INTRODUCTION

I. PART ONE: General remarks

1. This report, the seventh to be submitted b,y the Commission on the examination of Community secondary legislation, is the first of a series concerning the acts relating to the various sectors of the common agricultural policy.

These acts have been examined in accordance with procedures and systems similar to those followed during the accession negotiations with the four applicant countries in 1970-71. As these systems and procedures are b,y nature common to the examination of aqy Community secondary legislation and 1 have alrea~ been described in the first part of the first report (on transport) , which also includes remarks of general interest for this examination, they are not described again here.

2. For the sake of clarity, the conclusions of the examination of the matters dealt with in the Community secondary legislation relating to agriculture are set out in the form of separate annexes, one for each sector. In each annex, the acts referred to are classified as follows:

I. Acts (other than annual acts) not requiring technical adaptations (but which may necessitate institutional adaptation to take account of the weighting of the votes provided for under the Management Committees' procedures, this being specified in each case).

II. Acts requiring technical adaptations which can be clearly formulated now, i.e. addition or deletion of certain wordings, information or references relating to Greece, or linguistic adaptations.

III. Acts requiring technical adaptations the formulation of which cannot yet be proposed and concerning:

(a) either important matters, the formula for which will depend on the outcome of the accession negotiations on the subject in question, or

(b) less important matters, the formula for which can be adopted only after c certain information has been received (in some cases this information m~, for practical reasons, only be available just before actual accession).

IV. Acts which are still being examined (this categor,y has been kept as small as possible, but is necessar,y for texts which, for example, can be fully examined only after acts relating to other sectors have been studied). v. Acts regarded as "annual" acts, i.e. for the most part Regulations fixing prices or marketing measures valid for one marketing year.

These acts are sub-divided into:

(a) Those not_requiring technical adaptation (see I);

(b) Those requiring technical adaptations which can alrea~ be clearly formulated (see II);

(c) Those requiring technical adaptations which cannot as yet be clearly formulated (see III).

VI. Acts (other than those in categor.y V) which will no longer be applicable at the time of Greece's accession.

This classification gives a slightly more detailed breakdown of acts than the one used for the corresponding examinations carried out in 1970 and in 1971. It has proved suitable for all the acts examined so far, although other subdivisions may be required for the other sectors. The basic Regulations for each sector have been underlined, again for clarity.

3. With the exception of those in categories I, V(a) and VI, the acts can be classified in more than one category. If an act applies to more than one sector, it is referred to in each of the sectors in question.

4· For each sector, all the secondary legislation produced on the subject by the Council or the Commission which establishes general rules has been scrutinized, with the exception of acts relating to d~-to-day market administration, the titles of which are at present printed in light type in the Official Journal and which generally have a limited period of validity. - 3-

However, as an exception to the general rule of only considering acts of a permanent nature (like those mentioned in the first part of the first report on the transport sector (op cit)), the examination of secondary agricultural legislation includes some acts applicable for a limited period, especially regulations fixing agricultural prices for one year.

In the case of these acts, attention has been paid to price mechanisms rather than levels, on the assumption that when Greece actually joins the Community the,y will doubtless have lapsed, but will have been replaced b,y similar acts; acts of this kind are classified under one or other of the sub-divisions of group v, according to whether or not technical adaptations are required, and, where appropriate, according to the type of adaptation, this classification only applying of course if other similar acts are in force when Greece becomes a member of the Community.

5· Where the existence of substantive problems (and not just purely technical questions) has been discovered, the,y have been indicated. A description of the problem is then given, together with observations on the actual situation and, where this was felt to be necessary, a~ indications regarded b,y the Commission as helpful for the conduct of the negotiations which will have to be held to find a ~ of settling the problems posed (see sections II and III of this introduction on pages 5 and 6). -4-

6. The sectors covered in this report were examined in the following order, between December 1976 and February 1977, on the basis of inventories of the acts in force on the dates indicated below:

1· It should be noted that the order in which the various points are examined (an~ consequently, in which the reports are presented) depends entirely on the availability of complete inventories of Community secondary legislation and therefore in no way reflects the order of importance of the various sectors or the degree of complexity of the subjects examined.

II. PART TWO: Observations concerning certain acts in the sugar sector

9· Article 24 of Regulation (EEC) No 3330/74 l~s down the basic quote allocated to each of the Member States.

The Greek Delegation has reserved its position on its future quota, this being a question which must be discussed in the negotiations. This Article will therefore have to be supplemented in accordance with the solutions adopted.

The Commission, for its part, has reminded the Greek Delegation of the criteria according to which quotas arecurrentlyfixed in the Community; in its view, these should also govern the allocation of the quota for "",-,.', Greece.

10. Article 38 of the same Regulation allows Member States, for special reasons and on precise conditions, the possibility of granting certain national aids.

The Greek Delegation has wholly reserved its position on the possible granting of these national aids in Greece, and has said that it will set out its ideas on this subject during the negotiations.

The Commission therefore takes the view that this question should not be considered in greater detail until the Greek Delegation has stated its position.

This Article will therefore have to be reexamined in the light of developments in the negotiations. -6-

The Greek Delegation has said that it cannot accept the above acts relating to the cotton sector, arguing that there should be fuller and more extensive arrangements for this product in view of its importance for the Greek econo~. Detailed information has been provided on this subject (see pages 7 - 14).

The Commission, appreciating the importance of cotton as emphasized by the Greek Delegation, has noted the observations and information submitted.

This sector will therefore have to be reexamined in the light of the decisions adopted in the course of the negotiations.

Any solution to this problem could affect Regulation 136/66/EEC (oils and fats). - 7-

1 on the production and marketing of raw cotton in Greece

COTTON

1. Importance of cotton for the Greek economoc·

Cotton growing is one of the most qynamic sectors of Greek agriculture, employing approximately 70 000 farming families, contributing a decisive proportion of agricultural income, and covering almost all the raw material requirements of the country's cotton yarn mills, cloth mills and cottonseed oil mills.

It contributes substantially to the country's trade balance in that Greece is able to export considerable quantities of ginned cotton, cotton yarn and cotton fabrics. Greek cotton is noted for its excellent whiteness, purity, strength, fineness and maturity.

Thanks to the quality of Greek cotton, the country's cotton industr.y has succeeded in earning an excellent reputation on the Community market, where its product is lalown as "Greek cotton yarn".

7. Import-export arra.ngements

Cotton is imported from aqy country, and exported from Greece, freely. Cotton imported into the country is subject to a ~ ad valorem customs duty. Additional charges (fiscal stamps etc) bring total tax to approximately 5.6% of the value of the imported product.

8. Factors influencing production

To ensure that production does not vary, the country has been divided into large crop zones in which on~ the varieties of cotton specified b,y the Ministry of .Agriculture are grown.

Special seed production centres run by the Greek Cotton Office have been set up which supp~ producers with the necessary quantities of high quality cottonseed each year.

To mechanize cotton growing and reduce production costs the Greek Cotton Office encourages producers to form groups which are provided with subsidies and technical assistance.

Cotton producers also have the possibility of buying machinery at subsidized prices. In addition, they can take out loans at low interest rates through the Agricultural Bank to cover cultivation costs and to buy agricultural machinery.

The number of cotton-picking machines rose to 250 in 1974, 320 in 1975 and 400 in 1976.

9. Cotton ginning - standardization of production

The number and capacity of gins are as follows:

To standardize the product and facilitate commercial transactions, all ginned cotton produced is classed b,y the Greek Cotton Office, each bale being matched with the Greek boxes of standard samples, which are recognized b,y Foreign Arbitration Boards. Colour, impurities, the method of ginning and so on are - 11 -

taken into account when classing ~inned cotton, which is then given one or other of the standard sample box numbers 3,4,5,6,7 or 8. NUmber 3 corresponds to our finest qualit.y and number 8 to the poorest. A further criterion is the length of each type, this being measured in millimetres.

10. System of cotton protection applied in Greece

(a) Each year, the Government determines the guaranteed price for raw cotton b.y taking the cost of its production and adding a reasonable profit for the producer.

This price is not dependent on the domestic market price for raw cotton, which is formed freely on the basis of international market prices (Liverpool A Index).

(b) The Greek Cooton Office, after prior approval b.y the Ministry of Agriculture, publishes an official list of raw cotton and ginned cotton prices based on international market prices (Liverpool A Index).

Where the raw cotton price indicated in the official list is lower than the guaranteed price, an aid equal to the difference between these two prices is granted to producers.

(c) To ensure that producers can dispose of their raw cotton at the prices indicated in the official list and to keep these prices attractive for producers, the following additional measures are taken:

(i) unlimited financing for agricultural cooperatives which buy in from producers all the raw cotton that is offered at the price indicated in the official list;

(ii) financial facilities for trade and industry if the,y buy domestic production at the price listed b,y the Greek Cotton Office.

(d) To facilitate exports, a subsi~ is paid to exporters of ginned cotton (price equalization), since the Liverpool A Index price is taken as the fob price at Greek ports for determining the price of cotton on the domestic market. - 12-

{e) Specialized employees of the Greek Cotton Office inspect cotton gins to ensure that the measures referred to above are applied.

12. Remarks

To sum up:

{a) Cotton grm·dng is one of the cornerstones of Greek agriculture, providing cotton growers with a relatively high income and contributing to the

countr~'s trade balance.

(b) Greek producers sell their entire production in the form of raw cotton. This system is not expected to change in the near future, since farms are small and output per farm is low, and cotton farmers are therefore not well placed to market their product in the form of ginned cotton.

{c) Under this system, a substantial and flexible trade in raw cotton has been developed as a result of considerable capital investment.

(d) Cotton growing makes a decisive contribution to the income of 70 000 families of Greek producers.

{e) The cotton protection system applied in our countr.y is in line with the basic principles of the EEC's common agricultural policy as regards both income support for producers and supply of raw materials to the cotton industr.y at world prices. -13- STATISTICAL INFORMATION
