Signature Living Hotel Limited. Section 27 (1) (c) Licensing Act 2003 – Lapsed Premises Licence.

We have been made aware from records held by Companies House that Signature Living Hotel Limited, company registration number 08124207 has entered into administration following the appointment of an administrator (Duff & Phelps Ltd, The Chancery, 58 Spring Gardens, , M2 1EN) on 5 May 2020.

Our records show Signature Living Hotel Limited as being the named premises licence holders for the premises, Hall, Warrington Road, Rainhill, St Helens, Merseyside, L35 6NZ. Premises licence number PL2239.

Section 27 (1) (c) of the Licensing Act 2003 advises that a premises licence lapses if the holder of the licence – becomes insolvent.

Section 27 (4) (b) of the Licensing Act 2003 further advises that a company becomes insolvent on – the appointment of an administrator in respect of the company.

Due to Signature Living Hotel Limited being in administration and therefore insolvent due to the appointment of an administrator on 5 May 2020 the premises licence for Rainhill Hall, Warrington Road, Rainhill, St Helens, Merseyside, L35 6NZ, premises licence number PL2239 has now lapsed.

Due to the premises licence having lapsed at Rainhill Hall all licensable activities previously authorised by the premises licence must now cease. These premises do not now currently hold a premises licence that authorises any licensable activities.

It must be pointed out that under section 136 of the Licensing Act 2003 the carrying out of licensable activities other than in accordance with a valid premises licence is an offence that carries a maximum penalty upon summary conviction in a Magistrates Court to a term of imprisonment not exceeding 6 months, a fine or both.

Should licensable activities be proposed to be carried out at the Rainhill Hall premises then a new premises licence would need to be applied for.

A copy of this letter has been forwarded to Merseyside Police and also the administrators Duff & Phelps Ltd.
