TERMS & CONDITIONS 2021/22 MEMBERSHIP Season

References in “members” or “memberships” relate to the rights and obligations attaching to packages sold by the Bullets Basketball Club (“the Club”) for each home and away National Basketball League (NBL) season unless specified otherwise. The following table outlines five various categories of basketball membership for home and away NBL season 2021/22.

4-Game Memberships Platinum, Gold, Silver and Bronze Yes – priority 2 memberships purchased under the 4-game category given the member access to 4 home games at Nissan Arena.

Non-Access Memberships 6th Man Supporter adult and Yes – priority 3 junior have no regular game access included in their package.

Other Baby Baller does not include any No Priority Access to Finals games access.

Any product sold through the membership website or system that is not listed above is not classified as a membership. 1. MEMBERSHIP 1.1 A concession discount is available on game access membership products. The member must hold a valid Pension Card (aged, single parent, disability or veterans’ affairs). Students must be enrolled full time to qualify for a concession discount. Health Care, Health Benefits and Senior Cards do not qualify for the concession discount. 1.2 A colour copy of a valid Concession Card must be provided to the Club at the time of the membership purchase or application. Concession memberships will not be issued until proof of concession has been provided.

1.3 A member having been issued with a National Companion Card may apply for the issue of a second seat at no extra charge to accommodate their companion. The National Companion Card must be sighted before the extra ticket can be issued. The ticket will be issued in the name of the card holder. The National Companion Card membership issued does not attract any rights, entitlements or benefits. The member is responsible for the conduct of their companion and will ensure that their conduct is in accordance with the Brisbane Bullets Code of Conduct policy.

1. MEMBERSHIP (continued)

1.4 Junior Memberships can be purchased for children aged under 15 years as of January 1, 2022 (born after January 1, 2007). Proof of age must accompany the purchase or application for membership, if not already on file. Proof of age can be supplied in the form of a birth certificate, passport or letter from the child’s school on official school letterhead signed by an authorised representative. Memberships will not be issued until proof of age is supplied.

1.5 A family membership consists of two adults and two children aged under 15 years as per the above conditions referred to in 1.4. Should the family have additional adults or children to add to the group, these will be purchased as a standard adult or junior membership.

1.6 The name, date of birth and relevant proof of age must be supplied at the time of purchase for the family membership.

1.7 The Club reserves the right to move existing members to accommodate the inclusion of a junior membership to ensure they are seated with an adult or family. Any members affected will be notified immediately and moved to comparable seating.

1.8 Brisbane Bullets memberships are non-transferrable and remain the responsibility of the member.

1.9 The membership card remains the property of the Club. Memberships cannot be on-sold for any purpose, exploited for commercial use, or used for promotions purposes or campaigns without the express written permission of the Club. Members in breach, will have their membership cancelled without refund.

1.10 All Brisbane Bullets basketball memberships relate to a specific home and away NBL season. The respective membership fee for each membership is valid during that home and away NBL season only. All memberships expire at the end of each home and away season.

1.11 The membership fee is for one season. The fee will not be reduced for new or renewing applications joining at any point once the season has commenced.

1.12 The Club does not accept any responsibility for membership cards that are lost, stolen or destroyed. Lost membership cards should be reported immediately to the Bullets Membership team on 1300 MYBULLETS or email [email protected]. Upon confirmation that the card has been lost, a replacement will be issued at a cost of $10.00 for those reported prior to January 31, 2022. Alternatively, members may log on to their online account and manage their tickets digitally. No replacement cards will be issued after January 31, 2022.

1.13 All members must always comply with the Club’s Code of Conduct policy within Brisbane Bullets venues and facilities. On game day, members must also comply with any stadium or venue terms and conditions of entry, and the ticketing terms and conditions issued by the relevant ticketing agent on game day. Any violation may result in the membership being withdrawn from the offending party without refund.

1.14 The Club reserves the right to refuse any application. The Club also reserves the right to cancel a membership without refund to any member in breach of these terms and conditions.

1.15 The cut off for members to purchase a membership for access to Finals in the event the Bullets qualify for the 2021/22 season, is midnight of the last round for the home and away NBL season.

1.16 Members should notify the Club immediately of any changes to address or contact details. All members of the household must update their details. Members can change their details online through their online account or by calling or emailing the Membership team.

1.17 Children aged four (4) years and over as of (January 1, 2022) will need to obtain a membership with Finals entitlements if they wish to be eligible to purchase Finals tickets during the priority rights access listed in the table referenced on page one (1) of this document.

1.18 Season Members are eligible to purchase additional tickets for guests at a discounted rate. The discounted rate is determined by the Club each season and is subject to change. The discount strictly applies to Platinum, Gold, Silver and Bronze seating. The Club does not guarantee that guests ticket allocation will sit them directly with the member. However, when booking directly with the Club, every effort will be made to allocate the closest available seat.

1.19 All Members are issued with an account ID and password for their online account. It is the members responsibility to protect this information. The Club is not responsible for any changes that are made of this site if the member allows access to their account by another party.

1.20 Season members have the opportunity to utilise ticket forwarding and ticket replacement functions through their online account. Should a member access these services, the members or guest who is sent a ticket is electronically required to print or use the e-ticket. The barcode on the members original card will be cancelled for the applicable game.

1.21 Any basketball member wishing to utilise their membership entitlements, must be up to date with all payments due on their membership or additional products purchased. The Club reserves the right to decline an application if the monies are outstanding on the account.

2. SUPPORTER 6TH MAN MEMBERSHIPS

2.1 Supporter 6th Man adult members must be aged over fifteen (15) years and junior members aged under fifteen (15) years as of January 1st, 2022, as referenced in 1.4.

2.2 Supporter members wishing to use their one complimentary ticket for an interstate game, must place their request with the Membership team no later than two (2) weeks prior to the respective game day. The category and location of the ticket provided will be at the discretion of the home team. The Brisbane Bullets bear no responsibility if basketball members are unable to obtain tickets due to home team restrictions.

3. FLEXI MEMBERSHIPS

3.1 4- and 6-game memberships are available across Platinum, Gold, Silver and Bronze categories. Reserved seats are based on a first in basis, and is the responsibility of the member to redeem online through member online accounts or Ticketek. Access to games is subject to capacity and availability at the time of redemption, particularly for high demand games.

3.2 4- and 6-game members can redeem tickets in their membership purchased seat category or any seat of lesser value.

3.3 4- and 6-game members can choose from any Brisbane Bullets home game at Nissan Arena during the home and away NBL Season 2021/22.

3.4 The Brisbane Bullets reserve the right to nominate games as being unavailable or capping the available seats for 4- and 6-game redemptions to 750 or less per game.

4. JUNIOR MEMBERS

4.1 Junior members including 6th Man Supporters must be aged under fifteen (15) years as of January 1, 2022.

4.2 Junior members who are purchasing a season reserved seat membership, must be linked with an adult, concession or family reserved seat membership.

5. PAYMENTS

5.1 Payment of your Club membership fee may be made in one of two ways:

5.1.1 Full Payment: membership can be paid using Visa, Mastercard, Cheque, Money Order, Cash or EFTPOS

5.1.2 Full or Fortnightly Instalments using the automatic rollover payment method

5.2 Separate terms and conditions relate to the automatic rollover payment method. These can be found at http://www.brisbanebullets.com.au or upon request through the Membership team.

5.3 Any person seeking a refund must do so in writing, addressed to the Head of Consumer Engagement at [email protected], prior to Sunday 14th October 2021. Other than a refund under clauses 5.4 and 5.5, all reasonable consideration will be given to refund requests. No request is guaranteed to receive a refund.

5.4 The Club will endeavor to honour all ticketing entitlements included in each membership, however, the Club cannot guarantee that there will be 14 home games, and take no responsibility should government restrictions mandate a change to member seats.

5.5 Should the Club not be able to honour 14 home games for season members only, the season member may be entitled to a refund.

5.6 Refund amounts will be pro rata, based on the number of home games left in the season less a $25 administrative fee if the member pack has been issued (Refund Amount).

5.7 The season member may choose to waive the Refund amount to help support the Club, a credit for the 2022/23 season or a refund.

5.8 If you wish to discuss your refund and any potential Refund Amount, please contact the Membership team on 1300MYBULLETS or [email protected].

5.9 All memberships prices for the home and away NBL season 2021/22, are inclusive of GST and postage. Additional fees for payment processing may apply from third party providers.

5.10 At its discretion, the Brisbane Bullets reserve all rights to amend the terms and conditions at any time.

6. COVID-19 POLICY

6.1 All members must comply with venue COVIDSafe protocols including contact tracing, hygiene practices and social distancing.

6.2 All members agree to abide by Government, Venue and NBL rules and regulations. This includes the requirement to avoid attending games and / or coming in contact with any person if they feel unwell or have symptoms which may include runny nose, cough or temperature.

7. FINALS

7.1 Memberships do not include Finals ticketing as part of the season membership fee already paid. Memberships include Finals priority access rights as referenced in the table on page one (1) of this document.

7.2 Memberships must be purchased by midnight of the last round of the home and away NBL season 2021/22 in order to be eligible to utilise the priority rights for the 2021/22 Finals Series. Memberships purchased after this date will not be entitled to the full Finals series priority access.

7. FINALS (continued)

7.3 All costs for Finals ticketing including the ticket, booking and transaction fees, travel and any other associated costs are the responsibility of the member to purchase through the authorised ticketing agent.

7.4 Ticket prices and availability are at the discretion of the home team and NBL, and the Brisbane Bullets bears no responsibility for members ticket allocations. 7.5 Should the Brisbane Bullets qualify to host a home game in the 2021/22 Finals Series, additional information and terms and conditions will be released to members and fans prior to tickets on sale.

8. OTHER 8.1 Season members may purchase carparking for games days directly from the Brisbane Bullets in a fourteen (14) game package. This purchase incurs an additional charge to the membership fee and is available via the same payment methods as your membership. 8.2 The Club bears no responsibility or liability for your car parked at the venue on game day, and customers do so take on any risk associated. Carpark terms and conditions and can be found at www.nissanarena.com.au. 8.3 Members purchasing a season carpark will be issued a carpark pass with their member pack. The Club does not accept any responsibility for membership carpark passes that are lost, stolen or destroyed. Passes needing to be replaced should be reported immediately to the Bullets Membership team on 1300 MYBULLETS or email [email protected] 8.4 Foundation Members are entitled to a 10% discount off their annual membership fee upon confirmation of Foundation status. Please see Foundation member terms & conditions for details at http://www.brisbanebullets.com.au The discount does not apply to any other product or services.

9. CODE OF CONDUCT 9.1 No member, guest or visit shall create undue noise, cause any disturbance or behave in an offensive manner on the premises or elsewhere in the venue. 9.2 Members are responsible for the conduct of their guests at all times. 9.3 A patron must not, at any time, abuse or harass an employee of the Club or a Club volunteer. 9.4 No member, guest or visitor shall participate in illegal gambling near or on the premises, including but not limited to “courtsiding” behavior. 9.5 The Club reserves the right to remove or refuse admission to any member, guest or visitor at its discretion. 9.6 The Club reserves the right to cancel a person’s membership without refund where that member is deemed by the Club to have breached these terms and conditions. 9.7 All members and their guests must comply with the terms of entry for Nissan Arena for all events at the venue which can be found online at www.nissanareana.com.au.

10. MISCELLANEOUS 10.1 The Club are committed to protecting the privacy of its Members. Information collected will be stored and used in accordance with the Club’s Privacy Policy - https://www.brisbanebullets.com. au/pages/privacy-policy. .. 10.2 Pursuant to the No Smoking Laws in Queensland, all Brisbane Bullets venues are non-smoking venues. 10.3 All members must always do everything within their power and control to protect and enhance the reputation and good name of the Brisbane Bullets Basketball Club. 10.4 The Club may from time to time, where necessary, vary the terms and conditions of Memberships. The Club will communicate any changes to its membership’s terms and conditions via the Club website. Members will have no claim against the Club by reason of any change made to its membership terms and conditions.
