Midlands-based airline Duo collapsed at the beginning of May, stranding more than 1,200 passengers abroad when it suddenly ceased trading. Fears are now rife that without further legislation and in the current climate of fierce competition between no-frills carriers, more airlines could fail, which could lead to many thousands more travellers being left stranded and out of pocket. The Civil Aviation Authority (CAA) administers the Air Travel Organiser’s Licence (ATOL), which tour operators must hold to ensure their customers are refunded or flown home in the event of operator failure. However, with 40 per cent of passengers now booking flights directly from the airlines, especially over the Internet, many people are not covered in the event of airline failure; unless, of course, they have purchased adequate travel insurance cover or, in some cases, have purchased the flight on their credit card. “The law hasn’t kept pace with how people book holidays now,” said a spokesperson from the Association of Independent Tour Operators (AITO). “Most of Duo’s customers will be shocked to find they have lost their money – the public thinks bonding covers everything. We have been lobbying the government to bring airlines into the established bonding scheme for the past 18 months.” So, with the CAA and AITO on their case to extend ATOL protection to airlines, the government is being pressed hard to pass legislation that would dissolve some of the inadequacies of current consumer protection. Surely those left stranded recently by Duo, as well as the 52,000 people holding forward bookings with the airline, along with any other passenger that thinks twice about travel cover, would not mind paying the estimated £2 premium on the cost of a return flight.

Reidy Flynn, Ombudsman – Insurance Ombudsman Bureau

“The goal of the Ombudsman,” Reidy said in an opening defence, “is to open dialogue and reduce complaints.” As she sees it, one problem with travel insurance is ‘that if the proposal (policy) is point of sale. “fraudulent” in the first place, then the The travel industry puts forward the argument that it document is useless from the beginning’. should not need to regulate business sold with a That is, if there is deliberate non- holiday. However, the FSA wants a transparent sales process that has clear sales standards, clear training and competency requirements, and a clear and fair ombudsman process. Reidy makes the case that Mike Monk, Head of Finance – it’s the clarity that is missing. Association of British Travel The wording by the insurer Agents (ABTA) is very important – and exclusions must be made clear. It is also important, Mike began by explaining that the where possible, to record Financial Services Authority (FSA) interaction: telephone sales introduced its first travel insurance should be recorded, for instance. There needs to be more emphasis on choice and less on price, for the customer to obtain the correct coverage. Controversially, Reidy also suggests that if the claimant knows they are going to have the amount of their claim negotiated down by the insurer, it is not unreasonable for them to exaggerate the cost, and that this may not be a form of fraud. What seems to disturb insurers is there is no one set of rules in place to determine all cases – it is very much a case-by-case judgement.

Future distribution of travel insurance, and regulations present and future… Working towards 2007

Ian briefed us on the new Financial Services Authority (FSA) regulations and how he felt they would impact on the travel insurance industry as a whole. The regulator’s objective is to make the customer understand what they are buying at the

He also believes that his members are being forced to endure layer after layer of bureaucracy, which is making it almost impossible to sell the insurance products. discourage travel agents to sell travel insurance. By doing so, his concern is that more travellers are likely to not purchase travel insurance at all. This will work against tour operators, who want all their customers to be properly insured. However, if the Financial Services Authority (FSA) forces travel agents and tour operators to regulate individually, he fears that it won’t be financially viable for them individually. His argument is that ‘if a system ain’t to sell travel insurance, whether it is in the broke, then don’t try and fix it’. consumer’s interest or not. He pointed out that in Mike quoted Mintel statistics to bolster his argument: the grand scheme of things, travel insurance sales There are six million travel insurance policies sold in make a relatively small impact on revenue for travel the UK every year. Jonathon Cooper, Manager Travel – Accident and Health AIG (UK) Ltd

Jonathon started by pointing out that the reason the Financial Services Authority (FSA) started regulating the general insurance market on 14 January 2005 was for fairness and transparency for the consumer. He also explained that the connected contracts exemption takes travel agents and tour operators outside individual regulation, but only until 2007. The FSA regulations are obviously worrying travel agencies, but Cooper welcomes the FSA regime as he feels the move will smarten up the industry, adding professionalism. the Financial Ombudsman Service, 37 per cent were Jonathon predicted that online and offline brands will upheld, and only two were towards travel agents show further growth in the years to come.
