6 Cullman County, Alabama; and,

7 number two, from all points in one

8 above to points in Jefferson,

9 Madison, Morgan, Blount, Winston,

10 and Walker and return.

11 This application was

12 filed on or about March 16, 2012,

13 and notice of today's hearing was

14 published on April the 11th,

15 2012.

16 Protests in this docket

17 have been received from Ala-Three,

18 LLC, doing business as Express

19 Medical Transporters, and A-Plus

20 Cab, LLC.

21 works down here in Montgomery and

22 probably needs to get back to his

9 Q. Mrs. Dunlap, will you state your full

10 name for the record, please, ma'am.

11 A. Tammy Michelle Dunlap.

12 Q. And are you a resident citizen of

13 Cullman, Alabama?

14 A. Yes, I am.

15 Q. And how long have you been a resident

16 citizen of Cullman, Alabama?

17 A. Was born there. But I've been back in

18 Cullman after living away for the last

19 21 years.

20 Q. And currently what do you do in Cullman,

21 Alabama?

22 A. I own Cullman Massage Therapy.

23 Q. And how long have you owned Cullman

2 A. Since July of 1993.

3 Q. And are you going to continue to own a

4 portion of the ownership in Cullman

5 Massage Therapy after the taxi cab

6 company -- Green Top Taxi is up and

7 running?

8 A. Yes. Yeah. I'm a sole proprietor, and

9 I have several therapists that work

10 there. So I can continue to operate it.

11 Q. And how many therapists do you have

12 currently working for you?

13 A. Two full time and then I have a couple

14 that I call on part time.

15 Q. And how many clients would you estimate

16 that you have at this point in your

17 business?

18 A. Me personally or the business?

19 Q. The business itself.

20 A. Gosh, you know, it can -- we probably

21 have about 3,000 that come off and on.

22 Q. So the business is fairly established

23 over its years; is that correct?

1 A. Oh, yes. Yes.

2 Q. Now, do you have any background in the

3 transportation industry?

4 A. No.

5 Q. Now, can you go into a little bit on

6 your driving record? Do you have any

7 issues with the driving record over your

8 past? Or how is your driving record?

9 A. No. Not at all. I've never had any

10 problem with it.

11 Q. Never had any tickets? Never had

12 anything? Just --

13 A. Just your standard occasional speeding.

14 Ten years ago.

15 Q. Now, with owning the business that you

16 own currently, how -- describe to the

17 Court how you're going to continue to

18 conduct two businesses -- two separate

19 businesses. Can you describe that for

20 the Court?

21 A. Yes. Because I have been in massage for

22 so many years, I've gradually -- you

23 know, you can only do -- massage is such

1 a physical business. You can only do it

2 for so long. So I'm kind of a

3 dinosaur. I've done it longer than

4 most. So I have been gradually moving

5 my clientele over to the younger

6 therapists that work for me.

7 So I also work by appointments. So

8 it's easy to do. That I've gradually

9 taken more and more time away from

10 actually working with my clients. So,

11 you know, I can manage the business and

12 still, you know, not work directly with

13 the clientele.

14 So we have dedicated a room in the

15 building to Green Top. So that's where

16 we actually will dispatch out of.

17 Q. And do you intend to hire any drivers

18 for the operation of the taxis through

19 Green Top?

20 A. We started conducting the interviews

21 together. And then actually -- because

22 Tim's background is transportation, he's

23 the one who had final say on who he

1 really wanted as the drivers. But we

2 settled on -- we have four that we

3 really have leaned toward and then a

4 couple of part-time drivers.

5 Q. So you've got your drivers picked out,

6 and they're ready to go?

7 A. Yes.

8 Q. They just need to hear the word if I'm

9 hired and -- after y'all got your okay,

10 hopefully, from the Commission; is that

11 correct?

12 A. Right. That's all we're waiting on.

13 Q. Now, kind of go into the financials of

14 the business. Do you -- what we need to

15 give for the Court is the information

16 that you're going to be able to continue

17 this business.

18 Y'all obviously -- you've already

19 purchased, is that correct, two taxis

20 for this business?

21 A. Yes. We've already got -- they're

22 completely ready to go, you know, as far

23 as metered. You know, they're painted.

1 The only thing that we'll have to do to

2 have them ready is -- it's my

3 understanding that there's a number

4 that's issued by the PSC that we'll have

5 to add. But other than that, they're

6 ready.

7 Q. I'm going to show you a couple of

8 pictures here that y'all provided to

9 me. If you would, look through these

10 pictures.

11 Is this pictures of the

12 automobiles -- of the taxis?

13 A. Yes.

14 Q. Do they fairly and accurately represent

15 the automobiles as they currently stand

16 today?

17 A. Yes.

18 Q. And are there any other items that have

19 been attached to the taxis since the

20 taking of those pictures?

21 A. No.

22 MR. MEHERG: Your Honor, if we

23 could, we'd like to obviously

1 introduce these and let you look

2 at the automobiles that have been

3 purchased at this point.

4 ALJ MORRIS: Okay.

5 A. The vehicles were purchased outright.

6 There is no -- no liens on them.

7 Q. So nothing is owed on the automobiles at

8 this time?

9 A. No. Right.

10 Q. Currently have y'all opened a bank

11 account for the business?

12 A. Yes, we have.

13 Q. Have you also formed an LLC for the

14 business as well?

15 A. Yes, we have.

16 Q. Currently with the bank account, can you

17 describe for the Court if there's any

18 financial amounts that have been

19 contributed to the account?

20 A. We opened the account with $20,000. The

21 only amount that's come out of it was to

22 purchase the business checks, which was

23 like $60.

1 Q. And can you describe to the Court how

2 this business is going to continue well

3 after the $20,000 has been exhausted?

4 A. Well, what we're looking at -- because

5 we have done our research, you know, and

6 our marketing strategy. So we expect

7 the business to do well.

8 Because our drivers are going to be

9 based on a -- paid on a per-mile basis.

10 So it's not like the drivers are going

11 to be drawing a salary without -- if

12 there's no work.

13 We, of course, as the business

14 owners -- we have salaries from other

15 areas. So we're not going to be --

16 we're not going to have to take anything

17 from the business if the business is not

18 making money.

19 Q. Now, currently on the automobiles -- do

20 you have insurance on the automobiles?

21 A. We do.

22 Q. And I'm going to show you also another

23 document.

2 insurance for Green Top Taxi?

3 A. Yes.

4 Q. And does that accurately reflect the

5 amounts of insurance that have been

6 taken out for the taxi service?

7 A. Yes, it is.

8 MR. MEHERG: All right. I'd

9 also like to introduce this as

10 well as proof of insurance for the

11 automobiles.

12 Your Honor, I don't have

13 any further questions of

14 Mrs. Dunlap at this time.

15 However, I'd like to reserve the

9 BY MR. MEHERG:

10 Q. Mr. Dunlap, would you state your age for

11 the record?

12 A. Fifty-two.

13 Q. Fifty-two.

14 And can you state your current

15 health at this time?

16 A. All right. Health is excellent.

17 Q. Health is excellent.

18 All right. Mr. Dunlap, would you go

19 into some of your experiences and your

20 business past with the Court, please,

21 sir?

22 A. Okay. After graduating college, I

23 entered into a family business of

1 celebrity entertainment transportation.

2 Prior to the graduation, I did a --

3 financed my school needs by driving

4 chartered buses on the weekends my final

5 year of college.

6 My experience was spend many weeks

7 and months touring with bands. And

8 because it was a family business, as I

9 grew into the business, tours would go

10 out with multiple buses.

11 I was chose as what they called a

12 lead driver. I would police the other

13 drivers. I would casually interview the

14 passengers on other buses to make sure

15 that they were properly keeping their

16 buses clean, their driving skills were

17 not abusive or disrupted to their sleep

18 or their rest.

19 And this -- now, over 27 years, the

20 last four years -- because of my trust

21 and the ability that people in the

22 industry has recognized, I've been

23 employed for four years by Dolly Parton

1 as her personal driver.

2 Q. So you currently drive for Dolly Parton,

3 and you're her sole transportation when

4 she needs to go somewhere?

5 A. I am.

6 Q. And you've been doing that for the past

7 four years, correct?

8 A. Yes.

9 Q. Is that job -- will it interfere at any

10 point in time with the taxi company,

11 Green Top Taxi?

12 A. No, it will not.

13 Q. And can you describe for the Court how

14 often you have to drive for Dolly

15 Parton?

16 A. Usually I'm sent a schedule from her

17 office. I have never been contacted to

18 leave earlier than a two-week notice.

19 Such as this year, I have left the

20 house three times, for a total of 15

21 days away from home. My next scheduled

22 drive is May 11th. And on the calendar,

23 my next scheduled drive is October 21st

1 to Las Vegas.

2 These schedules are sent to me.

3 I've never asked if -- or called to ask

4 if I remember or -- I have been totally

5 trusted to show up and never been late.

6 And obviously my cargo is very

7 precious, and I feel very flattered the

8 trust they do put into me. At the same

9 time as her private coach.

10 And so my other duties are to make

11 sure that it is -- service logs are kept

12 up. I am the sole person to make sure

13 the bus is maintained and ready to

14 operate whenever she's ready to go.

15 It's a to-go readiness at all times.

16 Q. So you're well aware of the needs of the

17 transportation business; is that

18 correct?

19 A. Yes, I am.

20 Q. And you've been in the transportation

21 business for 20-plus years; is that

22 correct?

23 A. Yes, I have.

1 Q. Now, are you also under the same idea

2 that Mrs. Dunlap is; that you are also

3 going to have drivers that you're going

4 to hire along with the business? Is

5 that what I've understood?

6 A. Yes, I am.

7 Q. And are you also under the same idea

8 that y'all have the financial ability to

9 continue this business throughout?

10 A. Absolutely.

11 Q. Even through tough times; is that

12 correct?

13 A. Yes, that's correct.

14 Q. And at this point in time, do you know

15 of any transportation service that's

16 provided in Cullman, Alabama?

17 A. No, I do not. Other than the CARTS

18 public service. It's a city and

19 county --

20 Q. Can you describe to the Court what CARTS

21 covers?

22 A. CARTS covers the city of Cullman and

23 county on -- for the elderly, the people

1 that cannot personally transfer

2 their self from curb to vehicle, and

3 also -- as well as the mentally

4 challenged.

5 CARTS runs on a -- five days a

6 week. No weekends. It must be

7 scheduled a day ahead of time. And

8 their fares are $1 per trip.

9 It's a good program, but finds to be

10 somewhat inconvenient at times for

11 people needing a ride. And those rides

12 that you do get on the days that you're

13 scheduled, it's -- you may wait, or you

14 ride the bus until they pass the point

15 along with the other passengers that you

16 are needing to be dropped off at.

17 Q. And you have to book those out days in

18 advance in order to get --

19 A. You have to book at least one day in

20 advance.

21 Q. And are y'all looking to provide a

22 service for individuals who call you up

23 and need to go somewhere immediately

1 that y'all can provide?

2 A. Absolutely. Yes. We plan on working a

3 24/7, 365 day business.

4 Q. If the Commission -- if they pass your

5 proposed application, are you willing to

6 provide -- or to comply with all rules,

7 regulations, and requirements that the

8 Commission may require you through the

9 code sections?

10 A. Absolutely.

11 Q. Now, are you aware of any bus or any

12 other type of line of transportation in

13 Cullman?

14 A. No, I am not.

15 Q. Are you aware of any city school

16 transportation for children that are

17 unable to transport themselves to and

18 from school?

19 A. There is none.

20 Q. And are y'all willing to provide a

21 service in order to transport

22 individuals back and forth through

23 Cullman in a safe and timely manner?

2 MR. MEHERG: Your Honor, I

3 don't have any further questions

4 at this time, unless you'd like to

5 ask a couple of questions.

6 ALJ MORRIS: I just have one.

7 Mr. Dunlap, are you

8 familiar with the rules and

9 regulations of the Public Service

10 Commission?

11 MR. DUNLAP: I have read the

12 rules and regulations. And to the

13 best of my knowledge, have tried

14 to understand and be able to

15 comply with the requirements for

16 lettering and operating the

17 vehicles. Yes.

18 ALJ MORRIS: And it is your

19 intention to abide by those rules

20 and regulations?

21 MR. DUNLAP: Absolutely.

22 ALJ MORRIS: Just one

23 question. How do you intend to

1 handle the maintenance on your

2 vehicles?

3 MR. DUNLAP: We have a couple

4 of independent garages. We have

5 one tire service that I have known

6 for years that I have already

7 spoke to to handle all of our tire

8 alignment, brake needs.

9 There's another garage, a

10 Williams NAPA. It's strictly

11 electronic and electronic repair.

12 And he also has been a long-time

13 friend and a very prominent and

14 well thought of mechanic and

15 garage.

16 As far as the maintenance

17 records and all, those will be

18 handled and the vehicles will be

19 inspected myself on a weekly

20 basis.

21 And drivers, under our

22 driver protocol, are to report any

23 mechanical defects to me on a

1 daily basis that they suspect.

2 ALJ MORRIS: That's all I

3 have.

4 MR. MEHERG: Your Honor, I

5 don't know procedurally how y'all

6 are going to issue an opinion or

7 whatever. But there are some

8 events that are coming up, and I'd

9 like to see if they could get some

10 type of -- maybe a go-ahead and

11 say, hey, you can go ahead and

12 operate.

13 ALJ MORRIS: Well, normally

14 what happens is, I would issue a

15 report and recommended order. But

16 because there are no protests, you

17 can waive that, and that certainly

18 expedites the process. And we

19 will endeavor to get this on the

20 next available Commission meeting

21 docket. If you would like to

22 waive the report and recommended

23 order --

1 MR. MEHERG: Absolutely. I

2 mean, anything that we can do to

3 speed this thing along.

4 I think there was some

5 other individuals before us that

6 had a hearing, and they're from

7 Cullman as well.

8 So if we can speed this

9 along. We need to get them up and

10 running. I think there's a

11 concert this weekend they're

12 having in Cullman, and there's

13 going to be a lot of individuals

14 there. They'd love to be able to

15 help those people get back and

16 forth.

17 ALJ MORRIS: Well, you know,

18 anything within the city itself is

19 nonjurisdictional to the

20 Commission. As long as you're in

21 the police jurisdiction of the

22 municipality, that is not

23 Commission jurisdiction.

1 So you can pick people up

2 in Cullman. And as long as you're

3 okay with the city and have your

4 proper city licenses, that is not

5 jurisdictional to the Commission.

6 It's only when you get outside of

7 that police jurisdiction area.

8 Say you were going over

9 into another county or into one of

10 the unincorporated areas in

11 Cullman County. That trip is

12 jurisdictional to the Commission.

13 MR. MEHERG: So they've got to

14 stay just within the city limits?

15 ALJ MORRIS: Well, within the

16 police jurisdiction, which I'm

17 sure Cullman is probably big

18 enough that that extends out three

19 miles beyond the --

20 MR. MEHERG: City limits?

21 ALJ MORRIS: -- the city

22 limits.

23 But I would -- yeah. I

1 can say that this weekend is --

2 there's no way we can do it that

3 quick. But we may be able to get

4 it on the May agenda, which will

5 be next week.

6 MR. MEHERG: One of the things

7 I would like to -- for the Court's

8 purposes real quick -- I know that

9 you've heard plenty of testimony.

10 We have several endorsements, if

11 the Court would like to have these

12 as well.

13 ALJ MORRIS: We can't -- well,

14 normally we can't accept those

15 because they're not here.

16 MR. MEHERG: Right.

17 ALJ MORRIS: But we don't have

18 any -- we don't need those for the

19 record. You're fine.

20 MR. MEHERG: Good. Thank you.

21 ALJ MORRIS: With that,

22 just -- once you do get the order,

23 you'll have three -- there are

1 three requirements. You're going

2 to have to get registration

3 numbers for the vehicles, which is

4 separate from your PSC number.

5 You will need to file a Form E,

6 which is something above and

7 beyond the proof of insurance.

8 There's actually a Form E that

9 needs to be filed by your

10 insurance company. That's a

11 binder between the insurance

12 company and the Commission. And

13 you will need to file your tariff
