As stated in the Joint Case Management Statement filed on August 17, 2007, Plaintiff has diligently attempted to serve foreign Defendant Meir Barel with the Summons and Complaint in the within matter filed on January 19, 2007. Plaintiff is continuing to effectuate service on Dr. Barel, and has therefore enclosed two copies of a Letter Rogatory as well as two copies of a Request for Service Abroad of Judicial Documents previously provided to Plaintiff's Counsel by the Court Administration. Both documents must have an original signature from Your Honor, as well as a seal from the Court.

The complaint in the Meir matter was filed in January of 2007, alleging claims for violations of Sections 10(b) and 20(a) of the Exchange Act. Plaintiff claims that Defendants issued materially false and misleading statements about the Company in order to artificially inflate the price of Alvarion stock long enough to allow insiders to sell their privately held shares.

Defendant Meir Barel has 45 days from the date of service to file an answer to Plaintiff's Complaint
