    STATE OF HAWAI‘I OFFICE OF THE PUBLIC DEFENDER Testimony of the Office of the Public Defender, State of Hawai‘i to the Senate Committee on Commerce, Consumer Protection, and Health February 10, 2020 S.B. No. 3044: RELATING TO OFFENSES AGAINST HEALTH CARE SECURITY PROFESSIONALS Chair Baker, Vice Chair Chang, and Members of the Committee: The Office of the Public Defender strongly opposes S.B. No. 3044. This measure expands Section 707-711(j) of the Hawaii Revised Statutes and adds another qualifying occupation to the ever-growing number of occupations which have been singled out for special protection against assaults in the normal course of their employment. While we understand the desire to carve out special protections for certain classes of individuals who are assaulted in the normal course of their employment, this measure is just another example of the expansion of misdemeanor level assaults to felony level assaults -- not based on the act itself but based on the job description of the victim. Over the years, this list of qualifying occupations has steadily grown to include many special categories and specific occupations. It is our position that all employees should feel safe as they go about performing their requisite duties. As we have cautioned in the past, we believe that with the passage of time, more and more special categories and occupations will be added to this list. As the list grows, additional employees and groups will be asking whether they should request special consideration and be included for special protection. Enhanced penalties for assaults committed upon health care security professionals will not have a concomitant effect on their safety.

We offer high-quality cancer care in more locations than anyone else in Hawai’i. Our family of cancer centers is dedicated to providing care that is comprehensive, well-coordinated and connected. • The Straub Cancer Center is committed to providing patients with top-quality care through its team of board-certified physicians and specialty trained staff at its Outpatient Treatment Center. • Kapi‘olani Medical Center for Women & Children has highly trained physicians and staff who are experienced in treating childhood and women’s cancers, including the only bone marrow transplant facility and one of the only pediatric oncology programs. • Pali Momi Medical Center is the only cancer treatment program in West O‘ahu that is nationally accredited. In 2016, Pali Momi Medical Center announced it plans to expand with the opening of a comprehensive cancer center in 2017 that will provide diagnostic and treatment services at one location. • Wilcox Health provides Kaua‘i residents with state-of-the-art, compassionate cancer care close to home. Our volunteer high school programs at Kapi‘olani and Straub in Honolulu are held year round and the program at Pali Momi (a six week program) is only available during the summer from June through July. The minimum age to participate is 16 years old. You are required to volunteer 4 hours per week. This can be done by doing two 2-hour shifts, twice a week; or one 4-hour shift, once a week – (equivalent to 48 hours in a 3-month period). You may continue in our high school program as long as you are able to make the time and service commitment to volunteer on a consistent basis. To receive credit for volunteering for school/club or to receive a letter of recommendation, you must comply with the program’s commitment requirements and leave the program in good standing. If you are interested in joining our volunteer team and can commit to volunteering on a consistent basis, please complete and send in your application. For our patients with cancer, this mission is realized by our dedication to providing excellent cancer care at all four of our medical centers – Kapiʻolani, Pali Momi, Straub and Wilcox. Each medical center continues to maintain the American College of Surgeons’ Commission on Cancer (CoC) accreditation. CoC accreditation indicates to the community that our integrated multidisciplinary cancer care team provides patient- centered care with access to all essential services. For patients and their families, accreditation serves as a measure of quality cancer care and a commitment by Hawai‘i Pacific Health. In addition to our four CoC accredited sites, Hawai‘i Pacific Health is now home to not one, but two accredited breast programs. We are pleased to share that in 2015, Kapi‘olani Medical Center for Women & Children, home of the state’s first comprehensive Breast Center, achieved full accreditation by the National Accreditation Program for Breast Centers (NAPBC) and was designated a Center of Excellence by the American College of Radiology for breast imaging. Kapi‘olani joined the Pali Momi Women’s Center in achieving this accomplishment. According to the American Cancer Society, breast cancer continues to be the leading type of cancer in Hawai‘i. Because of this, increasing access to specialized breast cancer care across O‘ahu and the neighbor islands is a priority for Hawai’i Pacific Health. A healthier Hawai‘i begins with cancer prevention and screening.
