I, Richard Wolfe of CH2M HILL AUSTRALIA Pty Ltd, 615 St Kilda Road, Melbourne, a person appointed by the Environment Protection Authority (“the Authority”) under the Environment Protection Act 1970 (“the Act”) as an environmental auditor for the purposes of the Act, having:-

1.O INTRODUCTION

The Shire of Campaspe (the Shire) is proposing to apply for the rezoning of the land at the former Parks and Gardens Depot, Lake Road, Kyabram for future residential redevelopment.

Under the provisions of the Ministerial Directive No. 1 issued under the Planning and Environment Act 1987, rezoning of land to more sensitive landuses is subject to the issue of a Certificate or Statement of Environmental Audit by an EPA-appointed Auditor pursuant to Section 57AA of the Environment Protection Act 1970.

Richard Wolfe of CH2M HILL AUSTRALIA (CH2M HILL) was engaged by the Shire in October 1996 to undertake the Audit. Note that Richard Wolfe was an employee of Gutteridge Haskins & Davey at the time of appointment as Auditor and subsequently joined CH2M HILL in December 1996. Richard Wolfe is accredited as an Environmental (Contaminated Sites) Auditor by the Environment Protection Authority of Victoria; this appointment extends to 25 March 1999.

2.0 EPA AUDIT REQUIREMENTS

Consistent with the requirements of Ministerial Directive No.1 issued in 1992, rezoning of potentiuallyland to more sensitive land uses is subject to the issue of a Certificate or Statement of Environmental Audit by an EPA-appointed Auditor pursuant to Section 57AA of the Environment Protection Act 1970.

A Certificate of Environmental Audit is issued where the Auditor is of the opinion that the condition of the land is not detrimental or potentially detrimental to any beneficial use. If the condition of the land precludes the issue of a Certificate, the Auditor is then required to provide a Statement setting out the reasons for declining the issue of a Certificate and may indicate, in a Statement, the types of usesldevelopments which are not prejudiced by the ground contamination. This may provide for residential development subject to implementation of a management plan. A Statement will therefore impose conditions on the site restricting landuse and the nature of site development.

3.0 SCOPE OF AUDIT

The scope of the Audit undertaken included the following:

Review of a Preliminary Environmental Site Assessment report dated January 1996 undertaken by CMPS&F Environmental (CMPS&F) for the Shire of Campaspe.

Site inspection by the Auditor;

Preparation of a Sampling and Analysis Plan (SAP) for the further assessment of the site;

Review of an Environmental Site Assessment report dated 15 August 1997 undertaken by CMPS&F for the Shire of Campaspe. The purpose of this assessment was to implement the SAP developed by the Auditor;

Review of Environmental Site Assessment report dated 29 October 1997 undertaken by CMPS&F. This report provided additional data requested by the Auditor which was omitted from 15 August 1997 report ;

Issue of a Certificate or Statement of Environmental Audit; and,

Preparation of an environmental audit report.

The Audit was commenced in October 1996 and a site inspection was undertaken by Richard Wolfe in November 1996. A SAP was prepared by the Auditor in May 1997, at the request of the Shire and detailed sampling was undertaken by CMPS&F in August and October 1997. The Audit was subsequently completed in December 1997.

5.0 SITE DESCRIPTION

5.1 SITE LOCATION

The site is located at Lake Road, Kyabram and comprises an area of approximately 0.64 hectares. The site is bounded on the northern side by a drainage basin, with the existing Council Depot on the other side of the stormwater drainage basin. The site is bounded to the east by Lake Road. Residential properties bound the site to the south and west.

5.2 LAND DESCRIPTION

The site was a former Shire depot used largely for servicing parks and gardens. All buildings and facilities have been removed from the site at the time of the inspection by the Auditor, with the exception of a shed and three concrete slabs located in the southeast portion of the site. A compacted gravel road runs in an east-west direction through the centre of the site from Lake Road to the rear of the site.

A proper identification of the site was not provided in the CMPS&F assessment report. Information provided by the Shire identified the site as Lot 2 of Plan of Subdivision PS 404879X (Title references Volume 3519 Folio 610 and Volume 2716 Folio 080 Shire of Campaspe, Parish of Kyabram East).

Copies of Certificates of Title were not provided to the Auditor, copies of the Plan of Subdivision are attached. (Appendix A).

5.3 SITE CHARACTERISTICS

CH2M HILL has reviewed existing site information and a description of relevant regional and site characteristics under topography and drainage, geology and groundwater is provided herein.

5.3.1 Topography and Drainage

The site was unpaved although a crushed rock surfacing had been placed across the site. Based on the inspection by the Auditor the site was generally flat with natural drainage to the adjacent stormwater retention basin.

5.3.2 Geology

The site is underlain by the Shepparton Formation which consists of clay, silt, sand and gravels with numerous levee traces on the surface, the soil is often red-brown in colour (Bendigo Sheet, 1:63:360, Geological Survey of Victoria). Field observations, by CMPS&F, were consistent with the geological survey data. Fill consisting of crushed rock, gravel and clay ranging in depth of 500mm was reported over a significant portion of the site.

5.3.3 Hydrogeology

A study of the hydrogeological data for the area, undertaken by CMPS&F, indicated that groundwater at the site was expected to be at a depth of less than 5 metres. No groundwater information was provided in any of the CMPS&F assessment reports.

5.3.4 Site History

The site has operated as a municipal depot since the 1950s and has served as a storage and handling facility for road making material and equipment, including bitumous cutback material, pipes and aggregate. A number of wash bay areas and hothouselplant propogation sheds were also located across the site.

A site history was compiled by CMPS&F, based on the inspection of historical aerial photographs. These aerial photographs were not provided in either of the CMPS&F assessment reports. A summary of the CMPS&F findings are as follows.

1945 - The site and surrounding land consisted of vacant paddocks. A faint grid appearance of the western portion of the site may indicate inigated cultivation.

By 1958 - The stormwater drainage basin had been constructed. No buidings or surface structures were present on the site or adjacent Council depot.

By 1977 - Aggregate bins are located at the rear of the site, together with the two garden sheds to the south of the site.

By 1990 - The site had achieved the configuration as detailed in CMPS&F’s January 1996 report, with a wire mesh fence separating the eastem and westem sections of the site. Refer Figure 6.1. The western section of the site contained a galvanised shed with car wash area, three garden sheds, a hanging rack, toilets, a wash area to the north which drained into the water-filled depression and a small transformer in the northeastern comer of the site.

6.0 REVIEW OF CMPS&F SITE ASSESSMENTS

6.1 GENERAL

CMPS&F was commissioned by the Shire of Campaspe to undertake a preliminary environmental site assessment at the Parks & Gardens Depot, Lake Road, Kyabram in late 1995 to assess shallow soil contamination at the site. A more comprehensive environmental site assessment was undertaken by CMPS&F in August 1997 generally in accordance with a SAP provided by the Auditor. Further work was undertaken by CMPS&F and reported in October 1997, to meet the requirements of the SAP to determine the extent of site contamination of natural soil underlying the fill.

The scope of the CMPS&F contamination assessments was to:

review site history of activities which may have been potentially contaminating and site physical conditions;

assess contamination of shallow soils across the site; and

characterise soil conditions at the site in order to satisfy Auditing requirements with a view to rezoning of land for low density residential redevelopment.

6.2 SOIL SAMPLING PROGRAMME

The preliminary soil sampling, undertaken by CMPS&F on 6 December 1995 and reported in January 1996, involved the recovery of soil samples at ten (10) locations. This included:

five (5) hand auger holes, (grid sample locations) sampled at nominal depths of 0-0.1m and approximately 0.5m; . four (4) hand auger holes, (target sample locations) sampled at nominal depths of 0-0.1 m and approximately 0.5m; and one (1) hand auger hole, (background location off-site) sampled at nominal depths of 0-0.1 m and approximately 0.5m.

The preliminary environmental assessment involved the collection of twenty soil samples, however individual samples were not analysed; only seven composite samples were analysed. The grid-based samples were composited into two samples (by depth) for analysis. Furthermore the analytical program was limited in scope and only provided an assessment of arsenic and organochlorine pesticide contamination for the grid-based (composite) samples at the site. This report identified a potential issue with arsenic in excess of the ANZECC Environmental Investigation Guidelines of 20mg/kg, but was inconclusive as a result of the compositing.

A SAP for the further assessment of the site was developed by the Auditor in May 1997. Refer to Appendix B.

The further sampling program was undertaken by CMPS&F in July 1997 and involved the recovery of soil samples at eighteen (18) locations, at nominal depths of 0.05-0.lm and 0.4-0.5m and two background locations in Lake Road. CMPS&F in October 1997 involved the collection of soil samples from naturally occurring material below the fill material at selected locations where the previous sampling depths were confined to the fill. Sampling at these locations was to a depth of 0.6 to 0.7 m. A sampling plan (from the CMPS&F October 1997 report) is attached as Figure 6.1 (Referenced from CMPS&F October 1997 report).

The SAP for the site, developed by the Auditor, set out minimum sample density requirements for the characterisation of soil contamination based on 95" percent confidence of detecting hotspots of contamination. A summary of the work undertaken by CMPS&F in July and October 1997 is presented in Table 6.1.

Only eighteen locations were sampled and although not in accordance with the original requirements, the December 1995 and 1997 data is considered to be representative.

The summary of field sampling protocols provided generally comply with good practice, although very few details were provided. The 6001700 mm depth samples from the October 1997 supplementary investigation were composited (across selected locations. Compositing is generally not recommended for detailed investigations, and is usually restricted to a maximum of three parts. Reanalysis of selected individual samples was undertaken.

Two (2) background soil samples were recovered from areas not impacted by site activities (AH19 and AH20), although the results are not discussed in the CMPS&F report.

6.3 ANALYTICAL PROGRAMME

Grid samples from the CMPS&F January 1996 report were analysed for arsenic and OCPs as noted. Analysis of targeted samples was for potential contaminants only generally arsenic, OCPs, PAHs and TRHs.

The analytical program undertaken by CMPS&F in July and October 1997 generally satisfied the SAP provided by the Auditor with respect to scope, methods of analysis and use of NATA-registered laboratories.

Sample AH20(50 - 100mm depth) was analysed and reported levels of heavy metals below ANZECC Environmental Investigation Level Guidelines.

Only limited analysis (heavy metals, TRHs, OCPs and PCBs) was undertaken on the supplementary samples collected in October 1997, from selected locations which were extended to natural material beneath the fill. This was considered acceptable given the primary concern with heavy metal and OCP contamination.

As required by the Auditor two samples were selected for full EPA screen analysis. However, analysis for strontium was not undertaken on either sample.

A number of the results provided in the original MGT Laboratory reports are misrepresented in the October 1997 report summary tables. Table 6.2 suggests that 32 samples were analysed for these phenols and cresols. In fact, it appears that only KAH3lS (and a duplicate of this sample) and KAH12lS were analysed for phenols and cresols. There are further transcript errors between the summary tables and MGT and AMDEL laboratory results; for instance the chromium result for KQA4 should be 20mglkg, (shown as 5 mglkg in Table 3); a xylenes level of 0.2 mglkg was reported for KAH3lS (shown as <0.01 in Table 4); and an OCP (dieldrin) level of 0.03 mglkg was reported for KAH16lS (shown as <0.01 in Table 6).

6.4 QUALITY ASSURANCEIQUALITY CONTROL (WQC)

A review of the quality of data has been based on the following:

review of the findings of sample analysis against field observations and measurement; review of data quality based on the verification of field QAlQC procedures, evidence of the proper transference of samples (chain-of-custody documentation), sample analysis (and extraction) within the recommended holding times; analysis of 5 percent blind field duplicate samples by the laboratory; analysis of 5 percent duplicate split samples by an independent laboratory; trip blanks andlor field equipment rinsate samples; and internal laboratory QAlQC analyses including analysis of reagent blanks, spike recoveries and duplicates.

The CMPS&F October 1997 report has the following deficiencies with regard to QA/QC:

samples were collected on 8 July and 10 October respectively and delivered to the laboratory within 2 days. The results were reported on 7 September and 29 October respectively. It is assumed that maximum sample holding times were not exceeded; CMPS8.F commented that there was close correlation between the blind duplicates and split samples. However, no relative percentage difference (RPD) values were calculated for the blind duplicates or field split samples; and laboratory methods specified in the SAP prepared by the Auditor were not confirmed. In this regard the full report provided by each laboratory should be provided as an Appendix; this was not done.

An equipment rinsate blank was collected and analysed to ensure no cross contamination during the sampling process. None of the contaminants analysed were detected above the method detection limit.

The RPD values for the blind duplicates and field split samples were not calculated by CMPS&F. The RPD values have been calculated by CH2M HILL, and are summarized in Tables 6.2 and 6.3.

The RPD values calculated for the WQCsample are all within an acceptable limit off 50% with the exception of one chromium analysis for AH610.6, which was 54%. The chromium analysis for AH610.6 is only slightly above the acceptable limit and therefore the RPD values indicate that the quality of the data is satisfactory.

7.0 DISCUSSION

7.1 ACCEPTANCE GUIDELINES

The ANZECClNHMRC (ANZECC) Guidelines for the Assessment and Management of Contaminated Sites (January 1992) were used by CMPS&F as the basis for assessment of the condition of the land. Where investigation guidelines are not nominated in the ANZECC guidelines, the Dutch guidelines may be referred to (Netherlands Ministry of Housing Spatial Planning and the Environment, 1994). These guidelines were adopted on the basis that the site was being assessed for residential development. Canadian and NSW EPA criteria have been used where there are no specified levels in either the ANZECC or Dutch guidelines (eg. beryllium, selenium and TRH).

The ANZECC guidelines have been set on the basis of current toxicological data and are considered to be conservative. In general the investigation levels are considered to protect the most sensitive receptors. Where the levels of chemicals in soils are below the ANZECC and Dutch investigation guidelines the condition of the land is considered to satisfy the requirements for protection of all beneficial uses (excepting groundwater quality). These guidelines provide a basis for the further investigation of contamination for a range of chemicals and, where exceeded a risk-based review of the potential impact from environmental exposure for the proposed residential land use is considered appropriate.

A review of health-based soil investigation or guidance levels has been undertaken by lmray and Langley (1995) through the Third National Workshop on the Health Risk Assessment and Management of Contaminated Sites. This provides a range of health-based investigation levels considered to be appropriate for a range of generic land uses for Australia. *

Proposed health-based guidance values for selected contaminants are presented in Table 7.1 for low and medium residential land uses.

The guidance values should only be applied statistically and therefore where adequate characterisation of soil contamination has been completed. This requires that firstly data quality is acceptable and secondly that a representative sample of data is provided. The review by lmray and Langley added that the level of any contaminant at a discrete location should not exceed the proposed guideline value by more that 250 percent.

7.2 CMPS&F FINDINGS

The results presented in the CMPS&F preliminary environmental site assessment report (January 1996) indicated that concentrationsof arsenic and OCPs were generally below the ANZECC Environmental Investigation levels or appropriate Dutch guidelines. None of the selected contaminants (arsenic] PAHs, OCPs or TRHs) were reported at levels exceeding the ANZECC Environment Investigation Level guidelines from the targeted sampling. The calculated arsenic level in one of the 5 part composites (grid samples) exceeded the ANZECC Environmental Investigation level of 20 mglkg. It is reported by CMPS&F that the concentration of arsenic reflected naturally occurring levles of arsenic in the regional soils. Analysis of background samples did not necessarily confirm this.

The results presented in the CMPS&F environmental site assessment report (October 1997) indicated that concentrations of heavy metals, TRHs, organochlorine pesticides, PAHs and phenols and cresols were below the ANZECC Environmental Investigation Levels, with the exception of two soil samples. Laboratory analyses of KAH6lS reported copper concentrations of 160mglkg, which exceed the ANZECC Environmental Investigation levels of 60mglkg. This soil sample was collected from the fill material which appeared to have been used to construct the gravel road within the site. A depth sample from this location, recovered from natural material reported a copper concentration below the ANZECC Environmental Investigation level. Laboratory analysis of KQA2 (duplicate sample of KAH4lS) reported a zinc concentration of 220mglkg which marginally exceeds the ANZECC Environmental Investigation levels of 200mglkg.

The copper and zinc concentrations detected at KAH6lS and KQA2, respectively, were below the

' health-based investigation level for low density residential areas for copper and zinc of 1,000mglkg and 7,00Omglkg, respectively and are not considered to impact the residential] or other beneficial use of the site.

There is on the basis of the CMPS&F reports, no evidence of contamination of shallow soils across the site which is considered to impact the beneficial uses of the land.

8.0 CONCLUSIONS

The environmental site assessments undertaken by CMPS&F at the former Parks and Gardens Depot, Lake Road, Kyabram indicated minor copper and zinc contamination of the surficial soils with reference to ANZECC Environmental Investigation levels. This is not considered to preclude the rezoning of the site as residential. The elevated copper and zinc concentrations in the surficial soils marginally exceed the ANZECC Environmental Investigation Levels and are not statistically significant. The concentrations are also significantly below the health-based investigation levels considered to be appropriate for low and medium density residential uses or levels which are likely to impact other beneficial uses of the land.

A Certificate of Environmental Audit has accordingly been issued for the parcel of land at the former Parks and Gardens Depot, Lake Road, Kyabram.

9.0 LIMITATIONS OF THIS REPORT

The advice provided herein relate only to the audit of soil conditions at the former Parks and Gardens Depot, Lake Road, Kyabram and must be reviewed by a competent Engineer, experienced in contaminated site investigations, before being used for any other purpose. CH2M HILL AUSTRALIA (CH2M HILL) accepts no responsibility for other use of the data.

Where drill hole or test pit logs, laboratory tests, geophysical tests and similar work have been performed and recorded by others the data is included and used in the form provided by others. The responsibility for the accuracy of such data remains with the issuing authority, not with CH2M HILL.

The advice tendered in this report is based on information obtained from the investigation locations, test points and sample points and is not warranted in respect to the conditions that may be encountered across the site at other than these locations. It is emphasised that the actual characteristics of the subsurface and surface materials may vary significantly between adjacent test points and sample intervals and at locations other than where observations, explorations and investigations have been made. Sub-surface conditions, including groundwater levels and contaminant concentrations can change in a limited time. This should be borne in mind when assessing the data. However, it is our opinion that the test points chosen are representative of conditions on the site.

It should be noted that because of the inherent uncertainties in sub-surface evaluations, changed or unanticipated sub-surface conditions may occur that could affect total project cost andlor execution. CH2M HILL does not accept responsibility for the consequences of significant variances in the conditions.

An understanding of the site conditions depends on the integration of many pieces of information, some regional, some site specific, some structure-specific and some experienced-based. Hence this report should not be altered, amended or abbreviated, issued in part and issued incomplete in any way without prior checking and approval by CH2M HILL.
