All football organisations need to be compliant with relevant “Working With Children” legislation.

This year, the Child Protection (Working with Children) Act 2012 replaces the Working with Children provisions contained in the Commission for Children and Young People Act 1998

The following is a summary only and all Clubs should refer directly to the Child Protection Legislation, and if necessary, take legal advice, to ascertain how the Child Protection Legislation affects them.

The 2012 Act

• Not yet in force, current transition period – likely 2014 transition for sporting groups.

• Likely that work as a coach or as a team manager, or an assistant coach or assistant team manager, is regarded as child-related work and will require the necessary working with children clearance check

• Until such time as the 2012 Act applies, the provisions of the 1998 Act remain operative

© Australian Football League 2010. This document is confidential and intended solely for the use and information of the addressee 16 CHILD PROTECTION

The defining legal requirement of the 1998 Act:

‘requires all paid and unpaid employees/volunteers, where one of the essential duties of the position involves direct and unsupervised contact with children, to sign a Prohibited employment declaration’ and

‘Conduct employment screening on preferred applicants of paid positions, where one of the essential duties for the position involves direct unsupervised contact with children.’

Forms are available at www.kids.nsw.gov.au

Some tips: • Appoint a ‘Child Protection Officer’ at your club to handle this administration • Keep the forms on file. You don’t need to fill in a form every year. • When in doubt, complete a form!
