To help you get a better understanding of the way the Planning Committee works, I have listed a few points below.

How the Committee makes a decision

The Planning Committee’s decision on an application can be based only on planning issues. These issues include:  Local, regional and national policies and Government guidance;  The design, appearance and layout of a proposed development;  Road safety and traffic;  The effect on the local area and local properties;  Loss of light and overlooking;  Nuisance caused by noise, disturbance and smell; and  Protecting buildings and trees

The agenda

You will find copies of the agenda in the public seating area of the Council Chamber. At the front of agenda, the planning applications being discussed are listed in order of the application number.

There may be an additional information sheet attached to this welcome letter. You should read this with the agenda. These sheets detail any comments received after the report was written, updates, comments and a list of the public speakers under each item number.

Committee Procedures

The Chairman will announce the application to be discussed, a Planning Officer will then give a short presentation followed by Public Speaking if applicable.

The rules for Public Speaking are detailed in the Council’s leaflet ‘Public Speaking at Planning Committees’. A copy of this leaflet is available by contacting 01252 774419.

The Committee will then discuss the application and make a decision. The member in whose ward the application is located will normally open the discussions.

The committee may decide to:

1. Approve the application 2. Refuse the application 3. Defer consideration e.g. for further information or amendments or 4. Defer consideration for a site visit by a panel of Councillors (the viewing panel).

Members asked for examples of similar sheltered housing schemes and the associated car parking provision.

- 3 - 12/01766/MAJOR- Wickham Court, Wickham Road, - Erection of new 41 unit sheltered housing scheme for over 55's with communal accommodation, a new car park and secure landscaped gardens following demolition of existing older people's housing scheme- permission granted 2012.

The proposed development would provide a total of 24 spaces for 41 flats (0.59 spaces per flat).

09/00557/MAJOR- 23 High Street, - Erection of 14 cottages for retired/ older persons with garage blocks, surface parking & landscaping following demolition of existing bungalow (allowed on appeal).

The proposed development provides a total of 19 spaces for 14 units (1.4 spaces per unit).

13/02298/MAJOR- Albany Court , Albany Road, Fleet- Renovation and conversion of existing 4 no. 1 bed flats, 15 no. bedsits and 1 no. 3-bed flat to create 13 no. 1-bed flats and 4 no. 2- bed flats. Works also include Demolition of link corridors, internal alterations, construction of new first floor walkway; new stair core; lift core; and extension for accommodation. External reconfiguration for landscaping, amenity facilities and car parking- permission granted 2014.

In this development there would be 1 space per unit.

09/02845/MAJOR- Curtis Court, Award Road, Church Crookham- Erection of 24 No. two bedroom and 3 No. one bedroom sheltered flats following demolition of existing buildings with associated landscaping and landscaped areas.

There are 19 spaces for 27 units therefore 0.7 spaces per unit.

The Council’s Parking Manager was asked for information regarding the adjacent car park should parking spill off site, and raises the following main points: • Number of car parking spaces in the car park: Long stay 95 spaces (Red bays 5) Short Stay 29 spaces (Red Bays 12) *(Red bays provide 90 minutes free parking paid for by the Parish Council). • The approximate usage of the car park is 65-75% on average. There is no particular time/ day when this maximum utilisation occurs, unless the Council offer free parking for a Parish event. • The Council have not experienced a full car park for several years due to the economic climate and the reduction in business permits. • I believe the car park can currently accommodate visitor parking but not designated parking. If residents where to purchase season tickets and the car park started to get oversubscribed we could reduce the number of season tickets available by reintroducing a waiting list.

One additional letter of representation has been received raising concern about parking provision.

A letter has been sent from the applicant to members of the planning committee raising the following main points: • Copy of the Design and Access Statement was attached.

- 4 - • Number and proportion of elderly population within the district is projected to increase substantially over the next two decades. • Existing building already offers a significant degree of overlooking, proposal would not result in further harm. • There would be more landscaping and less parking than the current site which would improve the amenity to 2 Chapter Terrace and Weatherby Gardens. • Whilst there would be a clause in the legal agreement restricting occupation to those of state pension age or above, the typical age of occupants for this type of accommodation is 79 years or older, as such it is found that very few are car owners i.e. those more active car-owning elderly would not normally choose to live in sheltered accommodation. • Accessible location. • The proposal would deliver financial contributions towards SANGs and off site affordable housing.

Further comments were received from Odiham Parish Council on 07.05.14:

Odiham Parish Council appreciates the agreement of the applicant to allow access by Thames Water through the site to service the North Warnborough Pumping Station.

We have now established that we misunderstood the revised plan apparently showing 10 parking spaces. We understand that the 2 spaces adjacent to the southern boundary with 1 Castlebridge Cottages are reserved for the use of 1 Castlebridge Cottages, and that therefore there are only 8 spaces provided where Hart's parking guidance requires 11.

This is a busy main road, but further south in North Warnborough, resident’s park on the same main road because there is no other option. In this case, they will have no option but to do the same, or to park in the bus stops. We therefore believe that the applicant should find a way to provide the full guidance level of parking, as there is nowhere else for people to go. Already there will be cars displaced which have enjoyed informal permission to use the Chilli Pad car park in recent years. Under-providing on this site will exacerbate that situation, whose effects will only be felt when the re-development takes place.

The draft officer's report referred to an appeal in Fleet, but we do not feel that the sustainability in transport terms of North Warnborough can be compared with that in Fleet.

We re-iterate that we have no objection to the re-development and conversion of the building itself.

Comments form the Council's Highways Officer on amended plans:

The revised site plan shows the parking for plot 4 has been relocated to the opposite side of the road which is adequate. The swept path analysis shows that vehicular movements into the existing garages for 1 and 7 Castlebridge are not compromised by the proposals; they also show that a 10m long rigid lorry which drives into the access from Hook Road, and manoeuvres without affecting the access to the garages for 1 and 7 Castlebridge Cottages.

After discussions with the case Officer, storage details will be secured via condition. The Streetcare OfficeR states that collection bins will be from Hook Road. No highway objection.

One additional letter of representation was received on 08.05.14 raising concern about the level of on site parking.

There is a typographical error on page 47 of the agenda in section 2- Accessibility- it should read 250 metres from a small shop.

One additional letter of representation was received on 14.05.14 regarding flood risk.

Essentially the objector considers that the same condition that was applied to 12/00787/FUL should be applied to this current application. For the reasons already set out in the agenda it is considered that this condition is not necessary on this current application given the reduction in footprint of the building and incorporation of SuDS resulting in reduced discharge rates.

In the committee report it makes reference that the Environment Agency have powers to enforce against landowners who fail to clear watercourses and therefore cause a serious risk of flooding. After seeking further advice from the Environment Agency, it is Hampshire County Council as the Lead Local Flood Authority that have this power to enforce for ordinary watercourses which is the case here. Again to take enforcement action the problem must be so severe that there is a serious risk of flooding.

The necessary legal agreement has not be completed. Consequently there should also be the following reasons for refusal.

2. The site is located within 5km of the Site of Special Scientific Interest (SSSI) which forms part of the Thames Basin Heaths Special Protection Area (SPA). In the absence of any evidence that the test of no alternatives under Regulation 62 of The Conservation of Habitats and Species Regulations 2010 can be satisfied, or evidence that there are grounds of overriding public interest, the proposed development, either alone or in combination with other plans or projects, would be likely to have a significant adverse effect on the SPA. As such the proposal is contrary to saved policies CON1 and CON2 in Local Plan, and policy NRM6 in the South East Plan.

3. The proposed development would give rise to additional detrimental impacts on the transport infrastructure. As such the proposal is contrary to paragraph 4.6.1 and saved

- 7 - policy T16 in the adopted Hart District Local Plan, and the Council's Community Infrastructure Policy.

4. The proposed development would exacerbate the existing deficiency in provision for leisure facilities within the vicinity of the site. As such the proposal is contrary to paragraph 4.6.1 in the adopted Hart District Local Plan (Replacement) 1996-2006, Hart District Council's adopted Leisure Strategy, and the Council's Community Infrastructure Policy.

5. The proposed development would exacerbate the existing deficiency in provision for primary and secondary schooling in the vicinity of the site. As such the proposal is contrary to paragraph 4.6.1 in the adopted Hart District Local Plan (Replacement) 1996-2006, and the Council's Community Infrastructure Policy.
