The court is asked to order a writ of mandate re- quiring the Alameda County Registrar Tim Dupuis and all persons acting under his direction and control to refrain from placing an invalid initiative on the city's November 6, 2018 ballot. The second petition filed by the Hospital Committee for the Livermore-Pleasan- ton Areas in the First District Court of Appeals also chal- lenged the constitutionality of the Initiative. According to a staff report, the Ap- pellate Court summarily denied the petition without considering the merits of the case, or making any findings on the information presented in the petition to show the measure is invalid on its face. The Appellate Court’s decision was to defer judicial resolution until after the election.
