1. QUESTIONS FOR ORAL ANSWER

1. The Hon Member for Douglas North (Mr Houghton) to ask the Minister for Infrastructure –

In respect of kerbside collections –

(a) on what date his Department intends to transfer the responsibilities to specified local authorities;

(b) how the special vehicles and any other equipment in the Department‟s ownership will be transferred to those local authorities;

(c) what the value is of each vehicle to be disposed of;

(d) whether any further vehicles have been acquired by the Department or local authorities in preparation for the transfer of this function; and, if so,

(e) when such vehicles were purchased, by whom and at what cost?

HKA1434 2. The Hon Member for (Mr Karran) to ask the Minister for Infrastructure –

What changes in policy and/or legislation he proposes that would prevent illegal advertisements being displayed before action is taken for them to be removed; and what changes in policy and/or legislation he proposes that would prevent commercial organisations from obtaining financial benefits from illegal advertising in the future?

3. The Hon Member for Onchan (Mr Karran) to ask the Minister for Social Care –

What proposals his Department has to promote adequate supervised accommodation for adult persons who have autism; when such facilities will be opened to assist families and individuals; and where these autistic people are to be accommodated when the family cannot cope?

4. The Hon Member for Onchan (Mr Karran) to ask the Minister for Education and Children –

What the new salary for the Chief Executive is; whether the new salary will affect the new role; and why, given the financial pressures on his Department, he did not alter the terms of appointment?

5. The Hon Member for Douglas North (Mr Henderson) to ask the Minister for Health –

Whether a consultant working at or from Noble‟s Hospital has the right to cancel an NHS procedure booked appointment, in favour of attending to his or her private patient list?

6. The Hon Member for Douglas North (Mr Henderson) to ask the Minister for Health –

Whether consultants working from or at Noble‟s Hospital can use Isle of Man NHS facilities to attend to private patients who no longer live on the Island?

7. The Hon Member for Onchan (Mr Karran) to ask the Chairman of the Manx Electricity Authority –

(a) Whether the MEA „feed in tariff‟ is available to all consumers throughout the Island;

(b) if he will give brief details of the scheme, including the price per unit of electricity currently paid by the MEA under the „feed in tariff‟ and ask the MEA to give greater publicity to the scheme; and

2 HKA1434 (c) if he will make a statement on the feasibility of a scheme whereby the MEA would offset the quantity of electricity fed into the grid by a consumer at equal unit value to the quantity of electricity taken out, so that consumers would pay only for the net number of units consumed?

8. The Hon Member for Onchan (Mr Karran) to ask the Minister for the Treasury –

On what basis haulage contractors are selected for Government funded work; and what safeguards are available to ensure that work is shared out fairly?

9. The Hon Member for Michael (Mr Cannan) to ask the Minister for Infrastructure –

(a) Whether the highways division has prepared a priority schedule and timescale for the repair and refurbishment of the damage to the public highways throughout the Island caused by the exceptional winter weather; and, if so,

(b) whether his Department will publish the priority schedule and timescale?

10. The Hon Member for Michael (Mr Cannan) to ask the Minister for Health –

How many persons are registered with GPs throughout the Island, as at 31st December 2010?

11. The Hon Member for Douglas North (Mr Henderson) to ask the Minister for Home Affairs –

If he will make a statement on the headline of the Isle of Man Courier, 27th January 2011 – „Jobs Bombshell as budget cuts bite at the DHA‟?

12. The Hon Member for Douglas North (Mr Henderson) to ask the Chief Minister –

What his Government‟s policy is on redundancies?

3 HKA1434 13. The Hon Member for Douglas North (Mr Henderson) to ask the Minister for Community, Culture and Leisure –

What the current employment status is of the Director of Transport within his Department; whether the current post holder has any external business interests and, if so, whether they could conflict with his current role and whether any external business interests were made known to the Department when the current post holder applied for the position of Director of Public Transport?

14. The Hon Member for Onchan (Mr Karran) to ask the Chief Minister -

(a) What his Government‟s policy is with regard to achieving a Manx Exclusive Economic Zone extending to the median line between the Isle of Man and the adjacent islands;

(b) what efforts have been made and what progress has been made to date towards achieving this objective; and

(c) if he will arrange for the matter to be discussed at the next meeting of the British Irish Council in the context of the increasing powers being given by the UK Government to the devolved assemblies?

15. The Hon Member for Onchan (Mr Karran) to ask the Minister for Infrastructure -

(a) whether his Department‟s policy has recently changed on allowing sports clubs interested party status in relation to planning applications that could affect them; and

(b) if he will consider widening the definition of persons and organisations that should be granted interested party status to include any that would be genuinely and significantly affected by a development proposal?

16. The Hon Member for Onchan (Mr Karran) to ask the Minister for Infrastructure -

With regard to the Richmond Hill road improvement project -

(a) what expenditure was approved by Court for this project;

(b) whether there have been any cost over-runs or additional expenditure incurred or expected with regard to the project;

4 HKA1434 (c) what the approximate increase in future liabilities on public sector pensions has been as a result of the salaries and service of all persons directly and indirectly involved in the project for their time spent working on it; and

(d) what the real total cost of the project to taxpayers is, taking into account pensions liabilities for those working on the project, as compared with expenditure approved by Tynwald Court?

17. The Hon Member for Onchan (Mr Karran) to ask the Minister for Environment, Food and Agriculture -

Further to his answer to Question 7 in this House on 25th January 2011 -

(a) who owns the energy currently being wasted from the Energy from Waste Plant (EfW);

(b) whether there would be any legal or contractual problems that would make it impractical to remove this wasted heat energy from the EfW site and use it profitably elsewhere;

(c) whether land is available near the EfW with appropriate zoning so that it could be practical to use this heat energy profitably; and

(d) if so, if he will consult his colleagues in the Council of Ministers and other interested and experienced persons to see whether they can formulate any practical propositions for the profitable use of this wasted energy and report back to this House in due course?

1. The Hon Member for Onchan (Mr Karran) to ask the Minister for Infrastructure –

What his Department‟s policy is on planning in relation to proposals for houses for first time buyers, which may be extended by the owners?

2. The Hon Member for (Mr Watterson) to ask the Minister for the Treasury -

Further to the Isle of Man Examiner headline of 4th January –

(a) what the Government‟s annual savings target is for the year 2010/11;

5 HKA1434 (b) what the expected savings were for the 3 quarters to 31st December 2010;

(c) what the actual achieved savings were to that date; and

(d) what the projected savings will be by 31st March 2011?

3. The Hon Member for Rushen (Mr Watterson) to ask the Minister for Infrastructure -

How many vehicles are eligible to be assessed for road tax based on emissions; and what percentage of the total number of vehicles registered on the Island this is?

4. The Hon Member for Onchan (Mr Karran) to ask the Minister for Economic Development –

(a) Further to his Answer to Question 38 in the December sitting of Tynwald, what could be supplied as a desktop shortcut on a Member of Tynwald‟s computer without any amendment to reports, without any new reports and without any data protection issues; Microsoft Axapta version 3 was released late 2002, version 4 early 2006 and version 6, the public sector version will not be released until late 2011; what the Microsoft Axapta version installed in each department is, the version pending installation, the scheduled project start date and the scheduled end date; what the external cost of changes to the standard Microsoft Axapta reports is, the maintenance percentage and the maintenance cost in each financial year; how many active suppliers are registered in the system; how many active suppliers have an email address; whether it is possible to forward transaction confirmations by email or, if not, what the estimated itemised cost is; and how many transactions in the previous financial year were repayments to employees such as online purchases with personal credit cards; and

(b) based on the Microsoft Dynamics system convergence policy, what the estimated financial year is for all financial records to be available –

(i) from the same front office enquiries system; and

(ii) from the same back office accounts system?

AMENDMENTS TO CLAUSE 2

1. Clause 2, line 7, after “propelled” insert “subject to subsection (2A)”.

2. Clause 2, line 8, insert –

“(2A) A road race order that would otherwise be permitted under subsection (2)(a) (Sunday racing of non-mechanically propelled vehicles) shall not authorise the use of any road adjoining land on which a building used principally as a place of worship is situated unless –

(a) the Department or the organiser of the race on its behalf has given written notice of the proposed race at least 2 months before the date of the proposed race to the minister of religion of the place of worship (or, if there is none, a person responsible for the building used as the place of worship) and invited that person to make written representations about the holding of the race, which must be received within 14 days of the date of the notice; and

(b) the Department has taken into account any such written representations received.”.

1. Page 1, lines 2 to 5, for subsection (1) substitute –

“(1) A person acts in an anti-social manner for the purposes of section 28 of the Criminal Justice Act 2001 [c.4] (anti-social behaviour orders) and may be the subject of an application for an order under that section if the person–

(a) deliberately prevents another person in charge of a baby from feeding milk to the baby in a public place or on licensed premises; or

(b) deliberately prevents another person in charge of a baby from being in a public place or on licensed premises on the ground that the other person is to, or may, feed milk to the baby whilst in the place or on the premises.”.

2. Page 1, lines 9 to 14, omit subsections (3) and (4).

Adjust the numbering of the subsequent subsections of clause 2.

3. For the marginal note to clause 2 substitute “Person not to prevent a baby being fed milk”.
