Lindsay Mason, the AAA NSW Division Chair, welcomed members to the meeting and advised apologies had been received from:

2. State AGM – Election of Chair, Deputy and Secretary Commenced with election: Handed over to Simon Bourke to elect Chair, Deputy Chair and secretary. All positions declared vacant.

 Sought nominations for position Chair o Lindsay Mason nominated by Kel Gardiner. No further nominations received. Lindsay elected unopposed.

 Sought nominations for position Deputy Chair o David Costello nominated by Kel Gardiner. No further nominations received. David elected unopposed.

 Sought nominations for position Secretary o No nominations received for secretary so combined with Deputy Chair Role.

Both David and Lindsay accepted the nominations.

Thanked Kel Gardiner and Geoff Smith for contributions.

3. AAA Report Simon Bourke provided a general update on AAA activities. The main points Simon covered in the presentation include:  National Conference 13 – 17 Nov (Adelaide) o Major and Regional streams on day 1 and 2, with Technical and Professional Development on days 3 and 4. o AAA Strategic Plan (Includes 4 pillars) 1) Advocacy 2) Members 3) Industry Development and 4) People and Processes

AAA Major Projects 17/18  Airport Act Review. Preparation for productivity Commission Review in 2018. International Air Service Agreement negotiations.  Regional Airport Infrastructure funding campaign (briefings with Ministers for budget submissions). Engaged Capital Hill to help with stakeholder engagement and briefing Ministers for future budget.  AAA online education (ARO/Airside Safety/ Wildlife Hazard).  Launch of webinars  Airport Safety Week  Review of website and communication methods.

Planning and Airport Safeguarding  AAA publications  AAA / Air Services Noise Forum  Ongoing advocacy for State Government implementation of NASF  Stakeholder engagement (PIA, UDIA, ALGA, PCA)

CASA and Aerodrome Safety  Major focus on post implementation review of CASR and MOS139  AAA to consult widely and develop comprehensive submission  PFAS issues currently being investigated further

Aviation Security  OTS security forums are ASAF and RICM.  New security measures at major airports  Security review of regional airports commissioned by Minister Chester.

4. Around the Tarmacs – Reports from member Airports Member Airports were invited to share updates on recent activity within their businesses, and were given verbally by the following airports:

 Narrabri – about to get return service to Sydney starting on the 13th September and looking at a possibility of building a new terminal.

 Newcastle – good PAX growth ~ 7% (1.25M), opened new international processing facility anmd building new 500 bay car park.

 Port Macquarie – advised they have steady growth, the $7.5M terminal upgrade is at design stage and the parallel taxiway currently being designed.

 Ballina – finalising the design for terminal expansion, restructure of staff following retirement of Neil and Graham and the results of staff recruitment to be announced shortly.

 Coffs Harbour – ~10% PAX increase (413K), lost Newcastle – Coffs service and growing car parking (now provide ticketless system).

 Moruya – $9.6M redevelopment underway

 Bankstown/Camden – no RPT services, GA starting to grow, with ~250,000 movements/year and commencing New Master Plan 2019

 Sydney – opening new plane spotters location, new Mantra Hotel has opened, 3.6% growth (mostly comprised international), baggage reclaim redevelopment, biometric trial with Qantas, $500M project to improve ground transport well underway and 200 additional train services to airport announced.

– major airside works happening, terminal expansion project currently on hold pending clarification on future security screening requirements and Jetgo services to Brisbane and Gold Coast going very well

 Albury – terminal expansion project under way, due for completion May 2018, bomb threat to inbound Virgin aircraft June 6, Jetgo services expanding to daily Brisbane Service and twice weekly Gold Coast service, PAX number up 6.5% (263K) and redevelopment of next 15 yr Master Plan about to commence.

 Bathurst – $5M to do parallel Taxiway, preparing for Supercar Races in October and PFAS issues currently being investigated

 Orange – review done on Master Plan, rejuvenation of Taxiways, fly Corporate commenced new service

 Dubbo – ~7% PAX growth (217K), capital works project – runway strengthening and lighting, Upgrade to GA area and aero medical and new airport manager

 Parkes – recently held emergency exercise with emergency services, finalised plans for $3.2M business park and new terminal been open for twelve months and it’s functioning well

 Scone – GA traffic continues to grow and now up to 10,000 movements, have detailed design for Warbird aviation centre, looking at runway plus airside upgrade ($20M), put in EOI for grant funding and successful in getting to the next stage in funding round. Also announced that the next Warbird show on 25 March 2018.

5. CASA Update – MOS 139 Darren’s presentation included:  Post Implementation Review (PIR) o 400 unique issues identified within regulation standards o 7 industry project team meetings held to date o Regulation has been redrafted o MOS 139 redrafted twice (chapter by chapter) o Preparation of NPRM package released on 28/8/17 and closes on 8/12/17

 Proposed Changes: o ‘Certain other aerodromes’ removed o Registered aerodromes transition to scalable certificate and will be required to have Aerodrome Manual o Certified aerodromes – scalable certificate and will provide online manual building tool (MAAT) although this is an optional requirement o Introduced new concept of ‘Accountable Manager’ o Existing facilities prior to make date (ie commence of new legislation) will be automatically grandfathered until upgrade or replacement o New compliance triggers based on passenger numbers and aircraft movements o Encourage everyone to read ‘Change Summary Document’ and draft Reg and MOS annexes’ for further detail.

6. Airservices Update – Including Aviation Rescue Fire Fighting Services (ARFFS) and First Aid Services Justin Justin (Deputy Chief Fire Officer Aviation Rescue Fire Fighting Services) presented on the following topics:  26 locations throughout Australia, 850 staff, 120 vehicles. Typically at aerodromes with >350K PAX  Provide aviation rescue first and foremost but also provide First Aid Assistance.

7. Corporate Member Updates A brief update was provided by the following corporate members in attendance:

NSW Chairman Awards  The Chairman acknowledged the longstanding contributions of Chris Gryllis and Kel Gardiner for their respective contributions to the aviation industry and the AAA NSW State Division. Each were provided with a certificate to thank them for their contribution.

8. Tourism NSW Briefing Anthony Laver, General Manager Marketing of Destination NSW, provided Members with a brief update, including:  NSW Government aiming to double overnight visitor expenditure by 2020 ($18B to $36B by 2020)  Have a range of domestic and international partner programs to help stimulate overnight visitation  Destination NSW also work strategically with airline partners to increase number of new services  Regional Tourism Fund ($13M over 4years) to support product development and marketing (up to 2019). 9. Western Sydney Airport Briefing Kim Forbes, Director of Communications and Stakeholder Engagement at the Department Infrastructure, provided Members with an over on the following:  Australian Government announced up to $5.3B over 10 years to fund Western Sydney  Airport at Badgerys Creek which is 50km from Sydney CBD  Construction start 2018 and will be operational in 2026  WSA will operate without curfew  WSA Co is a new Australian Government Company established to deliver Western Sydney Airport  Key challenge of WSA is flight path design process  FOWSA (Forum on Western Sydney Airport) is a community consultation mechanism to manage issues and community concerns

10. The Future of Illawarra Regional Airport John Barnden, Airport Manager of Illawarra Regional Airport provided overview and history of Illawarra Airport, including key points:  RPT been on and off over a number of years with last service back in 2008  Now working solidly to re-commence RPT services  Key destinations sought are Melb/BNE/OOL  Purchased temporary building to provide terminal for initial stage, whilst concepts developed for new terminal and RPT infrastructure  Submitted TSP / screening authority documentation  Jetgo to commence 30 Oct 2017, with 9 return flights/week to Melbourne (Essendon) and 6 return flights/week to BNE  Discussed future development plans

11. The Future of Illawarra Regional Airport Presentation postponed as Julie Stewart an apology.

Purpose of Report

To amend the Council resolution for the acquisition of a ‘Denial of Access’ strip along the north side of Muntz Lane, as previously adopted by Council.

Background

A report to support the compulsory acquisition of a strip of land denying access to Muntz Lane from 13 properties to the north of the lane was presented to the Engineering and Works Committee on 10 July 2017, with the recommendations from that meeting subsequently adopted by Council at its meeting on 24 July 2017.

The recommendation was as follows:

That the Committee recommends to Council that Council: a. use its compulsory acquisition powers under the Roads Act 1993 to acquire the land shown as Lot 8002 DP 1218273; b. make an application to the Minister for Local Government for the compulsory acquisition of Lot 8002 DP 1218273; and c. authorise its Seal to be affixed to any document required to support the acquisition of the land shown as Lot 8002 DP 1218273, the Seal is to be affixed in the presence of two signatories pursuant to Regulation 400 of the Local Government (General) Regulation 2005 and the Use of the Council Seal Policy.

The Office of Local Government has recently advised (attachment 3) that the wording of the recommendation is not sufficient to allow them to proceed with processing this application.

Specifically, the current recommendation to make an application to the Minister for Local Government should have referred to the Minister and the Governor. Additionally, the relevant section of the Roads Act 1993 should be included in the recommendation.

Whilst there is no need to rescind the former resolutions, Council will need to approve the revised recommendations to allow the compulsory acquisition and denial of access application to proceed.

Community Engagement

The proposed acquisition comes at the request of property owners to the north of Muntz Lane, who wish to develop their land. All adjoining owners have been notified.

The proposal will be advertised in the local newspaper, a newspaper circulating generally in NSW, and a notice placed on the strip of land in question. The notice will invite anyone claiming ownership to contact Council.

Options

1. Not extend the resolution approved by Council on 24 July 2017, this will mean that Council cannot proceed with the acquisition of the strip of land currently denying access to Muntz Lane from the 13 properties to the north; or 2. Extend its resolution approved on 24 July 2017, thereby allowing Council to use its compulsory acquisition powers to acquire the ‘Denial of Access’ strip, and dedicate it as Public Road.

Conclusion

Council has already resolved to use its compulsory acquisition powers under the Roads Act 1993 to acquire the strip of land abutting the north side of Muntz Lane. In order to further this acquisition, it has become necessary to extend the resolution as recommended below.

Recommendation

That the Committee recommends to Council that Council: a. Proceed with the compulsory acquisition of the land described as Lot 8002 DP1218273 for the purpose of public road in accordance with the requirements of the Land Acquisition (Just Terms Compensation) Act 1991; and b. Make an application to the Minister and the Governor for approval to acquire Lot 8002 DP1218273 by compulsory process under section 177(1) of the Roads Act 1993.

Purpose of Report

To gain Council consent to the acquisition of a ‘Denial of Access’ strip along the north side of Muntz Lane.

Background

Muntz Lane extends in an east west direction between Frauenfelder Street and Mate Street and runs parallel to Smith Street and Bellevue Street in North Albury, as shown on the attached plan. The lane was originally created as a Right of Way by DP4100 (attached) in 1903, and was acquired by Council as Public Road under Section 16 of the Roads Act 1993 in 2015.

When the Right of Way was originally created, a strip of land one link (0.205m) wide was reserved along its northern edge. The reason for this would have been that the Right of Way was created by the owner of the land to the south, and it was only intended for the use of the lots subdivided on the south side. The owner of the land to the north would not have contributed to the cost of the Right of Way, and therefore the strip of land served the purpose of denying access.

Due to the passing of time, and the fact that Council has taken over ownership and maintenance of the lane, the Denial of Access strip is now irrelevant. The properties along the north side of Muntz Lane have been accessing the rear of their properties for some time (crossing a strip of land not owned by them), and it is proposed that they now be given legal access to Muntz Lane.

The Denial of Access strip is the residue of the land in Certificate of Title Volume 2531 Folio 165. It is still in the legal ownership of the heirs of Charles Frauenfelder, the original owner who subdivided the land in 1903.

It is proposed to acquire the Denial of Access strip using Council's compulsory acquisition powers under the Roads Act 1993. The strip of land would then become a widening of Muntz Lane.

Issues

DP1218273 has been created in order to support the acquisition of the Denial of Access Strip (shown as lot 8002), a copy being attached to this report. As can be seen on sheet 2, the fences of many of the properties to the north of lot 8002 encroach by a small amount on to lot 8002. They may therefore be able to claim an interest in the land up to their encroaching fence.

The compulsory acquisition process includes advertising of the proposal, and notification to owners. Should anyone express an interest in the land, their claim for compensation would need to be assessed in accordance with the Land Acquisition Just Terms Compensation Act 1991.

Council does not intend to pay compensation in order to create the road widening, as it is being carried out for the benefit of the property owners to the north. Therefore agreement has been sought

from the 13 owners of the properties to the north of lot 8002. To date Council has received written agreement from 12 of the 13 owners, that they will not claim compensation. The owner who has not provided agreement (Lot D DP153681 – corner Mate Street) is concerned that the road widening will make their building encroach on to Muntz Lane. This encroachment would be from 6 to 8 centimetres for a length of approximately 6 metres. Council has assured the owner that it is not in the practice of disputing such a minor encroachment. The compensation for this 0.4 square metres of land would be minor, and the owner would first have to make a claim to the ownership of this small sliver of land.

As the heirs to Charles Frauenfelder cannot be determined or located, Council intends to serve notice under Section 254(3) of the Roads Act 1993 and Section 72(2) of the Land Acquisition Just Terms Compensation Act 1991. This allows for the service of notice by affixing a letter to some conspicuous part of the land.

The total cost of the acquisition of the 'Denial of Access’ strip is estimated at less than $1,000.

Risk

 Corporate Risk – it is in the interests of Council's public image to allow property owners to the north of Muntz Lane to have legal access, and thereby be able to construct developments which rely on this access. Currently Council cannot approve such developments.  There is a risk that the one adjoining owner who has not provided written agreement to the acquisition may make claim to compensation. As this owner is only occupying 0.4 square metres of the land in question, this claim would be minor, and would not be considered worth the costs to claim the interest in the land.

Community Engagement

The proposed acquisition comes at the request of property owners to the north of Muntz Lane, who wish to develop their land. All adjoining owners have been notified.

The proposal will be advertised in the local newspaper, and a notice placed on the site.

Options

1. Not acquire the ‘Denial of Access’ strip. This will mean that Council cannot approve any development on adjoining land which would rely on access to Muntz Lane; or 2. Use Council's compulsory acquisition powers to acquire the ‘Denial of Access’ strip, and dedicate it as Public Road.

Conclusion

The ‘Denial of Access’ strip in Muntz Lane was created adjacent to the then Right of Way to limit access to the properties to its north. The Right of Way has subsequently been acquired by Council and is now a Public Road (Muntz Lane) with adjoining properties wishing to obtain legal access to the lane.

The cost to acquire the strip of land is considered minor and would allow 13 residences legal access to Muntz Lane by removing a now irrelevant control.

It is therefore recommended that the ‘Denial of Access’ strip along the north side of Muntz Lane be acquired by Council and that the land be dedicated as Public Road to effectively widen Muntz Lane by 0.205 metres.

Recommendation

That the Committee recommends to Council that Council: a. Use its compulsory acquisition powers under the Roads Act 1993 to acquire the land shown as Lot 8002 DP1218273; b. Make an application to the Minister for Local Government for the compulsory acquisition of Lot 8002 DP1218273; and c. Authorise its Seal to be affixed to any document required to support the acquisition of the land shown as Lot 8002 DP1218273, the Seal is to be affixed in the presence of two signatories pursuant to Regulation 400 of the Local Government (General) Regulation 2005 and the Use of the Council Seal Policy.

To recommend a preferred contractor to supply cleaning services for Council owned community properties.

Background

Council owns and manages 593 sites across the city. To ensure these facilities meet the demands of the community, cleaning services are separated into seven individual contracts as follows:

 City Area – Library/Museum, Retro Lane Youth Café, MAMA, and the Collections Storage Space at Thurgoona;  AlburyCity Community Properties - Thurgoona Community Centre, Banjora Child Care Centre, Springdale Heights Community Centre, Mirambeena Community Centre, Manual Activities Centre, Lavington Library, Lavington Hall, Lavington Sports Ground, Albury Family Day Care, Westside Community Centre, Waterview Laboratory, Volt Lane Car Park, the Emergency Management Centre and the Visitor Information Centre;  AlburyCity Administration Building;  Depots – Lavington, Albury, Botanic Gardens, Jelbart Pump Station, Wagirra Depot and Landfill;  Albury Airport;  Public Amenities – all public amenities including sports grounds and parks; and  Bus Shelters.

Tenders were invited for the Supply of Cleaning Services for AlburyCity’s Community Properties for a three-year term commencing 1 February 2018.

Tenders were invited in a schedule of rates format with daily, weekly, monthly and annual service frequencies based on historical information and in consultation with staff managing the relevant sites. The contract includes the provision of rate adjustments on a 12 monthly basis in line with the Consumer Price Index (CPI).

The contract comprises the cleaning of the Thurgoona Community Centre, Banjora Child Care Centre, Springdale Heights Community Centre, Mirambeena Community Centre, Manual Activities Centre, Lavington Library, Lavington Hall, Lavington Sports Ground, Albury Family Day Care, Westside Community Centre, Waterview Laboratory, Volt Lane Car Park, the Emergency Management Centre and the Visitor Information Centre.

The tender was advertised in the Border Mail on 16 September 2017, Sydney Morning Herald on 19 September 2017, and on Tenderlink. Tenders closed at 12 noon on Tuesday 10 October 2017.

The tender is considered an essential service for the maintenance and operation of these sites. Offering a three-year contract term (1 February 2018 – 31 January 2021) provides surety of service, economy of scale and minimises AlburyCity’s exposure to unpredictable price rises.

Based on the scope of the contract and historical cleaning budget expenditure, a budget allocation of $135K per annum (including GST) totalling $405K for a period of three years has been included in the respective building maintenance budgets.

Tender Assessment

At the close of tenders, submissions were received from the following companies:

The evaluation of the tenders was undertaken in a three stage process beginning with a general conformity assessment followed by quantitative and qualitative assessments. The general evaluation of the tenders was conducted by the contract assessment panel consisting of the Building Services Co-ordinator (Peter Kallaste), the Assistant Building Services Co-ordinator (Craig Dainer) and the Procurement and Contract Management Co-ordinator (Gerard Coyle).

The budget allocation for the three-year period for the provision of this service, based on scope and specification, is $405K (including GST). Only one of the submissions was within the budget allocation.

As detailed in the table above, the submission from HACCP International Property Services Pty Ltd was the most favourable, being $40K or 10% more favourable than Southern Asset Services and $74K or 19% more favourable than KC Facility Services Pty Ltd. All other submissions were between $74K and $1,073K (22% and 290%) greater than the lowest submission.

To ensure that AlburyCity secures an appropriately qualified and experienced service provider, able to undertake the requirements of the contract, it was considered that a sufficient pool of competitive tenders, being the five most price competitive tenderers as listed, should be progressed to a qualitative assessment. Accordingly, HACCP International Property Services Pty Ltd, Southern Asset Services, KC Facility Services Pty Ltd, Australian Corporate Enterprises Pty Ltd and BG Corporate Services have been progressed, all other submissions were not further considered for this contract based on the tender prices submitted.

HACCP International Property Services Pty Ltd are an Australian owned and operated company with over 40 years’ experience in the service industry and are an ISO9001 accredited company. Their head office is in Adelaide, South Australia, where they are based. They currently hold similar type contracts in their home state, also holding contracts in Victoria and NSW. HACCP International Property Services Pty Ltd indicated that if their submission was successful, all staff would be sourced locally and supervised from a local office, and that they would look to support the local community through sponsorships or donations to locally based charitable organisations or sporting groups. All referees rated this company 'very high'.

BG Corporate Services has been established for 30 years and is an ISO14001 and ISO9001 accredited company based in Taylor's Lakes, Victoria. They operate similar type contracts in areas such as Brimbank, Hume, Wodonga, Knox and Yarra City Councils amongst others. They do not currently hold any contracts with AlburyCity. BG Corporate Services indicated that if their submission was accepted they would set up a local office and employ local staff. All checks and referees rated them as ‘very high’.

Australian Corporate Enterprises Pty Ltd is based in Taylor's Lakes, Victoria. They hold similar type contracts including the current Community Properties contract with AlburyCity. They have a local office in Albury and employ five local staff. Most supplies are purchased locally. All checks and referees rated this company in the ‘average’ category, with some concerns raised regarding past performance and compliance with the contract specification.

In the qualitative assessment, Southern Asset Services rated the highest with HACCP International Property Services Pty Ltd, KC Facility Services Pty Ltd, BG Corporate Services rating very highly in contract performance, capability and information from referees. All submissions rated well in benefit to the local community. Australian Corporate Enterprises Pty Ltd rated slightly lower due to some issues regarding their ability to fully meet the requirements of the contract.

In the quantitative assessment HACCP International Property Services Pty Ltd provided the most competitive rates being 10% more favourable in comparison to Southern Asset Services and between 19% and 36% more cost effective than the other shortlisted companies.

HACCP International Property Services Pty Ltd, Southern Asset Services, KC Facility Services and BG Corporate Services rated very highly in areas such as the ability to meet cleaning frequencies, ability to perform the specified job function and experience in managing the same or similar contracts. Overall these companies were assessed as having the capability, experience and resources to meet the specifications of the contract for the provision of cleaning services for Council’s community properties.

The qualitative and quantitative assessment indicate that HACCP International Property Services Pty Ltd has the experience, capability and resources to meet the requirements of the tender. It has been assessed by the panel as being the most advantageous submission for Council.

Recommendation

Purpose of Report

To provide a summary on the status of the 2017/18 Works Program for the September quarter.

Background

As part of the 2017/18 budget process, Council adopted an extensive works program for asset construction, upgrading and maintenance.

This program is broadly divided into 13 sub programs which included a total of 420 identified projects with a combined value of approximately $78.7M.

The scheduling of projects and resources is an important component in ensuring that designated projects within the approved budget are completed. This report provides an update on the status of the 2017/18 Works Program including accomplishments to date and scheduling of upcoming projects.

Issues

With the focus on project delivery, the scheduling of projects is undertaken with the objective to achieve 100% completion. Project scheduling is based on factors including current asset condition, design status, appropriateness of timing for construction, funding qualifications, seasonal conditions and available in-house skills and resources.

A combination of internal and external resources is used to ensure that the program is completed to standard, within timeframes and in accordance with budget provisions. This project plan is continually monitored to highlight any variations from initial predictions and the determination of any required adjustments.

Attached for information is a Gantt Chart summarising the projects and their respective scheduling during 2017/18. Completed projects are represented by solid black bars, while projects in progress carry an internal black bar representing percentage complete.

Discussion

The Works Program, at the end of the September quarter in the 2017/18 financial year is tracking slightly behind the programmed schedule. The accomplishment as at 30 September 2017 is 24.9%, being 0.1% behind the projected target of 25%.

Since the commencement of the program, an extra eight projects have been included, bringing the total number of identified projects to 428. The extra projects included in the program have been

It should be noted that the 420 identified projects in the program include the proposed carry forwards from the 2016/17 financial year. It is expected that this will have no impact on the satisfactory accomplishment of the 2017/18 Works Program.

Progress at this stage is reasonably favourable and consistent with the programmed schedule. The program is well placed at this stage to achieve a completion in excess of 95.0%.

Conclusion

To ensure the accomplishment of the 2017/18 Works Program a combination of both internal and external work crews are utilised. The schedule is continually monitored and adjustments made as required. The program progress overall to the end of September is slightly behind schedule however considered a good result, with the completion rate projected to steadily continue. The overall program is well placed at this early stage to achieve a positive completion result.

Recommendation

That the Committee recommends to Council that the report on the status of the 2017/18 Works Program as at 30 September 2017 be received and noted.

Purpose of Report

To provide an update on the status of the Albury Airport Terminal upgrade project and to inform Council of the inclusion of the café/bar area as originally intended in the modified concept design.

Background

Albury Airport is a major regional airport servicing a population of approximately 190,000 people and providing essential transport links to Sydney, Melbourne and Brisbane. The airport supports Regular Passenger Transport (RPT) services, air charter operations, air ambulance services and a range of aircraft maintenance and aviation related industries. Through partnering with four RPT airlines, providing 180 flights per week, in excess of 260,000 passengers per annum utilise the facility to connect nationally and internationally.

A master plan for the airport terminal building was developed in 2007 with stages one and two (of five originally) completed, including the introduction of passenger screening infrastructure. With compound average passenger growth (3.1% per annum) as well as the current and projected increases in air travel demand, in early 2015 Council applied for grant funding through the NSW Government’s Regional Tourism Infrastructure Fund for the completion of the remaining three stages of the terminal master plan.

Council was advised in early December 2015 that it was successful in its application to undertake the major upgrade of the Albury Airport Terminal. Under a 70/30 funding arrangement this $5.17M (including GST) project is being funded by a grant of $3.62M (including GST) from the NSW State Government and $1.55M (including GST) from Council. This funding has been supplemented by a further Council allocation of $1.1M (including GST), to complete the upgrade of the mechanical (air conditioning) system to the entire building.

At its meeting on 24 April 2017, in awarding the contract for the construction of the Albury Airport Terminal Upgrade, Council resolved as follows:

That Council: a. accepts the tender from Southern Cross Developers for Contract No. 16/01789 – Albury Airport Terminal Upgrade Construction for the lump sum of $4,496,175.93 (including GST); and b. authorises the General Manager to negotiate a post award variation to include the café construction within the project scope, and that this information be communicated to Councillors as soon as possible.

Note that the estimated design cost allowed for the entire project is in the order of $420K, thus leaving $5.85M for the construction phase. With the award of the contract to Southern Cross Developers, this leaves a positive residual of $1.35M, largely because the café was excluded from the design when the construction tenders were called.

The reason for this positive residual is that following two independent quantity surveyor assessments estimating a total build price in the order of $8M, the decision was made to reduce the scope of the project by excluding the café. The project was also tendered in further separable portions to provide flexibility in scoping the construction to the available funding in case the tenders exceeded the budget.

Council’s resolution on 24 April 2017 allowed the opportunity to re-include the café and deliver the project in its entirety, taking advantage of economies of scale, operational efficiencies and the grant funding available.

Current Construction Status

Work is currently proceeding at the eastern end of the terminal which incorporates the new enlarged arrivals hall and will include two independent baggage carousels. The concrete ground slabs have been completed and structural steelwork and roofing is currently being erected.

In front of the entry to the new extended building, the road and kerbing has been adjusted to suit the new facility and the paved forecourt is now undergoing similar adjustment to complement the extended floor levels to the new extension.

Installation of mechanical services is scheduled to commence in mid-November.

Issues

Since awarding the contract, the architects, Clarke Keller, have been instructed to design and document the inclusion of the café into the overall design. Optimising the café design has been undertaken in consultation with the builder, a local commercial kitchen consultant and airport staff. It should be noted that although not expressly stated, the café has always included a bar area and this feature was sought to be retained and enhanced to maximise commercial return.

The café design has involved a reiterative process whereby the layout has been agreed upon and the architects have then sought to apply architectural features and finishes to complement the overall design. It has then been priced by the builders and rejected twice due to budgetary constraints. The last design iteration (floor plan and internal concepts attached) was considered the best compromise to meet the desired architectural intent within the available budget.

The priced variation for the café is $618,619.77 including GST. As a means of comparison, based on the DA drawings the café was costed by independent quantity surveyors Muller Partnership in September 2016 at $737,000, including GST.

It should be noted that the difference in the original tendered price between the lowest, accepted from Southern Cross Developers, and the next lowest was $483K. Had the café been included in the original scope with the same tenderers it’s highly unlikely it would have altered the outcome of the selected contractor.

The inclusion of the café will have no impact to the current works program as the critical path is being driven by other factors in the construction, specifically the mechanical system. It is anticipated that the arrivals hall (including the eastern half of the proposed café and bar area) will be completed and operational by early March 2018 and the remaining internal upgrade by the end of April 2018.

Cost Implications

The following amounts are all GST inclusive.

The current committed expenditure to design is $420K. With the construction so far, total variations amount to $344K and include the following significant items:

1. External fire hydrants to the entire building to meet BCA requirements, $103K; 2. The removal and replacement of unsuitable ground material, $105K; and 3. The removal of contaminated fill from a redundant underground fuel tank, $60K.

In summary, the committed funding currently stands as follows:

As can be seen, in accepting the café variation Council still has a remaining contingency of $350K which represents 7.8% of the original construction contract sum. This is on top of the approved and pending variations which represent 7.7% of the original contract sum. This is a comfortable contingency to have, especially now that the construction is ‘out of the ground’ which is where the majority of unknowns can be encountered.

Summary

The original project scope was varied to ensure that the tenders received would be within budget. It was encouraging to see that the extremely competitive tenders realised then provided an opportunity to include the café and deliver the project in its entirety as originally planned.

In a collaborative effort between the architects, builder, and staff, it is considered that an optimal design worthy of this important Council asset has been developed to comfortably fit within the available budget. The architects, Clarke Keller, advise that the priced variation from the builder “seems to be fair and reasonable” and so based on the foregoing analysis, the priced variation from Southern Cross Developers has been accepted.

Risk

The risk of not proceeding with the café inclusion compromises the commercial potential of the facility. The level of service offered by the proposed larger and better equipped café and bar area will supplement the increasing passenger numbers predicted.

With an architect currently engaged and a builder established on site, there is significant benefit in incorporating the café into the current construction process. The design and establishment costs have already been absorbed by the project and are now utilising the economies of scale to include the café and bar feature. Deferring the café inclusion into future budgets will only incur additional cost and cause further substantial disruption to airport operations.

The inclusion of the café will not impact on the delivery program, as the critical path is being driven by other factors in the construction. As such, from the point of commercial prudency, logistics and to improve the level of service for all users of the airport terminal, significant efficiencies and benefit is gained with the inclusion of the café and bar in the current construction.

Conclusion

Albury Airport is a major regional airport servicing a regional population and providing essential transport links nationally and internationally. With four airlines providing 180 flights per week, in excess of 260,000 passengers annually utilise the facility. A master plan for the airport terminal building was developed in 2007 to accommodate strong growth and stages one and two were completed shortly thereafter.

In early December 2015 Council was successful in its application to secure NSW Government grant funding to undertake a major upgrade of the Albury Airport Terminal under a 70/30 funding arrangement. Based on the advice of two independent quantity surveyors during the design phase of the proposed new airport terminal upgrade, it was considered ineffective to pursue the inclusion of the café component of the project. Considering this, it was removed from the tender scope in order to contain project costs.

Four shortlisted contractors were invited to tender for the contract and overall provided extremely competitive submissions which were well below independent forecasts, therefore it was recommended that the café construction be reintroduced to the scope of the contract via a post award contract variation to take advantage of timing, operational efficiencies and grant funding.
