Subject:- WRIT PETITION NO. 24945-19 GULSHAN E LUQMAN EXECUTIVE BLOCK

Introduction:

Gulshan-e-Luqman (Executive Block) is located on Main Road Sargodha Cantt. The owners M/s Muhammad Kamran & Muhammad Luqman Ss/o Muhammad Akram Bajwa applied for approval of housing scheme on Khewat No. 28 Khatooni No. 65 to 69 Qita No. 35 Chak No. 49 NB Adjacent to Gulshan E Luqman Sargodha Cantt. Total area of housing scheme was 110 Kanals 14 Marlas 64 Sft. The applicant was asked to submit layout plan in the light of guidelines for regulating the preparation / operation of housing scheme on private land.

After that the applicants applied dated 09-01-2018 to this office for reduction of area of housing scheme below 100 Kanals and submitted another schematic plan in this regard. Due to change of area of housing scheme all the procedure came null and void.

Approval of the Board:

Schematic plan was referred to PAF Base Mushaf for security & ATC clearance which were received vide letter Nos. MSF (Prov)/851/1/Sec dated 11-05-2016 & No. MSF/C-258/10/ATC dated 05-05-2016, respectively but schematic plan was never referred to Board for approval.

Approval from HQ ML&C: As the scheme was reduced i.e less than 100 Kanals therefore as per rule principal approval of HQ ML&C Deptt Rawalpindi was required. Therefore, the same forwarded to the HQ and principally approved by HQ ML&C vide letters No. 48/169/ Land/ML&C/201809-08-2018 &RHQ Multan Region letter No. 12/RHA/MTN/14/72 dated 28-8-2018 subject to completion of all codal formalities.

Objected by the Audit Authorities

The audit authorities have also objected during audit for the year 2017-18 that CB dues are not deposited and codal formalities have not been completed as per housing policy 2011 issued by HQ ML&C Deptt. This office informed the applicants to deposit CB dues and complete / fulfill codal formalities vide this office letter No. CBS/Gulshan E Luq Ex Block/Lands/256 dated 18-04-2019.

Calculation of CB dues: CB dues (conversion charges, scrutiny fee and other CB dues) asper guidelines issued by Ministry of Defence ML&C Deptt areRs. 19,501,062/- Non fulfillment of codal formalities / other conditions:

(i) Layout/Schematic plan will be adhering to in all its details strictly. 14

(ii) Non pledge of 20 % plots on saleable area in favour of Cantt Board Sargodha.

(iii) Non transfer of public amenities plots / area specified in the schematic plan in favour of Cantt Board Sargodha in the Revenue record / sub Registrar Sargodha. (iv) Sanitation of scheme should be at the standard of Bahria Town to cater for Bird Hazard. (v) Height restricted upto 24 feet.

(vi) Society will complete development works i.e roads, Sui gas, electrification, sewerage network, etc. upto the required standard at its own cost. (vii) Houses will be constructed according to the layout / schematic plans approved by the Board. (viii) No Govt land / private land which is not owned by the society will be allotted to any member or brought into use by society its self for any purpose.

(ix) The Society will follow Cantt. Board Building Bye-Laws regarding the construction of commercial /residential building in letter spirit. (x) The management of Gulshan-e-Luqman (Executive Block) will provide the latest list of all members of Society. (xi) The Cantt Board shall at all the Developers cost, cause to be published in two daily national newspapers, public notice giving the details of plots mortgaged with it, if any, providing that such plots shall not be purchased or disposed off until the same are released after satisfactory completion works. Litigation:

Due to non-payment of CB dues and non-completion / fulfillment of codal formalities, all types of construction of developmental works was stopped. This office time and again asked the owner to deposit the CB dues as well as complete codal formalities but they did not do so and filed Writ Petition No. 24945-19 in the Lahore High Court Lahore. Later the Lahore High Court passed an order to deposit Rs.12,400,000/- with the Deputy Registrar Office within 20 days and verification of NOCs issued for installation of utilities and developmental works will also not be disturbed. As per directions of the Court this office allowed to carry developmental works but verifications of NOCs(external electrification and sui gas) were not issued due to non-completion / fulfillment of codal formalities.

Due to non-verification of NOC which were issued earlier (external electrification and sui gas) the Lahore High Court directed CEO to appear in person before the court on 18-07-2019. In pursuance of court orders the CEO appeared before the court and the court vide order dated 18-07-2019 directed to verify the NOCs of utilities within a week.

Resolution:- The Board considered the case of Gulshan e Luqman Executive Block in detail and resolved that verification of NOCs regarding external electrification and Sui Gas connection be issued as per directions of Hon’able Lahore High Court with the direction to apprise the Hon’able Lahore High Court that codal formalities which were conveyed to the owner vide this office letter No.CBS/Gulshan E Luq Ex Block/Lands/256 dated 18-04-2019 have not been completed yet. Hon’able Lahore High Court be also apprised that due to non-completion of codal formalities in various other housing scheme in 15

Cantt area even housing scheme approved in 2007 the audit authorities during the audit for the year 2017-18 have objected and raised Draft Paras.

Subject: - CONVERSION OF SCHEDULE-IX-A LEASE OF CLA RULES,1937 IN RESPECT OF UNIT NO. 45, SITUATED AT KHALIQABAD (KATCHIABADI) FROM RESIDENTIAL INTO SCHEDULE IX-C OF THE CLA RULES,1937 FOR COMMERCIAL PURPOSE. To consider an application dated 17-07-2018 submitted by Mr. Muhammad Aslam Naveed S/o Malik Allah Banda requesting for regularization of lease schedule IX-C of the CLA Rules,1937 for commercial purposes in respect of Unit No.45 measuring 07 Marlas & 176 Sft situated at Katchi Abadi Khaliqabad. The applicant / lessee deposited the following dues into Cantt Fund Account through Bank Challan No. 01/20 dated 30-12-2014

For the information of Board that applicant has deposited above dues well in time, whereas the cutoff date as per sanction of RHQ Multan for completion of formalities was 31-12-2014. But lease deed was executed after laps of 34 days due to ignorance of Rules. Necessary ex-post facto sanction for a period of 34 days delay from RHQ Multan is required in the light of instructions of Government of Pakistan, Ministry of Defence vide U.O. Note No.3/6/D-12/ML&C/97 dated 04-06-2018 received through HQ ML&C Deptt letter No.55/305/Lands/ML&C/2018 dated 05-06-2018 has extended the limitation period of the conversion policy for further five yearswith effect from 01 Jan 2017 for the regularization of lease for commercial purposes.

To consider the report submitted by the Revenue Superintendent regarding renewal of tenancy rights of National Bank of Pakistan PAF Branch.

Existing tenancy period of subject building had expired on 30-06-2019 which required to be extended for a further period of three years w.e.f 01-07-2019 after enhancement of monthly rent. Previously Cantonment Board Sargodha enhanced rent @ 25 % per annum.

Subject: - CANCELLATION OF CONTRACT OF COLLECTION RIGHTS OF 35-NOS T-SIGN BOARDS.

To consider various applications dated 10-10-2018, 06-02-2019 and 18-04-2019 submitted by the contractor of Collection rights of 35 no T-Sign Board for the cancellation of contract w.e.f 01-04-2019 as he is unable to run the contract further due to heavy loss. 20

It is further stated that Mr. Jamshed Iqbal, M/s Sehar Advertisers got the contract of collection rights of 35 No T-Sign Boards w.e.f 01-11-2017 for the period of 03 years against an amount of Rs.11,550,000/ with an annual increase of 10 %. An amount of Rs.79,480/- balance amount of contract and Rs.1,564,125/- on account of income tax is outstanding up to 31-03-2019.

Subject: - CANCELLATION OF CONTRACT OF L.E.D’s.

To consider the various companies have applied for grant of permission for displaying of LED’s 3x6 and 20x40 at different locations in Cantt area. In which 05 companies have been granted permission to display their advertising media vide Board CBR No.15 dated 12-09-2017. After the scrutiny of the record it has been observed that auction procedure have not been followed in the whole process i.e Newspaper Advertisement and PPRA rules. As the codal formalities were not completed therefore the CBR No.15 dated 12-09-2017 is required to be cancelled to avoid any audit objection etc.
