the bare minimum to house all the facilities for the University. Well connected transport system is an added advantage. which includes very few building structures (especially residential structures) and well connected transport system was not available for the construction of the University.

1.5 Social impacts

For the proposed project an extend of 39.61 hectares of land spread over 23 survey numbers in Vilappil Village of Kattakkada Taluk in Thiruvananthapuram District is to be acquired. The area is mainly used for rubber plantation. Around 19 residential buildings and a poultry farm is identified at the proposed project area, which needs to be acquired for the project. Rehabilitation for the displaced people should be provided. A water stream is also present in the proposed area. Measures should be taken to conserve the natural drainage system in the area.

1.6 Mitigation measures

To mitigate the social impact of the proposed land acquisition, R&R package should be provided to the families as per the Policies issued by Revenue(B) Department, Government of vide G.O.(MS)No.485/2015/RD dated 23/09/2015 and G.O.(Ms)No.448/2017/RD dated 29/12/2017 for the rehabilitation and resettlement package for land acquisition in the state in lieu of RFCT in LAR&R Act 2013.

 The authorities should take necessary actions to ensure that the existing water bodies such as streams in the project area will not be affected during and after each stage of the implementation of the project.  Reconstruction of livelihood of people is an important factor in this project. It is a very difficult task to the people to recreate their commercial enterprises in a new area. So, the assistance should be provided to them in order to successfully recreate their livelihood.  The families losing place of stay should be provided with proper rehabilitation measures as per the Act.  Safety of the people during the construction phase of the project and healthy disposal of wastages which may arise out of construction should be ensured.

 Maintaining roads, pathways, present on the proposed land should be given priorities as the people residing on the boundary of the proposed land will face difficulties for free passage.

CHAPTER 2

DETAILED PROJECT DESCRIPTION

2.1 Background of the Project including Developer’s Background and Governance/Management structure

The proposed project is intended for the construction of APJ Abdul Kalam Technological University. Currently the University is functioning from a rented facility owned by College of Engineering, Thiruvananthapuram (CET). The University was established in the year 2014 by an ordinance No. 17 of 2014 and later by an act No. 17 of 2015 of State Legislature of Kerala as a state University vide notifcation No. 8558/Leg.G2/2014/Law dated 31/08/2015 and is empowered to award degrees as specified by the University Grants Commission (UGC) under section 22 of the UGC Act 1965 through its course. At present 143 colleges across Kerala are affiliated to the University. For the proposed project an extend of 39.61 hectares of land spread over 23 survey numbers in Vilappil Village of Kattakkada Taluk in Thiruvananthapuram District is to be acquired. The District Collector Thiruvananthapuram as per letter no. K3–159990/18 dated 26/11/2019 invited proposals t o conduct Social Impact Assessment prior to the Land Acquisition for the project. The Centre for Management was entrusted with the work by the Government of Kerala vide GO(P) No. 95/2019/RD dated 23/12/2019 (Kerala Gazette No. 3184 – Vol. 8 dated 24/12/2019) to conduct the Social Impact Assessment.

2.2 Rationale for Project, including how the project fits the public purpose criteria listed in the Act.

The proposed project intends to construct an independent campus for the APJ Abdul Kalam Technological University (APJAKTU) . Currently the University is functioning from a rented facility owned by College of Engineering, Thiruvananthapuram (CET). The implementation of the project will provide an independent campus for the university. The University is established with an aim to coordinate all the activities related to 143 Engineering colleges across Kerala. The advancement of science in the modern era caters the need for interdisciplinary

technologies with research based innovations. The University has not yet established teaching and research departments so far. The establishment of various departments have to be completed in a time bound manner. The proposed campus will house seven academic and research departments, to be called as ‘Schools’. The establishment of ‘Schools’ is essential to receive development grants from the UGC The University will qualify to get 12 (B) status of UGC, only if its campus is built and it should start at least five teaching departments. The campus needs to fulfil the norms laid down by UGC/AICTE. As per the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 Section 2-(1)-(b)-(v), the project can be considered as a public purpose.

2.3 Details of Project size, location, capacity outputs, production targets, costs and risks

The area to be acquired for the proposed project is spread over 39.61 hectares of land under 23 survey numbers in Vilappil Village of Kattakkada Taluk in Thiruvananthapuram District.

The University will house 7 schools in the proposed location

i) School of Mechanical Science and Engineering ii) School of Building Sciences and Engineering iii) School of Electrical and Communication Science and Engineering iv) School of Mathematical and Computing Sciences v) School of Life Sciences and Engineering vi) School of Humanities and Social Sciences vii) School of Basic Sciences

In addition to the academic buildings, other facilities are also needed to be constructed in the campus such as class rooms, faculty rooms, laboratories, research centres, central computing facility, central library, convention centre, guest house, student residence including international students’ hostel, faculty residence, staff residence, common infrastructure facilities such as power distribution centre, STP, other basic facility required for the campus of a University/Educational Institution, etc.

2.4 Examination of alternatives

The present location for the establishment of the University is located 15 kms from Thiruvananthapuram Central Railway Station and 18 kms from Thiruvananthapuram International Airport. In accordance with the proposed project, an independent campus will be established for the APJ Abdul Kalam Technological University.

2.6 Core design Features, size and Type of Facilities

The proposed project aims at the construction of APJ Abdul Kalam Technological University. The project requires a total area of 39.61 hectares of land spread over Vilappil Village of Kattakkada Taluk in Thiruvananthapuram District.

2.7 Need for Ancillary Infrastructural Facilities

In addition to the establishment of the University, a good road network should be maintained at the project area. The acquisition of the proposed land include pathways used by the people residing near the area.

2.8 Workforce Requirements (temporary and permanent)

The work force for the project is not yet assessed. Both temporary and permanent workforce need be employed with modern machineries and equipment at appropriate stages of the project implementation.

No Social Impact Assessment/Environment Impact Assessment has been conducted previously in association with the proposed project.

2.10 Applicable legislations and policies

The land acquisition for the proposed project is governed by the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013.

TEAM COMPOSITION, APPROACH, METHODOLOGY AND SCHEDULE OF THE SOCIAL IMPACT ASSESSMENT

3.1 List of all Team Members with Qualifications

The details of the team members involved in the SIA are given in Annexure III.

3.2 Description and Rationale for the Methodology and Tools Used to collect Information for the Social Impact Assessment

An inclusive and participatory approach through involvement of multiple stakeholders such as elected representatives and project affected people including vulnerable sections such as Scheduled Castes, Scheduled Tribes, women, and those among below poverty line, at appropriate stages of the project.

3.3 Sampling Methodology Used

Qualitative information was gathered along with the field survey through public consultation/Focus Group Discussions (FGDs) with all relevant stakeholders. The public consultation encompassed the project components as well as its socio- economic impacts. The SIA team had preliminary discussions with the key officials of the district administration and gathered information regarding the status of the government procedures, the project area and intensity of the acquisition. The team also made a preliminary site visit with the officials for physical inspection and information dissemination purposes. The existing conditions of land, status of infrastructure/structures, land use pattern and the facilities available to people residing in the project area were analysed.

The quantitative information regarding the families affected by the project was collected through household surveys, in the form of structured questionnaires. The survey was conducted in all the households of the persons affected by the project. The results of the survey provided information pertaining to the demography, socio-economic status and livelihood status of the target community, and formed the basis for development of Social Impact Management Plan.

3.4 Overview of Information/Data Sources Used

The primary data was collected directly from the representatives all affected families through face to face interview. Structured questionnaires were used for collecting the details of the affected people. The results of the survey provided information pertaining to the demography, socio-economic status and livelihood status of the target community.

The secondary data was collected from the Requiring Body and the Revenue department. The SIA team had preliminary discussions with the key officials of the district administration and gathered information regarding the status of the government procedures, the project area and intensity of the acquisition.

3.6 Public Hearing

In accordance with the Section 5 of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, a Public Hearing was conducted at Chowalur Devi Temple Auditorium on 12/02/2020 at 10:00 am to collect the views and opinions of the people affected by the project. Prior intimation was given to all the stakeholders regarding the date and venue of the public hearing through advertisements in leading newspapers, individual letters and/or over telephone and by notices displayed at various locations in the project site.

CHAPTER 4

LAND ASSESSMENT

4.1 Description of Land with the help of Maps, Information from Land Inventories and Primary Sources

The land to be acquired for the project is spread over Vilappil Village of Kattakkada Taluk in Thiruvananthapuram District. The sketch of the land for the proposed project is shown in annexure no. VI

4.2 Entire area of impact under the influence of the project

For the implementation of the project a total area of 39.61 hectares of land from Vilappil Village of Kattakkada Taluk in Thiruvananthapuram District needs to be acquired.

4.3 Total Land Requirement for the Project

For the implementation of the proposed project an extend of 39.61 Hectares of land Vilappil Village is required.

4.4 Present Use of any Public, Utilized land in the Vicinity of the Project Area

A building owned by Vilappil Grama Panchayath, Sushanth Memorial Centre for

Continuous Education (സുശാന്ത് മെമ്മാറിയൽ സാക്ഷരത െിഷൻ തുടർ

വിദ്യാഭ്യാസ മ്േന്ദ്രം).

4.5 Land (if any) Already Purchased, Alienated, Leased or Acquired, and the intended Use for Each Plot of Land required for the project

No land has been already acquired for the proposed project.

4.6 Quantity and Location of Land Proposed to be Acquired for the Project

A total extend of 39.61 hectares of land spread over Vilappil Villages needs to be acquired for the project.

4.7 Nature, Present use and classification of Land and if Agricultural Land, Irrigation Coverage and Cropping Patterns

The proposed project area is mainly used for rubber plantation. No other commercial cultivations are present on the project area.

4.8 Size of Holding, Ownership Pattern, Land Distributions and Number of Residential Houses

Houses of 19 families will be lost on acquisition. In addition to this land owned by 76 families need to be acquired. During public hearing 106 individuals also claimed that their land also will be lost on acquiaition. The details are listed in the Annexure No. VII.

4.9 Land prices and recent changes in ownership, transfer and use of lands over the last 3 years

As per the information received from the respondents, no land transactions were done in the proposed area for the last 3 years.

ESTIMATION AND ENUMERATION OF AFFECTED FAMILIES AND ASSETS

5.1 Estimation of families

Houses of 19 families will be lost on acquisition. In addition to this land owned by 76 families need to be acquired. During public hearing 106 individuals also claimed that their land also will be lost on acquiaition. The details are listed in the Annexure No. VII.

5.2 Family of Scheduled Tribes and other Traditional Forest Dwellers who have lost any of their Forest Rights

Majority of the families living in the area receive income through rubber plantation. The loss in land will affect the source of income of these families.

During the implementation stage of the project, the families and shops close to the project area are prone to be affected with different types of pollutions. Most of the residents who resides near to the boundary of the proposed sketch expressed their concerns over the pathways that will get acquired as part of the land acquisition of the project. They also raised concerns for the natural drainage system.

Project area mainly comprises of rubber plantation. No other commercial cultivations are identified at the project area.

Affected families maintain nuclear family structure.

The land is mainly used for rubber plantation. A poultry farm is also functioning at the project area. The acquisition of land will affect the income of people who depend on these as a source of income.

The local economic activity for the proposed area depends on rubber plantation. A poultry farm is functioning at the proposed area. The land acquisition will affect the people depending on these sources for income.

6.4 Factors that Contribute to Local Livelihood

Local Livelihood activities include income earned from rubber plantation and a poultry farm functioning at the project area.

6.5 Kinship Patterns and Social and Cultural Organization

Majority of the property belonging to the stake holders are obtained through hereditary. The project affected people have a harmonious way of living at the location.

The Quality of the Living Environment is fair in the project area with decent livelihood options and transportation facilities with access to amenities such as Schools, Hospitals, Civil Organisations, etc.

SOCIAL IMPACT MANAGEMENT

7.1 Approach to Mitigation

The CMD team made use of a combination of two research approaches i.e., quantitative and qualitative, for the identification of various social impact and the mitigation measures. Adoption of a combination of both qualitative and quantitative methodology was indented to obtain a more comprehensive data and more holistic result without excluding any important area of assessment.

7.2 Measures to avoid, mitigate and compensate impact

For the proposed project an extend of 39.61 hectares of land spread over 23 survey numbers in Vilappil Village of Kattakkada Taluk in Thiruvananthapuram District is to be acquired. The area is mainly used for rubber plantation. Around 20 residential buildings and a poultry farm is identified at the proposed project area, which needs to be acquired for the project. 7.4 Measures that the Requiring Body has stated it will introduce in the project proposal

The requiring body has stated that sufficient fund has been reserved as compensation.

7.5 Alterations to project design and additional measures that may be required to address the extend and intensity of impacts across various groups as identified during SIA

The alignment for the proposed project was prepared by minimising the negative impacts. No alterations to the project design is suggested.

7.6 Detailed Mitigation Plan including detailed activities to be carried out for each mitigation strategy, timelines for each mitigation strategy

The Government of Kerala had appointed Special Tehsildar LA General, Thiruvananthapuram to perform one or more functions of the collector under in the Right to Fair Compensation and Transparency in Land Acquisition, Resettlement and Rehabilitation Act (RFCTLARR), 2013 within their area of jurisdiction.

Also vide G. O. (P) M. No. 590/2015/RD dated 11 November 2015, Government of Kerala, in line with the sub-section (1) of section 43 of the Right to Fair Compensation and Transparency in Land Acquisition, Resettlement and Rehabilitation Act (RFCTLARR) 2013 and sub-rule (1) of rule 21 of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Kerala) Rules, 2015, the Deputy Collector (Land Acquisition) in each district has been appointed as the Administrator for Rehabilitation and Resettlement, for performing the functions under the said act and Rules in respect of involuntary displacement of persons due to requisition of land. The Administrator shall be responsible for the formulation, execution and monitoring of the Rehabilitation and Resettlement scheme in respect of land acquisition.

No. 589/2015/RD dated 11 November 2015, in exercise of the powers conferred by sub-section (1) of section 44 of the Right to Fair Compensation and Transparency in Land Acquisition, Resettlement and Rehabilitation Act (RFCTLARR), 2013, the commissioner for Rehabilitation and Resettlement supervising the formulation of Rehabilitation and Resettlement scheme or plans, proper implementation of the same and post implementation of social audit.

CHAPTER 10

SOCIAL IMPACT MANAGEMENT PLAN MONITORING AND EVALUATION

10.1 Key monitoring and evaluative indicators

Monitoring is a long-term process, which should begin from the starting of the project and should continue throughout the life of the project. Its purpose is to establish benchmarks so that the nature and magnitude of anticipated social impacts can be continually assessed. Monitoring involves the continuous or periodic review to determine the effectiveness of recommended mitigation measures. The types of parameters that can be monitored may include mitigation measures or design features, or actual impacts. All the mitigation measures stated in Chapter 7 should be considered as the indicators for evaluation.

10.2 Reporting mechanisms and monitoring roles

Rehabilitation and Resettlement procedures as stated in the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement act, 2013 will be applicable.

ANALYSIS OF COSTS AND BENEFITS AND RECOMMENDATION ON ACQUISITION

11.1 Final conclusions on: Assessment of public purpose, less displacing alternatives, minimum requirements of land, the nature and intensity of social impacts, and viable mitigation measures and the extent to which mitigation measures will address costs

The proposed project is envisioned to construct APJ Abdul Kalam Technological University. For the implementation of the project an area of 39.61 hectares of land spread over Vilappil Village of Kattakkada Taluk in Thiruvananthapuram District needs to be acquired. As per the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 Section 2-(1)-(b)-(v), the project can be considered as a public purpose. Around 20 residential buildings and a poultry farm is identified at the proposed project area, which needs to be acquired for the project. Rehabilitation for the displaced people should be provided. A water stream is also present in the proposed area. Measures should be taken to conserve the natural drainage system in the area.

The alignment of the proposed project was designed with an effort to reduce the number of people who will be affected with the land acquisition. Through the proper measures as per RFCTLARR Act 2013 the negative impacts of land acquisition can be mitigated.

11.2 The above analysis will use the equity principle as a framework of analysis for presenting a final recommendation on whether the acquisition should go through or not.

The acquisition of 39.61 Hectares of land spread over Vilappil Village of Kattakkada Taluk in Thiruvananthapuram District needs to be acquired for the construction of APJ Abdul Kalam Technological University. The proposed extend is the bare minimum required for the establishment of the University. --- residential structures are identified in the proposed location. The research facilities will attract international students. The University coordinates the academic activities of the 143 engineering colleges across the state. negative impacts, it can be observed that even though the recreation of livelihood and rehabilitation to those families who lose their place of stay need to be provided with proper mitigation measures, the implementation of the project will provide ample opportunities to the technological advancement to the nation by providing quality education to the younger generation.

The families that are affected would require adequate and fair compensation. So, the authorities should make proper action plan to reconstruct the livelihood opportunities for the people who solely relied on the project area for income. It is observed that many of the negative impacts highlighted can be minimized or reduced with effective and relevant mitigation measures and strategies mentioned. So the study recommends acquisition of the land providing proper compensation to the affected people.
