SB 1586 - AUDIO RECORDING OF CLOSED MEETINGS PASSES SENATE Representative , D-. SB 1586 is an ini- tiative of the Illinois Press Association, which amends the Open Meetings Act requiring public bodies to make and maintain audio or video recordings of LEGISLATIVE closed meetings. This legislation will pose a significant burden on municipal- ities around the state. SB 607 - REINSTATEMENT OF PHOTOPROCESSING TAX - Action Alert! Representative Sid Mathias, R-Buffalo Grove. Senate Bill 607 is scheduled for the House Revenue Committee and would reinstate the monthly transfer of 0.4% of the State portion (5%) of the State Sales Tax to municipalities and counties based on a per person distribution. The counties’ share is based on their unincorporat- ed population. SB 607 equates to $26.1 million for local governments of which $22.4 million is for municipali- ties around the state. IML POSITION: SUPPORT.

HB 2216 - DOWNSTATE FIRE PENSION - Action Alert! Representative Mike Smith, D-Canton/Senator George Shadid, D-Edwards. HB 2216 would increase the pension benefits for survivors of firefighters who participated in the Downstate Fire Pension System (Article 4). The cost of this legislation is estimated by the Pension Laws Commission to be upwards of 4.42% of payroll. Please consult our website at www.iml.org for more detailed information. HB 2216 is currently in the Senate Rules Committee. IML OPPOSED.

SB 609 – STATE MANDATED ENERGY EFFICIENCY BUILDING CODE - Action Alert! Senator Denny Jacobs, D-East Moline/Representative Julie Hamos, D-Evanston. SB 609 creates the Energy Efficiency Building Act, which requires municipalities to adopt the International Energy Efficiency Code for all future residential, commercial and industrial construction. The League believes this bill to be unnecessary due to the fact that the adoption of building codes has always been an issue of local authority.

We still need your help on this issue. The bill is scheduled for a hearing in the House Local Government Committee next week. Use the League’s Legislative Action Center to get the message to your legislators that a statewide energy building code is not needed! IML OPPOSED.

HB 2577 - PUBLIC LABOR RELATIONS ACT – 5 EMPLOYEES – Action Alert! Representative Eddie Washington, D-Waukegan/Senator , D-Vernon Hills. HB 2577 was amended and passed out of the House on Tuesday, April 1 to require that municipalities recognize bargaining units unless the municipality has fewer than 5 employees. Current law provides that municipalities with fewer than 35 employees are exempt from having to recognize bargaining units. HB 2577 has been assigned to the Senate Labor and Commerce Committee. IML OPPOSED.

LABOR ISSUES

HB 235 - ECONOMIC DEVELOPMENT INCENTIVES Representative Jack Franks, D-Woodstock. HB 235 is an initiative of the AFL-CIO that would have restricted economic development incentives issued by both the State and local governments. An amendment added in the House appears to have removed requirements and restrictions that were placed upon local government. The League will continue to monitor this legislation closely. SB 235 has been assigned to the Senate Labor and Commerce Committee. Please make your Senator(s) aware of your position on this bill.

HB 3399 - PREVAILING WAGE FOR PUBLIC PROJECTS Representative Jack McGuire, D-Joliet. HB 3399 stipulates that all public works projects involving Illinois First money must adhere to the Prevailing Wage Act. Prevailing wage rates must also be paid for TIF-relat- ed projects. Several concerns with the bill were raised during committee testimony. Among the concerns were that the bill appears to include private home construction and remodeling projects under the prevailing wage requirement if the projects are inside a TIF district. Also, if a public works project is locally financed but partial- ly funded with Illinois First money, the entire project could fall under the Prevailing Wage Act. Even if these issues were resolved, HB 3399 would almost certainly increase the costs of some public works projects. The bill remains in the House, but was given an extended deadline until May 2, 2003. IML OPPOSED. Legislative Bulletin 2003-14 April 22, 2003 Page 3

HB 1729 – GARBAGE TRANSFER STATIONS Senator James Clayborne-D-Belleville amends the Environmental Protection Act relating to garbage trans- fer stations. The bills purpose is designed to limit municipal powers by preempting current municipal authority. Specifically this legislation attempts to ensure the siting of a garbage transfer station in McHenry County that is now being disputed by homeowners, the village of Cary, a private landowner and the local conservation district. IML OPPOSED.

SB 690 – FREEDOM OF INFORMATION ACT/ATTORNEY’S FEES Senator -D-Chicago/Representative Barbara Flynn Currie, D-Chicago. SB 690 amends the Freedom of Information Act permitting a court to award attorney’s fees and costs to a party denied public records requested fundamentally for their commercial value. The original bill has been amended on two occasions. The Illinois Municipal League remains opposed to the bill as written. However, Sen. Cullerton was asked and respond- ed during debate in the Senate that he would work with the House sponsor to try to amend the legislation. The Illinois Appellate Court said no to attorney’s fees for commercial interests. Currently written, this legislation reverses the last decision and essentially allows attorneys fees to newspapers, which is not the current law. IML OPPOSED.

HB 3597 – VESTED PROPERTY RIGHTS Representative Mary K. O’Brien, D-Watseka. HB 3597 creates the Illinois Vested Property Rights Act. This is an initiative of the Home Builders Association of Illinois. Specifically, the legislation states that the approval of an application to a unit of local government for a site-specific development establishes a vested prop- erty right. Essentially, local governments would not be allowed to change its zoning or regulations for 10 years regarding a parcel of property after an application has been approved. This legislation also preempts home rule. The League has checked with a few attorneys who are experts in the property rights field and uniformly they strongly came back how this is not a positive for local governments. Various amendments are pending before the House rules committee. The bill remains in the House, but was given an extended deadline until May 2, 2003. IML OPPOSES HB 3597.

HB 185 - ROAD GRADER REVOLVING LOAN FUND Representative Don Moffitt, R-Gilson/Senator George Shidid, D-Edwards. HB 185 provides that the Rural Bond Bank shall administer a road grader revolving loan program to provide loans to units of local govern- ment for the purchase of road graders that are manufactured in the USA. IML Supports.

HB 298 - FAILURE TO PAY FINES FOR ABANDONED VEHICLE/SUSPEND OWNER’S DRIVERS LICENSE Representative Raymond Poe, R-Andrew/Senator Lawrence Walsh, D-Elwood. HB 298 changes the per- son who loses driving privileges if a fine for having an abandoned vehicle is not paid. Currently, if the local or state authorities pursue the scofflaw driver of the abandoned vehicle, his or her driving privileges can be suspend- ed. This bill changes “driver” to “owner” of the abandoned vehicle as the one who loses driving privileges. IML SUPPORTS.

HB 438 -FREEDOM OF INFORMATION ACT/PAYMENT OF ATTORNEYS FEES Representative Barbara Flynn Currie,D-Chicago/Senator Jeffrey Schoenberg, D-Evanston. HB 438 cre- ates a new rule for when a person suing a public body can receive attorney’s fees. Under this bill, if the court deter- mines that the public body unlawfully refused to permit a public record to be inspected, examined, or copied, or has otherwise failed to comply with FOIA, the court shall award the costs of enforcing the Act, including reason- able attorney’s fees. HB 532 - POLICE ASSISTANCE IN OTHER JURISDICATIONS Representative John Milner, R-Elmhurst/Senator Antonio Munoz, D-Chicago. HB 532 allows police offi- cers to make arrests and conduct questioning in another jurisdiction if requested by an appropriate officer in that jurisdiction. IML SUPPORTS.

HB 1194 - PROPERTY OWNERS OWE REASONABLE CARE TO FIRE INVESTIGATORS Representative Mike Boland, D-East Moline/Senator Denny Jacobs, D-East Moline. HB 1194 requires that the owner or occupier of a premises owe fire fighters who are conducting fire investigations or inspections or are responding to fire alarms or actual fires on the premises a duty of reasonable care in the maintenance of the prem- ises according to applicable fire safety codes, regulations, ordinances, etc. IML SUPPORTS.

HB 1251 - INTERGOVERNMENTAL AGREEMENTS FOR ZONING AUTHORITY Representative Ricca Slone, D-Peoria Heights/Senator Bill Haine, D-Alton. HB 1251 would specifically grant authority allowing municipalities and counties to enter into intergovernmental cooperation agreements dele- gating zoning authority to municipalities over jurisdictions beyond their territorial limits in a county that has enact- ed a zoning ordinance. The zoning authority imposed would be that of the municipality. This bill is an IML ini- tiative. IML SUPPORTS.

HB 2186 - EXTENSION OF EARNED INCOME TAX CREDIT Representative Barbara Flynn Currie, D-Chicago/Senator , D-Chicago. HB 2186 would amend the Illinois Income Tax Act with respect to the earned income tax credit. Extends the 5% credit through tax- able years beginning on or before December 31, 2004. Beginning in 2004, requires the excess credit to be refund- ed to the taxpayer, but not counted in determining eligibility for means-tested benefits. Deletes the repeal of the credit. Exempts the credit from the sunset provisions of the Act. The bill will result in a loss of revenue to munic- ipalities. HB 2186 passed out of the House and will next be considered by the Senate Revenue Committee. IML OPPOSED.

SB 4 – EXTENSION OF EARNED INCOME TAX CREDIT Senator Barack Obama, D-Chicago/ Representative Barbara Flynn Currie, D-Chicago. SB 4 amends the Illinois Income Tax Act. Removes language that terminates the earned income tax credit with taxable years end- ing on or before December 31, 2002. The bill exempts the credit from the sunset requirements. This legislation would result in a loss of revenue to municipalities. SB 4 is currently scheduled for a hearing in the House Revenue Committee. IML OPPOSED.

SB 600 - INCREASED MINIMUM WAGE Senator Kimberly Lightford, D-Chicago/Speaker , D-Chicago. An initiative of the Governor, SB 600 would raise the minimum wage incrementally from $5.15 per hour to $6.50 per hour. The bill provides that the Director of the Department of Labor would have the authority to establish the minimum wage for employees under the age of 18. SB 600 has been scheduled for a hearing before the House Executive Committee. IML OPPOSED.

SB 1883 - REAL ESTATE TRANSFER TAX Senate President , D-Chicago. SB 1883 amends the real estate transfer tax to assure that in the future both State and local real estate transfer taxes will apply to transfers of property via complex stock swaps between corporations which can now allow real estate transfer tax taxes to be avoided even though the real estate has been transferred from one party to another.
