S3M-4882# : Don’t Derail GARL—That the Parliament regrets the proposal in the SNP government’s draft budget, published on 17 September 2009, to drop the Glasgow Airport Rail Link (GARL) project; considers that the proposed cut is short-sighted, given that a new airport rail link would provide Glasgow with a direct connection to three international airports and would contribute in a positive fashion to the economic development of Glasgow and west central Scotland, especially at this difficult time; believes that the rail link is an indispensable component of a modern 21st century transport infrastructure for the whole of Scotland; considers that GARL will boost public transport and reduce the number of car journeys to the airport; further considers that the promise to have GARL in place was a vital consideration in the awarding of the 2014 Commonwealth Games to Glasgow, and hopes that, in the course of the budget process, wiser counsel prevails.

S3M-4852# : Charter of Rights for People with Dementia in Scotland— That the Parliament welcomes the principle of a charter of rights for people with dementia, as proposed by the Cross-Party Group on Alzheimer’s; believes that changing attitudes and practices that deny people with dementia their rights is a major challenge facing health and social care groups; notes the recent publication of a number of reports that have highlighted the inefficiencies in the quality of care for people with dementia in the community, in care homes and in long-term hospital care, including the Care Commission report, Better care, every step of the way, and the joint report by the Care Commission and Mental Welfare Commission for Scotland, Remember, I’m Still Me; notes the consultation undertaken over the summer to give people with dementia, their carers, health professionals and care home staff, among other stakeholders, an opportunity to express their views on the issues that they believe a charter should address; welcomes the commitment of Alzheimer Scotland to enable stakeholders to participate by organising roadshows in Irvine, Glasgow, Edinburgh, and ; acknowledges that the charter of rights is based on internationally agreed human rights and is intended to promote the respect, protection and fulfilment of all human rights of people with dementia and their carers, and therefore welcomes the idea of a charter as both an instrument for enabling culture change and as a tool to empower people with dementia.

S3M-4851# Mike Rumbles: Kintore Station and Crossrail—That the Parliament welcomes the announcement that passenger numbers at the reopened Laurencekirk station have exceeded estimations by around 80%; notes that the decision by the previous Scottish Executive to reopen the Laurencekirk station followed a long community-based campaign;

believes that a reopened Kintore station would be similarly successful; expresses its concern that progress on the Aberdeen Crossrail project has stalled under the current , and would welcome funding being brought forward to reopen Kintore station as part of the Aberdeen Crossrail project.

S3M-4814# Angela Constance: Bausch and Lomb Job losses in Livingston—That the Parliament regrets the decision by Bausch and Lomb to pursue closure of its manufacturing plant in Livingston; is deeply concerned that this will result in the loss of 500 jobs; notes that unemployment in West Lothian is at its highest in a decade; applauds the productive, skilled and committed workforce, which has been crucial to the success and efficiency of the Livingston site; also regrets the Bausch and Lomb plans to remove production from Livingston to the Republic of Ireland and is concerned that some of the reasons for this decision include the higher costs involved in closing the Irish site, lower corporation tax in the Republic of Ireland and the lack of access to additional funding streams, given that West Lothian lost its Regional Selective Assistance status in 2006; considers that the 90-day statutory consultation period and plans for phased closure will afford an opportunity for all alternatives to be extensively explored with a view to saving jobs in Livingston; also notes that both Bausch and Lomb and the Scottish Government have confirmed their commitment to continue their dialogue; hopes that both the Scottish Government and Bausch and Lomb will respectfully and meaningfully listen to the views of staff and their representatives, and welcomes the cross-party and community-wide support for the workforce and the determination to succeed that exists in West Lothian despite the current economic challenges.

S3M-4791# Elaine Smith: Highway Robbery—That the Parliament expresses concern at the growing trend for parking enforcement in private car parks and the vast amounts of money being taken from drivers in this regard, including in Coatbridge town centre; recognises that, while it may be legal for companies to charge for the use of their land for parking with appropriate planning consents, there is growing concern that many so-called fines for breaches of private parking rules are neither reasonable nor reflect a fair recompense for loss of business; notes that the law surrounding this issue is the common law of contract, involving companies making their offer by prominently and clearly displaying signs indicating that the relevant car parks are private property requiring payment or subject to time limitations, with the acceptance of the contract being implied by the client’s parking there; further notes that such offer and acceptance would require to be tested in a civil court if disputed; is disturbed by the apparent ease with which car parking companies can access the private details of car owners from the DVLA’s vehicle database to then issue fines to people at their home addresses; agrees with the recent comments by the Automobile Association that “the prevalence of bad and immoral practices is now shocking and unacceptable”, and condemns the often threatening and predatory manner in which these modern-day highway robbers pursue payment of these charges.

S3M-4788# Linda Fabiani: Sconestone—That the Parliament welcomes the initiation of the First Keeper of the Sconestone, the Reverend Neil Galbraith, and the historic associations that the Sconestone has with the ancient traditions and symbols of Scotland; congratulates Hunter Primary School in East Kilbride on entering into the spirit of the ethos of the stone by creating a kindness tree to mark the day, 4 September 2009, when the school hosted the Sconestone prior to its travels around the globe to promote kindness to others as a value that Scots seek to uphold, and congratulates sculptor Warren MacLeod on his design, inspired by ancient Scottish orbs first used by the Scots’ earliest ancestors, and the concept of using Scottish symbolism and values to stimulate acts of kindness in people around the world.

S3M-4780# Des McNulty: Concessionary Travel—That the Parliament welcomes the recommendation of the Review of the Scotland Wide Free Bus Travel Scheme for Older and Disabled People to include seriously injured armed forces veterans in the scheme but notes with disappointment and concern the review’s recommendation that appears to disenfranchise disabled people who receive the lower rate of Disability Living Allowance (DLA) from the scheme; further notes that the review paints a worst-case scenario of the costs of including disabled people who receive the lower rate of DLA, that the methods used to arrive at these projected costs is questionable and that the review also played down the positive social impact that the scheme has on people’s lives; considers that denying disabled people on the lower rate of DLA access to the scheme will damage the main aims and ethos of the scheme, namely to allow disabled people improved access to services, facilities and social networks by free scheduled bus services and so promote social inclusion and improve health by promoting a more active lifestyle for disabled people; notes that previous local schemes operated in Strathclyde and West Lothian provided people on the lower rate of DLA access to concessionary travel schemes and that they supported the national scheme, mirroring its eligibility criteria instead of the stringent criteria that are now adopted; supports disability organisations Leonard Cheshire Disability, Learning Disability Alliance Scotland (LDAS), Inclusion Scotland and many more in challenging the review’s negative recommendation; considers that disabled people’s views and those of the organisations that represent them should be taken into account, and believes that the recommendation on eligibility contained in the review is unfair and that that the national concessionary travel scheme should include those in receipt of the lower rate of DLA.

S3M-4777# Anne McLaughlin: Rights for Constituents to be Represented by Members of the —That the Parliament expresses its concern at the apparent refusal of the UK Border Agency to work with members of the Scottish Parliament seeking to represent constituents in Glasgow; considers that constituents should have the right to be represented by any of their elected representatives, be they councillors, MSPs, MPs or MEPs; considers that the Scottish Parliament is a legitimate body of representation for the people of Scotland, as is recognised by other government agencies in Scotland and the UK, and believes that constituents, who are often vulnerable asylum seekers, have the right to choose who should represent them.

S3M-4738# Margaret Mitchell: Deafblind Scotland—That the Parliament welcomes the work of Deafblind Scotland, based in Lenzie, which seeks to enable Scots who are both deaf and blind to receive the support and recognition that they require to be equal citizens; notes with concern the difficulties faced by deafblind people in freely accessing public transport due to the varying restrictions placed by local authorities on concessionary travel for guide communicators who provide professional communication and guiding support, and believes that cooperation among all relevant bodies will ensure that deafblind citizens can enjoy full access to public transport.

S3M-4733# Elaine Smith: Auchengeich Colliery Disaster—That the Parliament notes the 50th anniversary of the Auchengeich Colliery disaster, which claimed the lives of 47 miners on 18 September 1959; recognises that the tragedy not only directly affected the 41 widows and 76 children left fatherless but also impacted on all of the people of the Chryston area and surrounding communities; appreciates that this devastating event continues to be significant to the people of the area; welcomes local projects set up in memory of the tragedy including the opening of *memorial gardens in St Michael’s and Glenmanor primary schools*, Moodiesburn and a fund-raising amateur boxing tournament in Auchengeich Miners Welfare, both of which ensure continued awareness of the disaster among future generations; commends the local community for the dignity and respect that it has shown to the memory of the victims and their families during commemorative events held annually at the disaster memorial; considers that such events play an important role in ensuring that those who die as a result of work are not forgotten, and welcomes all support for the 50th anniversary commemoration event organised by the Auchengeich Colliery Memorial Committee, which takes place on 20 September 2009.

S3M-4701# Stuart McMillan: World Pipe Band Championships—That the Parliament congratulates Simon Fraser University of Vancouver, Canada on winning the World Pipe Band Championships; notes the success of the event, held at Glasgow Green, which attracted over 40,000 spectators and bands from 16 countries; further notes that Strathclyde Police Pipe Band was the highest-placed Scottish band, finishing an excellent fourth overall out of over 200 bands, and considers that its future success will be jeopardised if planned cuts to Strathclyde Police Pipe Band are implemented.

S3M-4696# Sandra White: Concerns over Children’s Beauty Salon—That the Parliament notes with concern the opening in Glasgow of Scotland’s first beauty salon targeted at children, Tantrims and Tiaras, which caters for tots to 16-year-olds, offering pamper parties accompanied with glasses of alcohol-free bubbly served up in champagne glasses; believes that the further erosion of childhood innocence and the continuing sexualisation of children pressurises children into acting and behaving in ways that are detrimental to their natural healthy development, leading to possible problems in the future such as emotional distress, anxiety, low self-esteem, eating disorders and depression; notes the findings of The Good Childhood Inquiry, which was commissioned by The Children’s Society with the aim of renewing society’s understanding of modern childhood and which, alongside its other recommendations, believes that the premature sexualisation of children should be discouraged, and hopes that this inquiry and other work done in this field will help inform and shape policy toward providing children with the best possible childhood.

S3M-4646# Robert Brown: Tokyo Beer—That the Parliament is concerned at the extent of health and criminal justice problems associated with excessive and unhealthy alcohol consumption in Glasgow and other parts of Scotland; notes the production of Tokyo beer by BrewDog brewery; further notes that Tokyo is being cited as Britain’s strongest beer; is

concerned that, with an alcohol content of 18.2%, each 330ml bottle will contain the equivalent of six units of alcohol, which is twice the recommended daily limit for women set by health professionals; recognises the significant health and social harms associated with irresponsible drinking; further recognises that major cultural change is required if Scotland is to tackle its damaging relationship with alcohol, and therefore believes that promoting drinks of this kind with both a very high alcohol content and unit volume is reprehensible in a society where the medical evidence shows that, across all age groups and socio-economic categories, individuals are drinking too much alcohol.

S3M-4644# Shirley-Anne Somerville: Votes for Women—That the Parliament welcomes the new exhibition, Votes for Women: The Women’s Suffrage Movement in Edinburgh, at the Museum of Edinburgh from 31 July 2009 to 9 January 2010; notes that the exhibition uses photos and artefacts to chart the long struggle to win the vote, which was eventually granted to all women in 1928; further notes that at the height of the campaign in October 1909 a grand pageant was held in Edinburgh and to honour its 100 year anniversary and history of women’s activism a re-enactment march will take place on 10 October 2009; encourages all women to join in the parade in honour of all suffragettes who fought hard for all sisters to have a free vote; congratulates the Gude Cause, based at the Edinburgh Peace and Justice Centre, for organising the march and complementary events, and further notes that more information can be found at www.gudecause.org.uk.

S3M-4641# Shirley-Anne Somerville: Celebrating the Scottish-Polish Connection—That the Parliament commemorates the 70th anniversary of the arrival of the Polish navy in Leith on 1 September 1939; notes that the three Polish destroyers Burza (Storm), Grom (Thunder) and Blyskawica (Lightning) saw service alongside the Royal Navy during the Second World War, with Grom being sunk with heavy loss of life on 4 May 1940; recognises that the arrival of the destroyers marked the beginning of a strong wartime Scottish-Polish connection with several squadrons of the Polish Air Force serving in the country and Polish ships based at a number of Scottish ports, including Rosyth, Greenock, Port Glasgow, Ardrossan, Gourock, Dundee and Scapa Flow; further recognises that the main influx of Poles during the war occurred following the collapse of France in 1940 when some 30,000 Polish troops were evacuated to the United Kingdom and were stationed in Scotland, many of whom settled here; notes that a Polish house was organised in Edinburgh by the British Council to help the Polish community socially and educationally at this time; celebrates not just the wartime links but the long historical connection between Scotland and Poland, which includes upwards of 40,000 Scots migrating to Poland during the 17th century, and applauds the work of many organisations, including the Polish Institute and Sikorski Museum and the Scottish Polish Cultural Association, for helping to develop awareness of the historical connections, promote cultural understanding and foster strong relations between modern generations of Scots and Poles.

S3M-4106# Dr Richard Simpson: Overnight Freight Trains to Longannet—That the Parliament recognises the serious problems being experienced by residents in the Riverside, Broomridge and Braehead areas of , Clackmannanshire, Kincardine and Larbert as a result of heavy coal freight trains being introduced on the railway line; understands that this is having a damaging effect on the quality of life of local residents, many of whom lived comfortably in proximity to this busy line until the introduction of the coal trains; notes that Network Rail has stated that it will examine the noise and vibration test data being made available to it by Clackmannanshire and Falkirk councils respectively; regrets that Stirling Council has so far not undertaken similar studies; welcomes the efforts by Network Rail to tackle line and signalling problems at hot spots along the line, and considers that, notwithstanding the vital importance of transporting coal to Longannet for Scotland’s energy needs, residents in these areas would welcome a reduction in the environmental impact of these trains.

Introduction

1. The Bureau is invited to agree the following motion—

Bruce Crawford on behalf of the Parliamentary Bureau: That the Parliament agrees that the draft Mutual Recognition of Criminal Financial Penalties in the European Union (Scotland) Order 2009 be approved.

Purpose and consideration by Committee

The draft Mutual Recognition of Criminal Financial Penalties in the European Union (Scotland) Order 2009 2. The purpose of this Order is to implement in Scotland the European Union Framework Decision on the Application of the Principle of Mutual Recognition to Financial Penalties (2005/214/JHA). In a wide range of offences, it will enable Scottish fines and fixed penalties to be enforced elsewhere in the EU and vice versa.

3. The Justice Committee considered the instrument at its meeting on 15 September 2009. After debate, the motion to approve the instrument was agreed to without division, and the committee agreed its report on the instrument on 22 September 2009.

CRIMINAL JUSTICE AND LICENSING (SCOTLAND) BILL – EXTENSION TO STAGE 1 TIMETABLE

1. At its meeting on 18 March 2009, the Parliament agreed that consideration of the Criminal Justice and Licensing (Scotland) Bill at Stage 1 be completed by 9 October 2009. On 17 June, the Parliament agreed that the Stage 1 timetable be extended to 30 October.

2. At its meeting on 22 September, the Justice Committee agreed to request a further extension to the Stage 1 deadline to allow additional time to complete its Stage 1 report. A letter from the Convener of the Justice Committee to the Presiding Officer, which outlines the committee’s progress with Stage 1 consideration of the Bill, is attached at Annex A.

3. The Scottish Government has indicated that it is content with the proposed extension.

4. The Bureau is therefore invited to recommend to the Parliament that the deadline for consideration of the Bill at Stage 1 be further extended to 27 November 2009.

Stage 1 timetable: Criminal Justice and Licensing (Scotland) Bill

I am writing to update you on the Justice Committee’s progress with Stage 1 consideration of the above Bill. As you know, the Parliament has agreed that Stage 1 should be completed by 30 October (which would require the Stage 1 debate to take place in the first week after the October recess).

Yesterday’s Justice Committee meeting was the third in succession at which the Committee has devoted the majority of the available time to detailed consideration of a draft report containing over 500 paragraphs of text. So far, the Committee has considered 267 paragraphs. As the programme of Stage 1 evidence-taking prior to the summer recess did not allow time for substantial discussion of the issues raised in evidence, the Committee has been having those discussions alongside consideration of the draft report text. Although many of the most difficult issues have now been dealt with, it was clear by the end of today’s meeting that the Committee will need more time than we had originally envisaged to finalise the Stage 1 report.

Accordingly, the Committee agreed unanimously at the end of today’s meeting that I should write to you to seek an extension to the Stage 1 timetable. It has become clear to all of us that this Bill raises a large number of complex and controversial topics consideration of which cannot easily be rushed. We will continue to devote as much time as we can to making progress with the draft report – indeed, we are planning to continue next week’s meeting into the afternoon for that purpose. However, in my estimation, we will need at least two more meetings (including next week’s) to complete discussion of the issues raised – and then a further two meetings to finalise our draft conclusions. I would therefore invite the Bureau to recommend extending the Stage 1 deadline by at least four weeks. I would, of course, be happy to attend a Bureau meeting to discuss this, if that would be helpful.

PARLIAMENTARY BUREAU

FINANCE COMMITTEE: REQUEST TO MEET IN GLASGOW

Nature of request

1. The Finance Committee seeks the Parliamentary Bureau’s approval to meet in Glasgow on Monday 9 November 2009, as part of its consideration of the 2010-11 budget process.

Number of participants

2. It is intended that all committee members and four members of the clerking team will attend the formal meeting, along with staff from security, broadcasting and official report. As the meeting forms a fundamental part of the budget scrutiny process, it is also necessary for the committee’s budget adviser to attend.

3. The committee has agreed that it wishes to follow the format used successfully in previous years of holding meetings outside Edinburgh at the Draft Budget scrutiny stage of the annual budget process. The meeting will involve morning workshop sessions with representatives of local organisations and a formal committee meeting in the afternoon, which will include taking evidence from the Cabinet Secretary for Finance and Sustainable Growth.

4. The morning workshops with local organisations are intended to provide committee members with an insight into how national priorities and spending plans impact on the local area, and to allow discussion on the organisations’ engagement with the budget process. The outcomes of the workshops will help to inform questioning at the committee meeting in the afternoon, and the committee’s report on the budget and subsequent Parliamentary debate.

5. It is proposed that the meeting is held on a Monday in order to minimise any disruption to the business of the Parliament or members’ attendance at other committees.

6. The committee believes that the meeting will encourage public participation, particularly among those who are unable to, or have difficulty in, attending a meeting in Edinburgh, and raise awareness of the work of the Parliament.

7. Previously, the committee has held meetings across Scotland (in Orkney, Skye, Kirkcudbright, Perth, Motherwell, Cupar, Elgin, Dumfries, Dundee and Ayr). For this visit, the committee has chosen Glasgow as a suitable area and clerks have identified the City Chambers as the most appropriate venue.

REMOVAL OF MOTIONS FROM THE BUSINESS BULLETIN

Background

1. Under Rule 8.2.8 of Standing Orders, the Bureau may remove from the list of admissible motions any motion that has been on the list for more than six weeks without a date for it to be taken by the Parliament being appointed in the business programme.

2. The Bureau has agreed that all motions should be removed from the Bulletin after six weeks (excluding recess time) unless:

(a) the motion has the support of at least 30 other Members and these supporters came from more than two political parties; or

(b) the motion remains highly topical; or

(c) the motion has been selected for Members’ Business.

3. The attached spreadsheet lists all motions over six weeks old on 15 September 2009 (i.e. those lodged on or before 16 June 2009) and includes the number of supporters and dates of five most recent registrations of support.

4. Based on the criteria in paragraph 2, it is recommended that the following motion from the attached list be retained (note that in cases where the number of supporters exceeds 30, the topicality of the motion and the extent of the recent support have also been taken into account when making this recommendation).

Introduction

1. The deadlines relating to the submission of names and questions for Question Times on 29 October 2009 both fall in October recess. In order for Members to be informed before the start of recess that they have been selected to submit a question for the first Question Times after recess, it has become standard practice for the Bureau to exercise its powers under Rule 13.6A to propose an earlier deadline for the submission of names. The Bureau has not previously seen the need to propose an earlier deadline for the subsequent submission of questions.

Recommendation

2. In line with previous years, the Bureau is invited to propose that the deadline for the submission of names for Question Times on 29 October 2009 be brought forward to 12 noon on Wednesday 7 October 2009.
