Doc- tors and scientists do not know what percentage of the general population has been infected and what percentage of the infected develops symptoms. State and local governments and the federal public health system are deploying strategies to contain the spread of the virus and consider ways to mitigate the effects of the disease on vulnerable groups, the health care system and the economy. But amid all the planning, and a growing sense of panic, the impact of the spread of COVID-19 among homeless people is not being widely discussed. It should, however, be of special concern to local officials. I am a professor of preventive medicine and health policy at the Keck School of Medicine at the University of Southern California. USC is in Los Angeles, which has one of the largest homeless populations in the nation. I am concerned about how infectious disease could undermine our efforts to provide humane care to homeless people and assist them to get off the streets and into stable housing. I am also deeply concerned about infection rates and mortali- ty more generally among vulnerable populations.

A vulnerable group, even when the economy is humming More than half a million people are homeless in the U.S. Their living conditions and poor health may place them at higher risk for contracting the disease and dying from it, although as of this writing, there have been no reported cases among homeless people. High rates of infectious diseases among people experiencing homelessness is hardly new. Since those of us who work with the homeless have been keeping data, we know that homeless people have a higher risk of tuberculosis, hepatitis, HIV and pneumonia. This should give government officials and health providers cause for concern that the coronavirus may also spread among the homeless. While it’s too early for specific studies, the conditions of homelessness may increase the risk of transmitting the coronavirus to homeless people and ultimately its spread to others in the community. COVID-19 is a respiratory illness. People get it when an in- fected person sneezes or coughs, spreading droplets in the air that could be transmitted to others. The Centers for Disease Con- trol and Prevention has recommended staying away from others who are sick, avoiding crowds and proper hand-washing. The agency also suggests that since the virus lives on surfaces for at least several hours, people should avoid touching surfaces that others may have touched. These practices, however, are nearly impossible for those liv- ing on the streets who have no way to bathe or wash hands. Few encampments have portable toilets or sinks. People eat, sleep and congregate close to each other. CLAIMS OF FRAUD UNPROVEN IN MORTGAGE FORECLOSURE Appellate Division, Second Department In the Appellate Division, Second Department, defendant Michael Knott appealed an order by Hon. Cheree Buggs of Queens County Supreme Court, Civil Term. The order denied Knott’s motion to vacate an order of reference and for leave to serve a late answer. In 2008, U. S. Bank National Association commenced a fore- closure proceeding against Knott, among others, to foreclose a mortgage on prop- erty in Rosedale. Knott failed to appear or answer the complaint in a timely fashion. Hon. Cheree Buggs Thereafter, the Supreme Court granted the bank’s unopposed motion for an order Photo courtesy of Hon. Cheree Buggs of reference. In April 2016, Knott moved to vacate the order of reference and for leave to serve a late answer. In response, the Supreme Court denied his motion. Upon Knott’s appeal, the justices of the Second Department affirmed the determination of the lower court. They explained that a party may be relieved from an order or judgment on the ground of “fraud, misrepresentation or other misconduct” by an adverse party. In his appeal, Knott contended that U.S. Bank obtained the order of reference through the submission of fraudulent docu- ments, which amounted to an allegation of intrinsic fraud. In their review of the record, the justices concluded that Knott failed to offer any excuse for his default in answering the complaint or his default in opposing the bank’s motion for an order of reference. Additionally, the justices found that Knott failed to meet his bur- den of establishing fraud, misrepresentation or other misconduct on the part of the bank that would warrant vacating the order of reference. Due to that, the justices determined it was unneces- sary for them to consider whether Knott had a potentially meri- torious defense to the complaint. —U.S. Bank, N.A. v. Gadson, 2017-03568, March 11, 2020 ••• FORECLOSURE AND SALE VACATED FOR FAILURE TO JOIN ESTATE Appellate Division, Second Department The justices of the Appellate Division, Second Department, modified an order of the Kings County Supreme Court, Civil Term, upon an appeal by the plaintiff, U. S. Bank National Association. In June 2013, U.S. Bank commenced a mortgage foreclosure pro- ceeding on property owned by Joseph Gedeon, who had died intestate, or without a will, on Mar. 28, 2010. The complaint named as a defendant, among others, Joseph’s daughter, “Sylvanie Gedeon, Individually and as Voluntary Administratrix of the Estate of Joseph E. Gedeon.” In response to the complaint, Sylvanie interposed an answer but she did not oppose the bank’s subsequent motions for an order of reference and for a judgment of foreclosure and sale, which the Supreme Court subsequently granted. Sylvanie thereafter moved to vacate the order of reference and the judgment of foreclosure and sale and to dismiss the complaint asserted against her for failure to join a necessary party. In the order that was appealed, the Supreme Court granted the motion. Upon the appeal by U. S. Bank, the appellate justices modified the judgment of the Supreme Court. First, the justices concluded that, contrary to the bank’s contention, the Supreme Court was empowered to vacate the order of reference and the judgment of foreclosure and sale, on the ground of lack of juris- diction. They agreed with the Supreme Court’s determination that, under the circumstances presented, the estate of Joseph Gedeon was a necessary party to the complaint and that the fail- ure to join Gedeon’s estate warranted vacating the order of ref- erence and the judgment of foreclosure and sale. The justices explained that when a property owner dies intestate, the title to property is automatically vested in his or her heirs and that, generally, a foreclosure action may be commenced directly against the heirs. In this case, only one heir, Sylvanie, was named as a defendant. The justices determined that the record contained insufficient information as to whether Sylvanie was the only heir. Additionally, the justices noted that the bank alleged a default in payment of the mortgage loan after the death of Joseph Gedeon. Under those circumstances, the justices concluded that the estate of Joseph Gedeon was a necessary party to the mortgage foreclosure and agreed with the Supreme Court’s determination to grant Sylvanie’s motion to vacate the order of reference and judgment of foreclosure and sale. However, the justices found that the Supreme Court should have denied Sylvanie’s motion to dismiss the complaint against her.
