In recent years we’ve seen frustrated owners opt out of the traditional design/bid/build approach in favor of design/build contracts for their projects. At Merchants Bonding Company, we are willing to consider design/build contracts for the well qualified contractor who is financially strong, has experience relevant to the contract, and has effectively mitigated the additional exposure being assumed when including design in the contract. The challenge we face, along with the rest of the surety industry, is that bonds were never intended to cover design and the long-term warranties typically associated with the design part of a project. While surety professionals understand construction, we still have a lot to learn about design.

Working ‘unlicensed’ in California can really ‘sting’. If you are ‘planting’ pipe are you a contractor, a farmer or both? Another contractor discovers that his ‘judgment’ has limitations that might never go away…

As 2013 winds down, we can look back at the many illegal and unlicensed individuals that were taken off the street by the CSLB. While there is no way to fully alleviate unlicensed activities in CA, the Contrac- tor’s Board Enforcement Unit is doing its best to level the playing field for those who are properly li- censed and playing by the rules. For instance, in late July, fifteen illegal individuals were arrested and cited in Concord for working without a contractor’s license. According to the CSLB, back in May State- wide Investigative Fraud Team (SWIFT) Investigators were in Ridgecrest “doing what they do best…citing (another fifteen) illegal operators masquerading as licensed contractors”. Eight unlicensed individuals were ‘stung’ and cited by the CSLB in one San Jose neighborhood last February, while more recently in September, the Board apprehended another eight suspected illegal “contractors” bidding work in Santa Monica. To date, SWIFT, in conjunction with various State and local government agencies, have con- ducted over 30 stings throughout the State. It is common knowledge that some homeowners fail to check whether a person has a valid contractors license or go with the unlicensed operator thinking they are saving money. “Unlicensed contractors put homeowners in jeopardy,” said CSLB Registrar Steve Sands. “If a contractor isn’t properly licensed and insured, the homeowner could pay more than ex- pected to get the job done right or could be liable for accidental onsite injuries.”

Q: We are a General Building contractor and a question has been raised as to whether a contractor’s li- cense is required for installing irrigation and drainage pipelines? All of this work is done on agricultural operations. Thank you in advance for your response. A: B&P Code section 7049 allows for an agricultural exemption from requiring a contractor’s license for any “construction or operation incidental to the construction and repair of irrigation and drainage ditches of regularly constituted irrigation districts, reclamation districts, or to farming, dairying, agricul- ture, viticulture, horticulture, or stock or poultry raising, or clearing or other work upon the land in rural districts for fire prevention purposes”. So if the work being done is strictly for agricultural operations, then it appears based on the above code section that a Contractor’s License would not be needed. However, if you would like an official determination I recommend contacting the CSLB.

Q: I had a judgment on my previous sole owner license but the judgment is over 8 years old. I recently applied for a new contractor's license in the name of my corporation. The application was denied based on the 8-year old judgment that is "unsatisfied". It was my understanding that judgments go away after a period of 7 years. Is that not true? A: It is our understanding that the CSLB has no statute of limitations for a judgment on a license. The Superior Court of California does have a 10-year statute of limitations. After 10 years if the Superior Court does not renew the judgment, you can provide proof of non-renewal to the CSLB in order to have the judgment forgiven.

Punctures and cuts are common on-the-job injuries. Punctures occur when objects such as splinters, nails, glass, and sharp tools such as scissors and knives pierce the skin and cause a small hole. Cuts occur when sharp objects, including knives, scissors, sharp metal edges, and glass slice through the skin superfi cially or into the deeper layers of fat, tendons, muscles, and even bone.

The best way to deal with cuts and punctures is to avoid getting them in the fi rst place. Wear appropriate clothing on the job such as sturdy shoes or work boots, long sleeve shirts, and long pants. Consider sturdy coveralls to protect your skin from sharp and fl ying objects. Wear personal protective equipment (PPE) appropriate to your job tasks such as gloves, safety glasses, work boots, gauntlets, and chaps. Follow safe work practices and know how to use your tools properly. Inspect, maintain, and replace your tools when necessary. Always use the correct tool for the job. Ensure that blades on cutting tools are sharpened; dull cutting surfaces can cause accidents. When working with sharp tools, always know where both of your hands are at all times. Practice good housekeeping with your sharp and cutting tools by sheathing and storing them properly. Place tools far back on workbenches and shelves, not against the edge where someone walking by might get stuck.

If you have to pick up broken glass or metal shards, use a broom and a dustpan or pieces of cardboard. Never pick up broken glass with your bare hands. Dispose of sharp objects properly in rigid sided containers that will not get punctured and spill. Label these containers with the word “Sharp” to warn coworkers of the hazard. Never reach into a garbage can with your hands or try to “tamp” it down with your hands or booted feet in case someone has improperly disposed of a sharp object or even a syringe. To properly dispose of syringes, pick them up with tongs and place them into hard plastic medical waste containers.

If you receive a puncture or cut on the job, notify your supervisor immediately. If you can, gently wash the area with soap and water. To stop bleeding, apply gentle pressure to the wound with clean gauze, cotton, or other absorbent material. When bleeding has stopped, apply an antibacterial ointment and a clean dressing to the wound. If you cannot stop the bleeding, if the wound is very large, or if you are impaled with an object, seek medical attention. Watch your wounds for signs of infection including fever, severe pain, redness beyond the wound edge, swelling, warmth, or pus drainage. Get medical attention immediately if you suspect infection.

If your wound was caused by stepping on a nail or other sharp object in contact with the soil, you may be exposed to the bacteria that cause tetanus. Consider getting regular boosters for tetanus every fi ve to ten years. If your wound was caused by a needlestick, seek medical testing and treatment due to a potential exposure to bloodborne pathogens. Consider a Hepatitis B vaccination if you are exposed to potential needlesticks.Any way you cut it, puncture and cut wounds expose you to pain and potential infection, so avoid them through good work practices!
