Statement / Purpose: Consider resolutions for two separate grant applications to the Federal Lands Access Program (FLAP) for a) the Sagebrush Connector Pathway and b) Teton Pass Improvements.

Background / Description (Pros & Cons): FLAP provides funding to state, county, tribal, or city government agencies to improve transportation facilities that provide access to, are adjacent to, or are located within Federal lands. The FLAP program is accepting applications through December 8, 2020. At the September 21, 2020 BCC workshop, staff presented two candidate projects and received direction from the Board to prepare applications for both: • Sagebrush Connector Pathway o $2,260,000 request to construct a 0.8-mile non-motorized pathway between Golf and Tennis and Gros Ventre Junction o Connects two existing pathway segments o Identified in the 2007 Teton County Pathways Master Plan and the 2006 Grand Teton National Park (GTNP) Transportation Plan o Construction ready—design plans and NEPA have been completed • Teton Pass Improvements o Up to $5,000,000 request for various safety improvements at multiple locations on Wyoming Hwy 22-Teton Pass approximately as follows: . $2,000,000 - Summit and Overflow parking lot enhancements . $400,000 - Turn lane on Hwy 22 at Trail Creek Road . $300,000 – Chain up and skier pickup pullout below Heidelburg . $1,500,000 – Coal Creek Trailhead underpass at Hwy 22 . $72,000 – Summit and Phillips pedestrian safety digital messaging signs . $350,000 – Pass Corridor Plan (socio-economic analysis, trailhead needs, safety needs)

In order to submit the applications to the FLAP program, Teton County will need to approve a resolution for each application that authorizes applying for FLAP funds and designates an authorized representative to act on behalf of the County for matters related to the application.

Stakeholder Analysis & Involvement: Sagebrush Connector Pathway: Teton County and GTNP have coordinated on the preliminary planning for the FLAP application, and GTNP continues to provide assistance with grant preparation.

Teton Pass Improvements: Teton County has coordinated with WYDOT, Bridger-Teton National Forest, Caribou-Targhee National Forest, Teton Backcountry Alliance, and Wyoming Pathways on grant preparation.

Fiscal Impact: The FLAP program requires a local match of at least 9.51% and requires that the applicant agency assume maintenance of the assets.

Sagebrush Connector Pathway: Based on the 2017 engineer’s estimate of $1,871,575, plus contingencies that are required to be applied to the project in the FLAP application, the total estimate for construction is $2,260,000, which results in a local match obligation of approximately $214,926 (9.51% of total). Friends of Pathways has pledged to cover 1/3 of the match (up to $60,000). Additional matching funds may also be available through GTNP funding sources. Routine and capital maintenance costs are estimated at $3,391 per

Board of County Commissioners - Staff Report year. This estimate assumes a five-year cycle for sealcoating and restriping and that the pathway would not be plowed regularly during winter. Teton County would be responsible for long-term replacement costs.

Teton Pass Improvements: Local match of up to $475,500 (9.51% of total) based upon current cost estimates.

WYDOT has committed to maintaining items associated with minor improvements to their existing infrastructure, such as the turn lane and chain-up area and equivalent areas of parking. Additional areas of parking would need to be independently plowed and maintained by developing a public/private partnership agreement.

It is recommended that Memoranda of Understanding (MOUs) be developed with WYDOT, BTNF, CTNF and NGOs to define long-term maintenance responsibilities. This may include developing a system of paid parking or use that generates funds for parking lot and trailhead plowing and maintenance. Similar parking pass programs exist in other national forest locations that could be used as a model.

Staff Impact: Engineering and Pathways staff have completed the grant applications for each project.

Sagebrush Connector Pathway: • Pathways staff impacts: o Grant preparation (10-30 hours FY21) - COMPLETED o Grant administration (estimated 10-20 hours per year for FY21-23) o Construction coordination (TBD) o Operations and maintenance (4-6 hours per year, with more hours on sealcoating years) • Parks and Rec staff impacts: o Routine maintenance (8 hours per year) Teton Pass Improvements: • Public Works staff impacts: o Grant preparation (40-80 hours FY21) - COMPLETED o Grant administration (estimated 10-20 hours per year for FY21-23) o Project management and agency coordination (TBD – likely significant for several years) Legal Review: Gingery

RESOLUTION

Authorizing Submission of a Grant Application to the Federal Lands Access Program

WHEREAS, the Board of County Commissioners for Teton County desires to participate in the Federal Lands Access Program to assist in financing this project; and

WHEREAS, the Federal Highway Administration requires that certain criteria be met and to the best of our knowledge, this application meets those criteria; and

WHEREAS, the Board of County Commissioners recognizes the need for the project and authorizes a grant application for the Sagebrush Drive Trail to include construction of the pathway adjacent to Spring Gulch Road and Sagebrush Drive from the end of the current pathway at Lot 39 of the Resort at Jackson Hole Golf & Tennis Club (Fire Station lot) to the intersection of Sagebrush Drive and US Highway 26-89, for a distance of approximately one mile. Teton County intends to match the requested funds of up to $2,260,000 by up to $214,926 or 9.51% from the Teton County Capital budget or by providing in-kind services.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners for Teton County, that a Federal Lands Access Program grant application be submitted to the Department of Transportation. BE IT FURTHER RESOLVED, that Brian Schilling is hereby designated as the authorized representative of Teton County to act on behalf of the Board of County Commissioners on all matters relating to this grant application.

RESOLUTION

Authorizing Submission of a Grant Application To the Federal Lands Access Program

WHEREAS, the Board of County Commissioners for Teton County desires to participate in the Federal Lands Access Program to assist in financing this project; and

WHEREAS, the Federal Highway Administration requires that certain criteria be met and to the best of our knowledge, this application meets those criteria; and

WHEREAS, the Board of County Commissioners recognizes the need for the project and authorizes a grant application for the Teton Pass Improvements for the planning, design, and construction of safety improvements at various locations along Wyoming State Highway 22 on or near Teton Pass beginning just east of Trail Creek Road westerly to the Coal Creek Trailhead area. Teton County intends to match the requested funds of up to $5,000,000 by up to $475,500 or 9.51% from the Teton County Capital budget, developing MOUs with state, federal and private agencies, and/or by providing in-kind services.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners for Teton County, that a Federal Lands Access Program grant application be submitted to the Department of Transportation. BE IT FURTHER RESOLVED, that Amy Ramage is hereby designated as the authorized representative of Teton County to act on behalf of the Board of County Commissioners on all matters relating to this grant application.
