This order authorizes the City Council to approve the transfer of $750 and $614 in forfeited assets from the State of to the City of Portland from the case of the State of Maine v. Joseph Robichaud.

This money was seized during a drug investigation conducted by the Maine Drug Enforcement Agency in conjunction with the Portland Police Department.

The money will be deposited into the Portland Police Department’s drug investigation account. The money is used to offset the costs of drug investigations, such as drug analysis, drug purchases, covert surveillance, surveillance equipment, drug training and protective gear, such as body armor. The money may also be used to support the department’s Law Enforcement Addiction Advocacy Program.

Order 2-16/17 Order Declaring August 28, 2016 as the Pet Rock in the Park 2016 (Tab 4) Festival – Sponsored by Jon P. Jennings, City Manager.

This order declares Sunday, August 28, 2016, as the Pet Rock in the Park 2016 Festival to be held in Deering Oaks Park from 11:00 a.m. to 4:00 p.m.

The event raises awareness for many local animal shelters and benefits the charity group Emma’s Foundation for Canine Cancer.

This order declares the 17th Annual Portland Trails’ Trail to Ale 10K Race/Walk Festival to be held Sunday, September 18, 2016, from 6:00 a.m. to 1:00 p.m. The race time is from 9:00 a.m. to 11:00 a.m. The festival time is 10:00 a.m. to 1:00 p.m. The festival area is the Eastern Prom Park, Eastern Prom Roadway, Cutter Street parking lot area, and the streets for the race route which are included in the agenda backup. This event is a fundraiser for Portland Trails.

Order 322-15/16 Amendment to Portland City Code Chapter 14 Land Use, Article III (Tab 15) Re: Food Trucks – Sponsored by Elizabeth Boepple, Chair, Planning Board.

This item asks Council to consider changes to Chapter 14 to amend references to Chapter 2 of the City Code relating to these food trucks.

Specifically, this amendment removes a requirement for a competitive bid process as prerequisite for food trucks being allowed uses in the Open Space and Recreation" and Eastern Waterfront Port zones. To date the food truck program has been very successful and as such the impetus for the competitive process to manage access is no longer needed.

In addition, this process was time consuming and placed additional financial burdens both on the businesses and the City.

This item must be read on two separate days. It was given a first reading on June 6, 2016. Five affirmative votes are required for passage after public comment.

Order 12-16/17 Order Establishing the School Facilities Ad Hoc Committee and (Tab 16) Referring the Board of Education’s Buildings for Our Future Initiative for Review - Sponsored by Mayor Ethan K. Strimling and Councilor Nicholas M. Mavodones, Jr.

This order creates an Ad Hoc Committee, comprised of representatives from the City Council and Board of Education, to be formed to study the Board of Education’s Buildings for Our Future Initiative. The initiative is a $70,593,229 million educational facilities rehabilitation bond passed by the Portland Board of Education on June 21, 2016 and subsequently sent to this Council. The Ad Hoc Committee shall review the initiative after holding a workshop with the Council, and refer it, including any recommended changes, to the Board of Education and then the Council’s Finance Committee.

Additional backup material on the specifics of the Bond Order will be distributed at the City Council meeting.

AMENDMENTS:

Order 13-16/17 Amendment to Portland City Code Chapter 28 Traffic and Motor (Tab 17) Vehicles, Section 28-24 Re: Allowing Minor Traffic Schedule Changes by Traffic Engineer - Sponsored by Jon P. Jennings, City Manager.

Currently, the City’s Ordinance requires City Council review and action for relatively small parking space changes (as little as one space in many situations), projects already having Planning Board site plan approval, and certain street improvement projects.

The proposed Chapter 28 changes will allow the City Traffic Engineer in the Department of Public Works (DPW) to adjust up to two parking spaces per street block face per year with City Manager approval. In addition, projects with parking changes associated with a Planning Board approval would be sufficient for a traffic schedule amendment. Lastly, a wider range of streetscape projects that are undertaken by DPW could make needed parking adjustments without a separate Council approval process.

This item must be read on two separate days. This is its first reading.

III, BACKGROUND. The State Forfeiture Statute, IS M.R.S.A. § 5824 (3) and§ 5826(6), requires that before any f01feitable item may be transferred to a State agency, County or municipality, the legislative body of that entity must publicly vote to accept the item.

Portland Radio Group shall defend, indemnify and hold harmless the City of Portland, its officers and employees, from and against all claims arising out of or resulting from the Festival and/or use of City streets and property for said Festival, and shall procure and maintain public liability insurance in the minimum amount of $400,000 per occurrence for personal or bodily injury, death or property damage and covering the obligation of indemnification hereunder. Portland Radio Group shall provide the City with a certificate showing evidence of such insurance and showing the City as an additional insured on said insurance;

2. No alcoholic beverages may be sold on the streets or public property during the Festival within the Festival area; 3. The Portland Radio Group shall be responsible for trash clean-up at the festival and shall be required to leave a security deposit on file at the Public Assembly Facilities Division office;

4. Conditions for use of grounds and requirements for food service, vending sales, and other items specified in a permit issued from the Public Assembly Facilities Division shall be adhered to;

5. Portland Radio Group shall have sole authority over participating vendors at the festival and may charge a fee to vendors for the opportunity to vend at the Pet Rock in the Park 2016 Festival;

6. Portland Radio Group shall pay city license fees, permit fees and costs for staff assistance; and

7. In addition, the City Clerk's Office shall charge the usual fees for licensing food vendors, street goods vendors, and other needed licenses for the Festival to those vendors the Portland Radio Group has agreed shall participate; and

BE IT FURTHER ORDERED, that the City Manager is authorized to waive fees and to issue such other temporary licenses, including licenses for food service establishments, as may be required by the City Code, provided that all other applicable Code requirements for the operation of the Festival have been met. ,. I am requesting that the following order be placed on tbe next City Council agenda:

Order declaring "Pet Rock in the Park 2016," Sunday, August 28, 2016, as a festival.

For a number of years, Portland Radio Group has organized Pet Rock in tbe Park, taking place at Deering Oaks Park. Tbe event raises awareness for many local animal shelters and benefits the charity group Emma's Foundation for Canine Cancer. This years event expects to draw in over 2000 people. Tbe festival includes Music (live bands), Food Booths and Food Trucks, many informational booths from animal groups and pet store businesses, as well as games for children. There is no admission fee to tbe festival grounds and stage area (food and drink is for sale).

Tbe Friends of Deering Oaks has endorsed the event.

The Order should include the following items: Pet Rock in the Park be authorized for Sunday, August 28, 2016, from llam- 4pm, (set up 7am, breakdown 5pm) to be held in Deering Oaks Park, specifically: Festival Zone (areas falling under Portland Radio Group's purview)- Oaks Bandstand area and grass areas around the bandstand, the grass and tree area between Tennis Court Road and Farmers Market Road, Farmers Market Road itself, and Tennis Court Road itself- from Deering Ave. to the exit of King Court Roadway (baseball field). Park areas near the Castle (TIQA Cafe) are not part of the festival zone.

These areas above will be closed to street vendors pursuant to Section 19-17 of the Portland City Code and is reserved for the use of Portland Radio Group, for the purpose of conducting the Pet Rock in the Park Festival, subject to the direction and control of the City Manager.

The City Manager is authorized to issue a revocable permit under Sections 25-26 thru 25-30 of Portland City Code to Portland Radio Group subject to the following conditions:

• Under no circumstances may alcoholic beverages be sold or consumed on City of Portland right-of-ways during said event.

Closed Streets: For setup purposes and during the festival itself, Tennis Court Road (main roadway through the park) will be closed to vehicle traffic from approx. 7am- 5pm, Sunday, August 28. Tennis Court Road may also need to be posted "No Parking." Vehicles parked illegally at "No Parking" signs shall be towed at owner's expense.

The City Manager is also authorized to waive any other fees, and issue such other temporary licenses and temporary permits, including licenses for food service establishments and permits for sales of non-food related items, as may be required by the Portland City Code, provided that all applicable requirements of said code have been met regarding the operation of said event.

? All cords in the public way must be covered by rugs, mats or orange cones to avoid public hazard. If weather is inclement (drizzle, rain, snow, etc.) we require that ou not use electricity, unless all connections and equipment are covered and protected from the elements.

Barbecuing must first be approved by Public Works and is subject to weather conditions, and possible further review by the Fire Dept. Grills must be set up away from children's activities. PORTA-RESTROOMS I BATHROOM FACILITIES Porta-Restrooms are required for large events and events where food is being served. Some of Portland's parks already have portable restrooms (including Deering Oaks Park). If over 150 people are expected to attend the event, a $25 user fee is required (paid to Public Works). The restrooms are cleaned M, W, & F. If you would like to guarantee that they are cleaned just prior to your event, then you need to call the porta-restroom company (Associated Septic, 207-799-1980, M-F) to request and pay for a cleaning. *Because you are providing porta-restrooms, the $25 user fee will be waived.*

TRASH All groups must abide by our Carry In/ Carry Out Policy. Please bring extra trash bags and/or trash receptacles and remove all trash. You will need to haul all of your trash out of the park/public space or forfeit the security deposit(s). Please recycle whenever possible, (please do not use Styrofoam - it is NOT recyclable). The area will be checked following your event and if the park is clean and conditions for use adhered to, your security deposit will be returned to you. Thank you in advance!

PARKING ON GRASS AREAS I SIDEWALKS/ILLEGALLY PARKED VEHICLES Public Works has a strict policy that prohibits vehicles from parking on grass areas/sidewalks/park streets (unless specifically approved by city staff). $10 will be deducted from your security deposit for each vehicle parked on grass/sidewalk areas or vehicles parked illegally. Any tire ruts/damage to the grass areas would mean a forfeit of your security deposits.

I am requesting that the following order be placed on the next City Council agenda:

Order declaring 17th Annual Portland Trails "Trail to Ale 10K RacejWalk & Festival," Sunday, September 18, 2016, as a festival.

This is the 17th year for this event and is a fundraiser for Portland Trails. The race and festivities area organized by Portland Trails staff and race managers. A Beer Garden is staffed by an Event Coordinator and security staff from the city's Public Assembly Facilities Division. Number of expected runners this year is 2,300 (any event held on public property, with anticipated attendance over 2000, needs to be approved by City Council).

The race registration area makes use of the Middle Parking Lot on Cutter Street (and the Eastern Prom grass areas). The race begins at 9am in the street. The route of the race is as follows: Start Line is on the Eastern Prom Roadway near Quebec Street, runners head north on the E. Prom, round Loring Memorial down to Washington Ave., take a left onto Washington, then take a right Fox Street, then a right onto Anderson Street, then up onto the Bayside Trail to connect with the Back Cove Trail, running under Tukey's Bridge and continuing on Back Cove Trail, running around the cove, back under the bridge, and onto the Eastern Prom Trail heading south, finishing on the grass area beside the Trail just before reaching Cutter Street.

A number of Streets need to be closed to traffic for the race, some streets posted "No Parking," and traffic held back at some intersections while runners cross. Race organizers will hire Police Officers to assist with closing down some streets (Washington Ave. & E. Prom intersection).

Start location is on Eastern Prom near bottom of Quebec Street. Runners proceed west to Washington Avenue, left to Fox St, right onto Anderson St, and right onto the Bayside Trail to connect to Back Cove Trail (clockwise around) and back to the Eastern Prom Trail, ending before East End Beach. BOTH LANES of Eastern Prom (and side streets) from Congress St. to Washington Ave., closed to traffic: 8:30am- 9:15am (via Barricades, volunteers, and a Police Officer).

After the race runners proceed to mid-Cutter Street parking lot for the awards and party. Pizza will be supplied by Portland Pie Company and beer by Shipyard Brewing and snacks by Whole Foods Market. A 20'x40' tent will cover the beer table in a fenced-in beer garden within the lot. The beer garden will be specifically designated for runners and supporters 21 +. A live DJ will be present with speakers and microphone. Several awards will be presented. Families of runners will be able to hang out inside the parking lot but outside the tent and cordoned area. Several sponsors' 1Ox1 0 tents will be set up. Party will wrap up around noon. The beer garden area will be overseen by CITY PAF STAFF.

PUBLIC WORKS POLICIES

ELECTRICITY All cords in the public way must be covered by rugs, mats or orange cones to avoid public hazard. If weather is inclement (drizzle, rain, snow, etc.) we require that you not use electricity, unless all connections and equipment are covered and protected from the elements.

PORTA-RESTROOMS I BATHROOM FACILITIES Porta-Restrooms are required for large events and events where food is being served. Some of Portland's parks already have portable restrooms (*Preble Street Grass Area at the Preble Street Parking Lot- across from Hannafords, *Entrance to Dyer's Flat- beside Payson Park, *East End Beach). If over 150 people are expected to attend the event, a $25 user fee is required (paid to Public Works). The restrooms are cleaned M, W, & F. 'If you would like to guarantee that they are cleaned just prior to your event, then you need to call the porta-restroom company (Associated Septic, 207-799-1980, M-F} to request and pay for a cleaning.

TRASH All groups must abide by our Carry In/ Carry Out Policy. Please bring extra trash bags and/or trash receptacles and remove all trash. u will need to haul all of your trash out of the park/public space or forfeit the security deposit(s). Greater Portland Board of Realtors has proposed holding an event around Back Cove, Sunday, September 18, 2016, as a fundraiser for United Way of Greater Portland. This Hands Around the Cove event would bring together 3, 500- 5000 people in order to hold hands around Back Cove. Following this event, there would be a festival in Payson Park which would feature musical acts and food trucks. Times: 11am- Noon, Registration; Noon, Hand Holding; 12:30- 3pm, Festival. Organizers are charging a registration fee to participate; food and drink will be for sale at the festival. Parking for attendees is on nearby side streets, at area parking lots, schools, participating businesses, Preble St. Parking Lot, and the Dyer's Flat Parking Lot at Payson Park.

Hands Around the Cove is being held on a Sundays on the Blvd. day (Baxter Blvd. is closed to vehicles: Vannah Ave. to Payson Park, 9am- 4pm).

Other parks may be used for Registration: Bel meade Park, Sundial Park, Preble Street Grass area, grass + pathway across from Cheverus Field, grass/pathway area near Bates Street, grass/pathway area across from Franklin Street.

PUBLIC WORKS POLICIES

ELECTRICITY All cords in the public way must be covered by rugs, mats or orange cones to avoid public hazard. If weather is inclement (drizzle, rain, snow, etc.) we require that you not use electricity, unless all connections and equipment are covered and protected from the elements.

PORTA-RESTROOMS I BATHROOM FACILITIES Porta-Restrooms are required for large events and events where food is being served. Some of Portland's parks already have portable restrooms (•Preble Street Grass Area at the Preble Street Parking Lot- across from Hannafords, •Entrance to Dyer's Flat- beside Payson Park). If over 150 people are expected to attend the event, a $25 user fee is required (paid to Public Works). The restrooms are cleaned M, W, & F. If you would like to guarantee that they are cleaned just prior to your event, then you need to call the porta-restroom company (Associated Septic, 207-799-1980, M-F) to request and pay for a cleaninQ.

TRASH All groups must abide by our Carry In/ Carry Out Policy. Please bring extra trash bags and/or trash receptacles and remove all trash. You will need to haul all of your trash out of the park/public space or forfeit the security deposit(s). Please recycle whenever possible, (please do not use Styrofoam- it is NOT recyclable). The area will be checked following your event and if the park is clean and conditions for use adhered to, your security deposit will be returned to you. Thank you in advance!

PARKING ON GRASS AREAS I SIDEWALKS/ILLEGALLY PARKED VEHICLES Public Works has a strict policy that prohibits vehicles from parking on grass areas/sidewalks/park streets (unless specifically approved by city staff). $10 will be deducted from your security deposit for each vehicle parked on grass/sidewalk areas or vehicles parked illegally. 'Y tire ruts/damage to the grass areas would mean a forfeit of your security deposits.

TOBACCO FREE ZONES By city ordinance, smoking a cigar, cigarette, pipe, electronic cigarette, electronic cigar, electronic pipe, or other similar product that relies on vaporization or aerosolization, is prohibited at and within 20 feet of the following outdoor recreation and event areas: downtown squares and plazas, trails, parks, playgrounds, beaches, and athletic facilities. The pier infrastructure hosts all the same amenities as the site in Bangor and are prepared to cooperate all the proper departments within the City of Portland to satisfy all prerequisites for consideration.

RESOLUTION ENDORSING THE COMMUNITY-WIDE GOALS OF THRIVE 2027

WHEREAS, Thrive 2027 envisions a Greater Portland that is more inclusive, more caring, and more collaborative through focusing on developing resources that provide everyone living here with the opportunity to reach their full potential; and

WHEREAS, children will lead our community tomorrow and ensuring their healthy development is essential; and

WHEREAS, when a community opens pathways to health, everyone benefits; and

WHEREAS, when people become more fmancially stable, they are able to take better care of basic needs like shelter, food, and medical care not only for themselves, but their families; and

WHEREAS, while Greater Portland is a great place to live and work, not everyone is doing well, including nearly one-third of Cumberland County 3rd graders who are not reading at grade level and more than half of residents who do not have sufficient resources for housing and other necessities,

WHEREAS, while Americans with major mental illness die 14 to 32 years younger than the general population, these individuals can be greatly helped by good health care; and

WHEREAS, working together toward a shared vision and engaging new voices around measurable and achievable goals can make long-lasting change in this community; and

WHEREAS, the Greater Portland Community-Wide Goal Setting Council, a group of23 individuals from all sectors of the area, looked at the needs in the community to draft goals to serve as a road map for people and organizations to come together to make measurable progress in strengthening our community; and

WHEREAS, during that work, more than 2,100 people shared aspirations and solutions through conversations and surveys; and WHEREAS, the three goals adopted by the Greater Portland Community-Wide Goal Setting Council are grounded in data and aligned with the aspirations of the community conversation participants; and

WHEREAS, we believe that these goals represent a holistic and integrated approach to increasing opportunities, improving lives, and strengthening community so that everyone in Greater Portland grows and prospers; and

WHEREAS, success requires cross-sector partners to come together in a new, more intentional way, aligning individual and collective contributions, employing strategies that reinforce each other, mobilizing community resources and public will, and relying on data and robust evaluation efforts; and

AMENDMENT TO PORTLAND CITY CODE CHAPTER 14 LAND USE, ARTICLE III Re: Food Trucks

I. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORTLAND, MAINE IN CITY COUNCIL ASSEMBLED AS FOLLOWS:

That Chapter 14, Sections 14-154 and 14-301 of the Portland City Code are hereby amended to read as follows:

Sec. 14-154. Permitted uses.

The following uses are permitted uses within the recreation and open space zone, subject to the development standards contained herein:

(a) Municipal parks, public open spaces, picnic areas, playgrounds and play lots;

(o) Wind energy systems, as defined and allowed in Article X, Alternative Energy;

(p) Street vendors licensed pursuant to Chapter 19 as a result of a competitive bid process conducted pursuant to Chapter 2 of the City Code; and

( q) Events, activities, and uses licensed by the city, including but not limited to markets, festivals, cafe seating, concerts, and other gatherings.

Sec.14-301. Permitted uses.

Subject to a determination that the proposed use meets the standards of section 14-300.1. (no adverse impact on marine uses), the following uses are permitted in the Eastern Waterfront Port Zone: (a) Marine passenger:

(c) Commercial:

1. Professional, business, government, and general office located in upper floors of structures existing as of September 18, 2006.

2. Temporary events, except festivals as otherwise governed under secti9n 14-30113 below.

Buildings, piers and lands within the EWPZ may be used for temporary public and private events including but not limited to exhibitions, conferences, meetings, and trade shows under the following conditions:

a. Temporary events occupying more than 10,000 square feet of building or outdoor space shall not exceed a combined total of sixty (60) days between May l"t to October 3l"t;

b. No temporary event may continue for more than 14 days of continuous operation;

c. Any temporary event that anticipates more than 5,000 people in attendance on any single day must provide and be subject to a parking management plan. The parking management plan must be submitted for the review and approval of the public works authority at least 60 days prior to the first day of the event.

I. ONE SENTENCE SUMMARY Upon the Council's request to review the text amendments pertaining to the elimination of the City's RFP process for Food Trucks, the Planning Board recommends the proposed revisions to the ordinance as written which would allow Food Trucks as permitted uses in the ROS and EWPZ subject to City's Food Truck regulations.

II. AGENDA DESCRIPTION This item asks Council to consider changes to Chapter 14 to amend references to Chapter 2 of the City Code relating to these food trucks. Specifically, the removal of a requirement for a competitive bid process as prerequisite for food trucks being allowed uses in the "Open Space and Recreation" and "Eastern Waterfront Port" zones. To date the food truck program has been very successful and as such the impetus for the competitive process to manage access is no longer needed. In addition, this process was time consuming and placed additional fmancial burdens both on the businesses and the City. ill. III. INTENDED RESULT AND OR COUNCIL GOAL ADDRESSED Create more efficient permitting process. Simplification of the requirements for Food Trucks will reduce the regulatory burden on these entrepreneurs.

Section 14-154 Permitted Uses of the R-OS zone currently reads:

"(p) Street vendors licensed pursuant to Chapter 19 as a result of a competitive bid process conducted pursuant to Chapter 2 of the City Code;"

The City is proposing the following revision:

"(p) Street vendors licensed pursuant to Chapter 19"

Additionally, Section 14-301 Permitted Uses of the Eastern Waterfront zone currently reads:

"4. Street vendors licensed pursuant to Chapter 19 as a result of a competitive bid process conducted pursuant to Chapter 2 of the City Code."

The City is proposing the following revision:

"4. Street vendors licensed pursuant to Chapter 19."

These changes reflect similar changes to the City's Food Truck Rules and Regulations which currently read:

"c. City Parks: • On city streets or in city-owned parking lots in city parks, if granted a license through the competitive bid process or RFP process described in Chapter 2, Sections 2-301 through 2-314 of the Portland City Code. "

And as revised will read:

"c. City Parks: • On designated areas of city streets or in city-owned parking lots in city parks."

III. COMPREHENSIVE PLAN The permission of food trucks, as small independent entrepreneurs, within certain zones of the city is consistent with the City of Portland's Comprehensive Plan. The Vision element of the Comprehensive Plan states that the City should: • Strive for innovation and bold initiatives that increase the livability and quality oflife in Portland. • Support a dynamic downtown that embraces an intertwining of uses, including residential, business, retail, institutional, service, and arts and cultural uses. • Capitalize on Portland's economic assets and develop a strong economy based upon traditional industries, a strong retail and office center, and emergent opportunities in industry, business, and coastal commerce.

Further, the economic development goals of the Comprehensive Plan emphasize creativity and responsiveness to emerging industries. The goals from the 1994 Industry and Commerce Plan include making Portland attractive to new businesses and creating "thoughtful flexibility for emerging industries" (38).

Portland's Comprehensive Plan also cites being "creative, responsive, and work[ing] hard to retain existing businesses" as an explicit goal of the Industry and Commerce Plan (38). It should

2 be noted that the Food Truck Task Force grappled at length with the issue of competition, and whether food trucks would represent an encroachment upon established "bricks and mortar" restaurants in those districts where zone changes are suggested. As a product of this concern, the Task Force suggested separation requirements in order to prevent food trucks from operating too close to existing food establishments.

IV. STAFF RECOMMENDATION

The staff supports a positive recommendation from the Planning Board regarding the several changes required in the Land Use Code to expand the zones under which street vendors are explicitly permitted.

V. PROPOSED MOTION Based on the material provided in this report, public testimony, a review of applicable policies, and other information the Planning Board finds that the proposed text amendment to the R-OS and EWPZ zones to allow street vendors as a permitted nse [is or is not] consistent with the Comprehensive Plan and recommends adoption of the proposed amendments to the City Council.

AMENDMENT TO PORTLAND CITY CODE CHAPTER 28 TRAFFIC AND MOTOR VEHICLES, SECTION 28-24 Re: Allowing Minor Traffic Schedule Changes by Traffic Engineer

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORTLAND, MAINE IN CITY COUNCIL ASSEMBLED AS FOLLOWS:

1. That Chapter 28, Section 15-24, is hereby amended to read:

Sec. 28-24. Regulatory powers.

In addition to any other authority granted under this Code, the city traffic engineer shall have authority to:

(a) Designate and maintain, by appropriate devices, marks or lines upon the surface of the roadway, eros swal ks at intersections where in his or her opinion there is particular danger to pedestrians crossing the roadway, and at such other places as he or she may deem necessary;

(g) (1) Establish parking regulations and publish them in the traffic schedule, except the following actions require amendment of the traffic schedule by order of the city council:

i. Change of parking to "no parking any time" or "no parking any time" to parking;

ii. Change from time limit or metered parking to unregulated parking, or from unregulated or unmetered parking to time limit or metered parking; or~

iii. Any change to Traffic circulation, such as changing a one-way street to a two-way street or a two-way street to a one-way street; i v. City Council approval of amendments to the traffic schedule for the actions in i. and ii. above shall not be required for:

a. Amendments to the traffic schedule to change up to two (2) parking spaces per block face within a twelve (12) month period with review and approval by the traffic engineer and the city manager;

b) Amendments to the traffic schedule to implement pedestrian crossing or streetscape improvements (such as the installation of islands, curb extensions, striping, stop signs, transit stops etc.) after review and approval by the Public Works Director or his or her designee; and

c) Amendments to the traffic schedule to change an on-street parking layout after review and approval by the Planning Board.

(3) In additioR to the parlcing changes iR subparagraph (1) above, aay change ia traffic circulation, for eJcample, from a one '.Jay to a two way street or the reverse, shall require ameadment of the traffic schedule by order of the city council.

(~4) Whenever any time limit parking is imposed, and wherever a one-way street is established, the city traffic engineer shall erect appropriate signs or meters, as applicable, giving notice thereof, and no such regulations shall be effective until and unless such signs or meters are erected. (h) Declare any street or part thereof, a "play street" and to place appropriate signs or devices in the roadway indicating and helping to protect the same;

(i) Determine the location of passenger zones and freight loading zones and place and maintain appropriate signs indicating the same and stating the hours during which the provisions of this subsection are applicable;

( j) Establish bus stops and stands for other passenger common carrier motor vehicles on such public streets, in such places and in such manner as he or she shall determine to be of the greatest benefit and convenience to the public, and every such bus stop or other stand shall be designated by appropriate signs;

( k) Erect signs indicating no parking upon that side of any street adjacent to any school property when such parking would, in his or her opinion, interfere with traffic or create a hazardous situation;

BE IT FURTHER ORDERED, that notwithstanding 1 M.R.S. Section 302, the above amendments shall be applicable to all projects that have completed Level I, II, or III Site Plan review or received Administrative Authorization approval, pursuant to the applicable Chapter 14, Division V, but have not yet received a Certificate of Occupancy on or before July 6, 2016. I. ONE SENTENCE SUMMARY Changes proposed to Chapter 28 in the City's Ordinance to streamline traffic schedule change approvals for minor on-street parking changes, projects with site plan approvals from the Planning Board, and streetscape projects.

II. AGENDA DESCRIPTION Currently, the City's Ordinance requires City Council review and action for relatively small parking space changes (as little as one space in many situations), projects already having Planning Board site plan approval, and certain street improvement projects. The proposed Chapter 28 changes will allow DPW to adjust up to two parking spaces per street block face per year with City Manager approval. In addition, projects with parking changes associated with a Planning Board approval would be sufficient for a traffic schedule amendment. Lastly, a wider range of streetscape projects that are undertaken by DPW could make needed parking adjustments without a separate Council approval process.

III. BACKGROUND The origin ofthese requested changes was largely due to the fact that many parking changes were subjected to differing public processes. In addition, staff time for prep and meeting attendance has been significant as a result. IV. INTENDED RESULT AND OR COUNCIL GOAL ADDRESSED The outcome for these changes is the intent for more flexible and faster outcomes, and fewer small or redundant items needing to be taken up by the City Council.

V. FINANCIALIMPACT If anything, these changes will reduce costs in terms of administration and staff time, as well as for project applicants and design consultants.

VI. STAFF ANALYSIS AND BACKGROUND THAT WILL NOT APPEAR IN THE AGENDA DESCRIPTION Parking Division, Public Works, and Corp. Counsel have all reviewed and concur with the proposed changes. Planning & Urban Development recommends these changes as well because, in the case of Site Plan Approvals requiring minor amendments to the parking schedule, there has already been a public process of review and approval.

In the case of site plan approvals, these changes will avoid the potential of the Council not providing needed changes to a development project already holding site plan approval through a prior public process.

VII. RECOMMENDATION DPW recommends that this change take place as soon as possible to avoid requiring ongoing developments to have to come to Council with needed parking changes prior to their Certificate of Occupancy.
