I. INTRODUCTION

A. Background

1. The Government of India (GOI) has launched Pradhan Mantri Gram Sadak Yojana (PMGSY), a nationwide rural road investment program as part of the poverty reduction agenda for the rural sector. PMGSY aims to provide all weather road connectivity to unserved habitations in India’s rural areas, where 70% of the population live.

2. GOI has entered into a Framework Financing Agreement (FFA) with ADB for the Rural Road Sector II Project (RRSIIP) in November 2005 where the government requested financial assistance from ADB through a Multitranche Financing Facility (MFF) for the implementation of PMGSY. The Investment Program has been categorized as “B” for environment based on ADB’s Environmental Assessment Guidelines (2003). The Initial Environmental Examination (IEE) of sample subprojects was prepared for each tranche. There were 5 tranches approved under the Facility. The IEE rates the physical interventions of the Investment Program as minor. None of the sample subprojects involved realignment, and most only required black topping of 3.5-meter carriageway and earthen shoulders, and side drains if roads run through residential areas. Mitigation measures are available and can be easily integrated into construction works. An environmental code of practice (ECOP) has been prepared to provide guidelines to address environmental concerns into rural roads construction.

3. Rural road projects aim to improve rural connectivity, which in turn will improve economic and social welfare of rural communities. Improved pavements will invite private and public transport operators to provide transport services connecting remote and rural areas. The proposed road would prove to be beneficial to all the villages. The benefits could be mostly of a socioeconomic nature by way of access to health, education, and commercial centres at all times. Villagers will have more opportunities to interact with civic and government bodies. With the present level of traffic, pollution effects from motor vehicles will be negligible. Adequate number of cross drainage structures and longitudinal drains along the proposed road near built up areas will be provided to ensure quick disposal of runoff. There will be provision for horticulture at both sides of the embankment slope, which will protect the slope from erosion as well as it will help to check the environmental pollution.

4. For all the positive impacts, rural road projects, which are usually small in terms of physical intervention scale, could also generate some adverse direct and indirect environmental impacts. The direct environmental impacts are usually due to activities that are directly related to construction and rehabilitation activities, while indirect environmental impacts are usually related to the operation of improved roads. Such indirect environmental impacts include cumulative impacts due to improved access of certain geographic areas.

5. The rural road Environment Management Standard contains a set of environmental codes of practice (ECOP) that can be implemented to address the direct environmental impacts associated with rural roads projects, but also to some extent, indirect environmental impacts. 2

B. Project Implementation Arrangement

6. The Executing Agencies (EAs) for the Project are Ministry of Rural Development (MORD) at the central level and the governments of Assam, Orissa, Madhya Pradesh and West Bengal at the state level. MORD, with technical and management support from National Rural Roads Development Agency (NRRDA), were responsible for overall Project supervision and execution. The state governments, through their respective state departments responsible for rural road improvement, were responsible for executing the Project at the state level.

7. The MORD joint secretary chaired a coordination committee, which was set-up by the Government within 3 months after loan effectiveness. The loan became effective in November 2005. The committee met quarterly and monitored the use of loan funds and overall implementation performance of the Project. The committee members which comprised senior 3

officials of MORD include the Department of Economic Affairs; NRRDA; and the governments of Assam, Orissa, Madhya Pradesh and West Bengal.

8. The implementing agencies for the Project were the SRRDAs in the participating states, namely Assam State Road Board, Orissa State Rural Roads Agency, Madhya Pradesh Rural Road Development Authority and West Bengal State Rural Development Agency.

9. The SRRDAs were each headed by a chief executive officer who is the state program director for overall coordination of implementation, including planning, management, consultant selection, and procurement. The chief executive officer was supported by experienced personnel at state headquarters and in the district PIUs, which implement PMGSY investments. A PIU was headed by a superintending/executive engineer and staffed with assistant/junior engineers and clerks/cashiers.

10. To monitor the use of loan funds and overall implementation performance of the Projects under the MFF at the state level, and to ensure coordination among key agencies involved, each participating state established a project implementation committee within 3 months of loan effectiveness. The committee was scheduled to meet monthly and chaired by the chief executive officer of the SRRDA, with representation from the respective state department responsible for rural road development, 2 PIUs, and consultants. As necessary, other state agencies were invited to this committee to assist in implementing the Project in areas such as forestry and land availability.

11. Each SRRDA assigned an environment officer with a primary responsibility to mainstream environmental concerns related to development of rural roads. At the initial implementation of the Projects under the MFF, environment specialists were engaged as part of the TSC to work closely with the environment officers in the respective states to appraise additional subprojects and to monitor implementation of the mitigation measures. The environmental checklist, which serves as the IEE, identified the relevant provisions of the ECOP. This served as the environmental management plan for the subproject. ADB provided special training early in project implementation to the environment officers as well as to the PIUs of the SRRDAs.

12. MORD, the Executing Agency, ensured that ADB is given access to undertake environmental due diligence for all subprojects, if needed. However, MORD has the responsibility for undertaking environmental due diligence and monitoring of the implementation of environmental mitigation measures for all subprojects. The due diligence as well as monitoring of the implementation of the environmental management plan needs to be documented systematically.

13. Project Implementation Unit. The PIU (i) completed the detailed project report (DPR) using the environmental checklist that serves as IEE for construction and ensured that construction was along the existing alignment; and (ii) obtained necessary statutory environmental clearance prior to commencement of civil works.

14. State Rural Roads Development Agencies. The SRRDAs (i) ensured that DPRs for follow-on subprojects are completed with the environmental checklists that serve as IEE; (ii) ensured that the environmental checklists are reviewed by the environmental officer of the concerned SRRDA; (iii) ensured that all required statutory environmental clearances are obtained and the conditions noted in the clearances are implemented; (iv) ensured that the relevant provisions of the environmental codes of practice are followed as part of the effort to mainstream environmental concerns; (v) ensured that bidding documents cover required environmental 4

mitigation measures; (vi) ensured that the environmental checklist, which covers recommendations to mitigate the impacts, is made available to the contractors; and (vii) undertook routine monitoring of the implementation of the identified mitigation measures.

II. COMPLIANCE WITH SAFEGUARDS PROVISIONS

C. Project Agreement

15. The Project Agreement signed between the Ministry of Rural Development and the State of West Bengal and the ADB on August 29, 2006 under Tranche 1 specified in Section 2.01 that (a) MORD and West Bengal shall carry out the Project with due diligence and efficiency, and in conformity with sound administrative, financial, engineering, environmental and rural roads developmental practices. With respect to environmental assessment and monitoring, MORD and West Bengal carried out the Project with due diligence and efficiency.

III. COMPLIANCE WITH ENVIRONMENTAL MANAGEMENT PLAN AND SOCIAL DUE DILIGENCE IMPLEMENTATION

16. Annexure 1 shows the summary of EMP implementation and monitoring. Annexure 2 describes the Social Diligence done for the projects implemented in West Bengal.

17. As of 31st January 2013, construction of Batch III Lot 2 (Project 5) roads under RRSP II are going on. As per progress report of WBSRDA at present most of the roads (63% of the total roads) under Batch III Lot 2 (Project 5) are completed and the rest are under construction. Table 1 shows the implementation status of project 5 roads.

18. Overall district wise monitoring status for Project 5 is shown in Table 2 below. Annexure 1 depicts details of road for those monitoring has been done till February 2013.

19. It is noted that out of 75 roads under project 5 “during construction” monitoring is done for only 22 roads and post construction monitoring for only 11 roads. Only 44% of roads (total 223.876 km within 434.67 km) are monitored up to 28th February 2013. Pre- construction monitoring was done for all the 75 roads under implementation.

20. During March 11th to 13th of 2013 Environmental Specialist of TSC reviewed the summary monitoring checklist filled up by PIC containing degree of application of mitigation measures for 33 roads of project 5 spread over in 11 districts.

21. Road wise issues, particularly for post construction compliance are attached as Annexure 1 and discuss below.

A. Roads under Operation/ Post Construction

• It is noted that there is no requirement for environmental and forest clearances. Also, no hot mix plant and batching plant established during construction period. • As per desk review it is noted that in all the roads closure of labour camp done satisfactorily • Construction of Cross drainage structure done adequately in all the cases • Borrow area rehabilitation is not done in most of the cases. • Tree felling is not required in most of the roads. Tree plantation is not carried out by Gram Panchayat. In few cases plantation has been done by local people • Arrangement of safety signage and display board placed properly in most of the cases • Shifting of utilities like electric and telephone post is far lacking. Intervention from district administration is required for complete shifting of utility. Presence of electric and telephone posts within road pavement is risky for road users.

B. Roads during Construction

• It is noted that there is no requirement for environmental and forest clearances. Also, no hot mix plant and batching plants were established during construction period. Only spot mix plant is used during construction of road • Soil stabilization through compaction and use of eucalyptus and bamboo protection work near water body is noted • Collection of Pollution Under Control Certificate for vehicles and equipment engage in construction work have been done only partially • Traffic diversion particularly during construction of Cross Drainage (CD) structures and public safety by using caution tape done as per requirement • Use of personal protective equipment (PPE) by the labourer is not practiced continuously. 22. The action plan for compliance of application of mitigation measures during construction of road are discussed below.

23. General Action Plan

• Close micro-level observation is needed during filling up monitoring checklist, discussion with local villagers and their opinion also should be taken into account. • Filling up monitoring checklist format should be based on primary observation of monitoring team not through discussion with PIU • Degree of application of mitigation measures say satisfactory, partially satisfactory etc. should be judge after field observation • During filing up monitoring format necessary instruction should be given to contractor for application of mitigation measures and regular follow up necessary • Changing application of mitigation measures with advancement of construction work should be properly reflected in monitoring format.

GLOSSARY

Affected Persons (APs): Affected persons are people (households) who stand to lose, as a consequence of a project, all or part of their physical and non-physical assets, irrespective of legal or ownership titles.

Encroacher: A person, who has trespassed government land, adjacent to his/her own land or asset, to which he/she is not entitled, by deriving his/her livelihood there. Such act is called “Encroachment.”

GP/panchyat Resolution: A resolution drawn up by the collective decision of villagers. The resolution drawn up for the purpose of the project refers to identification of the affected persons, extent of their losses by unique identification and signed consent of the affected persons to donate voluntarily the identified assets for the project purpose. The resolution is also signed by the village sarpanch, village president and other villagers including senior citizens of the village.

Panchayat: An institution (by whatever name called) of self-government for rural areas constituted at the village, intermediate, and district levels under article 243B of the Constitution of India. The three levels of panchayat comprise gram panchayat at village level, intermediate panchayat at block level, and zilla panchayat at district level.

Village level mechanism for grievance redress: village committees were in place comprising the village sarpanch, village president and senior citizens for the purpose of redressal of grievances

Sarpanch: Elected head of the Gram Panchayat

Zilla : A district which is the first administrative division at the state level.

DUE DILIGENCE OF SOCIAL SAFEGUARDS: WEST BENGAL

1.0 CONTEXT AND PURPOSE OF THE REPORT

As one of the key features of the Government’s poverty reduction agenda for the rural sector, the Government of India (GoI) is implementing a nation-wide rural road investment program, Pradhan Mantri Gram Sadak Yojana (PMGSY). PMGSY aims to provide all-weather road connectivity to currently unserved habitations in India’s rural areas, where 70% of the population live.

The Government of India (GOI) launched “The Pradhan Mantri Gram Sadak Yojna (PMGSY) in year 2000 The objective of PMGSY is to provide all-weather road connectivity to all rural habitations with a population of more than 500 persons in plains and and 250 persons in hill states. This program is being implemented through National Rural Road Development Authority (NRRDA) under Ministry of Rural Development (MORD) at central level and through State Rural Road Development Authority/Agencies (SRRDA) at state level.

The Rural Connectivity Investment Program (RCIP) is continuation of Rural Road Sector II Program (RRS IIP) and is a multi-tranche financing facility (MFF) that will construct or upgrade to the all-weather standard about 12,000 km of rural roads connecting around 4,000 habitations in the states of Assam, Chhattisgarh, Orissa, Madhya Pradesh and West Bengal (RCIP states). The RCIP will also focus on improvement of institutional arrangements, business processes and associated capacity building. This will especially be done in relation with design, operation, safeguard, financial, road safety, and asset management matters. Investments in rural roads will improve connectivity, cut transport costs, and provide enabling infrastructure to areas currently with poor access to markets and urban towns, and thus contribute to growth and equity in the country’s largest sector.

The Government is now planning to submit to ADB the second Periodic Finance Request (PFR) that includes the proposal for about 930.084 km rural roads in the state of West Bengal. WBSRDA is the implementing agency (IA) for the ADB funded subprojects in the state. The preparatory works for the second Batch of roads have been completed for the state. As per the requirements of ADB, it is mandatory that the subprojects under the programme comply with ADB's social safeguards. This due dilligence report is prepared to fulfill the requirement of this compliance. It may be noted here that the physical construction of 28 roads comprising 30 number of roads with 28 pckages covering 166.456 Kms of Tranch 1 sub project roads of RCIP I is yet to be started. Within this vicinity of circumstance ADB/NRRDA desired inorder to fulfill the compliance requirement the due diligence of last batch of RRSIIP(ADB loan 2651-IND) needs to be done. Hence this report considered ADB loan 2651-IND for due diligence purpose.

2.0 ADB Loan 2651-IND PROJECTS IN WEST BENGAL –CURRENT STATUS

A list of district wise subproject roads under batch III (Project 5) is presented in Appendix -1. Summary of the proposed subprojects is as under. It can be seen from table 1 that there are 76 subproject roads with total length of Kms 443.321 spread over 11 districts. Of the total 76 sub project roads proposed in this batch, there are 68 numbers of packages.

It can be seen from table 2 that district bankura proposed highest number of roads 16 with total km length of 79.38. The district Paschim Medinipur proposed 9 numbers of roads with total km length of 87.31. The

district Burdwan proposed only 1 road with total km length of 15.16. In the context of total Kms distribution of sub project roads, of the total kms of 443.32, the South Bengal has the highest percentage share (76.57 percentages). In the context of distribution of number of roads the same trend is also prevelant in south Bengal. Of the total number of 76 sub project roads 54 number of sub project roads are distributed in South Bengal.

All the 76 sub project roads will provide connectivity to 249 habitations. Of the total 249 habitations, 90,85,55,19 are having estimated population of 1000+,,500+, 250+,and Less than 250 respectively. The proposed sub project roads will be serving an estimated population of 1,51,000. The physical constructions of all most all the roads are completed. The subproject wise and PIU wise details of sub project progress of work as on April 2013 have been presented in APPENDIX -1.

3.0 Social Safeguards in the Project

The strategy adopted to address the social safeguards and other social risks in the project include the Community Participation Framework (CPF) 1 that establishes guidelines supplemental to the PMGSY guidelines for community consultation, detailing the procedural steps and requirements to be followed for all subprojects to be included under the Rural Roads Sector II Investment Program (RRSIP II) to be financed under ADB Loans.

The PMGSY employs a bottom-up approach for project planning and preparation. The Core Network, from which the roads to be improved are selected, is prepared at the block level in consultation with the concerned Panchayats and consolidated at the district level. The list of roads to be taken up in each yearly allocation is first prepared by the PIU, approved by the Zilla Parishad, and then forwarded to the state government for further approval.

In the preparation stage, the alignment of PMGSY roads is finalized through community consultation. The PMGSY guidelines require the PIU to conduct Transect Walk along project roads before finalizing the alignment, to ensure active community participation, select the alignment that best suits the community’s needs and minimizes adverse social and environmental impacts of the proposed improvement.

Under the PMGSY, the existing revenue tracks are taken up for construction to the standards in the Rural Roads Manual and other relevant specifications. The available width of the existing tracks is not always sufficient to accommodate the proposed improvements, as a result requiring additional land. A standard

practice is voluntary land contribution by affected households to meet this requirement for improvements and/or upgrading of rural roads (e.g., shoulder adjustment and drainage). However, the extent of impacts on land, structures and livelihood sources is expected to be minimal, as the road improvements are generally carried out along the existing tracks.

Additional land required for road improvement under the PMGSY has been secured through voluntary donation by the land/asset owners. The CPF establishes the guidelines to ensure that donation is voluntary and the negative social and economic impacts due to the Project will be avoided or minimized. The community consultation processes for subproject preparation result in a set of documents that collectively serve as a plan for mitigating likely negative impacts of each subproject. This process follows the ADB social safeguard requirements mentioned below for projects involving voluntary donations:

(i) full consultation with landowners and any non-titled people on site selection;

(ii) voluntary donations do not severely affect the living standards of APs and are directly linked to benefits, with community sanctioned measures to replace any losses that are agreed through verbal and written record by affected people; and

(iii) Voluntary donations are confirmed through verbal and written record and verified and adopted through constitutional process.

(iv) Adequate grievance redress mechanisms are in place.

Appendix-2 presents the Outline Community Participation Framework and the mitigation measures matrix adopted for the project by the SRDAs of the three participating states of RRSIP II.

4.0 Methodology for Due Dilligence

A combination of desk review of monitoring documents available with the SRDA/PIUs and field visits to selected roads were carried out to study the procedure adopted and documentations carried out while preparing the subprojects roads and the monitoring reports. The desk review comprised review of project documents, files, correspondences, progress reports, data of the SRDA/PIUs and monitoring reports (Appendix – 3 provides details of roads selected for review). During field visits in-depth consultations, focus group discussions, individual interviews were carried out involving officials of SRDA/PIUs, civil construction contractors, project affected families, officials of other line agencies like President and Members of Village panchayats, eminent citizens, community leaders, members of women groups in project area. The field visits were carried out during November 2012 to March 2013. The team comprised of the TSC’s Social Development/Monitoring Specialist, Environment Specialist and other support staff including social scientists. During the field visit the specific task assigned to the support staff was to interact with the local community specifically the APs and to assess the procedures adopted during the transect walks and presence of officials during the exercise. The APs were also enquired about their consent for voluntary land donation. For the review, the subprojects were randomly selected with representations of the geographical universe of the state. Of the total 16 roads were reviewed which is 13 percent of the total roads.

5.0 Findings

The CPF adopted for the project follows the ADB social safeguard requirements mentioned below for projects involving voluntary donations:

(i) Road Selection and consultation with landowners and any non-titled people

The selections of roads for improvement under the project were from the PMGSY Core Network. The selection of the PMGSY roads were discussed during the meetings of the Zilla Parishad and the concerned Gram Panchayats.

Most of the subproject roads already had adequate RoW for the construction purpose and were free of encumbrances. The direct impacts were limited to narrow strips of land along the existing alignment and/or shifting of temporary boundary fences. In case of one road, minor portion of the veranda will be affected without affecting the structure of the residence thus not requiring dislocation of the APs. None of the subproject roads impacted structures or Common Property Resources (CPRs) like community land, places of worship etc.

The PIUs in case of all the subproject roads conducted transect walks and held meetings attended by the panchayat officials and land owners/ non-titled persons on site selection. Various stakeholders from the government (AE/JE of PIUs, Revenue officials), Panchayati Raj Institutions (PRIs), and the local community participated in the transect walk. The rural roads under batch-II followed existing alignments and no new alignment was proposed for any subproject road.

The consultation with the community also focused on avoiding/ minimizing displacement due to the sub- project road. Inside habitation areas in village sections the road width has been restricted to 3.5 to 4 m to avoid damage to any residential or commercial structure. It can be seen from table 3 that all the activities related to CPF requirement on road selection and project planning design stage of sample roads have been completed.

(ii) Voluntary donations do not severely affect the living standards of APs and are directly linked to benefits, with community sanctioned measures to replace any losses that are agreed through verbal and written record by affected people

Subsequent to the transect walks, the PIUs with help of Gram Panchayats conducted formal consultation with all those persons likely to get affected as a result of the road improvement. "GP" meetings were held at Gram Panchayat level attended by the PIU officials, the Sarpanch, president, senior citizens of the village and the village community including all the APs. During the conduct of the transect walks, all APs were identified, fully consulted on the voluntary donation process. Vulnerable APs were identified through census survey and support/ assistance to the APs were finalized in consultation with the community through the village panchayat in case of all the subproject roads.

The CPF includes criteria for assistance to vulnerable APs. Vulnerable households are considered (i) those headed by women, (ii) Scheduled Tribes (ST), (iii) Scheduled Castes (SC), and (iv) Disabled persons, (v) Households Below Poverty Line (BPL) as per the state poverty line for rural areas, (vi) Households who will become BPL as result of loss to assets and / or livelihoods and (vii) Households losing structure. It was evident from the consultations on the roads that vulnerable APs had agreed for voluntarily donating their land for the road improvement. Based on the assessment, the voluntary donation has marginal impact on extensions of residential structures, on agricultural lands in which the APs have average landholdings of 1.15 acres. In some cases temporary boundary fences were affected. It is important to note that no AP has been relegated to BPL category as a result of the project. All those belonging to the BPL category has long been there prior to the impact of the project. Table -4 below provides sampled sub project road wise APs and vulnerable APs. The Appendix 4 presents the number of APs and VAPs of all 76 roads.There are 3715 APs and 977 VAPs.

The impact on loss of agricultural land has been varying, highest being less than than 5 % category. Written consent for voluntary donation was obtained through "PRI resolution". Census survey of the APs was carried out by the PIUs with the support of PICs. Interaction of TSC experts with the Panchayat and PIU officials revealed that the PIUs are in close consultation with the Gram Panchayats for provision of assistance and support to the vulnerable APs to ensure that they are not adversely affected by the Project. The consultation process supplemented by distribution of information booklets in Bengali (local language) has made the APs aware of their special entitlement in view of their vulnerability. The Panchayats have taken steps to include the names of all the poor APs for issuance of BPL (Below Poverty Line) cards that would entitle these APs to receive essential commodities e.g food grains, sugar, kerosene fuel etc. through government programmes like Public Distribution System (PDS) at subsidized rates. All vulnerable APs have been considered for provision of guaranteed employment for fixed number of days under the NREGP 2 scheme and the same has been provided by the Panchayats under programs like road construction works in Panchayat roads, tree plantation works etc.

The sample subproject wise findings as per the major activities carried out to comply with CPF requirements are presented in Table 3. Appendix- 5 presents the overview of sample subproject road wise compliance to various reporting formats of CPF. The formats complying the social safeguard requirements are: 1] Form M1: Summary Monitoring Sheet Form;2] M3: Collection of MOU or other documentation acceptable to ADB and Grievance Redressal;3] Form M-4: Progress of Distribution of Support/Assistance;4] Certification by PRI/GP on support/assistance disbursement,proposal for tree plantation etc.

(III) Grievance Redresses Mechanism

In case of all the subproject roads for grievance redressal, 'Panchayats'/PRIs held meetings and redressed the grievances. PIU officials were often present in meetings held at the panchayats, although they did not keep records of how many such meetings were held and how many cases were redressed. At PIU level, typical management structure at place comprises the PIU head in the rank of Superintending/ Executive Engineer. He is assisted by the AEE, AEs/SDOs, JEs. During transect walk, the AEs and JEs take the lead role in coordinating PIC activities with PRIs and line departments like revenue, forest, etc. At the first stage of information disclosure, the PRIs are informed about the project and their cooperation is sought for the transect walks. Subsequently village level meetings are held and transect walk is conducted. The PRIs are requested to form a village committee 3 to address any grievance/complaint. These committees are in place typically comprising the sarpanch, village president and senior citizens. Invariably the PIU JEs are in regular touch with the PRIs during the project preparation as well as implementation while the higher PIU officials are involved in periodic monitoring of the works. All the PIUs in West Bengal have this arrangement in place. No formal grievance was received as the process of selection of road and requirements of land donation was through a participatory approach. With the mobilization of PIC starting with preparation activities for Batch II subprojects, the interaction with the PRIs and PIUs have been further strengthened. PIC has been advised to keep record of such meetings held at PRIs. PIC professionals and PIU staff are in regular contact with the village community and community leaders to facilitate in resolving any grievance that may arise.The report of GRC has been presented in Appendix-5 (M3: Collection of MOU or other documentation acceptable to ADB and Grievance Redressal)

6.0 Institutional Arrangement

The Project Implementation Consultants (PIC) has been mobilized by the SRRDA for the project in December 2012. The PIC has been assisting the PIUs in conducting the transect walk, ‘PRI meetings’, public consultations and other requirements of the CPF. At the outset PIC had a meeting with the concerned PIUs for their cooperation in involving the revenue and other line department officials in the transect walk and obtaining official documents needed for meeting CPF requirements. This helped in better communication with the stakeholders including the villagers as updated revenue records are generally not readily available on demand. The TSC also had a number of meetings with PIC and PIU officials in improving the documentation of the monitoring of sub project roads.

7.0 Gender Concern

2 National Rural Employment Guarantee Scheme (NREGS) launched across 200 poorest districts spreading over 27 states, the Act (NREGS Act) guarantees 100 days of unskilled manual work in a year to one adult member of every rural household. The Act aims at eradication of extreme poverty and making villages self-sustaining through productive asset creation. Under the Act creation of productive assets like water tanks and soil conservation works get preference. This is to regenerate the village’s natural resources, which in turn result in sustainable livelihoods for residents. The Act puts the Panchayati Raj Institutions (PRIs) at the focal point to administer and implement the programme. 3 Village Beneficiary Committee

During the process of monitoring PIC and PIU officials conducted series of consultations with villagers. The gender concern was one of the key isues of those consultations. The general and gender related concerned as an out come of those consultations are presented below. The consultation details with number of participants (Total, male, female, date of consultations etc) for sampled roads are presented in Appendix-6. The photographs of consultations and other compliances are presented in Appendix- 7

Outcome of consultations:

To minimize impact and to reduce disruption of livelihood, efforts were undertaken during the initial design by keeping the ROW within the existing alignments. In keeping with PMGSY guidelines, technical design was adjusted to avoid or minimize loss of structures, by construction within the ROW particularly when the road runs through an intermediate village.

The rural road project ingeneral and for the women in particular improved the accessibility of the inhabitants of the rural areas to education, health, employment, and trading opportunities and will consequently alleviate poverty in the process. The lack of all weather road access in the subproject areas constraints economic activities in these isolated areas, and prevents the communities from being fully integrated into the structure of the national economy and accessing essential services such as education, health and employment. Thus, the rural access roads are expected to provide critical support and development links, including personal mobility, access to services, and growth of non-farm employment in the previously unserved areas.

The positive impacts of the Project, as derived from the consultations held with the people are enumerated below. The foremost benefit of the Project is that it will provide improved transport services, thus, reducing the travel time considerably for the girls to go to school, college and hospitals. The subproject regions were earlier isolated for up to four months during the monsoon season, due to poor or minimal road connectivity to district and state networks. As a result, improved roads helped people to have better & improved access to health, education & other social services. Furthermore, it increased new economic & employment opportunities by providing improved linkages to new markets, production centers & other areas of economic opportunities. As a result, people have wider options in buying and selling their commodities. The villagers are able to transport their produce faster and get more profit margins instead of depending solely on local ‘haats’ and middlemen. Fourth, improved connectivity facilitates travel to Block Development Office and other local government/development agencies. Women especially benefit, since their mobility have been augmented both in terms of access to social services, as well as access to higher levels of schooling. Women’s access to higher levels of health care outside the village particularly during the time of childbearing also improves considerably. Hence, the proposed Project brought economic and social changes in the area, which in turn bring economic prosperity and lead to poverty alleviation. 8.0 Monitoring

Till the mobilization of the PIC, the PIUs have been monitoring the implementation of CPF at the sub project level. However, this aspect was weak and reporting of progress was not regular. PIC is regularly assisting the PIUs in documenting the progress monitoring all subproject roads as well as periodic reporting to the SRRDA.

9.0 Tree Plantation

Regarding avenue plantation, the PIUs have already initiated the process to include the avenue plantation through social forestery programme implemented by GPs/PRIs. With the effort of PIUs the GPs have passed the resolution and included the same in annual action plan. This action has been confirmed through the consultation with GPs during field visit.

10.0 Conclusion

The field visits and review of CPF documentation revealed that (i) The PIC is assisting the PIUs in documenting the records of transect walk, conduct of the meetings as per CPF requirements while designing and implementing the project. Written records of voluntary donations in the form of 'PRI resolutions' were maintained by the PIUs. Village level committees were also in place for addressing any grievance redress. (ii) One of the subproject roads needed providing assistance through inclusion of VAP in MGNREGS scheme, this has already been done and the requisite documents have been placed in appendix. In

one of the subproject road the villagers contributed extra land for improvement of gemotric curves. In addition, the PRIs are proposed to provide assistance to VAPs through NREGS. (iii) In some cases temporary boundary walls were shifted by the villagers for whom they gave written group consent through the “PRI Resolution”. The PIUs have covered adequately the measures that need to be adhered to for implementation of CPF. (iv) The panchayats have arranged to provide assistance to the identified vulnerable APs through issuance of BPL cards, making available essential commodities through government programmes like Public Distribution System (PDS) at subsidized rates and providing employment opportunities to the APs under NREGS. (v) The PIUs were aware of the grievance redress mechanism provided in the CPF. However, no case was reported by any PIU for redressal through grievance redress mechanism.

It could be concluded that the social safeguard measures covered by the CPF and the institutional arrangement of WBSRDA with support from PIC were able to safeguard the project.

Appendix- 2

OUTLINE COMMUNITY PARTICIPATION FRAMEWORK

1. The proposed multitranche financing facility (MFF) will finance the construction and upgrading of rural roads eligible for Pradhan Mantri Gram Sadak Yojana (PMGSY), the Prime Minister’s Rural Roads Program, in the selected states (initially Assam, Orissa, and West Bengal, and any other states meeting the requirements in the Framework Financing Agreement). The criteria for subproject selection, social assessment, and review procedures are provided here.

A. Social Criteria for Subproject Selection

2. Criteria include the following:

(i) adequate land width availability as specified in the Rural Roads Manual, Specification for Rural Roads 2004 and PMGSY Operations Manual 2005; (ii) the proposed alignment involves limited land loss, and the remaining land and or/structures remain viable for continued use; (iii) if impacts are unavoidable, the impacts will be minimized through one or more of the following mechanisms: (a) design modifications by reducing land width, shifting the alignment, modifying cross-sections, etc., to the extent required by safety considerations; (b) voluntary donation of land/assets by the land/asset owner by means of memorandum of understanding (MOU) or other documentation acceptable to ADB; and (c) provision of support and assistance to vulnerable affected people4 through gram panchayat5 and rural development schemes and agreed mitigation matrix; and (iv) roads with no scope for addressing social impacts through any of the mechanisms above will not be taken up under the MFF for that particular year. Such roads will be taken up after the community resolves the social issues.

B. Social Assessment Requirement

3. After subproject selection (para. 2), the following processes will be undertaken and documented in specified formats:

4. Planning. This involves the following activities: (i) Disseminate project information to (a) sensitize the communities on project related issues, and (b) articulate community expectations of the proposed project and the mechanism for beneficiaries’ land contribution. (ii) Finalize alignment through community planning: (a) transect walk conducted by the PIU, panchayat, and local community; (b) joint on-site inventory, crosschecking, verification of alignment, and transfer of information on revenue maps; (c) Identification and redress of grievances; (d) initiation of the process of land transfer; (e) Identification of vulnerable 6 people affected by the project identified; (f) Community acceptance of the project and road alignment; (g) voluntary land donations made through MOU or other documentation acceptable to ADB; and (h) Adjustment of community/panchayat land to mitigate severe livelihood disturbances arising from land donations. (iii) The PIU/gram panchayat consults with people affected by the project after 15 days of the transect walk to (a) disseminate information and data on how the concerns of affected people (AP) are incorporated in design modifications; (b) describe procedures to be adopted for land transfer; (c)

4 Affected people are defined as people (households) who stand to lose, as a consequence of the project, all or part of their physical and nonphysical assets irrespective of legal or ownership titles. 5 A panchayat is a body of directly elected people responsible for development of activities in an area. The three levels of panchayat comprise gram panchayat at village level, intermediate panchayat at block level, and zilla panchayat at district level.

(vii) Submit MOU or other documentation acceptable ADB to panchayati raj institution (PRI) and documentation of structure losses that are to be replaced by the PIU, state, and/or panchayat.

5. Mitigation Measures Matrix. A voluntary land donation system is adopted for the project in recognition of the effectiveness of the system for rural roads development in India. The project will also ensure that (i) there is full consultation with landowners and any nontitled people on site selection (ii) voluntary donations do not severely affect the living standards of affected people and are directly linked to benefits for the affected people, with community sanctioned measures to replace any losses that are agreed through verbal and written record by affected people; (iii) any voluntary donation will be confirmed through verbal and written record, and verified by an independent third party; and (iv) adequate grievance redress mechanisms are in place.

6. To mitigate the possible adverse impacts of the subprojects, the community participation framework (CPF) lists various types of impact categories and mitigation measures which would apply to sample as well as additional subprojects, based on the specific project impacts.

7. Implementation. The following activities will be undertaken:

(i) For the implementation of civil works, the states will acquire or make available on a timely basis the land and rights in land, free from any encumbrances. (ii) The PIU will facilitate enrollment of vulnerable AP in rural development schemes with prior disclosure of information of the process and schedule. (iii) Entitlements will be disbursed through civil support mechanism by gram panchayat or any other agency that holds jurisdiction over such disbursement. (iv) For lands involving traditional tenurial rights, the PIU and gram panchayat, through consultations, will assess the impacts of such land donations and the extent of dependence of the local community on such land. (v) Loss of other assets (well, trees, etc.) will be accounted for either through willing transfer (MOU or other documentation acceptable to ADB) or relocation/construction by gram panchayat/community with technical inputs from the PIU. (vi) Grievances will be resolved through the land management committee and grievance redress committees. (vii) The PIU takes physical possession of land. (viii) Temporary use of land during construction will be through written approval of the landowner or the panchayati raj institution.
