    LCB_18_2_Art_2_Grow (Do Not Delete) 8/26/2014 6:25 AM INSOLVENT PROFESSIONAL SPORTS TEAMS: A HISTORICAL CASE STUDY by Nathaniel Grow* The U.S. professional sports industry has recently witnessed a series of high-profile bankruptcy proceedings involving teams from both Major League Baseball (“MLB”) and the National Hockey League (“NHL”). In some cases—most notably those involving MLB’s Los Angeles Dodgers and the NHL’s Phoenix Coyotes—these proceedings raised difficult issues regarding the proper balance for bankruptcy courts to strike between the authority of a professional sports league to control the disposition of its financially struggling franchise’s assets and the rights of the debtor team to maximize the value of its property. However, these cases did not mark the first time that a court was called upon to balance the interests of a professional sports league and one of its insolvent teams. Drawing upon original court records and contemporaneous newspaper accounts, this Article documents the history of two long-forgotten disputes in 1915 for the control of a pair of insolvent franchises in the Federal League of Professional Base Ball Clubs (specifically, the Kansas City Packers and the Indianapolis Hoosiers). In the process, the Article contends that despite the passage of time—and the different factual and procedural postures of the respective cases—courts both then and now have adopted similar approaches to managing litigation between professional sports leagues and their insolvent franchises. Moreover, the Article discusses how the history of these 1915 disputes helps explain why U.S. professional sports leagues have traditionally disfavored public franchise ownership.

The following outlines the proposed terms by the Chicago Cubs as the organization considers the most extensive renovation of Wrigley Field in history. The framework contains many elements and addresses key areas including: community investment, parking, public safety, amenities, the ballpark operations and scheduling. If approved, this $500 million in new investment to Wrigley Field and the surrounding areas will create 2,100 new jobs and generate hundreds of millions in new tax revenue for the city, state and county. It would be among the biggest investments currently underway in Chicago. The Cubs and the Ricketts family are also committed to be good neighbors and the proposal demonstrates this commitment and is consistent with our on-going community involvement. The Restoration plan includes the following: Community Benefits • A $1 million commitment to fund a new park and playlot at 1230 W. Scholars argue that although local governments invest in new stadiums as tools of economic revitalization, the intended benefits often fall short. These scholars, however, analyze ballparks at a regional level. By taking a wide scope they overlook smaller scale results and impacts at the neighborhood level. Wrigleyville, the Chicago neighborhood surrounding Wrigley Field home of the Chicago Cubs, contrasts sharply with Armour Square, the neighborhood surrounding Guaranteed Rate Field (formerly US Cellular and Comiskey Park) home of the Chicago White Sox. While both neighborhoods contain a Major League Baseball field, Wrigleyville is a thriving community and commercial center, whereas Armour Square, is still struggling from its industrial past and is divided across racial and ethnic lines. Using Wrigleyville and Armour Square as case studies for the relationship between economic development and ballparks, this paper considers the extent to which these ballparks stimulate economic development and affect city initiatives. For ballparks to have a net-positive impact on neighborhood economic development, the community must view the ballpark as an asset. Further, private investment by the ballpark owners is the key to creating a thriving neighborhood surrounding the ballpark.     September 26, 2015 Chicago Tribune Cubs secure first playoff berth since 2008 after Giants lose to Oakland By Mark Gonzales It took some help from the Oakland Athletics late Friday night, but the Chicago Cubs received their first National League playoff berth since 2008. Despite a 3-2 loss to the Pittsburgh Pirates on Friday at Wrigley Field, the Cubs (89-64) backed into the playoffs by virtue of the Athletics’ 5-4 victory over the Giants (79-74) at the Oakland Coliseum. The Cubs are assured no worse than playing in the NL wild-card game on Oct. 7 – with the Pirates (94-60) being their likely opponent. The wild card game will be played at PNC Park as long as the Pirates finish ahead of the Cubs. This marks the fifth playoff appearance in 10 seasons for manager Joe Maddon, who directed the Tampa Bay Rays to four American League playoffs (2008, 2010-11, 2013). This also is the first playoff berth for the Ricketts family, which purchased a majority interest in the Cubs from the Tribune Co. in October of 2009. Some Cubs players and manager Joe Maddon said after Friday's game that they didn't plan on staying up to await a Giants result. “No. I won’t,” outfielder Chris Coghlan said. “I’m going to get rest. We play at (12:05 p.m.).” Maddon had an interesting way of explaining how he might follow the Giants-A’s game. “Probably when I have to go to the bathroom at night,” Maddon quipped, adding that the Cubs could celebrate “maybe via text.” But the Cubs' Dexter Fowler and Jake Arrieta apparently stayed up.
