Congratulations The Cathaoirleach and members congratulated Mr. Michael (Mouse) Morris on his historic achievement training the winners of both the Irish and English Grand National.

Item 3.1 With the agreement of the members Item 3.1 was taken first on the agenda. Casual Vacancy This casual vacancy arose in the membership of as a result of Co-option the passing of Cllr. Willie Kennedy on 7th March 2016 and it was required that the vacancy would be filled at the next meeting of the Council after the expiration of fourteen days from the occurrence of the vacancy or as soon after the expiration of fourteen days as circumstances permit. Members attention had been drawn to Section 19 of the Local Government Act, 2001 and Standing Order No. 83 for the filling of a casual vacancy.

“Each Member of the Council who was elected as a non-party candidate to the Council must, immediately after his/her election to the Council, submit to the Meetings Administrator, the name of his/her nominee to be co-opted as a replacement on the Council in the event of he/she being required to vacate his/her office, for any reason, during the lifetime of the Council. The Council shall co-opt any person thus nominated”

The replacement nominee as submitted to the Meetings Administrator by Cllr. Willie Kennedy on 14th July, 2014, was Mr. Eddie Moran. Proposed by Cllr. M. Lowry, seconded by Cllr. M. O’Meara and resolved “That pursuant to the provisions of Section 19 of the Local Government Act, 2001 that Eddie Moran be appointed to the casual Vacancy which exists on Tipperary County Council”. Members welcomed Cllr Moran to the membership of Tipperary County Council. Cllr Moran thanked his proposer and seconder, the Kennedy family and his supporters.

Item 3.11 Mr. Brian Beck, Senior Planner, informed the members that the Proposed Variation No. 3 of To Note Proposed County Development Plan 2010(Tipperary Renewable Energy Strategy) Variation No. 3 of was being put on public display for a period of four weeks and the Chief Executives Report North Tipperary would be brought to the July Meeting with a workshop being held prior to the meeting. Item 3.12 Mr. Brian Beck, Senior Planner, informed the members that the Proposed Variation No. 3 of To Note proposed County Development Plan 2010(Tipperary Renewable Energy Strategy) Variation No. 3 of was being put on public display for a period of four weeks and the Chief Executives Report the South would be brought to the July Meeting with a workshop being held prior to the meeting. Item 3.13 The Local Government Reform Act, 2014, established the requirement for each local Draft Service authority to prepare an Annual Service Delivery Plan, identifying the services that it Delivery Plan 2016 proposed to deliver to the public in the year ahead. The purpose of this Service Delivery Plan was to provide a corporate document that highlighted the services that would be provided by Tipperary County Council across all departments in 2016 and has been prepared based on the provision of the adopted budget of Tipperary County Council for 2016. The draft Service Delivery Plan for 2016 had been circulated to allow the members time to consider its content before it would be listed on the Agenda for the May Meeting for adoption by the members. Members were asked to direct specific queries to the relevant Director of Services in advance of the May monthly meeting.

Item 5.1 The Management Report with a focus on Directorates in Clonmel as circulated with the Consideration of Agenda was noted and considered by the Council. Management Report 6

Community and Economic Development

Suicide Prevention In reply to queries from Cllr D. Doran in relation to Suicide Prevention , Ms. S. Carr, Director of Services, confirmed that the Council were working closely with the H.S.E., on Mental Health. There were a multiplicity of groups in the County dealing with Mental Health issues and all were working to ensure the existence of a more simple and more effective support structure which would be supported by all agencies and voluntary groups through the development of the Suicide Prevention Plans. The simpler the structure the more effective the supports could be for this very vulnerable group and once agreed, it was important that all agencies got behind this and advocated with one voice – keeping the message clear and simple. Two suicide prevention plans were being developed, one for North Tipperary and one for South Tipperary. It was agreed to write to the Department of Health to express support for increased funding for Mental Health Services and a request would issue to the Health Service Executive seeking a presentation to the Council by the relevant Suicide Prevention Officers for Tipperary. Members welcomed a Taxi Watch initiative introduced in Clonmel recently. 1916 Commemorations Members complimented all those involved in 1916 Commemoration Events, in particular the recently launched 1916 Exhibition currently on display at the County Museum. Benmore Site, Roscrea In response to an enquiry by Cllr Smith, Ms. S. Carr, D.O.S., stated that the outcome of a grant application submitted to Enterprise Ireland was awaited in order to progress this project. Sports Partnership. Cllr Morris requested that consideration be given to the holding of a conference dealing with nutrition in sports for coaches and parents. FAI Presentation The Cathaoirleach acknowledged the approval of the CPG to facilitate a presentation by Mr. John Delaney, CEO, FAI at the May meeting of the Council in relation to the Festival of Football and FAI AGM in Tipperary during July 2016. This was noted and agreed.

Item 5.2 It was agreed to take this item with the Community and Economic Development Section. Joint Policing A report on The Joint Policing Strategy had been circulated to the members which outlined Committee the process in the development of the strategy, its priority objectives and strategic actions. Strategy Cllr R. Kennedy, Chair of the Joint Policing Committee, thanked the members of the J.P.C. for their input into the formation of the Strategy which incorporated an ambitious and wide ranging programme for the five year term of the plan Further to queries raised regarding the control of sulky racing and the consideration of the designated area to facilitate same, which had been considered by the J.P.C. at the request of Cllr Hogan, supported by Cllr Dunne, it was agreed that this matter would revert back to the Environment and Roads SPC for further consideration of the JPC’s proposals.

Water Services Thurles Pumping Station Concerns were raised by Cllr Ryan regarding the overflow system in operation at the pumping station whereby sewage was released into the river in certain flood situations. Mr. S. Keating, D.O.S. stated this was standard practice countrywide and Irish Water were looking at future treatment of surface water and sewage. The matter in Thurles would be dealt with as part of a future sewerage scheme for Thurles. Combined Drains It was clarified that the responsibility for the maintenance of combined drains was set in legislation. Maintenance of private combined drains was the responsibility of the residents connected to the drain up to the point at which it connects to the public sewer. It was noted that it was not legally the remit of Irish Water and would require legislative change to address the matter. Waste Water Treatment Plant, Golden Cllr Fitzgerald, supported by Cllr Kennedy, expressed his disappointment that Golden had not been prioritised for a Waste Water Treatment Plant. He outlined the effect the lack of a treatment plant was having on the development of the Golden area and urged that action be taken. It was agreed to raise the matter with Irish Water. Non Domestic Billing It was confirmed that Irish Water proposed to have the takeover of billing for non domestic water accounts completed by the end of 2016. Burncourt Treatment Plant It was confirmed that this plant was undergoing its final testing. Once operational, the relevant procedure would be followed with the HSE to remove the boil water notice affecting certain residents in the Skeheenarinka area. Clonmel Town Water Supply Scheme Irish water have included this scheme in their 'Emerging Capital Investment Plan' soon to be submitted to the Regulator. Water would be abstracted from the River Suir and treated in a new water treatment plant. This source would replace a number of the current small sources serving the Clonmel area Hardwater, Clonmel North Mr. S. Keating DoS advised that the water from the River Suir would be somewhat harder than that from the current upland sources, but not as hard as that from the boreholes north of the town. Credits for Consumers Cllr Moloney enquired about credits for a particular domestic consumer where the water 8

supply was regularly unavailable. He agreed to forward details to the DoS, who would follow up with Irish Water.

Riverstown Pumping Station It was agreed to revert to Cllr Hannigan with an update on a sewage issue. Installation of Meters It was agreed to follow up on comments from Cllr Kennedy regarding the replacement of water meters

Environment Burial Charges In response to queries regarding the varying burial charges in the County, Mr. Matt Shortt, D.O.S. confirmed that the harmonisation of charges would be considered by the Strategic Policy Committee during 2016. Control of Dogs Following a request to have dangerous dog breeds banned from public parks and green areas in estates, it was agreed that the matter would be considered by the Strategic Policy Committee. Control of Horses It was noted that there was a single contractor for the collection of stray horse covering the whole County and that the matter was being examined further in a regional context. Pound It was noted that expressions of interest had been sought but no decision on the future development of Kilsheelan Pound had been taken to date. Hazardous Waste Collection Members referred to the success of a recent Hazardous Waste Collection Day. Mr Shortt confirmed that further Collection Days would be considered but there was a significant cost factor to the Council. Litter Control In response to issues raised by members concerning Litter Control, Mr. M. Shortt outlined works carried out by the Environmental Patrol Officers with Communities and Housing Estates with a view to preventing litter and to the success of Civic Amenity Sites. He acknowledged there were difficulties in the issue of on-the-spot fines and prosecutions for fly-tipping. It was agreed to bring suggestions for the control of litter from fast food outlets to the Strategic Policy Committee for consideration.

Housing It was agreed to consider the following motions with this Directorate. Item 8.3 Notice of Motion Motion No. 8.3 (671) in the name of Cllrs. M. Browne, D. Dunne, S. Morris, Leahy Upgrade Older "That this Council draw up a priority list of older housing estates in the County and start work Housing Estates on upgrading them to present standards". The Motion was proposed by Cllr. S. Morris, seconded by Cllr. M. Browne The reply to the Motion was noted as follows:-

The current funding available to upgrade houses is under the Energy Efficiency Programme. The Council has sought funding from the Department in 2016 for completion of phase one works on the remainder of Council stock and to commence phase 2 works on those already upgraded. In response to queries by Cllr Brown, Ms. C. Curley, confirmed that the Council had received an allocation of €400,000 under the Energy Efficiency Scheme and currently had lodged a claim for further funding. It was hoped to receive notification of the allocation shortly.

Item 8.4 Motion No. 8.4 (673) in the name of Cllr. S. Ambrose Notice of Motion "That Tipperary County Council uses the profits from its upcoming tenant purchase scheme Upgrade Works to to carry out immediate upgrade works to its existing Council House Stock through the existing Council replacement of windows and doors, electrical and plumbing upgrades". Housing Stock The motion was proposed by Cllr. S. Ambrose, seconded by Cllr. R. Kennedy The reply to the Motion was noted as follows:- Receipts from the sale of Council houses become part of the Council’s Internal Capital Receipts fund. The Council can then seek approval from the Department on an annual basis for expenditure of these monies under the Housing Programme.

Item 8.5 Motion No. 8.5 (672) in the name of Cllrs. C. Carey, D. Dunne Notice of Motion "That this Council, at a time when social housing lists are at historic heights and emergency Refurbish vacant homeless shelters are bursting at the seams, take action to refurbish and make habitable Social Housing their existing vacant social housing properties where financially feasible, and not allow Properties further social housing to remain idle for more than six months when a vacancy occurs in such properties in Tipperary". The motion was proposed by Cllr. C. Carey, seconded by Cllr. M. Browne The reply to the Motion was noted as follows:-

In 2015 173 vacant houses were refurbished. An initial allocation of €953,882 was received from the Department and in September a further allocation of €428,840 was received.

The Council also invested €500,000 of its own funds in this area in 2015. The total expenditure was then €1.88m. The Housing Section has sought funding for 2016 for the refurbishment of all houses vacant in February 2016 that came within the limit allowed of €30,000. Funding has also been sought separately for houses that would cost in excess of €30,000 to repair.

Item 8.6 Motion No. 8.6 (667) in the name of Cllr. P. English Notice of Motion "That Tipperary County Council request the incoming Government to provide 40,000 social Social Housing housing units over the next 5 years, as there is a record number of 100,000 households on social housing waiting lists nationwide". The motion was proposed by Cllr. P. English, seconded by Cllr. M. Browne The reply to the Motion was noted as follows:- Subject to the approval of the full Council, this motion will be referred to the Department of Environment, Community & Local Government for their consideration and response.

Emergency Accommodation Cllr Morris, supported by Cllr M. Hanna Hourigan, requested that a special meeting be held to deal with homelessness and emergency accommodation issues. This request was supported by a number of members. Mr. Joe MacGrath, Chief Executive, referred to the availability of housing staff to deal with issues and also to the attendance of staff in the Housing Section at Municipal District Meetings to discuss housing issues pertinent to the Districts. He undertook to discuss the holding of a special meeting/workshop as requested by the members with Senior Housing Staff. Mr. A. Fennessy, S.E.O. Housing, in response to queries raised, confirmed that currently there was no person in emergency accommodation due to house repossessions and in the case of a respossession, if the person qualified for social housing, they would be approved immediately as a result of their circumstances. Following further discussion on the matter, it was agreed to facilitate a workshop on housing matters following the May monthly meeting which would be held in committee.

Item 5.3 Ms. Ruth Maher, Information Systems, gave the members a tutorial on a Calendar for Tipperary Festival Festival and Events which was on the www.tipperarycoco.ie website and urged the Calendar members to make committees/community groups in their area aware of this facility. This was welcomed by the members.

Item 6.1 This item was deferred to a future date at the request of ALONE. Presentation by ALONE Item 7.1 Chief Executive and Delegated Officers Orders for the period to 31st March 2016 were Consideration of noted. CE Orders – March 2016

Item 8.1 Notice of Motion Motion No. 8.1 (642) in the name of Cllr. J. Ryan was considered by the Council: Marketing Plan to "I am calling on Tipperary County Council to come up with both a Marketing Plan and promote Tipperary Incentive Scheme to help promote our County as a venue for major music concerts and to as a venue for Music Concerts contact all music promoters such as MCD and Aiken Promotions when these plans are completed".

The reply to the motion was noted as follows:-

Tipperary County Council is currently engaged in developing a marketing destination tourism plan for the County and it is expected that this will be complete by mid-year at the latest. This will be brought through the SPC for Economic Development and the full council in due course

In the context of attracting appropriate inward investment from a business perspective, the Council is also currently preparing to develop an inward investment marketing plan for the County in 2016 and again this will be debated through the SPC for Economic Development.

In the context of the arts, the Council has always supported festivals/events/occasions as it recognises the value that this brings to the County and will continue to do so as appropriate with any groups that wish to engage in this area. Major music events can only occur in certain areas (due to issues around venue size; infrastructural requirements, health and safety requirements etc) and it is appropriate that it is the owner of these appropriate venues who are the key drivers of such initiatives. The Council will continue to engage and support such initiatives where it is appropriate to do so and where it has the funds to support same.

It was agreed that the matter would be brought to the attention of Music Promoters advising of the Council’s support in this regard.

The reply to the motion was noted as follows:-

Tipperary County Council recently prepared a Settlement Hierarchy for the County as part of the preparation of Variation No. 2 of the South Tipperary County Development Plan, 2009 and the North Tipperary County Development Plan, 2010.

The Variation of the County Development Plan(s), as adopted in December 2015, were carried out in accordance with the requirements of Section 13 Planning and Development Act 2000 (as amended) and included an extensive public consultation programme.

The Settlement Strategy, as adopted, recognised the strong urban framework of the County. The role and function of Tipperary Town is consistent with a number of other large towns geographically spread across the county.

The Strategy and associated policies provides a strong framework for attracting investment, and for the economic and social development of the town. Furthermore, the Tipperary Town and Environs Development Plan 2013-2019 sets out a vision and detailed planning framework for the town, and addresses key economic, social and environmental priorities over the plan period.

The Council has agreed a Settlement Strategy, which will support the future balanced growth of the county over the plan period. The Settlement Hierarchy will be reviewed in future years during the preparation of the Tipperary County Development Plan.

Item 8.7 Motion No. 8.7 (668) in the name of Cllr. P. English was considered by the Council: Notice of Motion "That Tipperary County Council request the Minister for Health to recognise the urgent need Acute Inpatient for acute inpatient psychiatric beds for Tipperary following the closure of the 49 bed St. Phychiatric Beds Michael's Unit in Clonmel a number of years ago". for Tipperary

Item 8.8 Motion No. 8.8 (670) in the name of Cllrs. G. Darcy, M. O’Meara, J. Hannigan was Notice of Motion considered by the Council: Constituency Boundary “That, having regard to the very significant dissatisfaction and sense of disenfranchisement by the electorate arising from the recent re-drawing of Dáil constituency boundaries involving the transfer of 24 electoral divisions with a population of 10,953 persons from Tipperary to the Offaly constituency, we the Members of Tipperary County Council request the Chief Executive;

1. To write to the Minister for the Environment, Community and Local Government outlining the extent of dissatisfaction and the adverse impact on the electorate of the division of the county for the purpose of elections to Dáil Eireann and request that he introduce measures, including if necessary legislative measures, to ensure the primacy of county boundaries in the delineation of Dáil constituency boundaries and;

2. To prepare a written submission for consideration by the Members of Tipperary County Council to be made to the next Constituency Commission and following its call for written submissions.

We further request that a copy of this Notice of Motion be circulated to all local authorities whose functional areas are divided by Dáil constituency boundaries”. The Motion was proposed by Cllr. G. Darcy, seconded by Cllr. M. O’Meara

The reply to the motion was noted as follows:-

The review of Dail Constituencies is considered by a Constituency Commission established under Part II of the Electoral Act, 1997. The most recent Constituency Commission reviewed the constituencies for the Dail (and European Parliament) in light of the results from the 2011 census and published its Report in 2012. The task of this Commission was unique in that it was the first Commission to be requested to carry out a review of of constituencies on the basis of a reduced number of members of Dail Eireann.

Subject to the approval of the Council, the motion will be referred to the Department of the Environment, Community and Local Government for their consideration and response.

Pending a request for written submissions from the next Constituency Commission review, a detailed written submission will also be prepared for consideration by the members of the Council.

A copy of the motion would also be forwarded to all similarly affected Local Authorities for their consideration and support.

Item 8.9 Motion No. 8.9 (674) in the name of Cllr. S. Ambrose was considered by the Council: Notice of Motion “What is the latest update regarding the rollout of broadband and improved mobile coverage Rollout of across ". Broadband across County Tipperary 13

The objective of the National Broadband Plan Implementation Strategy is to provide access to high speed broadband (minimum download speed of 30Mbps and minimum upload speed of 6 Mbps) in areas where it is not commercially viable to so. It is proposed to have high speed broadband rolled out to 60% of premises in intervention areas by 2018 and 100% by 2020. The procurement process in ongoing currently with Government approval for contract finalisation and commencement of network build expected by end 2016. The successful bidder(s) will be required to set up an interactive website showing planned deployment on a geographical basis.

Tipperary County Council has previously contacted service operators regarding inadequate mobile telephone coverage. These operators have advised individuals encountering difficulties with coverage to contact the Operator’s Support Team indicating area and citing examples of outgoing and/or incoming calls where signal was poor, calls failed or dropped. The Operator has then investigated the matter as required.
