A peaceful election process would set a precedent for future democratic elections with diminished coalition and U.S. involvement. But on Saturday two workers for Abdullah Abdullah were shot and killed in the western city of Herat, and the Taliban has threatened to derail the campaign. Voters expressed anxiety about the safety of the polls, and said it could prevent people from casting ballots. Violence in Afghanistan has continued in recent months, with a recent Taliban attack on a Kabul cafe that served Western clientele killing 21 people.

Failure to conduct LB ISLAMABAD: The Supreme Court (SC) on Thursday observed it was an open violation of the polls violation of Constitution that the government was not holding local bodies (LB) elections in the cantonment boards. A two-member bench of the apex court comprising Chief Justice Tassaduq Hussain Jillani and Constitution: SC Justice Sheikh Azmat Saeed resumed hearing into the local bodies (LB) elections case. The SC asked as to what would be the consequence of any further delay in holding the local bodies (LB) elections in the cantonment boards in terms of Article 140A and as required by the Principles of Policy enshrined in the Constitution (Article 32). The court asked Attorney General Salman Aslam Butt to assist it on the points as to what could be the consequence of any further delay in holding of the LB elections in the cantonment boards in terms of Article 140A and as required by the Principles of Policy enshrined in the Constitution (Article 32). The court further asked the learned attorney general to assist it as to whether the LB elections in cantonment boards could be held under the existing law.The court ruled that the question of contempt against the Ministry of Defence Secretary Asif Yaseen Malik would also be taken up on the next date of hearing.The court observed that the LB elections in the cantonment boards had not been held since 1998 and now the reason being given by the federal government for the delay was that the government was contemplating on amending the Cantonment Act, 1924 and Cantonment Local Government Election Ordinance, 2002. The court also observed that holding of the local government elections was mandated by the Constitution.Earlier, during the hearing, the court asked Additional Attorney General Shah Khawar as to when the elections in cantonment boards would be held. Shah Khawar informed the court that the position on holding elections in the cantonment boards remained the same as an amendment in the laws was still to be made and was under process.He further told the court that a meeting was scheduled under the chair of the minister of defence with all the stakeholders but that meeting could not take place due to an emergency meeting between the minister of defence and prime minister. Meanwhile, the court adjourned the hearing till February 20. The court also issued anotice to the attorney general for February 20 in the case relating to the holding of local bodies elections in Sindh and Punjab.

SC admonishes govt ISLAMABAD - Chief Justice Tassaduq Hussain Jillani has said conducting Local Bodies (LB) polls in over delay in Cantt LB cantonment boards is legal and constitutional obligation of the government and any further delay cannot be allowed on this count. He gave these remarks while presiding over a 2-member Supreme polls Court bench hearing an appeal filed by the government against high court orders on annulment of The Nation 7th Feb, 2014 delimitation of constituencies in Punjab. “Enough is enough. LB polls have not been held in cantonment boards so far since 1998…. Responsibility for holding LB polls in cantonment boards rests with federal government. Defence secretary is facing contempt of court case for this reason. We will hear this case separately,” Justice Jillani said.“Delay in holding elections is breach of law and its consequences will not be good. Government had said it was legislating but legislation has not been enacted so far. People cannot be kept deprived of their rights for long time. Government should tell when it would hold elections,” the CJ remarked.“If government cannot make amendment then we will order for conducting LB polls under old and the existing laws. When amendment is made then we will get hold elections afresh under new laws. We have waited for government amendments to all possible limits and we will not allow more delay now. This is legal formality that government should hold LB polls in cantonment boards,” the chief judge said. The court observed that holding of LB elections is mandated by the Constitution in terms of Article 140A, as required by the Principles of Policy enshrined in the Article 32, and it asked Attorney General Salman Aslam Butt to assist on the consequence of any further delay in terms of these two articles of the constitution. The court ruled that

Government counsel Akram Sheikh said “the reasons of the decision have also come. I have applied for the decision. We will file the reply within next two days. The matters related to delimitations have been declared null and void in two provinces. Then how can the elections be conducted. High court has nullified delimitations in Sindh and Punjab. CJP remarked, “We will serve you notice that you should file reply within a week for providing assistance to us.”The court remarked further that these matters include: Firstly, delay in holding polls in cantonment boards leave what impact constitutionally; Secondly, if the federal government can hold LB polls in cantonment boards under the existing laws or not. The court sought reply till Feb 20 from the federal government as to if it was going to hold polls or not, and directed AG to assist it on the above said matters. Election Commission Secretary Ishtiaq Ahmed Khan later told the media outside the court that schedule for local body elections will be announce after completion of the process of delimitation by the provinces.

Jalil added that the groom had no outstanding warrants against him, nor had been nominated in any police report. He further revealed that Fahad was an MQM candidate for the upcoming local government elections. The MQM leader further said that they were trying to manage the fresh grief of extrajudicial killing of two of its workers, when this incident occurred. Jalil added that along with Fahad, another MQM worker, Rehan Qureshi, had been taken away by law enforcement agencies. He added that MQM was appealing to President, Prime Minister, Governor, Chief Minister DG Rangers to look into the matter.

CJ vows to decide ISLAMABAD: Chief Justice Tassaduq Hussain Jillani on Monday remarked that the Supreme Court delimitation of Sindh would decide the case of delimitation of constituencies in Sindh for the local government polls, in accordance with the Constitution and law. A three-member bench, headed by the chief justice constituencies on resumed hearing of the case regarding delimitation of constituencies in the province. Last month, the merit Sindh government had filed an appeal in the apex court against Sindh High Court (SHC) verdict that Dawn 17th Feb,2014 declared as illegal the fresh delimitations before the upcoming local government polls in the province. Awarding a legal victory to the MQM, the SHC on Dec 30 ruled all amendments made to the local government ordinance unconstitutional, paving way for the polls to be conducted under previous delimitations. During the course of proceedings, counsel for Muttahida Qaumi Movement (MQM) Farogh Naseem appeared before the bench and said that according to constitution a person is entitled to cast only one vote in the municipal elections and delimitation of constituencies were conducted without following the law, terming the Sindh government act illegal. He said that according to the Constitution, only Election Commission of Pakistan (ECP) can change the delimitation of constituencies and article 51 of the Constitution stated that the National Assembly seat should be in proportion to the population. On this, Justice Azmat Saeed remarked that seats are available but the proportion of the population has not been published. The MQM lawyer also challenged the matter of delimitation of constituencies through deputy commissioner, adding that there were no guidelines in this regard. Later, the court adjourned the hearing till February 18.

Going green for PESHAWAR: Minster for Local Government (LG) and Rural Development Inayatullah Khan said ‘Peace’: LG minister around 0.8 million saplings will be planted across the province during an ongoing cleanliness drive titled ‘Peace’. That’s 32,000 saplings per district. The minister participated by planting an olive plant promises 0.8m sapling in Hayatabad on Monday.Inayatullah said when he took oath as a minister, he had promised a saplings to be planted clean and green province and he still stands by those words. “We will provide a healthy and pleasant across K-P environment for residents.” The task cannot be achieved without the participation of educational th institutes and civil society, emphasized the LG minister. Media should also play its role to make the Expess Tribune 18 Feb, drive a success, he added. “People in K-P are confronted with various issues and planting these trees 2014 will be a positive activity,” greenery is not only essential for humans but for animals too, claimed the minister. Inayatullah said as a result of the drive, the province will be able to produce raw materials for

medicine and will be able to spread awareness about medicinal plants and their importance. The LG minster thanked participants who contributed in the drive, “Cleanliness is an integral part of religion.” He also appealed to the public to help municipal workers make the drive a success. Meanwhile, Governor Shaukatullah Khan launched the ‘Spring Tree Plantation Campaign’ for the tribal areas by planting a chir (pine) sapling at Governor House on Monday. Federally Administered Tribal Areas (Fata) Additional Chief Secretary Arbab Muhammad Arif was also present in addition to other senior officials of the FATA Forest Department. It was mentioned on the occasion that 3.5 million saplings of different trees will be planted throughout Fata. Of these, 3 million will be planted by the forest department itself while the rest will be planted by various departments, security forces personnel, students and the public at large.

Election strategy: PESHAWAR: The tripartite alliance of Pakistan Peoples Party (PPP), Jamiat Ulema-e-Islam-Fazl (JUI- Tripartite alliance F) and Awami National Party (ANP) on Monday urged the government to conduct local government (LG) polls at the earliest. Talking to reporters following a meeting of leaders of the three parties at the demands LG polls at residence of PPP senior leader Najumuddin Khan, alliance coordinator Mian Iftikhar Hussain said the the earliest tripartite alliance of opposition parties was aimed at giving the ruling coalition a tough time. “It is meant Expess Tribune 18th Feb, to provide the public with an alternative platform against the ruling alliance,” he said. Hussain added 2014 the constituent parties were intent on making this partnership a success. The alliance coordinator revealed the three parties have also decided that the alliance will be extended to the district level in preparation for the local bodies’ polls. He said in this regard, a tri-party meeting for central provincial districts, including Peshawar, Charsadda, Mardan, Nowshera and Swabi, will be held on February 21 at the residence of PPP leader Iftikhar Jhagra in Peshawar. On February 24, party leaders from Malakand division will meet at Chakdara; Hazara division leaders will convene in Abbottabad on February 26; and on March 1, a meeting for southern districts of K-P will take place in Bannu. Mian Iftikhar said the constituent parties have also agreed to retain the alliance for by-elections. The ANP leader added that political parties had given their mandate to the government at the time of the all- parties conference. Iftikhar claimed that terrorism-related incidents will not be tolerated simultaneously with the process of dialogue, claiming the government has failed to control the situation. He also criticised the Pakistan Tehreek-e-Insaf (PTI) – led government, saying it was pushing the province to a civil war like situation by neglecting its duties. He proposed that a search operation should be carried out in the city before sealing the city to ward off terrorist threats. PPP Provincial President Khanzada Khan, General Secretary Humayan Khan, former K-P assembly speaker Kiramatullah Khan, Najmuddin Khan, Rahimdad Khan, JUI-F deputy amir Maulana Attaur Rehman, Senator Ghulam Ali and ANP’s Syed Aqil Shah were also present at the occasion.

SC orders govt to ISLAMABAD: The Supreme Court (SC) on Wednesday warned the federal government to appoint the appoint CEC within chief election commissioner (CEC) within a month or the court would issue the orders in this regard. Justice Mian Saqib Nisar remarked, “The government is not discharging its legal and constitutional obligations due to which regular officers have not been appointed so far against legal and constitutional posts.” He further observed, “For want of regular Chief Election Commissioner (CEC), Justice Nasirul Mulk has to go to the Election Commission by leaving the most important cases of Supreme Court (SC). The appointment of acting CEC is temporary. A regular CEC has not been appointed for the last six months. Thousands of cases are pending owing to non induction of chairman and members in FST. Rush of cases has increased in high courts.” He further remarked, “It is better the government should discharge its obligations or we will be forced to issue any order. The government should not create difficulties for us and for itself.” At the inception of the hearing, the Attorney General (AG) Suleman Butt, parliamentary secretary and others appeared before the court.Justice Saqib Nisar remarked, “Only you can deal with this matter. The FST is not functional as per the SC’s 2013 decision. Several cases are pending hearing in high courts and this situation is alarming. It is said that the respective forum which the law has given is not there. The tribunal does not exist under Article 212. Ascertain from the government when will these tribunals be constituted. When will the amendment be introduced in the Constitution? The government is not addressing several important legal matters. It causes embarrassment to us particularly. Fakharuddin G Ebrahim resigned from his office in August. Six months have passed but a regular CEC has not been appointed. The acting CEC is for a short period. We are giving one month’s time to the government. FAFEN points at ISLAMABAD: The Election Commission of Pakistan must take immediate and effective measures to address critical discrepancies in voter registration especially of women voters, timely finalisation and

discrepancies in adherence to polling schemes and consolidation of results to improve the quality, legitimacy, transparency and effectiveness of elections, the Free and Fair Election Network (FAFEN) said on general elections 2013, Friday. In press release issued on Friday, the network put forth its recommendations on the basis of recommends removing findings compiled in its first detailed report titled “National Assembly Election Result Analysis” based them on data gathered through citizens’ observation of General Elections 2013 and Election Commission of st Pakistan’s (ECP) official documents. Parallel Vote Tabulation (PVT), turnout trends, voting patterns Express Tribune 21 Feb, and an in-depth analysis performance of political parties, are the key features of this report, which 2014 analyses the results of 266 out of 272 National Assembly constituencies. FAFEN claimed that the issue of voter registration is of primary concern as the number of registered voters in general elections 2013 decreased in 100 NA constituencies compared to the general elections 2008 despite a considerable increase in the issuance of computerised national identity cards (CNICs). The under- registration of women voters continued to undermine universal suffrage, equal representation and their constitutionally-promised measures to enhance participation of women in national life. Of the 86.2 million voters, 43.6% were women compared to 80 million voters in 2008 with 44% women voters. The finalisation of polling scheme by the ECP two weeks before the election day is a legal requirement and it cannot be changed by the returning officers (ROs) without prior permission of the ECP and a subsequent notification to that effect. FAFEN found that the number of registered voters in 93 NA constituencies was recorded differently in final polling scheme, election results accruing an absolute discrepancy of 246,858 voters. The distribution of constituencies showing voter discrepancy is significantly skewed across the regions with Punjab leading with 57 of the 93 NA constituencies showing a difference of voters between the final polling scheme and result Form XVII. Khyber Pakhtunkhwa has 16 such constituencies, followed by Sindh (15), FATA (4) and ICT (1). Of the total of 246,858 votes in question, Punjab accounts for 233,225 (94.5%), Khyber-Pakhtunkhwa 6,462 (2.6%), Sindh 6,317 (2.6%), FATA 580 (0.2%) and ICT 274 (0.1%). It is a serious question to the transparency of the elections and the ECP must look into this matter and ensure that the polling scheme is not changed after the stipulated time in order to protect the rights of the voters. The result consolidation process which includes ballot count, vote count, consolidation and finalisation of results must be transparent for the fairness of the elections and the ECP must release election results along with Form XIV (Statement of the Count), Form XV (Ballot Paper Account), Form XVI (Consolidation of Statement of the Results of the Count) and Form XVII (Result of the Count) for electoral transparency. The need is further reinforced by the fact that Form XVII published on the ECP website following the elections did not mention the number of rejected votes while the gazette notification of returned candidates did not record the number of registered voters. The ECP should hold the election officials responsible for consolidation, finalization and certification of results with discrepancies and stern action should be taken against them so that such irregularities could be checked in the future elections. The disproportionate and significant increase in the number of rejected votes emerged as one of the major discrepancy – the number increasing from 775,720 in 2002 to 973,694 in 2008 and further increasing to 1,502,717 in 2013 – an increase of 64% compared to 2008 elections. The issue is critical not merely due to the numbers but also given the skewed distribution across constituencies and regions – the numbers range from 0 in NA-53 to 25,908 in NA-266. From the results’ perspective, the issue is highlighted further by the fact that the number of rejected votes exceeds the margin of victory in 35 of the 266 constituencies analysed in this report. The report’s analysis of turnout trends in the 266 constituencies highlights an encouraging trend while the overall turnout was recorded at 54.7% (+/- 0.03%), a substantial increase, vis-à-vis 2008, across urban as well as rural areas bodes well for the legitimacy and public trust in the democratic system. The urban constituencies registered a substantial increase in turnout by 17%, followed by majority urban and predominantly urban constituencies seeing an increase of 13.2% and 12.8%, respectively. The predominantly rural constituencies witnessed an increase of 10.9% while majority rural constituencies showed an increase of 10.6%. The 2013 elections witnessed returns for parties that varied across regions and provinces. While Sindh largely produced similar results – PPPP dominated rural Sindh while MQM urban areas, particularly Karachi – the other provinces underwent a significant change. PML-N and PTI were the largest beneficiaries of the change in Punjab and Khyber-Pakhtunkhwa while Pakhtun and Baloch nationalist parties made a strong comeback in Balochistan. Among the religious parties, JUI – while far from the overwhelming performance of MMA – secured significant votes and seats in both Khyber-Pukhtunkhwa and Balochistan. For the 2013 elections, a total of 4,462 contestants vied for the 266 constituencies covered in this report. PTI fielded the most candidates, competing from 230 constituencies, followed by PPPP (227), PML-N (215) and MQM (207). Independent candidates constituted the largest group with 2,343 while other parties fielded a total of 1,240 candidates cumulatively. From the perspective of gender representation and participation, the elections had the most female candidates (161) compared to the number of female candidates in the previous two elections – 75 and 61 candidates contested in 2008 and 2002 elections, respectively. Most – 123 of the 161 – contested either as independent candidates (95) or from the platform of smaller/regional parties (28). Among the mainstream parties, PPPP awarded tickets to 15 females, followed by MQM, PML-N, PTI, and PML with 8, 7, 6 and 2 candidates respectively. Of the 161 women contestants, only 6 were successful in winning their seats in the 2013 elections compared to 16 and 13 successful female candidates for the 2008 and 2002 general elections, respectively. FAFEN recommends the Election Commission of Pakistan (ECP) to remove discrepancies in voter registration, finalisation of polling schemes and consolidation of results. These steps are very crucial for credible and transparent elections which enhance citizens’ trust in democratic processes and can lead to accountable, transparent and efficient governance in the

Dissenting note: LAHORE: Lawyers in five divisions of the province have decided to boycott the Lahore High Court Lawyers in 5 divisions Bar Association (LHCBA) elections scheduled on February 22, The Express Tribune has learnt.They are protesting the lack of Lahore lawyers’s support for demand for benches of the Lahore High Court to boycott LHC bar in their areas.Lawyers of Faisalabad, ujranwala, Sahiwal, Sargodha and Dera Ghazi Khan have election decided against voting in the upcoming elections of the LHCBA. An inter-division committee of the Express Tribune 21st Feb, lawyers association decided last week they would take action against any lawyers they participated in 2014 the elections. Tanveerur Rehman Randhawa, president of the Faisalabad Bar Association and the head of the inter-division committee (IDC), told The Express Tribune that the LHCBA representatives had “cheated” by not supporting the establishment of LHC benches in five divisions. He said a lawyer from Bhakkar had to spend three days to attend a single hearing at the Lahore High Court under the current arrangement. He said it often became too expensive for lawyers from these divisions to travel to Lahore and stay for court proceedings.He said the litigants also had to travel long distances to attend court proceedings.He said if LHC benches, like those in Multan, Rawalpindi, and Bahawalpur, had been setup in Faisalabad, Gujranwala, Sahiwal, Sargodha and DG Khan, many problems faced by litigants and lawyers would have been resolved. He said the burden on the principle seat of the LHC would also be reduced. He said the lack LHCBA support in this regard had been disappointing. The LHCBA general house meeting, under its president Abid Saqi, had also passed a resolution against the proposal to setup new LHC benches. Randhawa said instead of helping them, the LHCBA had sabotaged their campaign by passing the resolution. He said in a meeting of the IDC, lawyers had decided not to participate in the elections and urged the bar association to take disciplinary action against their members if they cast their vote. Shafqat Mahmood Chohan, a presidential candidate for the LHCBA, said some lawyers were trying to sabotage the elections.He said most lawyers would still participate in the elections. He said he had arranged for pick-and-drop facilities for lawyers of all parts of the province. He said if elected, he would not oppose establishment of the new benches. He also said, however, that he would also not join the campaign. The number of voting members of the LHCBA has dropped by 1,628 over last year even after registration of 1,138 new voters. Last year, there were 18,895 voting members of the LHCBA. This year, the number is 17,267. As many as 6,280 lawyers have not paid their vote renewal dues.

They were talking at a consultative session titled Transparent and Accountable Local Government System in the Punjab government polls organised by the Institute of Social and Policy Sciences (I-SAPS) in collaboration with Citizen Voice necessary to facilitate Project of the USAID. Lawmakers representing the Pakistan Muslim League-Nawaz (PML-N), the masses’ Pakistan Tehreek-i-Insaf (PTI) and the Pakistan Peoples Party (PPP) said holding of local government st elections and devolving powers to the grassroots level would serve the people. PTI’s Ahmad Khan Bhachar, Mian Aslam Iqbal and PPP’s Khurram Jahangir Wattoo criticised the delay in holding the polls. They said the ruling party was not interested in devolving power to the grassroot level. “The inordinate delay for one or the other excuse is regrettable,” Bachar said. He also said the government should immediately hold a census. Earlier, Muhammad Naeem Sidhu, a research fellow of the I-SAPS, gave a presentation on the issue of local governments.He said to ensure transparency, accountability and appropriate delivery of services at the doorsteps of common man, holding fair and free local government election was of immense significance.

SC seeks Punjab ISLAMABAD - The Supreme Court Thursday ordered the Advocate General Punjab to inform today govt’s fresh stance on whether the Punjab government is interested in challenging the Lahore High Court judgment regarding Local Government polls. A three-member bench, headed by Chief Justice Tassaduq Hussain Jillani, LG polls hearing the local government elections case also directed the Sindh government counsel to provide The Nation 21st Feb, 2014 the copy of Charter of Democracy, signed by PML-N leader and incumbent Prime Minister Nawaz Sharif and Benazir Bhutto in 2006 in London. During the proceedings, Khawaja Haris, amicus curea, argued the provincial governments have to frame the Local Government Institutions laws, while the Election Commission o Pakistan has to carry out the delimitation process. Khawaja Haris said right to vote is more important than the fundamental rights, because it was the basis of constitution and the democracy. The amicus further contended that Article 140A of the Constitution was about local bodies system and according to that it was the responsibility of the provincial government to frame laws for the local bodies’ institutions and ECP was empowered to carry out the delimitation of the constituencies. He said the election process starts with the notification of election schedule, but in 1973 Constitution the words ‘holding of elections’ have been used, which included the process from preparation of voter lists and the delimitation. The bench inquired what was the purpose of inserting Article 140A in the Constitution? Khawaja Haris stated to make sure the local bodies elections are held in transparent manner, as before that the LB elections held were dissatisfactory. The chief justice questioned as to whether the political parties did not trust each other, therefore, Article 140A was

inserted in the constitution. The CJP further asked whether this LB system was the part of Charter of Democracy. The learned counsel said he thinks it was but not quite sure about it. The bench then put that question to Farooq H Naek, the counsel Sindh government. He replied that it was the part of Charter of Democracy. The court therefore directed him to provide the copy of CoD on Friday. Khawaja Haris further argued that the local bodies institutions had financial power, but it’s control was with the provincial governments. But now the local bodies’ institutions have been given full financial power and they could spend funds without getting dictation from the provincial governments. He said the delimitation process was very important in LB polls because any error in that could not been rectified later on, which is against the spirit of transparent polls. Justice Sheikh Azmat Saeed remarked if it was accepted that the election process commences with the announcement of election schedule then all the provisions regarding preparation of voter lists would be unconstitutional as the voter lists are prepared before the elections. He questioned if the voter lists were part of election then why delimitation couldn’t be part of election process. These two are interlinked therefore either they have to be excluded or include in the constitution. Khawaja Haris concluded his arguments, while Makhdoom Ali Khan, another amicus curea, had already completed his arguments on Thursday. Advocate General Punjab Mustafa Ramday informed the court that the Lahore High Court had passed two orders regarding local bodies polls. He said the Punjab government had accepted the LHC first order, while have objections on certain portions of the LHC second order. The court inquired, why the Punjab government had not challenged the LHC orders? Mustafa Ramday replied that it had already been challenged by Azhar Siddique. Justice Azmat asked whether the Punjab government was relying on Azhar Siddique. The advocate general Punjab told that after taking instruction from the provincial government he would informed the court about it. Upon that Justice Azmat Saeed remarked that they know why the Punjab government was not challenging the LHC orders. Mustafa Ramday stated the provincial leadership was in China. The court asked him to take the instruction from the Punjab government and inform on Friday.

Situation to worsen if PESHAWAR: As the Federally Administered Tribal Areas (Fata) is once again the focus of military LG polls not held in reprisals against the Taliban, representatives of different segments of the society gathered around a table in a plush hotel here to debate the prospects of holding local government elections in the tribal Fata, warn participants region. They acknowledged there were several stumbling blocks, but insisted they should not provide th excuses to the federal government to keep the already deprived region without local government The News 24 system. He said it would be disastrous to prolong exclusion of tribal people from the political process and urged the Pakistan Muslim League-Nawaz government to conduct polls for local governments in the region. The government has been wrestling with a number of problems in Fata and calls for holding local bodies’ elections seem unlikely to catch attention of the authorities. Currently, the government is preoccupied with thoughts how to dismantle the Taliban safe havens in this borderland that is believed to be supplying terrorism to the rest of the country. Jetfighters and gunship helicopters targeted suspected locations of militants in different tribal agencies over the last several days to punish militants for carrying out a spree of terror that killed dozens of people. However, participants of the roundtable insisted that fight against terrorism should not be used as an excuse to avoid elections for local governments. “Law and order situation should not provide justifications to the government to not hold local bodies’ elections,” Ashraf Ali said, briefing the media after the event. “We believe that if elections for the National Assembly could be held, conducting local government polls should not be a problem,” he added. Engineer Toor Gul Chamkani, Sheikh Jehanzada, Brig (r) Said Nazeer, Mufti Hanif, Sakeena Rehman and Ikramullah Kukikhel were some of the participants. Ashraf Ali said his organisation held the event to generate a debate on local government system in the tribal areas. He said it was part of a series of events aimed at pressuring the government to take steps for holding the elections. The Frontier Crimes Regulation (FCR), a special set of laws that administer the tribal areas, is also an obstacle in putting in place the local government system in Fata. The FCR concentrates all the administrative, judicial and financial powers in the office of the political agent, undermining the role of the elected leaders at the grassroots level. But Ashraf Ali said that though the FCR needed more amendments to make it compatible with rights and wishes of the people, it still didn’t impede holding the elections. “Election could be held under the FCR, though it needs changes,” he said. Sheikh Jehanzada from Bajaur said political system in Fata would take roots after local government elections. He said the impression about tribesmen that they did not want to change the system was wrong. “We even want to change the name of PA,” he said, pointing to the point that how they were sick of the system controlled by political agent. “If we hold elections, we would be able to sort out flaws in the system,” Brig (R) Said Nazeer said. Ashraf Ali said the roundtable discussed three main questions: a) should local government elections be held in Fata? b) What could be its structure? and c) What could be qualification for the public representatives? He said there was a consensus among the participants that the local government elections should be held without delay. They recommended that the local government system in Fata should have three tiers-union council, tehsil council and agency council. He said the participants suggested the office of the PA should surrender judicial and financial powers to local governments and could share administrative powers
