INDICTMENT AND CHARGES On 10 November 1995, the initial indictment against Zlatko Aleksovski, Dario Kordić, Mario Čerkez, TihomirBlaškić,IvanŠantićandPeroSkopljakwasissued.TheindictmentsagainstIvanŠantićandPero Skopljakwerewithdrawn.ThetrialsofTihomirBlaškić,DarioKordićandMarioČerkezwereseparated. Theaccusedwasarrestedon8June1996intheterritoryofRepublicofCroatiabytheCroatianpolice actingpursuanttoanarrestwarrantissuedbytheTribunal.Afterhavingspent10monthsand20daysin detentionintheRepublicofCroatia,theaccusedwastransferredtotheTribunalon28April1997. The initialappearanceoftheaccusedwasheldon29April1997beforeTrialChamberI. Theaccusedenteredapleaofnotguiltytoallthreecountsoftheindictmentandwasremandedinto custodypendingtrial. TheoperativeindictmentchargedZlatkoAleksovskionthebasisofindividualcriminalresponsibility (Article7(1)oftheStatuteoftheTribunal)andsuperiorcriminalresponsibility(Article7(3))with: • Inhumantreatment;wilfullycausinggreatsufferingorseriousinjurytobodyorhealth(gravebreaches ofthe1949Genevaconventions,Article2), • Outragesuponpersonaldignity(violationsofthelawsorcustomsofwar,Article3). THE TRIAL The trial commenced on 6 January 1998 and took place before Trial Chamber I (Judge Rodrigues (presiding), Judge Vohrah, Judge NietoNavia). The closing arguments were heard on 22 and 23 March 1999. TRIAL CHAMBER JUDGEMENT ThistrialwasprimarilyconcernedwitheventstakingplaceintheKaonikprisonintheLašvaValleyarea, which stretches mainly over the municipalities of Travnik,VitezandBusovačaintheregionofcentral Bosnia and Herzegovina, over a limited period of fivemonthsduringthefirsthalfof1993.TheKaonik prisonwaslocatedbesidetheLašvariverapproximatelythreekilometresnorthofthetownofBusovača. Priortothewar,itwasusedbytheYugoslavNationalArmy(JNA)mainlyforthestorageofammunition. ZlatkoAleksovskiwaschargedwiththreecountsinthejointindictmentdated10November1995.Hewas foundguiltyofchargesfiledundercount10andacquittedofchargesundercount8and9respectively.He was sentenced to 2 years’ and 6 months’ imprisonment after being found guilty on the basis of both individualcriminalresponsibilityandsuperiorcriminalresponsibilityforviolationsofthelawsorcustoms ofwar(outragesuponpersonaldignity,Article3).

During the armed hostilities, which erupted on the territory of the newly independent Bosnia and Herzegovinain1992,theBosnianSerbsweregenerallyopposedbytheBosnianandtheBosnian Muslims,withthemilitaryunitsoftheBosnianCroats,theHVO,beingformallyunderthedirectionofthe armyofBosniaandHerzegovina(ABiH)andthecentralgovernmentinSarajevo. However, the cooperation between the HVO and the ABiH was gradually breaking down and clashes betweenthetwoforceswerereportedduringtheautumn of 1992. Towards theend of January1993, there was anoutbreak of open hostilities between the HVO and ABiH in the area. As a consequence, BosnianMuslimmenwereroundedupbytheHVOinthetownofBusovača,aswellasinthesurrounding villages.Approximatelyfourhundredofthesemenweretakentobedetainedatthenearbydetention facilityatKaonik.InthemiddleofApril1993,anotherroundingupofBosnianMuslimmenbytheBosnian Croatforcestookplace,whichresultedinthedetentionofatleastonehundredadditionalmenatthe Kaonikprison. AsacommanderoftheprisonfacilityatKaonik,fromJanuary1993tillMay1993,ZlatkoAleksovskiwas responsible for the safety and the wellbeing of the detainees during this time. Furthermore, as a commander of the prison, he was also in a superior position to the prison guards and therefore was responsiblefortheirbehaviourandconduct.

Onthebasisofindividualcriminalresponsibility,theTrialChamberfoundtheaccusedguiltyofordering, and/or aiding and abetting physical and psychological maltreatment of Muslim prisoners. This maltreatment qualifies as outrages upon personal dignity which falls under Article 3 of the Tribunal's Statute. TheTrialChamberfurtherfoundthattheaccusedknewoftheoffencesbeing committedand thathe failedtotakeanymeasuretopreventthemortopunishtheperpetratorsthereof.Consequently,theTrial Chamberalsofoundtheaccusedguiltyofsuperiorcriminal responsibility,Article7(3)oftheTribunal's Statute. Astoeventsoutsidetheprison,theTrialChamberfoundZlatkoAleksovskiguilty,pursuanttoArticle7(1) oftheStatute,ofaidingandabettingintheuseoftheprisonersashumanshieldsandfortrenchdigging. These offences qualify as outrages upon personal dignity, punishable under Article 3 of the Tribunal's Statute. Inrelationtothechargesofinhumantreatmentandwilfullycausinggreatsufferingorseriousinjuryto bodyorhealth(gravebreachesofthe1949Genevaconventions,Article2),theTrialChamberwasunable toagreeontheapplicabilityoftheArticleinthiscase.ThemajorityconcludedthattheMuslimsheldat theKaonikprisonbetweenJanuary1993andtheendofMay1993werenotprotectedpersonswithinthe meaningofArticle4ofthefourthGenevaconvention.TheTrialChamberthereforedecidedthatthere wasnovalueinexaminingwhetherthecriminalallegationsmadebytheProsecutorrepresenttheserious offencessetoutinthefourthGenevaconvention.Thelegalconsequenceofthiswasthattheaccusedwas foundnotguiltyonthetwocountsonwhichhewaschargedunderArticle2oftheTribunal'sStatute.

On7May1999,theTrialChamberrendereditsoraljudgement,convictingZlatkoAleksovski,onthebasis ofindividualcriminalresponsibility(Article7(1)),andsuperiorcriminalresponsibility(Article7(3)ofthe Statute of the Tribunal) of outrages upon personal dignity (violations of the laws or customs of war, Article3). Sentence:2years’and6months’imprisonment. TheTrialChamberrendereditsfullwrittenjudgementon25June1999. TheaccusedwasgivencreditfortimespentindetentionattheTribunalandpendingtrial(from8June 1996).TheTrialChamberthereforeorderedhisimmediaterelease,notwithstandinganyappeal. APPEALS CHAMBER JUDGEMENT On17and19May1999respectively,theDefenceandProsecutionfilednoticesofappealagainstboththe judgement and the sentence handed down by the Trial Chamber. Appeal briefs were filed on 24 September1999.TheappellantfiledfourandtheProsecutionthreegroundsofappeal. On 9 February 2000 (oral)and 24March 2000(written), the Appeals Chamber rendered its judgement sentencingZlatkoAleksovskito7years’imprisonment. The Appeals Chamber rejected all four grounds of appeal filed by the appellant. In terms of the Prosecution'sgroundsofappeal,theAppealsChamberpartlyacceptedthefirsttwoandfullyacceptedthe third. Amongotherthings,theAppealsChamberacceptedtheProsecution'sappealagainstthesentenceof2½ years.ItfoundthattheTrialChambermadeamistakebynothavingsufficientregardtothegravityofthe conduct of the accused. The Appeals Chamber determined that Zlatko Aleksovski's offences were not trivial,that–insteadofpreventingit,theappellantasasuperiorinvolvedhimselfinviolenceagainst thosewhomheshouldhavebeenprotecting,andallowedthemtobesubjectedtopsychologicalterror. Healsofailedtopunishthoseresponsible.Mostseriously,byparticipatingintheselectionofdetaineesto beusedashumanshieldsandfortrenchdigging,ZlatkoAleksovskiwasputtingatriskthelivesofthose entrusted to his custody. With his direct participation as a commander, he provided additional encouragementtohissubordinatestocommitsimilaracts.IntheopinionoftheAppealsChamber,the combination of these factors should have resulted in a longer sentence and should certainly not have providedgroundsformitigation.

Therefore, the Appeals Chamber decided to revise the sentence which it considered manifestly inadequate.However,inimposingarevisedsentence,theAppealsChamberalsoconsideredthefactthat ZlatkoAleksovskiwasreleasedafterthejudgementoftheTrialChamber,thathethenhadtoreappear forhissentencethesecondtimeforthesameconduct,whichcausedhimtheconsequentanxietyand distress,andalsothathehadbeendetainedasecondtimeafteraperiodofreleaseofninemonths.The Appeals Chamber stated that, had it not been for these factors, the sentence would have been considerablylonger. TheAppealsChamberrendereditsoraljudgementon9February2000andissuedthewrittenjudgement on24March2000.TheChambersentencedZlatkoAleksovskito7years’imprisonment. ZlatkoAleksovskiwasentitledtocreditfortimeservedwhichamountedto3yearsand12days. On 22 September 2000, Zlatko Aleksovski was transferred to Finland to serve his sentence. He was releasedon14November2001.
