REPORT OF THE SECRETARY-GENERAL’S PANEL OF EXPERTS ON ACCOUNTABILITY IN SRI LANKA 31 March 2011 REPORT OF THE SECRETARY-GENERAL’S PANEL OF EXPERTS ON ACCOUNTABILITY IN SRI LANKA Executive Summary On 22 June 2010, the Secretary-General announced the appointment of a Panel of Experts to advise him on the implementation of the joint commitment included in the statement issued by the President of Sri Lanka and the Secretary-General at the conclusion of the Secretary-General’s visit to Sri Lanka on 23 March 2009. In the Joint Statement, the Secretary-General “underlined the importance of an accountability process”, and the Government of Sri Lanka agreed that it “will take measures to address those grievances”. The Panel’s mandate is to advise the Secretary- General regarding the modalities, applicable international standards and comparative experience relevant to an accountability process, having regard to the nature and scope of alleged violations of international humanitarian and human rights law during the final stages of the armed conflict in Sri Lanka. The Secretary-General appointed as members of the Panel Marzuki Darusman (Indonesia), Chair; Steven Ratner (United States); and Yasmin Sooka (South Africa). The Panel formally commenced its work on 16 September 2010 and was assisted throughout by a secretariat. Framework for the Panel’s work In order to understand the accountability obligations arising from the last stages of the war, the Panel undertook an assessment of the “nature and scope of alleged violations” as required by its Terms of Reference. The Panel’s mandate however does not extend to fact- finding or investigation. -

The tension stems from Sri Lanka's colonial period and subsequent post- colonial policies that harmed the Tamil people. Without viable alternatives, a part of the Tamil population resorted to the degree of brutality that precipitated a second civil war. Regional, domestic, and global attempts to bring the war to a halt have been futile, though some more local measures have been active. A ruthless military campaign brought the conflict to an end. However, nothing has been done in the aftermath of the war to try to resolve the civil war, including its roots. Sri Lanka's civil war exemplifies the uncertain existence of civil war resolution. With this in mind, the war's conclusion was unquestionably the product of a strategic triumph. However, the civil war should have ended; a unique constellation of structural, state, and national forces collaborated to allow for unrestricted military aggression. As long as the dominant forces, including the United States and significant European countries, understood that enough bloodshed had happened, the country's aggression could be brought to a stop. China and India, with India abstaining, voted to support the Sri Lankan government in its major offensive against insurgents. -

How many people disappeared on 17–19 May 2009 in Sri Lanka? Patrick Ball∗ Frances Harrison† 12 December 2018 Executive Summary This is a mathematical estimate of the total number of people disappeared at the end of the Sri Lankan civil war, only including those who disappeared between 17–19 May 2009. To be clear, this is not an estimate of the total number of disappeared people during the war, only those who disappeared after surrendering during the last three days. Subsequent UN reports described which army divisions and commanders were present ac- cepting the surrenders (Office of the United Nations High Commissioner for Human Rights 2015). Sri Lanka has a very large number of disappeared people (United Nations Working Group on Enforced or Involuntary Disappearances 2018). Even in the context of the high frequency and great magnitude of disappearances in Sri Lanka, these three days at the end of the war are extraordinary. They represent the largest number of disappearances in one place and time in the country’s history. As a starting point to estimate the total number of disappeared people in the war’s last days, we collected seven lists identifying the people known to have disappeared. The lists include people whom eyewitnesses saw being handed over to the army, were seen in army custody, were seen crossing the bridge or being detained south of the bridge, were seen at the Omanthai checkpoint, or were on a list specifically designating them as surrendered to the Army. These lists have been linked such that we know which records on which lists refer to the same people.1 How many people were disappeared but are not documented by these seven lists? In the present international community, a number of issues remain unsettled. While the global economy appears to have emerged from the worst stage of the crisis, it is still struggling on the path to recovery. It is also the harsh reality that many people around the world suffer from hunger and disease, conflict, climate change, and natural disasters such as earthquakes, and live hard lives in which they can hardly maintain their dignity as human beings. For example, in January 2010, many people lost their lives in the large-scale earthquake in Haiti. Japan, as an earthquake-prone country, will contribute actively to Haiti’s reconstruction, making good use of its knowledge and experience. -

The Government of Sri Lanka has, however, failed to ensure independent and credible investigations into past violations of international human rights and humanitarian law. The report also contains updates on the ongoing attacks on religious minorities, and the harassment and intimidation of human rights defenders, lawyers and journalists. The Government has not responded to the offers of technical assistance made by the High Commissioner and the special procedures. Meanwhile, new evidence continues to emerge on the events that took place in the final stages of the armed conflict. Against this background, the High Commissioner recommends the establishment of an independent, international inquiry mechanism, which would contribute to establishing the truth where domestic inquiry mechanisms have failed. * Late submission. Since 2010, Sri Lankan universities have been the site of turbulent events, including a state-initiated military-led undergraduate orientation programme; appointments of allegedly unsuitable individuals to higher administrative positions in universities; infringements of student rights and unions. In parallel, a dynamic trade union campaign has generated discussions on the role of state universities and the functions of higher education. I study the discourses of academics on militarisation in this environment, in its public and individual aspects. The research questions are: a) What are the discourses of militarisation in Sri Lankan academia, as formulated publicly and individually? b) What changes are evident in individual discourses of militarisation amongst Sri Lankan academia over a long duration of time? The study uses a methodological framework that includes an ethnographic approach and discourse analysis. -
