Daily Media Report - 5/5/2014

**------(lwmain00314305042014)** On 5/4/2014 I responded to 820 Hospitality Dr in reference to a Domestic Disturbance. Upon my arrival on scene I met with the complainant David Booth. Mr. Booth had blood that had dried underneath his eye and his tank top t-shirt had been ripped.

The argument took place in the Travelers Inn parking lot while all parties were attempting to move there belongings into the room they had just paid for.

Upon making contact with Mr. Booth he stated that him and his girlfriend Nina Lancaster had gotten into an argument over her accusing him of trying to "get with" her mother Kathy Rhodes. He stated that once she said that he told her she was crazy and she then hit him in the face and scratched him as well as ripped his shirt.

At this time I had Mr. Booth write a voluntary statement describing what took place. As well as photographing his injuries and marks.

Mrs. Lancaster and her mother had left the scene and were not present at this time. I then notified Mrs. Lancaster by way of phone that I needed to speak with her and collect a statement from both her and her mother who was a witness, as well as photograph any injuries that she may have.

Mrs. Lancaster then stated that I needed to hurry and meet them at the waffle house at Asheville Hwy and I -26. This was due to her stating that she was pregnant and had been kicked in the stomach and was bleeding. I then told her that she needed to seek medical attention if that was the case and I would meet her there. She then told me that it would be ok until I got there.

Upon my arrival to speak with Mrs. Lancaster and her mother Mrs. Lancaster stated that she was bleeding and I asked her if she needed an ambulance due to her previously stating it was possible that from her getting kicked she could be having a miscarriage of the twins she was pregnant with, and when she stated no I then went to notify for an ambulance to be dispatched anyway, she told me that she wasn't pregnant and had a hysterectomy two years ago.

After resolving that issue she stated that she had been spit on an choked but that she had not been hit like she originally stated and that the bruises on her arm were from her moving furniture throughout the day on 5/3/2014.

I then asked her to provide a voluntary statement as well as her mother who was a witness. Her mother was able to provide one which stated that Mr. Booth had pushed her daughter and choked her and hit her at the back of her truck in the parking lot.

Mrs. Lancaster was unable to write a statement due to her stating she had nerve damage from a wreck after she attempted to write a statement which I collected. I then photographed her alleged marks which were not visible and did not fit the description of what she was claiming had happened.

I then uploaded all the pictures which I took to attach to the case file. As well as scanned all statements and the warrant in VIA the scanner at the Sheriffs Office.

Upon arrival at the jail I ran Mrs. Lancasters NCIC history which showed a previous CDV conviction.

I also spoke with Judge Atkins regarding the matter. Due to lack of physical injuries on Mrs. Lancasters behalf a warrant was issued for CDV Second offense in her name. Due to her having no visible injuries and Mr. Booth having injuries that matched his description of events.

Warrant # 2014A4210201317 for CDV2nd Offense For Nina Lane Lancaster VNI Issued = YES ~~------(lwmain00314305042014)~~

Upon arrival I spoke with the victim, Timothy Powell. He stated that he and his wife left the residence at approximately 1600 hours on 5/2/14 to go out of town and returned at approximately 1100 hours on 5/3/14. He stated that this evening at approximately 2315 hours he heard the dog barking towards the woods and went into his bedroom to retrieve his pistol so he could investigate. He stated that he went to his bedroom and opened the top drawer of his night stand but the gun was missing. He described the handgun as a semi- automatic Taurus .45 caliber, black in color receiver with a silver slide. He stated that he checked the doors and windows and all were secure with the exception of an upstairs window on the side of the house. He stated that the window appeared to be locked, however he found the window was actually unlocked. He then showed me the unsecured window at which time I observed two of the window blind cords hanging outside. I asked if there was access to a ladder and he stated that he had several in the yard on the other side of the house and showed me where they were located. I then observed a large extension ladder laying in the grass that appeared to have been moved because there was an imprint of the ladder adjacent to the ladder's current location.

The victim was unable to provide the model and serial number of the handgun at the time of the report, but should be able to provide it when he locates the information. I advised him to contact the Sheriff's Office with the information as soon as possible. The handgun was not placed in NCIC at this time. ID Investigator S. Horton responded to process the scene. Upon my arrival I met with the staff and they stated that William was in E.R. room 3 with a laceration to his face and that he was extremely intoxicated. The staff stated that at that time he was currently asleep, but prior to going to sleep when DR. Huntley was in the examine room with William he began to curse him and threatened to hit him if he touched him. William at one according to DR. Huntley had even took a swing at him in attempt to hit him.

While still on the scene RN nurse Grubb was entering the room to administer another injection on William. I at that time followed RN Grubb into the room and she tried to wake William to advise him of the injection. After administering the injection William then began to curse at the nurse. I began to explain to William that it would not be tolerated talking to ER staff in that manner and that if it continued then he would be arrested for public disorderly conduct . William then became upset with me and began cursing me and threatening to hit me in the face. William then took off running through the ER cursing and being loud. The security officer Rajagh and myself caught up with William and explained that if he did not go back to the room and calm down and get treatment he would be arrested. William then went back to the room and jumped up on the bed continuing to curse and be loud. I then looked at the nursing station and asked if the doctor was ready to release William and DR. Huntley advised that he was.

At that time I advised William he was being placed under arrest and he once again ran out of the room and ran to a locked door where Security Officer Rajagh and myself caught him. William was still cursing and then began to pull away resisting while trying to be handcuffed. Once handcuffed William was escorted to my patrol unit outside while he continued to curse and pull away. Once in the back of my patrol unit William was still being loud and then laid in the seat and began to kick my window on the driver side rear door. Deputy Cockrell arrived on the scene and at that time, I opened the patrol car door and advised William to lay down in the seat in an attempt to restrain his feet. William stated that he would kick me in the face while cursing. William was restrained and then transported to the detention center where I was met by deputies working the detention center. The deputies that met me escorted William from my patrol unit to a holding cell.

**------(lwmain21042505042014)** On 05/04/2014 I was dispatched with multiple deputies to a disturbance with weapons at 126 Fortune Drive in the County of Spartanburg. When I arrived I observed Mr. Wynn, who is a possible suspect, to be upset and posturing up to his neighbors. He informed me that someone had hit his wife, Mrs. Crystal Wynn, who is 6 months pregnant. He told me that a toddler was playing in their yard and then started crying. He said he then told his neighbors that they need to watch their child. Mr. Wynn claimed then that an individual, Ben Cody, who lives next door, exposed himself to his wife and mother-in-law. He said this is when he started getting physical in order to defend his wife. Mr. Wynn didn't have any injuries and did not wish to provide a voluntary statement. I then spoke to Mrs. Wynn, who corroborated what Mr. Wynn stated and added that she defended herself from a lady, later identified as Amanda Ballard. She stated that Ms. Ballard was attacking her and pulling out her hair. She stated that she was struck in the stomach with a stick and kicked. Mrs. Wynn said she was able to take the stick away from Ms. Ballard and used it to defend herself. There was a visible black mark about four inches long on her hand she stated was caused by the hit from the stick. Ms. Wynn was seen by Medic 3 for her injuries. I then spoke with Ms. Robin Cody and she told me that she observed that the neighbors (Mr. and Mrs. Wynn) came over and started beating her grandson and daughter with a stick. She said that the fight started over a rock being thrown at her grandson's head. She also stated that Ben Cody and Terry Cannon were hit with the stick. I spoke with Ms. Ballard and she stated that the fight started after her son got hit in the head with a rock and the neighbors told her to get her son out of the yard. She walked away and then she said that the neighbor came to her yard and she was hit in the head after she turned to walk away. Ms. Ballard had a gash on her head, and blood on her shirt and down her neck. She was seen by Medic 23. Mr. Cannon also told deputies that he came out in defense of his mom. He declined to give a voluntary statement. He had an injury to his left eye. Deputy Horton (I-54) responded upon request to document the injuries to all parties involved. After leaving the scene I went to the detention center to speak to the Magistrate Blakeley and a warrant was denied based on mutual combatants. VNI Issued = YES ~~------(lwmain21042505042014)~~

At that time I asked again where he was going and he just stared with a blank look on his face and uttered a few curse words.

It was then that I advised him he was under arrest for Public Disorderly Conduct and placed handcuffs on him and placed him in the back of my patrol car.

He was then transported to the Spartanburg County Detention Center where he was issued ticket#94055 GF. He was transported without incident and left in good standing at the Jail. VNI Issued = NO ~~------(lwmain05230205052014)~~
