PRECEDENT SAYS Federal Courts have a long history of Aabstaining@ from deciding the merits of a case that deals directly with state law NO CHANCE matters and Constitutional interpretation. by Andrew (Drew) Mollica Pursuant to the Younger and/or Pullman Abstention doctrines, which are related to the Acomity@ between the state and federal courts, it is likely the Federal Court will dismiss the case and demand it be brought in the state courts of Kentucky. The Federal Court, as it has done many times in the recent history, will likely reason the Kentucky State Court is the proper jurisdiction for such an action. Under this scenario the Wests will likely be forced to litigate the matter in State Court where the law and the precedent is clear and not in their favor. Primarily, Kentucky Racing Regulations deem the Stewards' decision regarding interference of a horse, including Maximum Security, is a "final order" and consequently not appealable. LM: When did you first start breaking horses for your uncle?

GM: I think the first year we had yearlings for him was 2012. He would have been part of the first crop. He was a big supporter.

LM: Was Bill (Mott) giving you a lot of early feedback on the horse?

GM: After Jerry passed, and we were going through all the legal paperwork, I knew something was up because Bill kept checking with the racing office about twice a week to see if our paperwork was in line. He did tip his cap a little bit from that standpoint. From the start, Bill had been telling me that this was a throwback type of horse.
