Summary

In September to October,2020, External Monitoring Unit of Hanbin District Subproject under the Shaanxi Mountainous Road Safety Demonstration Project (the Monitor) carried out external monitoring of Phase VII in project affected area. The monitoring period is from September 2019 to September 2020. This external monitoring scope involved 3 towns and 10 administrative villages/communities that are affected projects. This monitoring survey was conducted with the well-developed global participatory monitoring method in recent years, namely, establishing the project monitoring and consulting group, and in combination with the conventional monitoring methods, including field exploration, in-home survey and dictation record, arrangement of villagers discussion, visit of related authorities, consultation and collection of statistical materials, local chronicles, statutes documents, etc. By September 30, 2020, the relocation within the red line of the Hanbin Project has been completed. For G316 Hanbin Section, 1335 persons in 320 affected households have signed the agreement on relocation, in which, 98 persons in 22households are both affected by land acquisition and house demolition. The compensation fund has been paid to the affected persons who have signed the agreement on relocation. Actual compensation standard was formulated based on the principles in RP and shall not be less than that in RP. By September 30,2020, G316 Hanbin section totally involved the acquisition of collective land of 175.548mu and did not involve state-owned land. A compensation fund of CNY 9.22338 million for land acquisition and ground attachments has been paid. G316 Hanbin Section involved the relocation buildings of 4197.49m2 accumulatively, including 2695.39m2 of Brick-concrete houses, 1236.87m2 of Brick-wood houses, 127.5m2 of Earth-wood houses and 137.73m2 of Make-shift houses. The relocation agreement has been signed with 22 households with compensation amount of CNY 4.17668 million which had been paid to the affected persons totally. 21 affected households selected local settlement and one household selected the resettlement in Qingshuiwan Community. By September 30,2020, Yandong Road only needs to compensate for young crops and ground attachments because the ownership of land is not changed, which is detailed in section 2.4.4. Besides, the Hanbin District Project Management Office (HDPMO) has signed land use agreements with 91 affected households which stated the land is used free. Yandong Road involved the demolition of 1201m2 of houses with 12 AHs. All 12 households have been relocated, with one household choosing centralized resettlement and moving to a new house, and 11 households choosing scattered resettlement. By September 30,2020, In the -Xunyang Highway Project (G316), a total of CNY 13.400064 million has been paid for land acquisition, demolition compensation and ground attachments, and CNY 365,300 for special structures; CNY 3,411,174 for Yandong Road Project, and CNY 450,000 for special structures. Hanbin District Project paid a total of CNY 17,626,538 for compensation. Two village rods in Hanbin District, namely Zhaobao to Yousheng Village Road and Zabao to Wujiashan Road, have hold the villager’s meeting before starting construction, and the affected people signed the agreements that the land is used free. The process of free use of land was detailed in the latest DDR. No temporary land acquisition is involved.

In this monitoring, there was no major adjustment in the institutional setting and personnel in the HDPMO, and the work was carried out orderly. In this monitoring, the HDPMO did not receive any writing or systematic complaints.

1 Project introduction and implementation progress

1.1 Project Overview 1. The primary objectives of the road rehabilitation components are threefold: 1) to upgrade network capacity for an expanding transport volume in the area, 2) to provide all-weather access to the village and county roads that connect to the trunk roads, and 3) to improve the road safety condition of these rehabilitated roads and an additional 660 km of rural roads.

2. The Project comprises four components.

1) Component 1: Rehabilitation of 193km arterial highways, including 60.25 km of S102 Xunyang – Xiaohe Highway, 34.39 of G316 section from Xunyang – Ankang City Center Highway and 92.41 km S224 Chengguan Town – boundary of Shaanxi and Hubei provinces.

2) Component 2: Upgrade of 8 rural roads with the total distance of 139.656km, including three township roads in Xunyang County, Hanbin District and Shangnan County and five village roads in Xunyang County and Hanbin District.

3) Component 3: Improvement of the road safety of Component 1 and 2 and other road sections of about 660 km.

4) Component 4: Capability building and agency development, with the focus on the systematic capability of Shaanxi Provincial Transport Department related to road safety.

3. The project will benefit 1.7 million local people from the 3 project counties and districts (Xuyang County, Shangnan County and Hanbin District), and many more from the neighboring provinces and counties. Among the 1.7 million beneficiaries, rural and urban residents account for 78% and 22% respectively. 1.1.1 Hanbin District Subproject

4. Hanbin District Highway Road Subproject (the Subproject) includes four roads – (1) reconstruction of G316 between the Xunyang County border to Hanbin District in Ankang City (hereinafter called G316 Hanbin Section); (2) rehabilitation of Yanba Town to Dongqiao Village highway (hereinafter referred to as Yandong road); (3) rehabilitation of two village roads such as Zaobao to Yousheng highway (hereinafter called Zaobao-Yousheng Road and Zaobao-Wujiashan Road), with total construction length of 34.886km.

5. G316 (Hanbin Section) is a reconstruction project for secondary road G316. It starts from Lvhe Town in Xunyang County, enters Hanbin District via Lijiazhuang Village, Xuejiawan Village, Duanjiahe Village, Gaobiliang Village, and Bei’an Village in Xunyang County, and leads to the end of Hanjiang River Bridge in Jinxing Village via Longquan Village, Zaoyang Village and Dongwan Village in the west.

6. Yandong Road is a reconstruction project for a grade-4 highway from the central community of Yanba Town in Hanbin District to Dongqiao Village. It starts from Yanba Town, is connected to Jihe-Yanba Highway, and ends at Dongqiao Village of Yinghu Town via Heihu Village, Tangtai Village and Guiping Village, forming a T-shaped intersection with S207. Its total length is 10.699km.

7. Zaobao-Yousheng Road is a reconstruction of village road from Zaobao in Hanbin District to Yousheng Village. With the starting point of K0+000 (K13+020 of Gaoju-Zaobao Highway), it goes around the mountain and ends at K4+156.675 in Yousheng Village. The total length is 4.157km. This project is an extension highway, with design speed of 15km/h and 10km/h for special section.

8. Zaobao-Wujiashan Highway is a reconstruction of village road. With the starting point of K0+000 (K12+360 of Gaoju-Zaobao Highway), it goes around the mountain and ends at K4+318.737 in Wujiashan, with the length of 4.319km; the branch starts from K1+525 of main line, goes around the existing village road, and ends at K5+016.138 across the bealock at K3+700, with the length of 5.016km; the whole length is 9.335km. The project is an extension highway, with design speed of 15km/h and 10km/h for special section.

1.1.2 Project implementation process

9. As of September 30, 2020, with the exception of HB01(Yandong Road), all civil work contracts have been completed. HB01 has completed 96%. 1.1.3 Executing and implementing agencies

(i) Shaanxi Provincial Project Leading Group (SPPLG) and Its Office (SPPO)

10. SPPLG is the leading agency responsible comprehensively for the overall deployment of the Project and solving major issues. The group will include Comprehensive Planning Division and Road Management Division lead by a deputy director of Shaanxi Provincial Transport Department.

11. SPPMO in Foreign Funds Financed Project Office (FFPO) is the working body of SPPLG as coordinating agency in charge of applying for ADB loan, coordinating the formulation and implementation of RP, monitoring and evaluation of the RP implementation, including funds flow of compensation of LA and HD.

(ii) Hanbin District Project Management Office (HDPMO) 12. Hanbin District People’s Government is the implementing agency of this Subproject, and the project leading group consists of heads from relevant bureaus, including transport bureau, land and resources bureau, resettlement bureau, development and reform bureau, etc. Hanbin District Project management Office (HDPMO) set up under project implementing agency that is located at Hanbin District Traffic Transport Bureau, and is responsible for the project management, coordination, supervision, direction, quality assurance and annual planning, and the follow-up monitoring of the implementation, reporting to Shaanxi Provincial Project Leading Group regularly. The main responsibilities in resettlement include organizing the resettlement work of the project, developing the local policy on resettlement activities, coordinating relations among resettlement agencies at all levels, coordinating the work of the bureaus concerned at the preparation and implementation stages, and making decisions and consultation on major issues arising from construction and resettlement.

(iii) Hanbin District Project Resettlement Office (HDPRO)

13. The SCPMO, consisting of 4 persons, responsible for identifying and confirming the quantity of land acquisition and house demolition, special facilities and ground attachments, conducting the DMS and saving data; assisting in preparing the RP and implementing RP; selecting resettlement officials for operational training; organizing public consultation, and communicating resettlement policies; directing, coordinating and supervising LA and resettlement activities and progress; disbursing resettlement costs according to the agreement and handling grievances of APs; assisting and supervising the affected villages carry out economic rehabilitation plans and ensuring the income restoration of the affected people; carrying out internal monitoring, preparing internal monitoring reports and reporting to Hanbin PMO. (iv) Town/township Government

14. The town/township resettlement offices, headed by each Town/township leader are comprised of key officials of the land and resources office, police office, civil affairs office and village committees. The main responsibilities are:

 Participating in the survey of the project and assisting in the preparation of the RP.

 Organizing public participation, and communicating the resettlement policies;

 Implementing, inspecting, monitoring and recording all resettlement activities within the town;

 Settling the house demolition and reconstruction;

 Responsible for the disbursement and management of land compensation fees;

 Supervision of LA, HD and house restoration;

 Reporting LA, HD and resettlement information to the SCPMO;

 Coordinating and handling conflicts and issues arising from its work. (v) Village committees and village groups

15. The resettlement working team of a village committee or village group comprises its key community leaders and representatives of APs and with authorization of villagers’ convention. Its main responsibilities are:

 Participating in the socioeconomic survey and DMS;

 Assisting in preparing the Relocation and Resettlement Plan;

 Organizing public consultation, and communicating the policies on LA and HD;

 Organizing village meetings in discussing the proportion of compensation distribution to APs and supervision of the use of reserved funds in a village if any,

 To choose resettlement sites and distribute housing land for relocated families; Helping APs to get house construction approvals,

 Organizing the implementation of agricultural (including reserved land distribution) and nonagricultural resettlement activities;

 Reporting the APs’ opinions and suggestions to the relevant authorities;

 Providing assistance to relocated households with difficulties, particularly the vulnerable families

 Supervising land acquisition, housing and ancillary facilities demolition and reconstruction;

 Reporting the progress in land acquisition and resettlement;

 Preparing clearance letter to confirm the facility and infrastructure restored and meet their requirement. (Vi) Internal supervision agency 16. HDPMO set up an internal supervision office for land acquisition and resettlement, consisting of 2 persons. The duty of the office is to guarantee all the land acquisition and resettlement officers can fulfill their tasks, carry out the requirements of the RP, and guarantee all the affected people can get their rights and interests. (vii) External independent monitoring and evaluation agency

17. HDPMO (Shaanxi Hanbi Transportation Bureau) entrusted Shaanxi Kexin Consulting Company as the external monitoring and evaluation institution of Shaanxi Mountainous Road Safety Demonstration Project (Hanbin District Project). The main responsibility includes:

 Monitoring all aspects of resettlement planning and implementation, as an independent M&E agency, conducting base-line surveys, monitoring and evaluating the effectiveness of resettlement and the social adaptability of the APs, including women and vulnerable APs, and submitting M&E reports to SPPMO and ADB semi-annually;

 Providing technical advice to HDPMO and related agencies in resettlement implementation, data collection and processing, and so on.

1.2 Affected area

18. The impact of land acquisition and demolition of the project involves 3 towns and 8 administrative villages/communities. See Table 1-2 for details. 2 Monitoring on project LA and HD 2.1 Monitoring procedure

19. The external monitoring was conducted by Shaanxi Kexin Consulting Company (the Monitor) that was entrusted by Shaanxi Hanbin Transportation Bureau. Since then, the monitoring activities were conducted as follows:

 From August to September 2016, the monitor prepared the baseline report for impacts, payment and compensation of land acquisition and house demolition, and the procedure of contract signing at each step.

 From July 2016 to August 2019, the monitor had carried out resettlement monitoring activities and submitted 6 monitoring and evaluation (M&E) reports to ADB.

 From August to September to October 2020, the Monitor carried out the external monitoring of Phase VII from September 2019 to September,2020, focusing on the investigation of affected degree, compensation standard, payment, working progress as well as appeal and processing results of land acquisition and house demolition of affected villages and households. Meanwhile, the monitor systematically investigated the economic profile and development level of affected area and held the discussions with relevant departments of local government in certain area. 6 administrative villages/communities in 3 towns affected by the project are totally involved in the scope of this external monitoring. 2.2 Investigation methods 20. The following methods were adopted to conduct this monitoring:  review of records, such as LA and HD agreement, project documents, and the like,

 site visits and observations made that were substantiated with photos,

 Interview and consultation with affected people;

 based on the above analyze the RP implementation progress and effectiveness by using both quantitative and qualitative evidences.

2.3 LA and HD Status

21. The subproject refers to road construction, and the layout is characterized by linear distribution. Therefore, the project appears as vast affected area and sporadic land occupation. The LA&R is relatively scattered, and the quantity of LA&R is not huge. Project LA&R started to be implemented in August 2016. Relocation agencies of project LA&R counted and registered the affected quantity and varieties of the project, which has been confirmed in baseline report of resettlement for the subproject. The monitor conducted monitoring and evaluation on the implementation of land acquisition and house demolition for the seventh time that the period is from September 2019 to September 2020, and updated and confirmed the affected quantity of land acquisition and demolition made so far.

2.3.1 Land Acquisition

22. By September 30, 2020, the accumulative collective land acquisition of the G316 Hanbin Section was 175.548 mu, including homestead 7.243 mu, dry flat land 55.035 mu, dry slope land 65.901 mu, and forest land 47.399 mu. See details in Table 2-1.

The land acquisition for project of Yandong Road involved and affected Dongqiao Village and Central Community, occupying 145.61 mu of collectively owned land, including 84.4 mu of dry-land and 57.21 mu of forest-land with 91 affected households in total. After a negotiation with the cadres and villagers' representatives from the two affected villages/communities, the final decision was that the ownership of the land occupation for the road construction is not changed and still belongs to the village collective, the young crops and ground attachments on the land were compensated according to the compensation standard stated in the updated resettlement plan. The Appendix 3 is the scanned copy of the confirmation letter of Dongqiao Village and Central Community on the land use for Yandong Road, which was signed or stamped by village committee, village cadres, villagers’ representatives, women representatives, representatives of low income households and functional departments. 24. In July 2019, 91 affected households all signed the land use agreement with PMO that they contributed the land free for road construction. See Appendix 4 for the sample of 8

land use agreement, and for the scanned copy of the land use agreement without compensation signed by the affected persons.

25. The total length of two village roads (Zaoboa-Yousheng road, and Zaobao-Wujiashan road) is 13.492km. Because of the administrative division adjustment, the original affected villages, Yousheng Village, Maliu Village and Gaoju Village were merged, and renamed as Gaoju Village. Therefore, the subproject only involved Gaoju Village. The reconstruction of two village roads totally occupied 45.5 mu of collectively owned land, including 8.7 mu of sloping field and 36.8 mu of forest, affecting 18 households. According to the requirement of “One discussion over each matter” stated in the management method of Hanbin District village road, in April 2019, HDPMO organized a villagers’ meeting in Gaoju Village before road construction commencement, all the participants supported the road construction and agreed to contribute the land without compensation. They hoped the project could be finished as soon as possible, and it would be more convenient. At the meantime, the affected persons were asked to sign for their own opinions. See Figure 2-1 for the meeting minutes and the signature for confirmation.

2.3.2 House Demolition

26. By September 30, 2020, accumulative demolished buildings by Hanbin section of G316 was 4197.49m2, including 2695.39m2 of Brick-concrete houses, 1236.87m2 of Brick-wood houses, 127.5m2 of Earth-wood houses and 137.73m2 of Make-shift houses. There were 1201 m2 for demolition in completion of Yandong road, in which, the area of brick-concrete house was 457.2 m2, the brick -wood house was 397.6m2, and earth-wood house was 346.2m2. 2.3.3 LAR Impact status

27. By September 30, 2020, for Hanbin Section of G316, 1335 persons in 320 households have signed the LA agreement and obtained the compensation funds. 98 persons in 22 AHs by HD have signed the agreement and obtained the compensation funds. All 22 households have been resettled, of which 21 were scattered resettlement and one was resettled in Qingshuiwan Residential Area. 28. Yandong Road affected 53 persons of 12 households by HD. All 12 households have been resettled. One of them chose centralized resettlement and has moved into a new house, and 11 households chose local resettlement. See detailed in Table 2-4.

2.3.4 Compensation standard of LA & HD

29. A. The compensation for all Land Acquisition will follow these principles:

The following contents are added for compensation standard of homestead in the resettlement plan.

31. B. The compensation for all houses demolished will follow these principles:

1) Compensation will be given in the principle of compensation for demolished houses and compensation for relocation household with same structure, same area and same location regulated in RP. The affected persons shall receive full replacement cost without depreciation for the original house. Meanwhile, the affected persons can use the building materials of the original house free of charge/cost.

2) Villagers who lose houses will get homestead from their villages, centralized settlement, requesting for the construction arranged by town/township or village, and scattered settlement or settlement by using compensation expense and moving cost themselves will be the choice. Relocation households will obtain temporary transitional expense before moving into the new houses. They can also arrange themselves or ask the village or PMO to assist in rental houses for them.

3) Affected houses cannot be demolished before new houses are prepared or agreement is signed with new homestead/apartment unit: before new houses are constructed or transitional houses are provided, original houses cannot be demolished. Transitional period is calculated as 10 months, and it can be automatically postponed to the date of delivery for placement houses. The affected households will obtain transitional expense before moving into the new houses. If some families have troubles when moving, the village committee and the PMO will offer assistance in transportation. For families who have difficulties in searching transitional houses, the village committee and the PMO will provide assistance in leasing.

32. The implemented compensation standard for LA&R shall not be less than that in RP. See details in Table 2-5.

2.4 Temporary land occupation

33. As of September 30,2020, G316 Hanbin Section and Yandong Highway project has no temporary occupation land involved.

2.5 Ground attachments

34. During implementation, after detailed verification and confirmation with affected person, the ground attachments have been compensated based on market valuation according to the principles in the RP.

35. According to the actual situation on site, SDPMO first confirmed the species and quantity of land attachments with the affected people, then the affected people confirmed by signing their name on the confirmation sheet. After the compensation fund is in place, the affected people can get the compensation by signing their name to confirm according to the quantity confirmed.

36. Compensation for ground attachments has been included in the land acquisition compensation agreement, and fully paid. 2.6 Affected vulnerable groups

37. The vulnerable groups affected by the G316 Hanbin Section mainly include the elderly with no other supporting family members, single-mother families, orphans, family under MLSS, the disabled, poverty families, etc. The project of Ankang-Xunyang Highway and Yandong Road affects and involves vulnerable groups in total of 39 households and 136 people. According to poverty standard that Hanbin District annual income is less than CNY 3,800 in Hanbin District, 39 households belonging to vulnerable groups are poor households.

38. According to the survey, poverty is caused by: (1) Harsh living and production conditions due to geographical location, such as high mountain, poor soil, cold and dry weather; (2) low value-added grain dominated production model due to remote geographical location and poor road condition; (3) Lack of skill – limiting access as migrant labor seeking outside non-farming waged jobs; (4) lack of information; and (5) illness or disability or too senior.(6) Because the kids attend school, tuition fees and living expenses cause a huge burden to the families.

39. Project implementation institution (namely Hanbin District People’s Government) implements the support policy for vulnerable groups. Based on the investigation, the project affected households affirmed as poverty households by Hanbin District Peoples’ Government will be included in the scope of poverty alleviation policy and can enjoy the assistance policy below:

1) Credit loan for poverty alleviation. The poverty households enjoy a loan below CNY 50 thousand within 3 years without guarantee and mortgage, with full interest discount. The poverty households enjoying soft loan can settle the interest as scheduled and the interest discount fund is distributed to the household with “”one-card; and the loan interest discount support for another three years will be continued to the households out of poverty through industry development. Loan

interest will be directly subsided and deducted from poverty alleviation fund by financial department as quarters.

2) Medical subsidy policy. Poverty households enjoy outpatient coordination subsidy, outpatient chronic disease allowance, hospitalization subsidy, insurance subsidies for major diseases and poverty family-planning family entrepreneurship subsidy and rural medical assistance, etc.

3) Education subsidy. School children of poverty households enjoy pre-school education grants, subsistence allowance for poor boarders during compulsory cycle, students subsidy for the students in ordinary high school with economic difficulties, poverty alleviation assistance for vocational students in poverty households, poverty alleviation support for higher vocational students with economic difficulties, university grants, students loan and other subsidy policy.

4) Resettlement. The project provides priority to the resettlement intention of poverty households.

5) Training. Poverty households participate in industrial skill training and obtain crop seeds and livestock cub for free.

40. On the whole, the support policy for vulnerable groups carried out by the project or local government can provide the poor households with the support in health care and assistance, subsidized loan, resettlement and skill training, etc. for children of poverty households. In the long term, the aid fund enjoyed by affected poor households is far more than 1% of basic charge specified in RP.

3 Land acquisition, house demolition and resettlement 3.1 Impacts and cost of LA & HD

41. As of September 30, 2020, 175.548 mu land has been acquired by G316 Hanbin, 320 households with 1335 persons have signed the land acquisition agreement and has obtained the compensation fund. The agreement with 22 households on house demolition has been signed and the compensation fund has been paid. Among 22 households affected by house demolition, 21 households selected local settlement and one household selected the resettlement in Qingshuiwan Community. The total expenditure incurred in G316 Hanbin section was about CNY 13.76536 million, among which, CNY 9.22338 million was paid as land acquisition and ground attachments compensation, and about CNY 4.17668 million was compensation for house demolition,CNY 365,300 for special structures.

42. From September 2019 to September 2020, a total of CNY 1,140,000 was paid for compensation. All 12 households have completed resettlement, of which, two households have rebuilt their houses and moved into new homes, one household has moved to a centralized resettlement building, and the remaining nine households whose non-residential houses were affected were compensated in monetary. A total of CNY 3,411,174 million was paid for ground attachments, relocation compensation and other resettlement expenses, and CNY 450,000 was paid for the relocation of special structures. see details in Table 3-1.

43. Collective land acquisition was carried out based on the agreement of land acquisition and house demolition agency, the affected village (group) and the affected person; the house demolition was carried out through negotiation of land acquisition and house demolition agency and affected person.

3.2 Resettlement plan and economic recovery measure

44. Field surveys revealed that most of the affected houses had potential safety hazards and were out of repair, and had worse water, electricity supplies and road accessibility, and poor surrounding area sanitation. According to the principles of replacement cost and no depreciation, most affected persons thought that the compensation based on the standards in the RP was reasonable. The subproject also provided several options for APs to choose based on their own conditions, which positively facilitated to restore or improve their living condition smoothly. The major options included: (1) Cash Compensation without housing plot allocation a) Cash compensation for new house purchased voluntarily

45. For those households with alternative houses in the city or nearby places or who plan to buy commercial residential house in town and then to give up reconstructing new houses, a written application is required. In addition to cash compensation of housing lot and replacement price of house structure including annex buildings paid in cash to AH directly, an additional resettlement subsidy of CNY 10,000~45,000 per person will be granted once the written application is approved. b) Cash compensation with existing house expanding or rehabilitation

46. Households with an existing house have potential to add more floors, or where the housing plot is big enough to add an annex building, the AP does not need another housing plot. If APs choose this option, a written application is required. In addition to cash compensation of housing lot and house structure including annex buildings, an additional resettlement subsidy of CNY 10,000 ~ 45,000 per person will be granted once the written application is approved. (2) Centralized relocation in “Village development planning of new village”

47. For those who are willing to purchase new houses on residence zone based on village development planning of new village, cash compensation for homestead and replacement price will be paid to AH directly. In addition, discount has been negotiated completely and corresponding commitment has been made. On the whole, both location and quality of house are better than that of planned demolition house. House price committed is CNY 1,000-1800/m2, which is only construction cost and meets demolition compensation standard confirmed in the resettlement scheme as well as is far below the price of congeneric commercial housing residential. AF accepted survey believed that such arrangement is quite reasonable and acceptable. (3) Individual reconstruction on the government allocated housing site

48. If the households have difficulties finding a housing plot, but still want to reconstruct their new houses, the town government has committed to provide the AHs with housing plots acceptable to them. The price will not exceed the compensation standard regardless of actual costs (no matter how much the cost is). There will be no additional cost to the AHs.

49. The provided housing plot can either be in a concentrated area or a single housing plot. In any case, water, electricity supply and road facility will be made available, and

the land leveling will be done by the project. The design fee also will be covered by the project.

(4) Economic recovery and development plan

50. For households affected by land acquisition house demolition, all affected villages implemented economic recovery plan, which provided effective support for economic recovery of people affected by land acquisition and house demolition; for example, after implementation of the project, small amounts of land were expropriated, economic recovery was intensively carried out in affected villages. Currently, each village has formulated economic recovery plan, striving project implementing agency to provide support for recovery and development of the local economy. Economic recovery and development plan mainly included: 1) Strengthen agricultural science & technology education, improve labor productivity skill and labor quality. The measure has been put into implementation. 2) Actively organize surplus labor and participate in labor service export of project construction to increase income. As of September 30,2020, there were 1815 local labors participating in the project construction, including 175 affected persons, 266 persons from poor households, 387 women and 1318 local farmers. It was roughly calculated that each person can get CNY 50 to 150 per day as remuneration, thus bringing an extra income for their families, and the income is much higher than that gained from agricultural production. 3) Assist relocation households in engaging in tertiary industry and increase approach of economic sources. The measure has been put into implementation. If needed, the affected households can apply for government assistance. 4) Reform surplus land and increase output value of unit land. The measure is being carried out by District Government in a unified way. 5) Promote the circulation of agricultural and sideline products and increase the income of agricultural and sideline products. The measure is being carried out by District Government in a unified way. (5) Training

51. In June 2020, the Project Office cooperated with relevant government departments to carry out centralized training in Zaoyang town, including flue-cured tobacco planting and management, pepper planting and management, and APP evaluation of “Yunshang Zhinong”(Cloud Intelligent Agriculture). A total of 40 people attended the training, including 23 women.

52. Since the implementation of the project, a total of 14 trainings have been conducted in the project-affected villages and towns, including training in planting technology, breeding technology, employment skills, and other types of training. The cumulative number of women participating has exceeded 450 and the cumulative number of poor households has exceeded 250.

53. The main affected vulnerable groups all are the poor, including single parent family and women-led family, Wubao (five-guarantee households), households affected by disability and illness. A series of additional measures have been put in place to help them in livelihood restoration and relocation restoration.

A. Including eligible vulnerable groups in MLSS as a priority

54. According to the Minimum Living Standard Scheme (MLSS) policy of Hanbin District for rural residence, eligible vulnerable groups affected by the subproject have been included in the MLSS in time and received MLSS benefits so as to ensure that the per capita net income of each rural AH is not less than CNY 3,070 a year.

B. Providing rural medical assistance to eligible vulnerable groups

55. Rural medical assistance will be provided by Hanbin District Government to eligible vulnerable groups to solve the problems that they have difficulty in receiving medical treatment. Due to low income or no income, with the addition of suffering from serious illness, children’ educational problems, etc. as well as local backward economy and unfulfillment of medical security, farmers in mountain area go to hospital only when physical problems are very serious, and they have missed the best treatment time of disease at that time. It is a problem that vulnerable groups have difficulty in receiving medical treatment. The household medical assistance measures for the affected vulnerable group in this project shall be arranged by the district government uniformly, including incorporating into NCMS, enjoying the serious illness subsidy and other medical subsidy and assistance.

C. Giving priority to vulnerable groups in resettlement measures Land acquisition affected households: 85. For vulnerable groups, the following measures were specified to assist them. • Priorities will be given in obtaining replacement land through allocation of reserved land, or through land transfer if the vulnerable AH chooses to restore their income through agricultural measures. The measure has been executed. • The households with a labor force will be given priority in skill training, public welfare positions in government and reserved positions in the project and local government. In case of meeting the condition, small sum guaranteed loan will be given in priority; the measure has been executed. If needed, the affected vulnerable group can apply for assistance and have the priority to obtain help.

• Priorities will be given in LEF endowment insurance and new rural endowment insurance to eligible AH. The measure has been carried out by District Government in a unified way. • If necessary, provide preference loan to the significantly affected households in developing non-farming business, such as purchasing vehicles for transport business, operating repair shops, developing other income generating business, detailed plan will be discussed during implementation. The affected households can apply for help according to their own actual demand and obtain the assistance of the measure. • Apply for special recovery funds established by the project to restore production and living subsidy. HDPMO, town and village committee where affected person is located determined to provide additional CNY 3,000-5,000 for the vulnerable households to assist in their production restoration and life improvement. As presented in Section 2.7, the vulnerable groups have been covered by the transformation of government’s unified poverty alleviation policy from the special funds. 86. House demolition affected households: 87. For vulnerable groups, the following measures are specified to assist them. • Priorities have been given to vulnerable group to choose resettlement locations, floors, size, and etc. • They can apply for special recovery funds established in the project for production recovery and living subsidy. HDPMO, town and village committee where affected person is located determined that CNY 5,000 was provided for affected vulnerable groups families, which was used for living allowances and resettlement subsidy in transitional period. • Economic housing has been provided for the poor. 88. The measures above have been implemented at the time of the resettlement of low-income families, the low-income families which are willing to move in the centralized settlement buildings could acquire the policy subsidy, they can spend only a few money to get a set of apartment for their resettlement, and most of the compensation for the house demolition can be saved. The total compensation (including policy subsidy) that the low-income families who rebuilt their houses can acquire was higher than the standard of RP.

(7) Women’s Development Measures 89. During the resettlement process, women’s rights and interests be fully protected, and women will play an important role in socioeconomic and resettlement activities. To ensure women’s rights and interests, the following relevant measures will be adopted: A. Provide and assist women in applying for job opportunities related to the project:

90. For those who are interested in participating in project job opportunities, Women’s Federation staff at the township and village levels were responsible for informing them of job opportunities in advance and facilitated women to apply for the employment. Basic skill on landscaping and other relevant skill training has been provided prior to recruitment.

91. After project implementation started, 265 local women have participated in, and all work contents were available to them, including: traffic safety officer, carrying, tidying the engineering objects and chores. They also got the corresponding return, which was far higher than agricultural production revenue calculated with the daily average revenue. 22

The remuneration is helpful for their daily life at home; meanwhile, women play a more important role in family. B. Enhance the women’s ability to use media:

92. Provide conditions and opportunities for rural women to contact, study and use mass media; support and promote rural women to enhance the ability to use media and communication technology; encourage non-government institutions and enterprises to use various information communication technologies to help women gain information and service. C. Provide preferential training method and contents for women:

93. As women have relatively lower education levels and experience generated in migrant jobs, they have less available employment and income generation choices than men. Training is particularly crucial to them in developing new income sources becoming available through industrialization and urbanization development. They hope to have not only agricultural skill training on horticulture, fruit tree caring, but also non-farming skills with handicraft, urban employment skills such as hotels, restaurants, shopping malls, and garment factories in factories e.g. Women’s training needs has also been covered in RP, and training budget are reserved at the same time. The subproject has ensured that 40%~60% training opportunities were provided for the affected females. The Women’s Federation representatives together with the employer agencies consulted with women to develop the training design on methods and contents. 3.3 Recovery Plan of Special Facilities

94. The special facilities affected by the project were mainly power lines, telecommunication lines, etc. To minimize disruption to residents, detailed surveys have been done and the budget has been included in the RP budget. The relevant line agencies will be responsible for detailed relocation planning and rebuilding electric power and communication facilities that have be restored. 3.4 Status of resettlement

95. By September 30, 2020, 22 relocated households in G316 Hanbin Section have been resettled, of which 21 have chosen to be resettled separately and one has been resettled in Qingshuiwan Community. Yandong Road Project has 12 relocated households, one has been resettled in the central community resettlement site of Yanba Town, and 11 have chosen to be resettled separately. All relocated households in Hanbin Project have been resettled.

4 Public Participation 4.1 Public consultation results

96. During project preparation and implementation, the meaningful public consultations and participation activities have been carried out. From September to October 2020, the seventh phase of external monitoring activity and public consultation activities has been implemented. See details in Table 4-1. 97. From September to October, 2020, HBPMO, local government and the Monitor convoked centralized public consultation for affected persons. Meanwhile, the Monitor conducted in-home investigation and public consultation in Zaoyang Town, the results of the main consultations were as follow: i. There are four households affected by the demolition that participated in the consultation. The resettlement method of these four households is scattered resettlement. They have rebuilt their houses near the original houses and have moved into new houses to live. They said that the compensation standard had been publicized and was clear. Housing demolition fees, transitional fees and relocation fees were all paid in full at one time, and the compensation obtained was not lower than the compensation standard. They were very satisfied with their new houses and believed that their living environment has been improved.

ii. There are five people who participate in the consultation work in the Yanba Road Project, mainly as handymen, porters, and other unskilled laborers. One of the female workers said that the work site is close to her home, and she was paid CNY130 to 150 a day with breakfast and lunch. She was quite satisfied with the remuneration, which was much higher than the income from farming. At present, there are ten local people taking part in non-technical labor work at this construction site, of whom three are women.

iii. Three poverty households who participated in the consultation activities took part in free training, mainly in planting technology, breeding technology and vocational skills training. Another two poor households received training notices from 2019 to 2020, but did not participate in the training for personal reasons. iv. All affected people participating in the consultation were aware of the ways of complaining. The common way of affected people to complain are by telephone or face-to-face communication, with contacting of project office staff, construction team and village committee to solve problems.

98. In Yanba Town, affected person Tang Daping, a family of two people, was originally a poverty family and had just been lifted out of poverty in 2020. The main source of income is migrant workers, and farming is mainly for personal use. Affected by the project, about 100 m2 of civil structure houses will be demolished in 2019. The newly built house covers an area of about 120 m2 and will be moved into the new house by the end of 2019. The affected people think that the living environment has been significantly improved, but the road has not been repaired and there is a lot of dust at ordinary times. They hope that the construction can be completed as soon as possible to make the traffic conditions and environment better.

99. At the Yandong Road construction site, an interview was conducted with a female worker, Dai Ceqin, who stated that she worked as a porter and was paid by the day, with a daily salary of CNY 130 to 150 per day, and that the construction company provided breakfast and lunch. She goes to work at 8:00 a.m., takes a break of one to two hours at 12:00 noon, and finishes work at 5:30 p.m. She feels that the construction site is very close to her home, and there was no potential safety hazards on the way to and from work. `

100. HDPMO did not receive any writing or systematic complaints in this external monitoring. A designated person in HDPMO is specially responsible for receiving and addressing the complaint of people, and the governments above town level also have special complaint receiving office. If people complain about something, they will be recorded on files and will be timely informed to relevant personnel to address, the response on a complaint commonly will be answered to the complainant in five working days. Resettlement Information Manuals have been delivered to villages in 2015, in which, there was a description on the right of affected persons to complain, the complaint channel and procedure.

101. The written complaints have not been received since the subproject was implemented. However, some villagers complained to HDPMO by phone, and all these problems were about the living inconvenience caused by project implementation including the broken water pump, electricity power off and travelling barrier etc. After receiving the 26

complaints, HDPMO contacted with the project implementation unit in a timely manner to deal with them. All the problems have been solved.

5 Monitoring of LA and HD expenses in 2019 Annual Audit 1. G316 (Hanbin section) resettlement compensation cost problem: Problem: Affected people's compensation for land acquisition and demolition has not been paid in full and in time. The Shaanxi Provincial Department of Transport should ensure that these compensation costs are fully budgeted and paid in full. For three towns along the line of Ankang G316, the resettlement compensation cost was CNY3,359,400. According to the reply of Han Ya ban Zi [2020] No. 09 document: the main construction body of G316 National Road (from Xunyang to Ankang section) is Ankang Transportation Bureau. Xunyang County and Hanbin District are responsible for land acquisition, demolition and external environment coordination within their pertinent administrative region. According to the land acquisition and demolition agreement signed, the total cost of land acquisition and demolition in Hanbin District is about CNY 12,000,000. Due to the large amount of land acquisition and demolition, the Transportation Bureau takes the lead in the land acquisition and demolition work, and the District Natural Resources Bureau is specifically responsible for the land acquisition and demolition work in Zaoyang Town and Guanmiao Town. The scope of land acquisition was based on the needs of project construction. The construction unit released the line and the commanding officer informed the town under its jurisdiction to carry out land acquisition. The resettlement compensation was disbursed to APs from the Hanbin District Finance Bureau through bank account finally via Hanbin PMO, and affected township government. By the 2019 audit, a total of CNY16801946.4 has been allocated for land acquisition and demolition. As the project of Ankang G316 national highway has not been completed, the land acquisition and demolition has not been completed. Therefore, during the audit, the unit accounts involved in land acquisition and demolition are in balance (CNY1696581.9 in Zaoyang Town, CNY 212,300 in Guanmiao Town, and CNY 399,990 in the collection center), with a total balance of CNY 2,308,871.9. After the completion of the project, the Bureau actively urged the unified collection center and relevant towns to pay close attention to the final accounts. After the final accounts were audited, the excess was returned and the less was supplemented, and the relevant materials and procedures were improved. It should be noted that as of September 31, 2020, the construction change of bus harbor in Guanmiao Town has not been approved, and the land acquisition cost shall not be included in the acquisition and relocation cost of ADB project. 28

2 Yandong Road Project (Y305) resettlement compensation cost problem. Problem: The balance of the resettlement compensation costs for the Y305 rural road reconstruction project in two towns in Hanbin District is CNY145,200. Hanbin PMO replied with Han Ya ban Zi [2020] No.05 document: the book capital of Yanba Town land requisition and relocation compensation at the end of 2019 is CNY145, 200, because the land acquisition and relocation work is in progress. The book capital of CNY145,200 has been paid on January 23, 2020.

6 Conclusions and Suggestions 6.1 Assessment on project acquisition and resettlement

102. (1) Up to September 30, 2020, the relocation within the red line of the Hanbin Project has been completed. The land acquisition and relocation within the red line of Anxun highway (G316 Hanbin section) has been completed, for totaling 175.548 mu by LA, including 7.243mu of homestead, 55.035 mu of dry plain ground, 65.901mu of dry sloping dryland, and 47.399mu of forestland. Accumulative demolished buildings by Hanbin section of G316 was 4197.49m2, including 2695.39m2 of Brick-concrete houses, 1236.87m2 of Brick-wood houses, 127.5m2 of Earth-wood houses and 137.73m2 of Make-shift houses. The total compensation and resettlement expenses were CNY13,765,364. 103. (2) As of September 30,2020, the land acquisition and demolition work within the red line of Yandong road project has been completed, affecting Dongqiao village and central community. The total occupied collective land is 145.31 mu, including 88.1 mu of cultivated land and 57.21 mu of forest land; The total demolition area is 1201 m2 , including 457.2 m2 of brick concrete buildings, 397.6 m2 of brick and wood buildings, and 346.2 m2 of civil buildings. 104. (3)18 households were affected by two village roads, namely Zaobao to Yousheng Village Project and Zaobao to Wujiashan Project, with a total length of 13.492km. The roads occupied a total of 45.5 mu of collective land, including 8.7 mu of slope farmland and 36.8 mu of forest land. In April 2019, the HDPMO has held a villagers’ congress in Gaoju Village before the start of construction. With confirmation and signing, all the participants supported road construction and agreed to give up compensation for land occupying according to the requirements of “one case in one discussion” in the management measures for the construction of Tongcun Road in Hanbin District. 105. It can be seen from monitoring condition that land acquisition implementation scheme was based on the existing road subgrade basically and did not affect the life quality of affected person. The masses showed great expectation for the project. 106. According to the consultation results of this external monitoring, the affected households generally believed that the living conditions have been significantly improved than the past. The compensation payment was paid to the account at one time, and they are more satisfied with the current living environment. In addition, they also get labor opportunities and training opportunities. 107. Hanbin PMO has clarified the problem of acquisition and relocation costs raised in the audit report of 2019, and submitted the reply letter to the Provincial Project Office 108. (4) No writing or systematic complaints in this external monitoring.

6.2 Problems and suggestions

109. Our supervision and consulting work have been supported by Foreign Funds Project Office of Shaanxi Provincial Transport Department (Shaanxi Provincial PMO), HDPMO, thus went smoothly. Besides expressing thanks to various relevant organizations, we proposed the following suggestions for later land acquisition and demolishing:

110. Currently, although the land acquisition and resettlement with the red line of Yandong road was completed, the Yandong Road was delayed because the road is being used for transporting engineering materials for Shaanxi province highway project, which may affect some ground attachments further. In addition, there were the complaints over heavy volumes of traffic according to the survey, therefore, it is suggested that the HBPMO shall take its responsibility to cooperate and communicate among villagers and related units of highway to properly address this issue.

111. Since the LAR of the subproject has been completed, it is suggested that Hanbin PMO conduct a thorough review of LAR process and make all documents related to resettlement available for the preparation of resettlement completion report.
