Nav i ga tional warn ing - A broad cast mes sage con tain ing ur gent in for ma tion rel e vant to safe nav i ga tion.

Mar i time Safety In for ma tion (MSI) - Nav i ga tional and me te o ro log i cal warn ings, me te o ro log i cal fore casts, and other ur gent safety-re lated mes sages.

NAVAREA - A geo graph ical sea area, es tab lished for the pur pose of co-ordinating the trans mission of ra dio nav i ga tional warn ings. Where ap - pro pri ate, the term NAVAREA fol lowed by an iden ti fy ing Ro man numeral may be used as a short ti tle.

Re gion - That part of a NAVAREA es tab lished for the pur pose of co-ordinating the trans mission of coastal warn ings, by NAVTEX or INMARSAT-C EGC Broad cast.

NAVAREA co-ordinator - The au thor ity charged with re sponsi bil ity for co-ordinating, col lat ing and is suing long range nav i ga tional warn - ings and bul le tins to cover the whole of the NAVAREA.

Na tional co-ordinator - The na tional author ity charged with re sponsi bil ity for co-ordinating, col lat ing and is suing coastal warn ings in a re - gion.

NAVAREA warn ing - A nav i ga tional warn ing is sued by the NAVAREA Co-ordinator for the NAVAREA.

NAVAREA warn ings bul le tin - A list of se rial num bers of those NAVAREA warn ings in force, is sued and broad cast by the NAVAREA Co-ordinator dur ing at least the pre vi ous six weeks.

Coastal navwarning - A nav i ga tional warn ing pro mulgated by a na tional co-ordinator to cover a re gion.

Local navwarning - A nav i ga tional warn ing which cov ers in shore wa ters within the lim its of ju ris dic tion of a har bour or port au thor ity. IN TRO DUC TION 1. WWNWS is an In ter na tional Mar i time Or ga ni za tion (IMO) / In ter na tional Hy dro graphic Or ga ni za tion (IHO) ser vice es tab lished as part of the global mari time dis tress and safety sys tem (GMDSS) adopted by the In ter national Con ven tion for the Safety of Life at Sea (SOLAS), 1974, to which the RSA is a sig na tory. 2. To provide for the promul ga tion of Mar i time Safety Infor mation on a geographic ba sis the world has been di vided into 21 NAVAREAS. NAVAREA VII 3. The South At lan tic and South In dian Ocean area around South ern Af rica has been des ig nated NAVAREA VII. It is de scribed as the area bounded by the par al lel of lat i tude 6°S, drawn from the West Coast of Af rica to longi tude 20°W, thence south to Antarctica; and the par al lel of lat - i tude 10° 30’S drawn from the East Coast of Af rica to longi tude 55°E, thence south to the par al lel of lat i tude 30°S, thence east ward to lon gi tude 80°E and thence south to Antarctica. Ac compa ny ing Di a gram 1 shows this de limi ta tion. The partial limits of adjoin ing NAVAREAS are also shown. NAVAREA VII CO-ORDINATOR 4. The RSA has been des ig nated NAVAREA VII Co-ordinator and the na tional agency charged with ex e cut ing the RSAs re sponsi bil i ties in this re gard is the Hy drog ra pher, SA Navy. His re spon si bil i ties inter alia are: a. To en deavor to be in formed of all events af fect ing the safety of nav i ga tion in NAVAREA VII. b. To ex pertly as sess all re ceived in for ma tion af fect ing nav i ga tion safety. c. To draft NAVAREA warn ing messages iaw IHO/IMO guidance on stan dard iza tion of texts and message draft ing. d. To di rect and con trol the broad cast of NAVAREA warn ings via na tional broad cast fa cil i ties. e. To pass NAVAREA warn ings to ad ja cent NAVAREA co-ordinators where ap pro pri ate. f. To trans mit pe ri od i cal NAVAREA warn ings bul le tins. g. To pro mulgate the can cel la tion of NAVAREA warn ings no lon ger valid. h. To act as the cen tral point of con tact on MSI within the NAVAREA. i. To pro mote the use of es tab lished in ter na tional stan dards and prac tices in the pro mulga tion of nav i ga tional warn ings within the NAVAREA.

6 NAVAREA VII WARNINGS 5. NAVAREA VII warnings are is sued by the Hy drog ra pher from time to time for broad cast by Coast Ra dio Sta tions. De tails of this ser vice are to be found in SA List of Lights and Ra dio Sig nals (SAN HO-1). The warn ings are in Eng lish and are drafted in the for mat spec i fied in IHO/IMO Guidance Doc u ments for the WWNWS. The warn ings are num bered con sec utively through out the cal en dar year, com menc ing with 001at 0001 UTC on 1 Jan uary . 6. Navwarnings and a summary of warn ings are also pub lished and up dated on a daily ba sis during work ing hours. This can be viewed on the website: http://www.sanho.co.za . SOUTH AF RI CAN RE GION 7. The coastal wa ters out to 150 nau ti cal miles of the Re public of South Af rica are des ig nated the South Afri can Re gion. For the pres ent, for nav i ga tional warn ing pur poses, the coastal wa ters out to 150 nau ti cal miles of the Re pub lic of Namibia are in cluded in the South Af ri can Re - gion. SOUTH AF RI CAN RE GION CO-ORDINATOR 8. Within the South Af ri can Re gion the Hy drog ra pher, SA Navy, is ap pointed as the na tional agency re sponsi ble for dis charging the re sponsi - bil i ties of Na tional co-ordinator. These re spon si bil i ties, inter alia, are: a. To en deavor to be in formed of all events af fect ing safety of nav i ga tion in the re gion. b. To expertly assess all safety infor ma tion received. c. To draft Coastal navwarnings in ac cor dance with estab lished in ter na tional stan dards. d. To di rect and con trol the broad cast of Coastal navwarnings by the na tional broad cast system adopted for the WWNWS. e. To act as the cen tral point of con tact on mat ters re lat ing to nav i ga tional warn ings within the Re gion.

7 COASTAL NAVWARNINGS : SOUTH AF RI CAN RE GION 9. Coastal navwarnings are is sued by the Hy drog ra pher from time to time for broad cast by Coast Ra dio Sta tions. The warn ings are in Eng lish and are drafted in the for mat spec i fied in IHO/IMO Guide to Draft ing Ra dio Nav i ga tional Warnings for the WWNWS. The warn ings are num bered con sec u tively through out the cal en dar year, commenc ing with 001 at 0001 UTC on 1 Jan u ary. 10. NAVAREA VII warn ings and a sum mary of warn ings are also pub lished and up dated on a daily ba sis during work ing hours. It can be viewed on the website: www.sanho.co.za . LO CAL NAVWARNINGS 11. Har bour Masters of South Af ri can ports are re sponsi ble for the issue of Lo cal navwarnings per tain ing to MSI within the port limits of their re spec tive ports. Where it is con sidered that such warn ings are of sig nif i cance out side these port limits, the Hy drog ra pher, SA Navy, may issue NAVAREA VII or Coastal navwarnings in lieu, in which case the Lo cal navwarning is then cancelled. NAVTEX 12. NAVTEX is an in ter na tional au to mated di rect-print ing ser vice for the pro mul ga tion of nav i ga tional and me te o ro log i cal warn ings and ur - gent in for mation to ships. A fully oper a tional NAVTEX ser vice ex ists in the RSA and Namibia, de tails of which are given in the SA List of Lights and Ra dio Sig nals (SAN HO-1), Sec tion 3. SAFETYNET 13. SafetyNET is a ser vice of INMARSAT 's en hanced group call system (EGC) de signed spe cif i cally for pro mulga tion of MSI as a part of the GMDSS. SafetyNET pro vides ship ping with nav i ga tional and me te o ro log i cal warn ings, me te o ro log i cal fore casts, shore-to-ship dis tress alerts, and other ur gent in for ma tion. At pres ent me te o ro log i cal in for ma tion per tain ing to NAVAREA VII and NAVAREA VII warn ings are transmit ted via this service. Details are given in the SA List of Lights and Ra dio Signals (SAN HO-1). SOURCES FOR NAV I GA TION WARN INGS 14. Now that all ships are fit ted with echo-sounding equip ment, nu merous re ports of shoal sound ing are be ing re ceived by the Hy drog ra pher. A large pro por tion of these re ports are of lit tle value as in suf fi cient in for mation is for warded with them. 2. False soundings may be obtained from cor rectly ad justed E/S sets due to one of the fol low ing causes: a. The re turn ing echo be ing re ceived af ter the trans mission in ter val has been completed once or per haps twice, e.g. with a ro tary type E/S set hav ing a max i mum scale read ing of 600 metres, a read ing on the trace of 50 metres might in fact be a sound ing of 50 or 650 or even 1250 metres. (In the case of E/S sets fit ted with transmit ter ON/OFF switches, such doubts can easily be re solved. By break ing the transmis sion cir cuit, with the set still run ning, and then re-mak ing it, it is only nec es sary to note the number of sub se quent sty lus rev o lu tions oc cur ring be fore the echo re-ap pears.) b. Dense shoals of fish or lay ers of plank ton which some times give an echo completel y masking that from the bot tom. Such a layer is usually known as a “deep scat ter ing layer” and is of ten found to rise to wards the sur face at dusk and, af ter re main ing dur ing the night close to the sur face, descends again at dawn. The deep scatter ing layer is frequently encoun tered at or near the edge of the con ti nen tal shelf and is fre quently mistaken for shoal wa ter. c. Lay ers of wa ter of dif fer ent den sity from that of the sur round ing wa ter. d. Strong tidal streams or eddies with solid par ti cles in sus pen sion which may give feath ery ech oes. e. It is possi ble in the more power ful types of E/S sets now be ing de vel oped that dou ble ech oes may be ob tained even in depths of sev eral hun dred metres. The sec ond echo caused by the re bounding ul tra sonic waves will ap pear at twice the depth of true echo. Care should be taken when phas ing and us ing the ON/OFF switch, as de scribed above, that in fact the true echo is be ing re - corded. The sec ond echo is in vari ably weaker than the first and can be faded by turn ing down the sen sitiv ity of the re ceiver. 3. When unex pected shoal soundings are ob tained in wa ters where the charted depth gives no in di ca tion, even though dis col oured wa ter may be seen, the only cer tain method of con firming their exis tence is by tak ing a cast with the lead. Where, how ever, the charted depth is nowhere more than the scale read ing of the set and the shoal is seen to rise from the bot tom on the trace, pro vided speed and set ting of the set is cor rect, the shoal sound ing may be ac cepted con di tion ally. 4. When re ports of shoal sound ing are re ceived in the Hy dro graphic Of fice, they are care fully con sidered in the light of ac compa ny ing or other ev i dence be fore any ac tion is taken to amend charts. Un less re ports are con firmed by the cast of the lead, chart ac tion is usu ally with held un til the area can be ex amined by a sur vey ing ves sel. In the past much time and ef fort has been wasted search ing for non-ex istent shoals. 5. In or der that the Hy drog ra pher can make full use of re ports of soundings, the Echo Trace should al ways be for warded, to gether with Form HO-16 (Hy dro graphic Note), which ap pears at the end of this pub li ca tion. Nav i gat ing Of fi cers are re quested to note the fol lowing points re - gard ing es sen tial de tails: a. Mark the trace each time a fix is ob tained by draw ing a line along the curved edge of the scale, tak ing care not to foul the sty lus arm meanwhile. b. Number the fix and in sert the time. (The time is im por tant since the height of the tide must be found in or der to ob tain the cor rect depth.) c. In sert the re corded depth of all peak soundings. d. On comple tion of soundings, and be fore roll ing up the pa per, draw in the bot tom trace and trans mission line and dry the pa per, prefer a bly in a dim light if a wet paper machine is used. e. Mark any change of phase con spic uously . f. In sert the make and type of echo-sound ing machine.

g. It is rec ommended that an in del i ble pen cil or ball-point pen should be used in all writ ing on the trace. 6. It is impor tant to note that the draught of the ship should be the same as the depth of the trans mission line. If the lat ter is set to zero a note to this ef fect should be made on the trace, giv ing the draught of the ship. 7. In sets which have two op er at ing speeds (e.g. metre or me tre x 10) the trans mission line must be sep a rately ad justed to show the cor rect scale reading in each speed. 8. 7. Laden tankers when east bound off the South Af ri can coast, should simi larly maintain a mini mum distance of 25 (twenty five) nau ti cal miles when passing the points listed in 6.a. and 6.b. and when be tween Cape Agulhas and Cape Recife, steer a course to pass through the east - bound or southern lanes of the traf fic sep a ra tion schemes off the Alphard Banks and FA plat form. 8. The fol low ing ex emp tions to the laden tanker rules ap ply:

a. Vessels calling at Cape Town (Table Bay) to ren dez vous with ser vice craft or he li cop ters should fol low the rec ommended routes un til, in the case of laden tank ers, when pro ceed ing West bound, Cape Point Light bears 000°(T) x 20 nauti cal miles, thence al ter ing course to po sition, Slangkop Point Light 250°(T) x 20 nau ti cal miles. From this po sition course may be al tered to the ren dez vous area 6 nau ti cal miles west ward of Green Point Light (Z5834) (D5900) (re plen ishment area shown on charts SAN 118, 119, 1013 - INT 2681).

b. Laden tankers en gaged on voy ages solely be tween ports in the Re pub lic of South Af rica are ex empted from the pro vi sions of para graphs 6 and 7 of these regu la tions and are to maintain a distance of 10 (ten) nau ti cal miles off sa lient points of the coast sub - ject to weather, sea and cur rent con di tions, when set ting courses to their ports of load ing and dis charg ing.

c. Dur ing the win ter sea son (16 April to 15 Oc to ber) west bound laden tankers should main tain the mini mum distance of 20 miles off the ap pro pri ate land marks in para graph 6.a. However , on ap proach ing the win ter zone, they may re main within the sum mer zone as close to the sep a ra tion line as possi ble, and for the min i mum period nec es sary, to en sure that they can re main on their summer loadline through out. In the vi cin ity of the FA Plat form and Alphard Banks, they are to ad just their course to pass through the west bound traf fic lanes.

MARITIME LIMIT 9. Mar i ners are ad vised that for cer tain flag states that have signed the Load Lines Proto col (1988), the limits of the ‘South ern Win ter Sea - sonal Zone’ have changed off the South Af ri can Coast (See Di a gram 1). 10. Flag states that have not signed the Load Lines Proto col (1988) will con tinue to use the ex ist ing Load Lines Con ven tion (1966) de pic tion of the ‘South ern Win ter sea sonal Zone’ limits un til 28th Feb ru ary 2018. 11. Former Notice No 6/2015 is cancelled. SOUTH AF RICA, Oil Pol lu tion - Ob ser va tion and Re port ing 1. Since 1 Oc to ber 1985 the De part ment of En vi ron mental Af fairs and Tour ism (DEA&T) has been re sponsi ble for mat ters re lat ing to the com bat ing of oil pol lu tion with the De part ment of Trans port (DOT) re tain ing re spon si bil ity for pre ven tion. This ar range ment ap plied to func - tions in terms of the Pre ven tion and Com bat ing of Pol lu tion of the Sea by Oil Act 6 of 1981 (as it was orig i nally called). With the estab lish ment of the South Af ri can Mar i time Safety Author ity (SAMSA) on 1 April 1998, the ad minis tra tion of this Act [now called the Ma rine Pol lu tion (Con trol and Civil Li a bil ity) Act 6 of 1981] was transferred to SAMSA in terms of the South Af ri can Mar i time Safety Author ity Act 5 of 1998. However , sec tion 52 of the lat ter Act con tin ues DEA&T’s re sponsi bil ity for combat ing oil pol lu tion. 2. SAMSA, DEA (De part ment of En vi ron mental Af fairs) and Smit Amandla Ma rine (the man ag ers of the standby tug “Smit Amandla”) are all con cerned with the pre ven tion, con tain ment and cleaning up of oil spills at sea. These or ga ni za tions should be in formed as soon as possi ble whenever there is an oil spill or a threat of an oil spill. 3. Oil spills and threat ened spills should be re ported im medi ately to the near est SAMSA Princi pal Of fi cer, fail ing which (and in the fol lowing or der) SAMSA’s Regional Man ag ers, SAMSA’s Chief Ex ec u tive Of fi cer (CEO), any of the other SAMSA of fi cials, the DEA of fi cials, or the manag ers of Smit Amandla Marine. 4. For ships at sea, the South Af ri can coastal mar i time ra dio sta tions will con nect the re sponsi ble ship’s of fi cer to the South Afri can Mar i time Res cue Co or di na tion Cen tre (MRCC), which will alert the ap pro pri ate Prin ci pal Of fi cer. 5. A ship in port can re port to the duty of fi cer in the con trol tower of the Transnet Na tional Ports Au thor ity (TNPA), who will for ward the commu ni ca tion to the Prin ci pal Of fi cer of the port. Al ter na tively, the ship, or the ship’s agent, can commu ni cate di rectly with the Prin ci pal Of - fi cer. 6. The SAMSA of ficial re ceiving the initial report will im medi ately place the or ganisa tion on alert by inform ing the respon si ble persons at DEA and Smit Amandla Ma rine. He or she will then in form SAMSA’s Re gional Man ager about the in ci dent and any ac tion taken. The Re - gional Man ager will in form higher au thor ity, as ap pro pri ate, and, if nec es sary, ac ti vate SAMSA’s Ca sualty Re sponse Unit. 7. If for any rea son the above pro ce dure fails, any per son in the or gani sa tions men tioned in para graph 6 should carry for ward the pro ce dure by alerti ng other rele vant persons and organi sa tions. 8. Agree ment has been reached with TELKOM that ra dio tele phone or ra dio te leg ra phy re ports of this na ture passed through South Af ri can Coast Ra dio Sta tions, de pend ing on the lo cal ity, ra dio re ports may be ad dressed to The Prin ci pal Of fi cer of SAMSA via port con trol (VHF Chan nel 16) at the fol low ing ports: Rich ards Bay, Durban, East Lon don, Port Eliz a beth, Mossel Bay, Cape Town and Saldanha Bay. 9. As the pre ven tion of the pol lu tion of the sea by oil is of in ter na tional im por tance it is con sid ered that ves sels on pas sage along the coast line of the Re pub lic of South Af rica or ly ing in an an chor age off the var i ous ports can be of in valu able as sistance to the De part ment by re port ing: a. Oil slicks sighted; b. Oil ac ci dently dis charged; c. Oil dischar ged in the inter ests of Safety of Life at Sea; d. Vessels in distress likely to cause oil pollu tion. 10. Arti cle 8 and Pro to col I of MARPOL 73/78 es tab lishes re port ing re quire ments for pol lu tion in ci dents. Re ports should con tain as much of the fol low ing in for ma tion as pos si ble: a. Name of the per son re port ing the in ci dent; b. Tele phone number (work/home) or other means of con tact; c. Date and time of obser va tion;

d. De tails of ob ser va tion; e. Lo ca tion (e.g. lat i tude and lon gi tude or the po sition rel a tive to the coast line); f. Source and cause of pol lu tion (e.g. name and type of ves sel, col li sion or ground ing); g. Type and es ti mated quan tity of oil spilled and the po ten tial and prob a bil ity of fur ther pol lu tion; h. Weather and sea con di tions; i. Ac tion taken or in tended to re spond to the in ci dent. 11. The fol low ing is a guide as to the ap pear ance of oil on the sea and the method of re port ing such oil: a. Ef fect of oil on appear ance of the water:

i. Con di tion 1 :Barely vis i ble un der most fa vour able light con di tions. ii. Con di tion 2 :Visi ble as a silvery sheen on the water sur face. iii. Con di tion 3 :First trace of col our may be ob served. iv. Con di tion 4 :Bright bands of col our.

13 v. Con di tion 5 :Colours be gin to turn dull nat ural to col our of oil. vi. Con di tion 6 :Colours nat ural to col our of oil.

The Amver system, main tained and ad minis tered by the United States Coast Guard, with the co oper a tion of coast ra dio sta tions of many na tions, is a global ship re port ing system for search and rescue (SAR) which pro vides im- por tant aid to the de vel opment and co or di na tion of SAR ef forts in the off shore ar eas of the world. Former Notice No 10/2015 is cancelled. MAR I TIME BOUND ARIES AND ZONES 1. The Mari time Zones Act, 1994, de fines the Mar i time Bound aries of the RSA (See Dia gram 1 on page 20) as fol lows :

Base lines

2. Subject to subsec tions a. and b. be low, the low wa ter line shall be the base line. a. Not with stand ing the above, straight lines join ing the grouped co-or di nates men tioned in Sched ule 2 of this Act (de tailed at the end of this No tice), shall be the base lines of the rel e vant part of the coast. b. Not with stand ing the above, the outer limits pre scribed or de ter mined in ac cor dance with sub sec tions c. and d. be low shall be the base lines. c. Outer lim its of in ter nal wa ters re ferred to in para 2.b. be low shall be es tab lished in the pre scribed man ner. d. In the ab sence of any outer lim its of in ter nal wa ters pre scribed in ac cor dance with c. above, the outer limits shall be the out er - most harbour works which form an inte gral part of the har bour system.

e. In any pro ceed ings be fore a court of law any pre scribed chart or map shall be ad missi ble as prima facie proof of the con tents thereof.

In ter nal Wa ters

3. The in ter nal wa ters of the Re pub lic shall comprise: a. all waters landward of the baselines; and b. all har bours. 4. Any law in force in the Re pub lic, includ ing the com mon law, shall also ap ply in its in ter nal wa ters and the air space above its in ter nal wa - ters. 5. The right of inno cent passage shall not ex ist in the inter nal waters, except if the in ternal waters con cerned were terri to rial before the com- mencement of this Act.

Ter ri to rial Wa ters

6. The sea within a distance of twelve nau tical miles from the baselines shall be the terri to rial waters of the Repub lic. 7. Any law in force in the Re pub lic, includ ing the com mon law, shall also ap ply in its ter ri to rial wa ters and the air space above its ter ri to rial wa ters. 8. The right of in nocent passage shall exist in the terri to rial waters.

Con tig u ous Zone

9. The sea be yond the ter ri to rial wa ters re ferred to in para 6 above, but within a dis tance of twenty four nau ti cal miles from the base lines, shall be the con tig u ous zone of the Re pub lic. 10. Within the contig uous zone and the air space above it, the Re pub lic shall have the right to ex er cise any powers which may be con sidered nec es sary to pre vent con tra ven tion of any fiscal law or any cus toms, emi gra tion, im migra tion or san i tary law and to make such con tra ven tion pun ish able.

Mar i time Cul tural Zone

11. The sea be yond the ter ri to rial wa ters re ferred to in para 6, but within a dis tance of twenty four nau ti cal miles from the base lines, shall be the mari time cul tural zone of the Re pub lic. 12. Subject to any other law the Re pub lic shall have, in re spect of ob jects of an ar chae o log i cal na ture found in the mari time cul tural zone, the same rights and powers as it has in respect of its terri to rial waters.

Ex clu sive Eco nomic Zone

13. The sea be yond the ter ri to rial wa ters re ferred to in para 6, but within a dis tance of two hundred nau ti cal miles from the base lines, shall be the ex clu sive eco nomic zone of the Re public. 14. Subject to any other law the Re pub lic shall have, in re spect of ob jects of all nat u ral re sources in the ex clu sive eco nomic zone, the same rights and powers as it has in respect of its terri to rial waters.

18 Con ti nen tal Shelf

15. On 05 May 2009, the RSA submit ted to the Commis sion on the lim its of the Con ti nen tal Shelf, in ac cor dance with Ar ti cle 76, Para graph 8 of the United Nations Con ven tion on the Law of the Sea (UNCLOS), in for mation on the limits of the Con ti nen tal Shelf be yond 200 nau ti cal miles from the base lines from which the breadth of the Ter ri to rial Sea is measured in re spect of the main land of the ter ri tory of the RSA. Upon com ple tion of the con sid er ations of the sub mis sion, the Com mis sion will make rec om men da tions persuant to Arti cle 76 of the Con ven tion. 16. The co-ordi nates listed in Sched ule 2 be low es tab lish six straight base lines along the coast of the Re public. A dot ted line be tween grouped co-ordi nates in dicates the end/start of a straight baseline. The straight baselines are sepa rated by coastline.

Former Notice No 11/2015 is cancelled. IN FOR MA TION CON CERN ING SUB MA RINES Part I - SUB MA RINE WARNING SIG NALS 1. Mar i ners are warned that con sider able haz ard to life may re sult from disre gard ing the fol low ing warn ing sig nals, which de note the pres- ence of sub marines: Vi sual Sig nals

2. South Afri can war ships fly the In ter na tional Code Group NE2 to de note that subma rines, which may be sub merged, are in the vi cin ity. Other ves sels are cau tioned to steer a course so as to give a wide berth to any ves sel fly ing this sig nal. If, for any rea son, it is nec es sary to ap - proach her, a good look out must be kept for sub marines, whose pres ence may be in di cated only by their peri scopes or snort masts showing above water . Py ro tech nics and Smoke Can dles 3. The fol low ing sig nals are used by submer ged sub marines:

a. White smoke marker (with flare) float ing on sea sur face, in di cates po sition in re sponse to a re quest from a ship or as re quired. (See Diagram 1). b. Green para chute flare (fired 130 metres into the air) used to indi cate the po sition from which a prac tice tor pedo has been fired. All ves sels are requested to keep clear as the subma rine may want to surface after the fir ing. (See Diagram 2). c. Red para chute flare (fired 130 metres into the air), which may be ac compa nied by smoke can dles re peated as often as pos sible, mean - “Keep clear. I am car ry ing out an emer gency surfac ing pro cedure. Do not stop pro pellers. Clear the area im medi ately . Stand by to render assis tance”. (See Diagram 3).

Note: If the red parachute flare is sighted and the subma rine does not sur face within 5 minutes, it should be assumed that the subma rine is in distress and has sunk. An imme di ate at tempt should be made to fix the po sition in which the signal was sighted, after which ac tion in ac cor - dance with Part IV should be taken. The flare and marker signals will float for one hour then self scut tle and sink. d. Two white smoke sig nals released 3 minutes apart mean - “Keep clear. I am prepar ing to surface. Do not stop propel lers. Clear the im me di ate vi cin ity.” 4. It must not be in ferred from the above that sub marines ex er cise only when in com pany with es cort ing ves sels. 5. In certain circum stances warnings that sub marines are exer cis ing in speci fied areas may be broadcasted by a Coast Radio Station.

21 Part II - NAV IGA TION LIGHTS 6. Subma rines may be en coun tered on the surface at night, par tic u larly in the vi cin ity of the fol low ing ports: Saldanha Bay, Cape Town, Simon’ s Town, Hout Bay, Port Eliz a beth, East Lon don and Durban. 7. The steam ing and side lights of South Afri can sub marines ap pear to be placed well for ward and very low above the wa ter in pro por tion to the length and ton nage of these vessels. South Af ri can sub marines are fit ted with an amber quick flashing light situ ated abaft of the steaming light as an aid to iden ti fi ca tion. While at an chor or at a buoy by night sub marines dis play nor mal an chor lights. 8. The over all ar range ments of subma rines lights are there fore un usual and may well give the impres sion of be ing mark edly smaller and shorter ves sels than they are. Their vul ner a bil ity to col li sion when pro ceed ing on the sur face dic tates par tic ular cau tion when ap proach ing them. Part III - COL LI SIONS WITH SUB MA RINES 9. Most subma rine losses dur ing peace time have been caused by col li sion with other ves sels. Sub marines, with their low buoy ancy fac tor, if in volved in a col li sion, may sink or be un able to sur face be cause of their buoy ancy (bal last) tanks hav ing been rup tured. 10. Be cause of their size and low pro file, sur faced sub marines are of ten dif fi cult to see. Sub marines op er at ing at peri scope depth are obvi ously even more dif fi cult to de tect. 11. Col li sion or suspected col li sion, with a sub marine must be re ported by the fast est means avail able to the near est Coast Ra dio Sta tion. The po sition of the col li sion to gether with the es ti mated cur rent, wind force and sea state, as well as any other rel e vant par tic u lars, must be in cluded in the re port. 12. The re port should be sent by ra dio using Emer gency Clear ance Pro ce dure on dis tress or nor mal fre quen cies. The message can be passed di - rect to NAVCOMCENCAPE, via a Coast Ra dio Sta tion or har bour ra dio net work, which ever is con sidered the faster, as speed of han dling is es sen tial. The mes sage will then be sent to the Subma rine Op er a tions Author ity (SUBOPAUTH), Private Bag X1, Si mon's Town, 7995, or, sig - nals ad dress, Force Prep a ra tion Op er a tion Cen tre, tele phone (Cape Town) +27 21 787 4126/4129, fax (Cape Town) +27 21 787 4002. Part IV - SUNKEN SUB MA RINES 13. A bot tomed subma rine which is un able to sur face will try to in di cate its posi tion by the fol low ing meth ods: a. Re leas ing two life rafts, which are equipped with EPIRBS, as soon as the in ci dent oc curs. The life rafts are de scribed in Part V. b. On the ap proach of sur face ves sels, and at reg u lar in ter vals, by fir ing the smoke sig nals de scribed in Par 3 un der Part 1. c. Pumping out oil fuel or lu bri cat ing oil. d. Blowing out air. e. Ac ti vat ing her So nar Bea con. The So nar Bea con is de scribed in Part V. f. Trans mitting on her un der wa ter tele phone. The un der wa ter tele phone is de scribed in Part V. 14. It is vi tally impor tant that surface ships re frain from dis charg ing any oil or de bris which might ap pear to have come from a subma rine. Searching ships and aircraft can waste valu able time inves ti gat ing such false contacts. 15. Some subma rine py ro tech nics may carry messages. These may be re cov ered as soon as they have fin ished burn ing and the con tents of messages to gether with the po sition and time of re cov ery of the py ro tech nic must be passed to : a. Any Na val vessel in the vicin ity , or b. NAVCOMCENCAPE, Pri vate Bag X1, TOKAI, 7966, tele phone (Cape Town) 021 787 2911, 021 787 2459 , e-mail to [email protected] or c. COMFLEET, Na val Base, Si mon's Town or d. the nearest branch of the South Afri can Police Service.

Mes sages should be passed by the most rapid means of commu ni ca tion avail able. 16. South Af ri can sub ma rines are fit ted with two life rafts, each fitted with its own EPIRB which can be released from in side in case of emer - gency or if the sub marine is un able to sur face. 17. In any subma rine ac ci dent, time is the most vital fac tor af fect ing the chances of res cue of sur vi vors, and, as the sight ing of life rafts may be the first in dication that an acci dent has in fact occurred, it is vital that no time should be lost in tak ing action. 18. The sight ing of any smoke signals and/or life rafts an swering the de scrip tion should be re ported at once to the Na val au thor i ties or a Port Of fice. If a ves sel is un able to estab lish commu ni ca tion with out leav ing the vi cin ity of the sunken sub marine, she should stand by to res cue survi vors and not leave the scene of the ac ci dent. 19. South Afri can sub marines are equipped with smoke signals and life rafts. It is there fore of the ut most impor tance that the po sition, to gether with the es ti mated cur rent and the strength and di rec tion of the wind at the po sition, and the time of first sight ing of the smoke signals and/or life rafts be ac cu rately and speed ily re ported to any of the au thor i ties men tioned in para 15 above. 20. At any time after a subma rine acci dent sur vivors may start attempt ing to escape. Current policy dictates that sur vivors will wait before es- cap ing un til : a. res cue ves sels are known to be stand ing by, or b. con di tions in side the sub marine de te ri o rate to such an ex tent that an at tempt at es cape must be made.

22 c. it is de ter mined whether or not a DSRV res cue is pos sible. The DSRV is de scribed in Part V. 21. It should be noted that the air supply in a sunken sub marine may last for sev eral days, in which case sit u a tion b. may not arise for a con sider - able time after the sinking. However , if the subma rine is badly damaged, survi vors may have to make an im medi ate escape attempt . Any ship find ing smoke signals and/or life rafts an swering the de scrip tion should stand by well clear of it ready to pick up sur vi vors who will prob a bly surface at a dis tance from it de pend ing on the effect of wind and cur rent. On ar rival on the surface men may be ex hausted or ill, and the presence of a boat al ready lowered is very de sir able should weather con di tions per mit. Some men may re quire a de compres sion cham ber and the Na val au thor i ties will try to get such a chamber to the scene as soon as possi ble. 22. In or der that those trapped in the sub marine shall be made aware that help is at hand, na val ves sels drop small charges into the sea which can be heard from in side the sub marine. It is vital that they are not dropped too close since men in the pro cess of making as cents are par tic ularly vul ner a ble to un der wa ter ex plo sions, and may eas ily be fa tally in jured. A distance of 0.25 miles is con sidered safe. If no small charges are avail able, the run ning of an echo sounder or the bang ing of the outer skin of the ship’s hull with a ham mer from a posi tion be low the wa ter-line is likely to be heard in the sub marine, and such bang ing and/or sound ing should be car ried out at fre quent in ter vals. 23. Subma rines may at any time re lease py ro tech nic signals which, on reach ing the sur face, burn with flames and/or smoke, thus serv ing to mark the po sition. They are likely to ac knowledge sound sig nals by this means. 24. Summing up, the aims of a Sub marine Res cue Op er a tion are: a. To fix the ex act po sition of the sub marine. b. To get a ship stand ing by to pick up sur vi vors, if prac ti ca ble, with boats al ready lowered. c. To get med i cal as sistance to survi vors picked up. d. To get a diver’s de compres sion cham ber to the scene in case this is re quired by those se ri ously ill af ter be ing ex posed to great pres sure. e. To in form the trapped men that help is at hand. f. To get a DSRV to the scene of the sub marine in ci dent. 25. There is a Naval or gani za tion designed to fulfill these aims, which is always kept at instant readiness for action. It is clear, however , that any ship may at any time find ev i dence of a sub marine di saster , and if she takes prompt and cor rect ac tion as de scribed above, she may be in a posi tion to play a vi tal part. Part V - SUB MA RINE RES CUE DEVICES 26. The sub marine is fitted with two life rafts, which can be released from in board in case of an emer gency (See Diagram 4). They have the fol low ing char ac ter is tics: a. The life rafts pop out of pres sure proof GRP con tain ers. These GRP con tain ers will be vis i ble on the sur face. b. Each life raft can carry 25 persons . c. The life raft is teth ered to the subma rine with 600m of rope. d. Each life raft is fitted with: i. EPIRB. The Emer gency Posi tion In di cat ing Ra dio Bea con is teth ered to the life raft and is ac ti vated as soon as it comes into con tact with the sea wa ter. The EPIRB transmits a signal of war bling notes on 406 MHz. Ships hear ing this sig nal should re port the fact giv ing their po sition and if pos sible, an indi ca tion of sig nal strength. ii. SART . The Search and Res cue Radar Transpon der is used to locate survival craft or dis tressed vessels by cre ating a series of dots on a res cu ing ship’s ra dar dis play. The re sponse fre quency is 9.2 – 9.5 GHz. iii. Por ta ble VHF ra dio. 27. The So nar Bea con serves to alert res cue au thor i ties to the sub marines po sition and to pro vide a hom ing sig nal for the DSRV. It op er ates at a fre quency of 3,5 and 12 kHz.

28. The sub marine is fit ted with an un der wa ter tele phone, which is ca pa ble of voice and Morse commu ni ca tions. 29. The DSRV (deep sea rescue ves sel) is a mini sub mersible ca pa ble of res cu ing per sonnel from the sub marine should the sub marine have bot tomed or have fouled un der wa ter (See Diagram 5). The sub marine' s forward hatch is con fig ured to re ceive the DSRV skirt and form a wa - ter tight con nec tion. This al lows the for ward hatch to be opened and for the trapped per sonnel to be trans ferred to the DSRV.

All those who go to sea should be fa miliar with the oper a tion of ra dio equip ment, if car ried, for the pur pose of ra dio dis tress calls. The in tro duc tion of an Air Ser vice be tween South Af rica and Aus tra lia in No vember 1957, to gether with the Search and Rescue (SAR) ob - li ga tions ac cepted by South Africa as a mem ber of the In ter na tional Civil Avi a tion Or gani sa tion (ICAO) re sulted in the De part ment of Trans - port, on 1 Oc to ber 1958, as suming re sponsi bil ity for the co-or di na tion of South Af ri can Search and Rescue ser vices. A commit tee known as “The Perma nent Commit tee for the Co-or dina tion of Air/Sea Rescue Services” was estab lished shortly there after by the Secre tary for Trans- port. 2. The terms of the In ter national Con ven tion for the Safety of Life at Sea (LONDON) 1974 (SOLAS), to which South Af rica is a sig na tory, are en acted in Sched ule 2 of the Mer chant Ship ping Act (Act 57/51 as amended). This con ven tion has placed fur ther SAR obli ga tions upon the South Afri can Gov ern ment. Fur ther more, South Afri can reg istered mer chant ship ping, in terms of this enact ment, be came le gally obliged to as sist per sons in dis tress at sea. 3. In 1979, in or der to con form with the man ner in which other na tional SAR or gani sa tions are named, the South Af ri can Search and Rescue Or gani sa tion was es tab lished. It is known as the SASAR Or gani sa tion. THE FUNC TIONS OF THE SASAR OR GANI SA TION 4. The primary function of search and rescue oper a tions in the Southern Af rican area is to search for, to assist and, if neces sary , rescue: a. Survi vors of air craft ac ci dents or forced land ings. b. Crew and Pas sen gers of Ves sels in dis tress and Sur vi vors of mari time ac ci dents. 5. SASAR is also charged with co-ordinating the ef forts of var i ous Govern ment De part ments, vol untary or gani sa tions and, pri vate air craft and ship ping compa nies in the field of search and res cue and, with for mulat ing pol icy and pro ce dures. COM PO SI TION OF SASAR 6. The Ex ec utive Com mittee of SASAR is made up of rep re sen ta tives from those Gov ern ment De part ments which are able to con trib ute ser - vices and/or fa cil i ties for use by SASAR. These in clude Trans port, SAMSA, South Afri can Air ways (SAA), Defence, Police, Dept of Pro vin - cial and Lo cal Government (DPLG), Transnet Na tional Ports Au thor ity and TELKOM. The Direc tor-Gen eral : Trans port ap points the Chair man for the Ex ec u tive Com mit tee and pro vides sec re tarial ser vices to the Ex ec u tive Com mit tee and its sub-com mit tees. 7. In ad di tion to the Ex ec u tive Com mit tee two sub-com mit tees ex ist:

a. SASAR - Avi a tion Sub-com mit tee: This con sists of rep re sen ta tives of the SAMSA, SAA, South Af ri can Air Force (SAAF), DPLG and TELKOM.

b. SASAR - Ma rine Sub-com mit tee: This con sists of rep re sen ta tives of SAMSA, Transnet Na tional Ports Au thor ity, SAAF, South Afri can Navy (SAN), National Sea Rescue In sti tute (NSRI), DPLG, Ti tan Aviation and Smit Amandla Marine. SOUTH AF RI CAN AREA OF SAR RE SPON SI BIL ITY 8. The RSA’s area of respon sibil ity for SAR embraces the sea and land areas as in dicated in Di a gram 1 on the fol lowing page, in clud ing the in de pend ent states situ ated therein, and cor re sponds to that as laid down by the In ter na tional Civil Avi a tion Or gani sa tion (ICAO). SAR RE GIONS AND AS SO CI ATED RES CUE CO-OR DI NA TION CEN TRES 9. The South ern Af ri can area is di vided into two SAR Re gions (SRRs) with the con trol of SAR oper a tions in each re gion be ing cen tered at Res cue Co-or di na tion Cen tres (RCCs) namely (see Di a gram 1):

a. In land SRR - Aero nau ti cal Res cue Co-or di na tion Cen tre (ARCC), lo cated at O.R. Tambo In ter na tional Air port; and

b. Mar i time SRR - Mar i time Res cue Co-or di na tion Cen tre (MRCC), lo cated at Plattekloof, near Cape Town.

Note : Cape Town MRCC is primar ily con cerned with ocean SAR missions and air searches over the sea.

10. For mari time pur poses SAR missions may be classed as:

a. OCEAN : An in ci dent in which only ships and long range air craft may be avail able al though, in the more re mote ocean ar eas, only ships may be avail able.

29 13. The Har bour Master of a sub-area is the au thor ity for co-ordinating a search and res cue op er a tion in that sub-area. There fore, any distress signal in a re gion must be re layed to the Har bour Master of that sub-area. His of fice will re lay the message on to the MRCC. 14. As the above sub-ar eas are large, each pri mary co-ordinating Har bour Master has within his zone one or more Sec ond ary Author i ties to whom SAR re sponsi bil i ties can be del e gated. This del e ga tion of re sponsi bil ity may only take place af ter the co-ordinating Har bour Master has con sulted the Sec ond ary Author ity con cerned and is sat isfied that the lat ter is more suited to han dle the par tic u lar SAR in ci dent. 15. It must be re membered that fi nite sea ward bound aries to the above sub-ar eas are diffi cult to lay down. Close li ai son be tween Har bour Mas- ters and Cape Town MRCC is there fore done on a reg u lar ba sis. AIRCRAFT , VESSEL S, VEHI CLES AND EQUIP MENT AVAILABLE FOR SEARCH AND RESCUE PURPOSE S

16. Air craft : The South Af ri can Air Force, South Afri can Air ways and Ti tan Aviation pro vide suit able air craft on re quest.

17. The SA Navy will pro vide suit able ves sels and per sonnel where and when re quired. Re quests for as sistance may be ini ti ated by the Har - bour Master(s) through the Cape Town MRCC or local Na val Area Com mander.

18. Transnet National Ports Author ity will pro vide tugs and other suit able ves sels on the in struc tions of the Har bour Master(s) con cerned.

19. Deep Sea Res cue Tug : One large, fast (20 knot) res cue tug is oper ated by Smit Amandla Ma rine. This craft is ide ally suited for OCEAN type missions due to its ex ten sive com muni ca tions equip ment, hos pi tal fa cil i ties and speed. It is also well suited for COASTAL missions.

20. Na tional Sea Rescue In sti tute (NSRI) Sta tions : The NSRI oper ates Sta tions at the follow ing loca tions:- Hartbeespoort Dam, Vic toria Lake, Lambert' s Bay, Club Mykonos, Ta ble Bay, Bakoven, Hout Bay, Kommetjie, Si mon’s Town, Strandfontein, Gordon's Bay, , Agulhas, Mossel Bay, Still Bay, Witsand, Yzerfontein, Bea con Bay, Wil der ness, Knysna, Plettenberg Bay, St Fran cis Bay, Port Eliz a beth, Port Al fred, East Lon don, Port St Johns, Port Ed ward, Shelly Beach, Durban and Rich ards Bay. Aux il iary Sta tions at St Hel ena Bay, Melkbosstrand, Cof fee Bay, and . In ad di tion there is one in land op er a tion sta tion on the Vaal Dam at Deneysville. 21. NSRI Fleet : The fleet con sists of some 50 boats vary ing from 13 metre ves sels used for deep sea op er a tions, to 3 me tre in shore res cue ves - sels. The major ity of these are either 5 or 7 metre semi rigid in flatable and 8 metre longer range craft.

22. NSRI Coast Watch ing Aux il iary : The NSRI Sta tions are as sisted by vol unteer “Coast Watch ers” who re port on in ci dents ob served off shore.

23. Other Vessels : Shipmasters are obliged by cus tom, as well as Na tional and In ter na tional Stat ute, to render as sistance to per sons in distress at sea. In such cases assist ing ves sels are expected to report their inten tions and actions to the near est Har bour Master via a Coastal Radio Sta- tion. THE NA TIONAL SEA RES CUE IN STI TUTE 24. The South Af ri can So ci ety of Master Mar i ners, in 1966, brought into be ing an in shore sea res cue ser vice sim i lar to that of the Royal Na - tional Life boat In sti tu tion of Great Brit ain. This service was called the South Af ri can In shore Sea Res cue Ser vice. 25. In June 1967 the name was for mally changed to the Na tional Sea Rescue In sti tute of South Af rica (NSRI). The In sti tute’s Patron is the Pres i dent. 26. The NSRI is of fi cially rec og nized in ter na tion ally and by SAMSA as an or ga ni za tion un der tak ing Search and Res cue. Op er a tion ally it co - mes under the con trol of the SASAR Or ga ni za tion through the Har bour Masters of the sea ar eas con cerned. It op er ates in con junc tion with other means of search and rescue at the Harbour Masters’ disposal. 27. The Head quar ters are in Cape Town. The NSRI pro vides an in shore res cue ser vice from Saldanha Bay to Rich ards Bay. The po sitions of NSRI Sta tions are in di cated on SAN charts by the NSRI sym bol . In ad di tion to launches and boats, the NSRI oper ates offroad type ve hi cles fit ted with ra dio and res cue equip ment. 28. The main ob jec tives for which the NSRI was formed are briefly: a. To pro vide effi cient life-sav ing craft at var i ous lo ca tions in spe cific zones along the coast of RSA. b. To es tab lish cen tres at such lo ca tions for the train ing of crews ca pa ble of man ning the life-sav ing craft at all times. c. To en cour age all boat own ers to ac cept ad e quate safety stan dards and to ad here to rec og nized rules of con duct and sea manship. 29. All NSRI boats are equipped with VHF radios and some with HF radios. They are con trolled by the NSRI’s own shore-based ra dio trans - mitters op er at ing on a fre quency ex clu sive to NSRI which en sures unin ter rupted con tact dur ing search and rescue mis sions. For joint op er a - tions other fre quen cies are used as ap pro pri ate. 30. NSRI crews are all un paid vol un teers but are ad e quately in sured at the In sti tute’s ex pense. 31. Whilst the main cen tres of boat ing ac tiv ity are ad e quately cov ered other cen tres will be cov ered in due course when the need has been es - tab lished. 32. Re ports of boats or per sons in distress should be made di rect to the Har bour Masters, when pos sible, oth er wise to the SA Police Service who will alert the Harbour Masters, or whoever else may be re spon sible for alerting the rescue services in the area con cerned.

33. Control of NSRI Units is normally ex er cised by its own co-ordinators but is al ways under the over all con trol of the Har bour Masters.

34. A sea res cue service, sim ilar to the South Afri can NSRI, exists in Namibia. It is called Sea Rescue of Namibia and has one sta tion at Walvis Bay.

Former Notice No 17/2015 is cancelled. KWAZULU-NA TAL COAST, Shark Nets 1. The Sharks Board pres ently de ploys nets at 38 beaches along the coast line of KwaZulu-Na tal, ranging from Rich ards Bay to Port Ed ward See listing below for details. 2. The shark safety gear con sists of dif fer ent types, in clud ing shark nets and drumlines and are in stalled at all pro tected beaches. Histor i cally these nets com prised of pan els of 106 metres in length with a 6.2 metre drop and are re ferred to as “sin gle nets”. However , it has been found that “double nets” (213.5 metres) and, in some cases “tri ple nets” (304.8 metres) are more sta ble in cer tain ar eas. Var i ous con fig u ra tions are used. Single nets are se cured by 2 x 35kg an chors (one on each end of the net), dou ble nets by 4 x 35kg an chors (two on each end) and tri ple nets by 6 x 35kg an chors (three on each end). 3. All nets are man ufac tured from poly eth yl ene rope and twine and are indi cated by a red marker buoy at each end (See Di a gram 1). The nets are laid ap prox i mately 20 metres apart and par al lel to the coast line be tween 200 and 400 metres off shore in ap prox i mately 11 to 15 metre wa ter depth. 4. Drumlines con sist of a large red buoy and a baited hook, which is an chored and marked by a yel low an chor marker buoy. The drumlines are set adja cent to the shark nets and at the same dis tance offshor e. 5. Vessels passing these beaches are advised to sail at least 1 nauti cal mile offshor e to allow for safe passage. 6. Follow ing is a list of net ted beaches from north to south :

VES SEL TRAF FIC SER VICE (VTS) GEN ERAL NOTES. Navi ga tion around the South Afri can Coast which takes place in ar eas cov ered by a Ves sel Traf fic Ser vice will be obliged to com - ply with the pro vi sions of the South Afri can Marine Traf fic Act, 1981 (Act No. 2 Of 1981) Ma rine Traf fic (In shore Ves sel Traf fic Ser - vices) Reg u la tions 1999.

1. Lis ten ing Watch: All ves sels in South Afri can wa ters are to main tain a constant lis ten ing watch on VHF Ch 16, un less in the area of a VTS Sys tem when the watch should be on the ap pro pri ate des ig nated fre quency.

2. Nav i ga tional Safety Calls: Safety calls, compris ing ves sels name, po sition and in tended course of ac tion, are to be made on the fre quency in (1) above, in the event of any of the fol low ing: a. Risk of col li sion. b. A call from an other ves sel in di cat ing that a close quar ters sit ua tion is de vel oping. c. Over tak ing, or be ing over taken, in a nar row chan nel. d. Doubt about an other ves sel's in ten tions. e. An obstruc tion or bend in the chan nel which may obscure ap proach ing ves sels. f. In re stricted visi bil ity, ap proach ing charted routes or groups of ves sels.

g. If vessel is restricted in its ability to manoeuvre. h. Approach ing dredg ers and float ing plant in re stricted wa ters, which are not cov ered by a VTS system. i. Leav ing a berth, an chor age, moor ing area, etc. j. Any other oc ca sion when a call could con trib ute to safe nav i ga tion.

3. Ves sel Traf fic Ser vices: The fol lowing in for mation ap plies to all South Afri can In shore VTS sys tems (as distinct from the offshore sys- tem i.e. for Laden Tank ers off the Alphard Bank), unless oth er wise stated:

a. DE SCRIP TION: Partic ipa tion in these VTS systems is man da tory for the fol low ing: i. Ves sels of 15 m or more in length. ii. Towing ves sels where the tow is 15 m or more in length, or the over all length of ves sel and tow is 30 m or more. iii. Any pas sen ger car ry ing ves sels. iv. All ves sels car ry ing dan ger ous or pol lut ant car goes.

b. PRO CE DURE: Ves sels may be re quired to re port the fol low ing in for mation : i. Ves sels Name. ii. Call sign. iii. Po si tion.

iv. ETA of ves sel en ter ing the VTS zone. v. Des ti na tion. vi. ETA at des ti na tion. vii. Whether any pol lut ant or dan ger ous goods cargo is car ried on board, or car ried on any vessel or ob ject be ing towed or pushed. viii. ETD from a berth. ix. ETA at a lo ca tion re quir ing a re port (such as a re port ing system).

The above infor mation must be re ported as fol lows, when:

(1) Enter ing a VTS Zone. Fif teen min utes be fore en ter ing a VTS zone, a ves sel must ap ply for Traf fic Clear ance, stat ing: (i), (ii), (iii), (iv), (v), (vi) and (vii) above.

(2) Ar riv ing at a Re port ing in Point (RP). On ar riv ing at a Re port ing Point a ves sel must re port: (i), (iii) and (ix) above.

36 (3) Ar riv ing at a berth. As soon as prac ti ca ble af ter ar riv ing a ves sel must re port: (i) and (iii) above.

(4) De part ing a berth. 5 min prior to de part ing a berth a ves sel must ap ply for Traf fic Clear ance stat ing: (i), (ii), (iii), (v), (vi), (vii) and (viii) above.

(5) Im me di ately prior to de part ing a berth a ves sel must re port: (i), (iii) and (ix) above.

(6) Manoeuvers. Fifteen minutes prior to commenc ing any manoeuvre listed below , vessels must apply for Traf fic Clear ance stat ing: (i) and (iii) above plus a de scrip tion of their intende d manoeuvre.

Listed Manoeuvers

(a) Com pass ad just ment. (b) The cal i bra tion and ser vic ing of nav i ga tional aids. (c) A sea trial. (d) A dredg ing op er a tion. (e) The lay ing, pick ing up and ser vic ing of a subma rine ca ble or nav i ga tion mark. (f) Or any other manoeuvre that may be det ri mental to safe nav i ga tion.

As soon as possi ble af ter the manoeuver is completed, a de scrip tion of the manoeuver (just com pleted) must be com muni cated to the VTS Cen tre.

4. IN CI DENT RE PORTS: Ves sels should immediately re port any of the fol lowing and in clude (i) and (iii) as spec i fied un der Pro ce dure. a. Follow ing the fa tal run ning down of a fish ing craft by an un known vessel it is deemed nec es sary to draw the at ten tion of mar i ners to the sit - u a tion ex ist ing within 3 nau ti cal miles off the South Af ri can coast from a po sition abeam of the Orange River to a po sition South of Cape Agulhas, where small fish ing ves sels lay lines of, and/or in di vid ual, traps on the ocean bot tom. These traps are marked by float ing re cov ery lines and marker buoys. 2. The lines are ser viced dur ing the day when the fish ing ves sel can rec og nize her marker buoys. During the night the cray fish are pro cessed whilst the ves sel re mains at an chor or drifts with the cur rent. Dur ing this pe riod the light ing on board may be poor and a large ves sel not keep - ing a good look out could easily run down a small ves sel with out even be ing aware of it. 3. In gen eral no fish ing (at least in cer tain zones), con struc tion work, pol lu tion, or any form of distur bance is al lowed here un less writ ten per mission (which could be in the form of a per mit or ex emption is sued by the De part ment of En vi ron mental Af fairs) has been granted by the Min ister .

3. Closed Areas , de clared un der Sec tion 77 of the Ma rine Liv ing Re sources Act. Fish ing is re stricted or pro hib ited en tirely in these ar eas.

4. Na tional Parks, declared under the Protected Areas Act, can include marine areas and es tuar ies. Only the Ma rine Living Resour ce Act Reg u la tions that ap ply in these ar eas.

The Skulpiesbaai Re stricted Zone in cludes the area bounded by a line run ning from Noordkapperspunt at po sition 34° 23.963' S 021° 24.788' E to po sition 34° 23.963' S 021° 24.970' E and to po sition 34° 23.527' S 021° 24.970' E and along the high wa ter mark to the point of be gin ning at Noordkapperspunt. The Goukou Estuarine Restricted Zone in cludes part of the es tu ary that lies be tween po sition 34° 20.463' S 021° 24.187' E (ap prox i mately 2.3km upstream of the R323 road bridge) and po sition 34° 17.792' S 021° 18.592' E (ap prox i mately 15km up- stream from the mouth). Shell fish and bait organ isms or any in ver te brate spe cies may only be col lected in the con trolled zone of the Goukou es tu ary downstream of po sition 34° 20.463' S 021° 24.187' E and only along the east ern bank. No jetskis may be used any where in the MPA. 20. Amathole MPA No per son may fish, or at tempt to fish, within the Ma rine Pro tected Area from any ves sel. Fish ing gear on a vessel that en ters or tra verses the Ma rine Pro tected Area must be stowed, with all hooks discon nected and un-baited; and such a ves sel may not stop or move at less than 5 knots at any time while in the Ma rine Pro tected Area, ex cept for pur poses of pre par ing the ves sel for re-en ter ing the surf zone op po site the Haga Haga, Kei Mouth or Christmasvale launch sites. No spearfisher may use any floa ta tion de vice to ex tend swimming range when tra vers ing, div - ing, fish ing or land ing fish in a Ma rine Pro tected Area. 21. 26. The iSimangaliso Wet land Park (pre vi ously Greater St Lu cia Wet land Park, which include s St Lu cia and Maputaland MPAs) St Lu cia Ma rine Pro tected Area ex tends from bea con N3 north of Ngoboseleni Stream to bea con N4 south of Cape Vidal, and ex tends three nau ti cal miles seawards from the high wa ter mark. No fish ing is al lowed in the Sanc tu ary Zone be tween bea con N5 at Red Cliffs and bea con N6 at Leven Point, ex tend ing three nauti cal miles due east from the high-wa ter mark. In the Re stricted Zones which lie to the north of bea con N5 at Red Cliffs and to the south of bea con N6 at Leven Point, re spec tively, shore an glers may catch fish, and skiboat an glers and spearfishers may catch cer tain spe cies of pe lagic fish. Jetskis are al lowed in the MPA, but the man age ment au thor ity should be con tacted for more in for ma- tion.

27. Maputaland Marine Protected Area ex tends from bea con N7 at the Mo zam bique bor der to bea con N3 north of Ngoboseleni Stream, ex - tend ing three nauti cal miles seawards from the high-wa ter mark. No fish ing is al lowed in the Sanc tu ary Zone be tween the bea con N8 at Boteler Point and bea con N9 500m south of Dog Point, ex tend ing three nauti cal miles due east from the high-wa ter mark. No fish ing is al lowed in the Sanc tu ary Zone be tween the bea con N7 at the Mo zam bique bor der and the bea con N13, ex tend ing three nau ti cal miles due east from the high-wa ter mark, ex cept that shore an gling is al lowed north of bea con N27, which lies 2 km south of the mouth of the Kosi Lakes.

28. In the Re stricted Zones be tween bea con N13 and bea con N8 and be tween bea con N9 and bea con N3 shore an glers may catch fish, and skiboat anglers and spearfishers may catch cer tain species of pelagic fish. The Greater St Lucia Wetland Park (now iSimangaliso Wetland Park) is the man age ment agency (Contact num ber: 035-590 1633). 29. In addi tion to the above MPAs, the Hermanus Walker Bay Whale Sanctu ary MPA restricts vessels from enter ing the area of Walker Bay north and east of the new Har bour at Hermanus from July to Novem ber each year. 7. The Data Buoy Co op er a tion Panel work ing un der the aus pices of the World Me te o ro log i cal Or ga ni za tion and the In ter gov ern men tal Ocean o graphic Com mission maintains ar rays of instru mented drift ing and moored buoys in the world oceans. These au to mated buoys make rou tine mea sure ments and trans mit their data in real time through sat el lites. Such mea sure ments include wind speed and di rec tion, air hu mid- ity, atmo spher ic pressure, currents, sea surface temper a ture, but also water temper a ture at var ious depths to 500 metres. All buoys trans mit their po sitions along with the data. 2. Both drift ing and moored buoys pro vide valu able in for ma tion to many com mu ni ties, in clud ing fish er man and mar i ners.

What are the buoys used for?

Weather forecasts . Me te o ro log i cal mod els rou tinely as sim i late ob ser va tions from var i ous sources (in clud ing sat el lites, weather bal loons, land sta tions, ships and data buoys) around the planet to make their na tional fore casts. Buoy data are cru cial be cause they are de ployed in ocean areas where no other source of valuable data is available.

Ma rine fore cast. For simi lar rea sons, buoy data are es sen tial for pro duc ing improved ma rine fore casts.

As sis tance to fish er ies. Sea sur face temper a ture is an im por tant tool to find many dif fer ent spe cies of fish. The buoys provide fur ther in - for mation to weather cen tres, which pro duce charts of sea surface temper a ture and dis trib ute them to fish er man. Knowing where to look for fish saves both fuel and time. Using data buoys and other in struments such as subsurface floats, ocean o graphic mod els now per mit the pre dic tion of the im pact of EL NINO events and other sig nals on the ocean en vi ron ment. These pre dic tions can help fisher men to plan their op er a tion in ad vance.

Safety at sea. Sev eral na tions have suc cess fully used wind and ocean cur rent in for mation from the buoys to help lo cate miss ing or over - due boats.

Cli mate pre dic tions, me te o ro log i cal and ocean o graphic re search. Re searchers use the data from the buoys to learn how to pre dict fu - ture changes in the worlds cli mate. For ex ample, buoys were de ployed to learn how to pre dict the EL NINO / Southern Oscil la tion phe - nome non which causes dis rup tions in the ocean sur face winds and the upper ocean temper a ture pat tern and leads to sea sonal cli mate vari a tions and changes in fish migra tion pat terns in many ar eas of the world oceans.

AD VICE TO FISH ER MEN AND MAR I NERS

DO NOT pick up drift ing buoys. Buoy oper a tors do not re fur bish the drift ing buoys once de ployed. They would con tinue to transmit their po sition along with er ro ne ous mete o ro log i cal and ocean o graphic data from the deck of the ship.

DO keep watch for the moored buoys at sea, they should be vis i ble on ra dar and can be avoided. Dur ing fish ing op er a tions keep a safe dis tance from the buoys in or der to avoid entan gle ment of your net with the buoys.

DO NOT moor to, dam age, or destr oy any part of the buoys.

Mar i ners should be aware of the need to avoid an chor ing, trawl ing, fish ing, dredg ing, drill ing or car ry ing out any ac tiv ity close to sub ma- rine ca bles and pipe lines. Dam age to tele com mu ni ca tion ca bles can lead to ex ten sive dis rup tion of in ter na tional com mu ni ca tions, whilst dam- age to power ca bles will in ter rupt elec tric ity supply . Pipe lines may con tain flamma ble oil or gas under pres sure; a ves sel caus ing damage to a pipe line could face an imme di ate haz ard ei ther by loss of buoy ancy due to gas aer ated wa ter or by fire/ex plo sion, and re sult in an en vi ron men- tal haz ard. Such dam age to a sub marine ca ble or pipe line can lead to pros e cu tion. 2. If a sub marine ca ble is fouled whilst an chor ing, fish ing or trawl ing, ev ery ef fort should be made to dis en gage from the ca ble by nor mal meth ods, with out caus ing damage. If these ef forts fail, the an chor/gear/trawl should be slipped and aban doned. Par tic ular care should be ex er - cised should a vessel’ s trawl/fish ing gear foul a cable and raise it from the seabed. This may lead to a capsize situ a tion due to the exces sive load. Be fore any at tempt to slip or cut gear from the ca ble is made, the ca ble should first be lowered to the sea bed. 3. SUBMA RINE CABLES SHOULD NEVER BE CUT, as this is likely to en dan ger life or cause se ri ous injury . All power ca bles and most tele com mu ni ca tion ca bles carry high volt ages. 4. Subma rine pipelines are not always buried and their pres ence may ef fectively re duce the charted depth by as much as 2 metres. Where pipe lines are close to gether, only one may be charted. Pipe lines may span across sea bed un dula tions; the size and po sitions of such spans are not con stant and may vary due to tide and wave ac tion. It is possi ble for fish ing gear to be come snagged un der a pipe line so that it is ir re cov er - able, which could pres ent a se ri ous haz ard to the fishing ves sel. In the event that masters or skip pers suspect they have fouled a pipe line with gear or an chors, they should not place ex ces sive weight on their gear, which could damage the pipe line and en dan ger their vessel and crew. 5. In ci dents in volv ing the foul ing of sub ma rine ca bles or pipe lines should be re ported im me di ately to the ap pro pri ate au thor i ties. In most cases this will be the near est Coastal Ra dio Sta tion, who should be con tacted and ad vised as to the na ture of the prob lem and the po sition of the ves sel. 6. Former Notice No 24/2015 is cancelled. IN FOR MA TION CON CERN ING MA RINE MIN ING VES SELS 1. Di a monds were found on the Namibian coast in the Lüderitz area in 1908. In 1961 spe cially equipped barges started pro cess ing gravel re - cov ered from the sea-bed. A con sider able num ber of ves sels, some of whom are very large, can be en coun tered work ing fairly close in shore from Saddle Hill (Ap prox i mate po sition 25° 55' S 014° 55' E ) to Nee dle Point (Ap prox i mate po sition 27° 40.5' S 015° 31.5' E). 2. Mar i ners are warned of pos sible ex istence of lost mining gear, an chors and float ing ropes which may be en coun tered within the area de mar- cated on the rel e vant charts. Ex treme cau tion must be ex er cised when transiting and es pe cially trawl ing through this area. 3. Ma rine Min ing Ves sels (Dredg ers)(MMVs) are normally moored by a four an chors spread. These large an chors may be marked by unlit buoys. These ves sels move up to five ca bles within the an chor spread and mar i ners are ad vised to keep at least 1500 metres clear of MMVs. 4. MMVs, when on station and work ing, are re quired to ex hibit the lights and shapes as pre scribed by Rule 27 of the In ter na tional Reg ula - tions for Pre vent ing Col li sions at Sea, 1972 (as amended) (Colregs 72).

Summary This marine no tice sets out South Africa’ s re quire ments for pre-ar rival and pre-en try in for mation un der the Mer chant Ship ping (Mar i time Se cu rity) Reg u la tions, 2004. It replaces and consol i dates marine no- tices 19 and 27 of 2004, and gives guid ance on how to en sure the re ceipt of a pre-ar rival or pre-en try in - for mation re port by the MRCC.

1. In ac cor dance with regu la tion XI-2/9 of the In ter na tional Con ven tion for the Safety of Life at Sea, 1974, and para graph B/4.39 of the In ter - na tional Ship and Port Fa cil ity Secu rity (ISPS) Code, the Di rec tor-Gen eral: Trans port has, un der the Mer chant Ship ping (Mar i time Se cu rity) Reg u la tions, 2004, de ter mined the fol low ing re quire ments for pre-ar rival and pre-en try in for ma tion. The full of ficial text of the deter mi na - tion is pub lished by Govern ment Ga zette No. 27048 of 10 De cem ber 2004. 2. Pre-ar rival in for mation is re quired from for eign pas sen ger ships, cargo ships of 500 or more gross tonnage and mo bile off shore drill ing units (MODUs) on inter na tional voy ages bound for South Af ri can ports. 3. Pre-en try in for mation is re quired from for eign-go ing South Afri can pas sen ger ships, cargo ships of 500 or more gross tonnage and MODUs bound for a South Afri can port. 4. These re quire ments do not ap ply to fish ing ves sels, ves sels used solely for sport or rec re ation, gov ern ment ships engaged solely on non-commer cial voy ages, coasting ships, and ships transiting South Africa’ s ter ri to rial wa ters, in clud ing ships call ing off-limits at a South Afri can port for the trans fer of stores, crew, etc. However , for ships call ing off-limits vol un tary compli ance is en cour aged and may avoid de lay in the event, for ex ample, of transfer op er a tions hav ing to be done within port lim its be cause of ad verse weather con di tions.

5. The for mat and con tent of the pre-ar rival/pre-entry in for ma tion re port is given in the An nex. Masters are ad vised to exer cise care when draft ing re ports, par tic u larly when using a sin gle / or dou ble //. The re port com prises groups of words and numbers iden ti fied by a pre fix, with a dou ble // used to sepa rate the groups and a sin gle / used to sep a rate words or numbers within a group.

6. The report must be made at least 96 hours befor e the ship’s expected time of arrival (ETA) at the first South Afri can port. If the ship is ar riv ing from a for eign port where the voy age time be tween ports is less than 96 hours, the master must en sure that the pre-ar - rival/pre-en try in for mation is sent in com pli ance with the 96 hour re quire ment and up dated when the ship clears the last for eign port. 7. An amended re port must be made if: 1. the ETA date for the ship changes. How ever, a change in time on the same day need not be re ported; or 2. there has been a ship to ship or ship/port in ter face af ter the origi nal re port was made; or 3. any other in for mation in the origi nal re port changes. 8. Re ports are not re quired from ships making voy ages be tween South Af ri can ports (i.e. coast ing). How ever, if a ship makes a voy age to a port in an other coun try (e.g. to Maputo–Mo zam bique or Walvis Bay–Namibia), a pre-ar rival/pre-en try in for mation re port must be made be - fore any subse quent call at a South Af ri can port. Also, when a ship is coast ing be tween South Af ri can ports and in ter faces with an other ship be tween ports, the master must trans mit a pre-ar rival/pre-en try in for mation re port as soon as possi ble but at least 5 hours be fore the ship’s ETA. 9. The Mar i time Res cue Co or di na tion Cen tre (MRCC) in Cape Town is the first point of con tact for pre-ar rival/pre-en try in for mation. The pre-ar rival/pre-en try in for ma tion re port must be in Eng lish and in writ ing and is to be trans mit ted to the MRCC via Cape Town Radio. The MRCC will only ac cept re ports di rectly from the ship via Cape Town Ra dio; no re ports by voice com muni ca tion will be accepted. 10. The pre ferred means of ship to shore com muni ca tion for pre-ar rival/pre-en try in for mation re ports is an email to [email protected]. If Inmarsat C is used, the ship’s of fi cer can confirm re ceipt by se lect ing the op tion “re quest de liv ery con fir - mation” on the ship’s ter minal. A ship’s agent can also con firm re ceipt 6 hours af ter trans mission by con tact ing Cape Town Ra dio on the help line 0800 222 208. 11. Cape Town Ra dio will ac cept a for warded e-mail mes sage from a ship’s agent, pro vided the agent con firms receipt of the e-mail with Cape Town Ra dio — Cape Town Ra dio will not for ward an e-mail mes sage to the MRCC with out this con fir mation. When e-mail is used, re ports must not be sent as e-mail at tach ments but must be in the e-mail body text be cause the Cape Town Ra dio IT sys tem strips at tach - ments from e-mails. Cape Town Ra dio’s e-mail ad dress is [email protected].

Pre-ar rival/pre-en try in for ma tion re quired by this no tice for mar i time se cu rity pur poses is sim i lar to port en try in for ma tion re quired by the Transnet Na tional Ports Au thor ity (TNPA) for berth plan ning pur poses. However , the for mat and use of this in for mation dif fers con sider ably and masters and agents are ad vised to en sure that in for mation for the MRCC is not con fused with that re quired by the TNPA. 13. The MRCC does not se cu rity-clear ships. Its func tion is to check pre-ar rival/pre-en try in for mation re ports to en sure rel e vance and complete ness. The MRCC will commu ni cate with a ship, via Cape Town Ra dio, if it has any que ries about the ship’s re port. The MRCC for wards checked re ports to the Mar i time Se cu rity Co-or di na tion Cen tre (MSCC), which is re spon si ble for in form ing Port Se cu rity Of fi - cers (PSO) about ships’ secu rity clear ance status. Ships’ agents should therefor e obtain secu rity clearance in forma tion from the rele - vant PSO dir ectly.

14. Masters are cautioned that failur e to transmit timeously com plete and corr ectly format ted pre-arrival/p re-entry infor ma tion could re sult in delays and, in ap propri ate cases, de nial of port en try (see Ma rine No tice No. 12 of 2008). Ships whose masters re fuse to give pre-arrival/p re-entry infor ma tion will be denied port en try. 15. In the in ter ests of safety all ships are en cour aged to par tic i pate in the South Af ri can Ship Re port ing System (SAFREP). This sys tem as sists in search and res cue by pro vid ing up-to-date ship ping in for mation in the event of a mari time ca sualty . It is mod elled on IMO Res- o lu tion A.851(20) re gard ing gen eral prin ci ples for ship re port ing re quire ments and makes use of movement re ports, sub mitted to Cape Town Ra dio, from ships within the South Af ri can search and res cue re gion. In for mation about SAFREP can be found in the Ad miralty List of Radio Signals. Partic ipa tion in the system is volun tary .

South Af rica has im ple mented the Mar i time Se cu rity re quire ments con tained in Chap ter XI-2 of the In ter na tional Con ven tion for the Safety of Life at Sea, 1974, and the In ter na tional Ship and Port Fa cil ity Secu rity (ISPS) Code through the Mer chant Ship ping (Mar i time Se - cu rity) Reg u la tions, 2004. These regu la tions ap ply to South Africa’ s eight ma jor ports, namely Saldanha Bay, Cape Town, Mossel Bay, Port Eliz a beth, Ngqura, East Lon don, Durban, and Rich ards Bay. They also ap ply to pas sen ger ships, cargo ships of 500 or more gross tonnage and mobile off shore drill ing units (MODUs) on inter na tional voy ages. How ever, they do not ap ply to fish ing ves sels, ves sels used solely for sport or rec re ation, gov ern ment ships engaged solely on non-commer cial voy ages, coasting ships and ships transiting South Af rica’s ter ri to - rial waters.

Cer tif i ca tion of South Af ri can ships 2. The South Af ri can Mar i time Safety Author ity (SAMSA) is re sponsi ble for ap prov ing ship se cu rity plans for South Af ri can ships for ver i - fy ing com pli ance with plans and for is su ing the In ter na tional Ship Se cu rity Cer tif i cate (ISSC) and Con tin u ous Syn op sis Re cord (CSR).

Se cu rity Level in South Af ri can ter ri to rial wa ters 3. Secu rity Level 1 ap plies in South Af rica’s terri to rial waters. Any change of secu rity level or its area of appli ca tion will be noti fied by Ma - rine No tice, Nav i ga tional Warn ing and No tices to Mar i ners.

Port se cu rity 4. Se cu rity Level 1 is the de fault se cu rity level apply ing to South Af rica’s seven major ports (and the port fa cil i ties in these ports). Any change of se cu rity level will be de clared by the Di rec tor-Gen eral: Trans port, who is re quired to give proper no tice of the dec la ra tion. 5. If the ship is arriv ing from a foreign port where the voy age time be tween ports is less than 96 hours, the master must ensure that the pre-ar - rival/pre-en try in forma tion is sent in compli ance with the 96 hour re quire ment and updated when the ship clears the last for eign port.

11. An amended re port must be made if: 1. the ETA date for the ship changes. How ever, a change in time on the same day need not be re ported; or 2. there has been a ship-to-ship or ship/port in ter face af ter the orig i nal re port was made; or 3. any other in for mation in the orig i nal re port changes, ex clud ing those noted in 11.1.

61 12. The Mar i time Res cue Co or di na tion Cen tre (MRCC) in Cape Town is the sec ond point of con tact for pre-ar rival/pre-en try in for mation. The pre-ar rival/pre-entry in for ma tion re port must be in Eng lish and in writ ing, and is to be trans mit ted to the MRCC via Cape Town Ra dio, (the first point of contact) . The MRCC will only ac cept re ports directly from the ship via Cape Town Radio; no re ports by voice com muni ca tion will be ac cepted. The role of the MRCC is to scruti nise re ports for correct ness and complete ness. 13. The MRCC does not secu rity-clear ships. Its function is to check pre-ar rival/pre-en try in forma tion re ports to en sure rel e vance and com- plete ness. If MRCC has any que ries re gard ing the ship’s report, it will commu ni cate with the ship via Cape Town Radio. The MRCC for - wards checked re ports to the Mar i time Se cu rity Co-or di na tion Cen tre (MSCC), which is re spon si ble for in form ing port se cu rity of fi cers (PSO) about ships’ secu rity clear ance status. Ships’ agents should, therefor e, obtain secu rity clearance in forma tion from the rele vant PSO dir ectly. 14. The pre ferred means of ship-to-shore com muni ca tion for pre-ar rival/pre-en try in for mation re ports is via an email to [email protected]. The telex sys tem as sures receipt of the mes sage at Cape Town Radio. The report can be trans mitted on telex num ber 095 511600 or al ter natively on 095 521846. (The pre fix 095 is the in ter na tional di al ing code). If Inmarsat C is used, the ship’s of fi cer can con firm re ceipt by se lect ing the op tion “re quest de liv ery con fir mation” on the ship’s ter minal. A ship’s agent can also con - firm re ceipt 6 hours af ter trans mission by con tact ing Cape Town Ra dio on the help line 0800 222 208. 15. Gen eral In for ma tion

Back ground 1. In re sponse to a grow ing aware ness of the en vi ron ment, and the po ten tial cat a strophic ef fects of ma jor pol lu tion in ci dents at sea, of which the colli sion of the sister ships Venpet and Venoil (1977), Apollo Sea (1994) and the Trea sure (2000) are prob a bly the best known ex amples, the in ter na tional com mu nity has de vel oped con ven tions which reg u late the car riage of sub stances with po ten tial for pol lu tion and re strict or ban the dis charge over board of ma te ri als dam ag ing to the en vi ron ment.

Re ports 2. Ac tual or prob a ble dis charges of oil or nox ious substances or sight ings of pol lu tion should be re ported to the coastal au thor i ties. See South Af rican No tice to Mari ners No 6 in this publi ca tion.

The MARPOL 73/78 Conven tion 3. The In ter national Con ven tion for the Pre ven tion of Pol lu tion from Ships, 1973 was adopted by the In ter na tional Con fer ence on Ma rine Pollu tion con vened by the In ter na tional Mar i time Or ga ni za tion (IMO) in 1973. It was mod i fied by the Pro to col of 1978 re lat ing thereto and adopted by the In ter na tional Con fer ence on Tanker Safety and Pol lu tion Pre ven tion con vened by IMO in 1978. The Con ven tion, as mod i - fied by the Pro to col, is known as MARPOL 73/78. South Af rica be ing a member of the In ter na tional Mar i time Or ga ni za tion (IMO) is a sig - na tory to this Con ven tion.

Spe cial Ar eas

4. Special Areas, as desig nated un der MARPOL 73/78 Annex 1 (Reg ula tions for the Pre ven tion of Pol lu tion by Oil) are ar eas which, for tech ni cal rea sons relat ing to their ocean o graphic and eco log i cal con di tions and to their sea traf fic, re quire the adop tion of spe cial man da tory methods for the pre ven tion of sea pol lu tion. 5. A Special Area off the South Af ri can coast has been adopted by the IMO on 1 August 2008. The Spe cial Area in cor po rates the conti nen tal shelf from the mouth of the Spoeg River in the west to im medi ately east of the Great Fish river mouth in the east ex tend ing out to the con ti - nen tal shelf break at the 500 m isobath. The area en compasses the whole of the con ti nen tal shelf re gion known as the Agulhas Bank as well as the south ern and cen tral por tion of the south ern Benguela upwelling eco sys tem. Ta ble 1 lists the co-ordi nates for the Special Area and Di a gram 1 shows the Special Area within the context of a re gional di a gram.

Gen eral In for ma tion 6. This An nex con tains reg u la tions for the pre ven tion of pol lu tion by oil. The South Afri can do mestic legis la tion to im ple ment this Annex on Ma rine Pol lu tion (Pre ven tion of Pol lu tion from Ships) Act 2 of 1986, is admin is tered by the South Afri can Mari time Safety Author ity (SAMSA).

Dis charg ing of oil 7. The reg ula tions gov ern the dis charges, ex cept for clean or seg re gated bal last, from all ships. They re quire inter alia all ships to be fitted with pol lu tion pre ven tion equip ment to com ply with the strin gent dis charge reg u la tions.

8. Dis charge into the sea of oil or oily mixtures, as de fined in an Ap pen dix to the Con ven tion, is pro hib ited by the reg u la tions of Annex 1 ex cept when all the fol lowing con di tions are sat isfied:

64 a. From the machin ery space bilges of all ships, ex cept from those of tank ers where the dis charge is mixed with oil cargo res i due:

i. The ship is not within a Special Area. ii. The ship is more than 12 miles from the near est land. iii. The ship is en route. iv. The oil con tent of the ef flu ent is less than 15 parts per mil lion (ppm). v. The ship has in op er a tion an oil dischar ge moni tor ing and con trol system, oily-wa ter sep a rat ing equip ment, oil fil ter ing sys- tem or other in stal la tion re quired by this Annex.

b. These re stric tions do not ap ply to dis charges of oily mixture which with out di lu tion have an oil con tent not ex ceed ing 15 ppm.

c. From the cargo area of an oil tanker (dischar ges from cargo tanks, in clud ing cargo pump rooms; and from machin - ery space bilges mixed with cargo oil res i due):

i. The tanker is not within a Special Area. ii. The tanker is more than 50 miles from the near est land. iii. The tanker is proceed ing en route. iv. The in stan ta neous rate of dis charge of oil con tent does not ex ceed 30 li ters per mile. v. The to tal quan tity of oil dis charged into the sea does not ex ceed for exist ing tank ers 1/15 000 of the to tal quan tity of the par tic - u lar cargo of which the resi due formed a part, and for new tank ers (as de fined in the new Annex) 1/30 000 of the to tal quan tity of the par tic u lar cargo of which the resi due formed a part. vi. The tanker has in op er a tion, ex cept where pro vided for in the Annex, an oil dischar ge moni tor ing and con trol system and a slop tank ar range ment.

Spe cial Areas and PSSAs 9. An nex 1 ap plies to all such ar eas.

Ship board Oil Pollu tion Emergency Plans (SOPEP) 10. Reg ula tion 26 of An nex 1 to MARPOL 73/78 re quires ev ery oil tanker of 150 gt and above and ev ery other ves sel of 400 gt and above, to carry on board a SOPEP ap proved by the ves sel's flag ad minis tra tion. Reg u la tion 26 came into force on 4 April 1995 for all ex ist ing ves sels. IMO has produced guide lines, as IMO Res o lu tion MEPC 54(32), for the de vel op ment of SOPEPs. This regu la tion also ap plies to off shore in stal la tions en gaged in gas and oil pro duc tion, sea ports and oil ter minals.

IN STRUC TIONS

1. This form and its instruc tions have been de signed to help both the sender and the recip i ent. It should be used, or followe d closely, whenever appro pri ate . Form SAN HO-16a lists the infor m ati on require d for South Af rican Sail ing Di recti ons and should be used as an aide mem oir to this form if neces sary . Mari ners are request ed to noti fy the Hy drogra pher of the South Afri can Navy, when new or sus pected dangers to navi ga ti on are discov ered, changes observe d in aids to navi ga ti on, or cor- recti ons to publi cati ons seen to be neces sary . The Mari ner’s Handbook (NP 100) Chapter 8 gives general instruc tions. The provi sions of inter nati onal and nati onal laws should be com plied with when forward ing such reports.

2. When a po si tion is de fined by sextant angles or bearings (true or magneti c being speci fie d) more than two should be used in order to provide a check. Dis tances observe d by ra dar should be quoted if avail able. Lat itude and longi tude should only be used specif ical ly to posi ti on the de tails when they have been fixed by astro nom ical obser va ti ons or GPS and a full de- scripti on of the method, equipm ent and datum (where appli cable) used should be given.

3. A cut ting from the largest scale chart is the best medium for forward ing detai ls, the al ter ations and addi ti ons being shown thereon in red. When request ed, a new copy will be sent in replac em ent of a chart that has been used to forward infor m ati on, or when exten sive obser va ti ons have involved de face ment of the observe r’s chart. If it is preferred to show the amendm ents on a tracing of the largest scale chart (rather than on the chart it self) these should be in red as above, but ade quate detai ls from the chart must be traced in black ink to enable the amendm ents to be fit ted correct ly.

4. When soundings are obtai ned and a paper echo sounding trace is avail able, the echo sounding trace should be marked with times, depths, etc., and forwarded with the report. It is im portant to state whether the echo sounder is set to regis ter depths below the surface or below the keel; in the latter case the vessel ’s draught should be given. Time and date should be given in order that correc ti ons for the height of the tide may be made where nec essary . The make, name and type of the echo sounder should also be given.

5. Modern echo sounders frequentl y re cord signals from echoes re ceived back after one or more rota ti ons of the sty lus have been com pleted. Thus with a set whose maxi m um range is 500m, an echo recorded at 50m may be from depths of 50m, 550m or even 1050m. Soundings recorded be yond the set’s nom inal range can usuall y be recog nize d by the fol lowing: (a) the trace being weaker than norm al for the depth recorded, (b) the trace passing through the transm ission line, (c) the feath ery na ture of the trace.

As a check that appar entl y shoal soundings are not due to echoes re ceived beyond the set’s nom inal range, soundings should be conti nued unti l reason able agree ment with charted soundings is reached. However, soundings recei ved after one or more rota ti ons of the sty lus can still be useful and should be subm it ted if they show signif i cant differ ence s from charted depths.

6. Re ports which can not be confirm ed or are lacking in certai n detai ls should not be withheld. Shortcom ings should be stressed and any firm expec ta ti on of being able to check the infor m ati on on a suc ceeding voy age should be menti oned.

7. Re ports of shoal soundings, unchart ed dangers and navi ga ti onal aids out of order should, at the mari ner’s discre ti on, also be made by radio to the nearest coast ra dio stati on. The draught of modern tankers is such that any unchart ed depth under 30 metres may be of suf fi cient im por tance to jus tify a ra dio message.

8. Port infor m ati on should be forwarded on Form SAN HO-16a togethe r with Form SAN HO-16. Where there is insuf fi - cient space on the form an addi ti onal sheet should be used.

Note : An acknowl edge m ent or recei pt will be sent and the infor m ati on then used to the best advan tage which may mean im medi ate acti on or inclu sion in a revi sion in due course. When a Noti ce to Mar iners is is sued, the sender’s ship or name is quoted as author it y unles s (as someti mes happens) the infor m ati on is also re ceived from other author i ti es.
