#407/2016 BE IT RESOLVED THAT the General Operating Fund List of Accounts numbered #1582 to #1642 totalling $447,710.59 and the Utility Operating Fund List of Accounts numbered #3626 to #3639 totalling $2,333.69 be hereby approved.

#408/2016 BE IT RESOLVED THAT the Municipality of McCreary Draft Financial Statements as at November 30, 2016 be approved by Council as prepared by the Chief Administrative Officer on the understanding that these statements are subject to audit by Meyers Norris and Penny and do not include consolidated entities.

#409/2016 BE IT RESOLVED THAT the Municipality of McCreary advise the Minister of Indigenous and Municipal Relations that its general operating fund expenditures may exceed its revenue and transfers incurring a deficiency and requests approval to incur a deficiency in the Municipality of McCreary General Operating Fund in accordance with Subsection 165 (1) of The Municipal Act.

#410/2016 BE IT RESOLVED THAT the Municipality of McCreary Draft Consolidated Financial Statements for the Year Ended December 31, 2015 as prepared by MNP LLP, be accepted as provided.

BE IF FURTHER RESOLVED THAT the Reeve and the Chief Administrative Officer be hereby authorized to sign any and all documents necessary to accept/approve the above mentioned 2015 Consolidated Financial Statements for the Municipality of McCreary.

AND BE IT FURTHER RESOLVED THAT the Notice indicating availability of the said Statements for inspection be published in one issue of the Banner upon receipt of the finalized copy of the 2015 Audited Financial Statements.

#411/2016 WHEREAS it was necessary to replace the North Lift Station Pump and purchase Trash Pumps on an emergency basis;

AND WHEREAS this was not included in the 2016 Financial Plan;

THEREFORE BE IT RESOLVED THAT the Municipality of McCreary re- direct the amount of $8,000.00 included in its 2016 Capital Budget for Isolation Valves towards the cost of replacing the North Lift Station Pump in the amount of $5,737.60 and the cost of purchasing Trash Pumps in the amount of $2,262.40.

#432/2016 BE IT RESOLVED THAT the Municipality of McCreary set its regular meeting schedule for 2017 in accordance with Paragraph 8.0 of its Procedural By-Law #9/2016 as follows:

January 18, 2017; February 15, 2017; March 15, 2017; April 19, 2017; May 17, 2017; June 21, 2017; July 19, 2017; August 16, 2017; September 20, 2017; October 18, 2017; November 15, 2017; December 20, 2017.

b) Association of Manitoba Municipalities Convention Accommodations 2018: TABLED.

c) Night Hunting Concerns: This matter is to be researched with the Association of Manitoba Municipalities to determine if there is any lobbying action that could be supported as a united voice.

STANDING COMMITTEES OF COUNCIL:

a) Legislative, Finance, Personnel and Policy: (Roy–Cripps-Kohlman-McLauchlan)

Collective Agreement: The contract with all revisions has not yet been received from the Union.

#433/2016 BE IT RESOLVED THAT Tyler McFadyen be encouraged to use his 2016 vacation entitlement as he is able to on the understanding that 2016 vacation entitlement remaining effective December 31, 2016 be carried over to 2017 to a maximum of eight (8) days.

#434/2016 BE IT RESOLVED THAT the Municipality of McCreary make application under the Manitoba Urban/Hometown GREEN TEAM program for student employment for two employees in the Public Works Department for a maximum of 4 days per week at 8 hours per day for 8 weeks of employment per student. CARRIED.

#435/2016 BE IT RESOLVED THAT the Municipality of McCreary make application under the Canada Summer Jobs program for student employment for one employee in the Administration Department for a maximum of 35 hours of employment per week for a maximum of 16 weeks of employment at an hourly rate of pay equal to minimum wage at the time of employment. CARRIED.

#436/2016 BE IT RESOLVED THAT the Municipality of McCreary hereby agrees to renew and be responsible for 50% of premiums payable to Western Financial Group to provide its employees and elected officials with the Association of Manitoba Municipalities Group Health & Dental Insurance Plan at premiums as set by Western Financial Group for 2017. CARRIED.

#437/2016 BE IT RESOLVED THAT the Municipality of McCreary hereby agrees to pay and be responsible for 50% of premiums payable to Municipal Employee Benefits Program to provide its employees with the full benefit package including Pension Plan, Disability Income Plan and Group Insurance Plan at premiums as set by Municipal Employee Benefits Program for 2017. CARRIED.

b) Protective Services: (Buchanan-McLauchlan-Smith) Development and Building Permits Review: 311 Burrows Road: The Building Inspector is to finalize the file with the support of Council of enforcement efforts. 603 Rosamond Road: Permits are required as per by-laws in place. NE 27-20-14 W: A Development Permit Application has been received. NE 35-21-16 W: A further courtesy letter is to be sent.

#439/2016 BE IT RESOLVED THAT THE Municipality of McCreary pay an honorarium to Pat Blake, Volunteer Emergency Plan Coordinator, in the amount of $500.00 in recognition of her time spent and $500.00 as expenses incurred.

Grade Crossing Improvement Program – Information Sharing from CN Railway The Operations Foreman is gathering information.

Survey of Aline Drive Property Owners: The responses compiled were referred to the 2017 Budget File for further consideration.

Review of Urban Snow Clearing Policy: A draft is to be prepared as per instructions received.

#440/2016 BE IT RESOLVED THAT THE Municipality of McCreary pay an honorarium to Albert Fayant in the amount of $500.00 in recognition of his time spent and $250.00 as expenses incurred for training and assistance provided on grader operation and road maintenance.

Building Security and Insurance Claim – 432 First Avenue: Installations are proceeding. Quotes have been requested.

#443/2016 BE IT RESOLVED THAT the quote of Way To Go Consulting Inc. to prepare a water and sewer utility rate study for the Municipality of McCreary Water and Sewer Utility in accordance with the terms and requirements of the Guidelines as established by The Public Utilities Board be accepted as follows:

1. Preparation of the Study: $3,800.00

2. Preparation for and Attendance at a Hearing of the Public Utilities Board Of Manitoba if necessary: $ 600.00

3. Other Fees - Mileage $ 0.48/kilometer

#444/2016 BE IT RESOLVED THAT Tyler McFadyen, Operations Foreman, be hereby authorized to attend the Annual Conference and Trade Show being hosted by the Manitoba Water and Wastewater Association on January 29 through February 1, 2017 in , Manitoba on the understanding that the registration fee of $400.00 plus G.S.T., accommodations for two nights, meals not included in the registration, and use of the Municipality of McCreary Truck be at the expense of the Municipality of McCreary.

NOTICE OF MOTION:

#446/2016 BE IT RESOLVED THAT the Municipality of McCreary proceed to review and consider reversing Resolution #10/2016 dated January 27, 2016 and passed during its January 27, 2016 Special Meeting as requested in a Notice of Motion received from Councillor Clayton Kohlman made during the Municipality of McCreary Regular Meeting held on November 16, 2016 and as recorded in the approved minutes of the said meeting.

#447/2016 WHEREAS the Municipality of McCreary has received a Notice of Motion at its regular meeting held November 16, 2016 from Councillor Clayton Kohlman requesting that the Municipality of McCreary reconsider and reverse Resolution #10/2016 dated January 27, 2016 in its entirety in accordance with the said Notice of Motion and Subsection 139(1)(b) of The Municipal Act.

THEREFORE BE IT RESOLVED THAT Resolution #10/2016 passed at the January 27, 2016 Special Meeting of the Municipality of McCreary and which read as follows:

“WHEREAS Subsection 365(2) of The Municipal Act provides that Council may in any year designate the immediately preceding year or any earlier year as the year for which properties, the taxes in respect of which are in arrears for the year, must be offered for sale by auction to recover the tax arrears and costs.

THEREFORE BE IT RESOLVED THAT 2015 be the designated year for tax sale purposes for the fiscal year 2016.

THEREFORE BE IT FURTHER RESOLVED THAT the CAO be authorized to proceed with the Tax Sale Process in accordance with The Municipal Act and the Municipality of McCreary Tax Sale Policy.”

Councillor Shawn Buchanan gave his Notice of Motion in accordance with Subsection 139(1)(b) of The Municipal Act to review and reverse Resolution #358/2016 and for Council to reconsider the matter of the layoff of Lorne McNarland effective December 10, 2016. Based upon this Notice of Motion this matter will be reviewed at the next regular meeting on January 18, 2017.

REMARKS: The next Regular Meeting is scheduled for January 18, 2017 at 7:00 p.m.
