2 9.1 Introduction

3 As required by Section 3.3 of the NEB’s Filing Manual, Section 9 describes the public 4 consultation program undertaken by Keystone for the Cushing Expansion.

5 The contents of this section are organized to reflect the topics outlined in the Filing Manual 6 guidelines and include:

7 • principles and goals of the consultation program;

8 • design of the consultation program;

9 • implementation of the consultation program;

10 • stakeholder issues;

11 • aboriginal consultation;

12 • future consultation activities; and

13 • a summary of communications materials.

14 In addition, Section 9 contains two appendices. Appendix 9-1 is a compilation of the 15 communications materials that were made available to various stakeholders. Appendix 9-2 16 contains five consultation tracking tables, grouped as follows:

17 • community leaders;

18 • federal and provincial government representatives;

19 • aboriginal stakeholders;

20 • emergency responders; and

21 • other stakeholders.

22 Keystone adopted TransCanada’s standards of consultation, developing and adapting its 23 consultation program according to the nature, location and effects of the Cushing Expansion. 24 TransCanada’s ongoing community and stakeholder relations programs are designed to 25 encourage stakeholders to learn about proposed or ongoing activities, be engaged in the TransCanada Keystone Pipeline GP Ltd. 1 consultation process and be involved in addressing issues and opportunities that may affect them.

2 9.2 Principles and Goals of the Consultation Program

3 The principles and goals of Keystone’s public consultation program are described in subsections 4 9.2.1 and 9.2.2.

5 9.2.1 Principles

6 Keystone used an informative and consultative approach to ensure stakeholder and public 7 awareness of the proposed Cushing Expansion. Stakeholders directly or indirectly affected by the 8 proposed construction and operations of new facilities were consulted and informed of the 9 proposed Cushing Expansion prior to this application. Any concerns or recommendations voiced 10 by the stakeholders have been or will be considered in the planning phase and beyond. All 11 stakeholders were engaged in a fair, honest, consistent and timely manner by Keystone’s 12 representatives.

13 9.2.2 Goals

14 The goals of the consultation program, which are consistent with Guide 3.3 of the NEB’s Filing 15 Manual, are to:

16 • formally introduce the Cushing Expansion to key stakeholders, including elected and 17 non-elected officials, individual landowners who may be potentially affected by the 18 Cushing Expansion, neighbouring municipalities and other interested parties;

19 • actively seek and consider comments on the pipeline route and pump station site 20 selection, potential environmental and socio-economic effects of the Cushing Expansion, 21 and any required mitigation or enhancement measures;

22 • identify and respond, where possible, to public issues prior to the filing of this 23 Application; and

24 • initiate a communications program with as many relevant stakeholders as possible that 25 will continue throughout the subsequent construction and operations phases of the 26 Cushing Expansion to ensure future stakeholder concerns and issues, if any, are 27 addressed appropriately and in a timely manner. 1 In support of these goals, a collaborative consultation approach has been adopted to address 2 stakeholder issues with the objective of resolving and/or minimizing impacts and to address 3 concerns quickly and effectively.

4 9.3 Design of the Consultation Program

5 This subsection provides:

6 • a discussion of the public consultation process design considerations; and

7 • the methodology and approach for the program.

8 TransCanada’s consultation process differs in its approach according to the nature, location and 9 effects of proposed activities on relevant stakeholders. In the case of the Cushing Expansion, the 10 consultation process specifically addresses:

11 • new pump stations to be constructed in and Manitoba to accommodate 12 additional contracted crude volumes;

13 • the addition of pumping units at Approved Facilities;

14 • general project updates, including communication of the recent NEB Reasons for 15 Decision; and

16 • Keystone’s commitment to ongoing consultation and community relations.

17 9.3.1 Design Considerations for Pump Station Construction in Saskatchewan and 18 Manitoba

19 Construction of the proposed additional seven pump stations in Saskatchewan and Manitoba will 20 temporarily disturb residents adjacent to these facilities and, potentially, others in the host 21 communities/municipalities. It was anticipated that these land disturbance activities may raise a 22 level of interest and potential concern from landowners and other stakeholders, necessitating 23 consultation to discuss the expansion and resolve issues and concerns. 1 9.3.2 Stakeholder Knowledge of Pipelines and Associated Facilities

2 Landowners and other stakeholders in Saskatchewan tend to be familiar with the oil and gas 3 industry and the dynamics of pipeline construction and operations. Manitoba stakeholders, while 4 less familiar with pipelines, were engaged during consultation for the Keystone Pipeline prior to 5 Keystone’s application for a Certificate of Public Convenience and Necessity and, thus, are 6 today more aware and knowledgeable. Nonetheless, detailed information about pump station 7 construction and operations was provided to stakeholders throughout Saskatchewan and 8 Manitoba during this round of consultation for the Cushing Expansion.

9 9.3.3 Stakeholder Familiarity with TransCanada

10 TransCanada has established positive relationships with the majority of affected landowners and 11 other stakeholders over the past 50 years. Landowners are familiar with TransCanada and its 12 pipeline operations. Ongoing community relations and public awareness initiatives ensure that 13 many of the local authorities and other stakeholders are informed of TransCanada’s business 14 interests, including the Keystone Pipeline, in their area.

15 Stakeholder familiarity with pipelines, pump stations and TransCanada was important in

16 determining the level and type of engagement for the consultation process. In addition to

17 consultation with directly affected landowners, Keystone determined it would also engage

18 community leaders in the seven Rural Municipalities (“RMs”), as well as towns and villages in

19 those RMs, that would host the proposed additional pump stations. Landowners with disturbance

20 on their land due to proposed pump station construction and operations were also contacted and

21 engaged to ensure their input into the project and to obtain land access.

22 9.3.4 Stakeholders and Pump Stations

23 In support of the Cushing Expansion, the Keystone team consulted with stakeholders for the 24 RMs in which the additional seven proposed pump stations in Manitoba and Saskatchewan will 25 be located, as well as those for the nearest town or village. This consultation program consisted 26 of face-to-face meetings with representatives of the following communities:

6 • Village of Pense, Saskatchewan

7 • Village of Belle Plaine, Saskatchewan

8 • Rural Municipality of Silverwood #123, Saskatchewan

9 • Town of Whitewood, Saskatchewan

10 • Rural Municipality of North Cypress, Manitoba

11 • Town of Carberry, Manitoba

12 • Rural Municipality of Hamiota, Manitoba

13 • Town of Hamiota, Manitoba

14 • Rural Municipality of Miniota, Manitoba

15 These meetings were designed to inform communities about the proposed Cushing Expansion 16 and, more specifically, the need for additional pump stations and associated facilities. 17 Additionally, these meetings were undertaken to determine whether communities in proximity to 18 these additional facilities had concerns or questions and to ensure any concerns were 19 appropriately addressed.

20 In addition to those located in proximity to the proposed additional seven pump stations, 21 stakeholders along the entire Keystone Pipeline corridor were advised, through an information 22 package mail-out, of the proposed Cushing Expansion and associated facilities. These mail-outs, 23 which included a copy of the latest Keystone Pipeline newsletter and expansion-specific fact 24 sheets, provided details of the additional pipeline capacity, the proposed regulatory and 25 construction schedule, as well as technical information about pipeline and pump station 26 construction and operation. The mail-outs also provided stakeholders with company contact 27 information for those who may have questions or concerns about the Keystone Pipeline and the 28 Cushing Expansion. 1 9.4 Implementation of the Consultation Program

2 The following key activities were undertaken as part of the Cushing Expansion 3 consultation program:

4 • ongoing maintenance and tracking of the Keystone toll-free telephone line;

5 • ongoing maintenance and tracking of the Keystone email in-box;

6 • ongoing maintenance and updating of the Keystone website;

7 • identification of key stakeholders;

8 • development and updating of a comprehensive stakeholder mailing list;

9 • development and updating of the Keystone information package;

10 • distribution of Cushing Expansion information to key stakeholders;

11 • development and distribution of a stakeholder newsletter;

12 • distribution of news releases or bulletins about the achievement of milestones;

13 • personal contact with directly affected landowners;

14 • distribution of project updates and expansion plans with Federal and Provincial 15 government representatives and agencies;

16 • meetings with Municipal government officials and staff;

17 • discussions with Aboriginal communities;

18 • distribution of project updates and expansion plans with all other stakeholders, including 19 emergency responders and special interest groups;

20 • recording of notes from meetings, telephone conversations and written correspondence; 21 and;

22 • identifying and working toward the resolution of stakeholder issues.

23 9.4.1 Keystone Toll-free Line, Email and Website

24 Stakeholder consultation was formally initiated when the Keystone Pipeline Project was 25 originally announced on February 9, 2005. In conjunction with the public announcement of the 26 Project, the Keystone website e-mail account ([email protected]) and a toll-free 27 telephone line (1-866-717-7473) were established. 1 monitored to ensure Keystone representatives continue to address any questions, issues and/or 2 concerns that may arise.

3 9.4.2 Consultation Activities

4 Keystone consulted with Rural Municipalities (“RMs”) and towns/villages (including, 5 regional/local emergency response representatives) directly impacted by the proposed additional 6 seven pump stations required on the Keystone Pipeline in Saskatchewan and Manitoba. As well, 7 some RMs and villages not directly impacted were also consulted due to their proximity to the 8 proposed pump station locations or because RM offices were co-located and, in some cases, 9 served by the same Administrator.

10 During this round of consultation, Keystone provided community stakeholders with a verbal 11 update on the Keystone Pipeline project and the proposed Cushing Expansion.

12 Additionally, an updated information package was distributed to all Keystone stakeholders, 13 including those not directly impacted by the Cushing Expansion. This information package 14 included fact sheets and maps on the Cushing Expansion plans, updates on the Keystone Pipeline 15 project and generic fact sheets on: pump station operations; pipeline construction; safety and 16 integrity management; and pipeline operations generally.

17 None of the communities expressed any significant concerns related to the Cushing Expansion 18 and were generally thankful for Keystone’s efforts to keep them informed. The communities 19 expressed satisfaction with TransCanada’s operating record in their region and their ongoing 20 relationship with company representatives.

21 The Cushing Expansion consultation program included contact with all landowners located 22 within a two-kilometre radius of the proposed seven pump stations. These landowners were also 23 provided with an information package. No significant issues or concerns were raised by 24 landowners.

1 A summary of communication materials is provided in Table 9.1 and copies are found in 2 Appendix 9-1. As well, consultation tracking tables outlining specific meetings and 3 issues/questions raised by stakeholders – and actions taken by Keystone representatives to 4 address issues – are included in Appendix 9-2.

5 9.5 Issues Raised by Communities

6 The key issues raised by municipal stakeholders were economic impact/significance of the 7 Keystone Pipeline and Cushing Expansion (i.e., as a source of potential local/regional revenue 8 and employment), environmental impacts (e.g., noise, aquifers) and emergency response 9 procedures (crude oil vs. natural gas incidents).

10 9.6 Aboriginal Consultation

11 Keystone consulted with Aboriginal communities that could potentially experience impacts from 12 the proposed additional seven pump stations required as part of the Cushing Expansion.

13 During this round of consultation, Keystone provided potentially affected communities, or any 14 communities expressing an interest in the proposed expansion, with a verbal update on the 15 Keystone Pipeline, emphasizing the Cushing Expansion plan (with an explanation of the reason 16 for the expansion and the regulatory process it entailed). In Saskatchewan, Keystone contacted 17 the Treaty Four organization in compliance with a 2000 protocol agreement with TransCanada. 18 Keystone also met with the Treaty One organization in Manitoba. TransCanada is currently 19 involved in discussions with Treaty One regarding an overall Memorandum of Understanding.

20 An updated information package was distributed to these organizations. This information 21 package included fact sheets and maps on the Cushing Expansion plans, updates on the Keystone 22 Pipeline project and generic fact sheets on: pump station operations; pipeline construction; safety 23 and integrity management; and pipeline operations generally.

24 None of these organizations expressed any significant concerns related to the Cushing Expansion 25 plans. TransCanada Keystone Pipeline GP Ltd. Cushing Expansion Application Section 9: Consultation Page 9 of 12

1 Standing Buffalo Dakota First Nation has not responded to Keystone’s requests to meet to 2 provide information on the Cushing Expansion.

3 9.7 Follow-up Consultations

4 As part of this round of consultation on the Cushing Expansion, and as promised during face-to- 5 face meetings with Rural Municipalities and adjacent towns and villages, follow-up phone calls 6 were conducted with each of the communities to determine if there was a need for further 7 consultation and to ensure all questions or issues were appropriately addressed. Again, no issues 8 of concern were raised and most questions or concerns have either been resolved or will be 9 resolved prior to construction.

10 9.8 Addressing Stakeholder Issues

11 As previously noted, no significant issues of concern were raised by community leaders who 12 were consulted during this phase of community engagement. Keystone has addressed – and will 13 continue to address – questions from stakeholders on specific issues, such as emergency response 14 procedures, noise, impacts on aquifers and road usage during construction. Communities noted 15 that their relationship with Keystone and its operator, TransCanada, has generally been very 16 good to date and, as a result, they seemed satisfied that any questions or issues would be 17 appropriately addressed and felt the proposed Cushing Expansion plans are not a cause for 18 concern. Keystone intends to maintain an active level of engagement with these communities to 19 continue to address any issues that may arise, particularly during the construction phase of the 20 Cushing Expansion.

21 9.9 Future and Ongoing Consultation

22 Keystone is committed to ongoing consultation with affected stakeholders throughout the 23 regulatory review process and construction of the Cushing Expansion, ultimately transferring its 24 stakeholder and community relations activities to the operating regions. Following construction, 25 Keystone stakeholders will be integrated into TransCanada’s ongoing community relations 26 programs, including the Integrated Public Awareness Program. 1 9.10 Summary of Keystone Communication Materials and Process

2 Throughout the Cushing Expansion consultation program, Keystone employed a number of 3 communication methods, including face-to-face meetings and telephone contacts with 4 community leaders. During the face-to-face meetings, Keystone representatives provided an 5 information package with details about the expansion. Additional copies of these hand-outs were 6 also provided so that local officials would be able to distribute them to others who were not able 7 to attend the face-to-face meetings (i.e., some municipal administrators requested packages in 8 order to distribute to council members at future council meetings). Keystone subsequently 9 conducted follow-up phone calls with each of these communities to ensure any and all questions

10 or issues were addressed.

11 In addition, an updated information package was mailed to all stakeholders consulted during 12 previous phases of the Keystone Pipeline Project. The mail-out provided an update on the 13 Keystone Pipeline, information about the Cushing Expansion, and notification of the NEB’s 14 recent decision on Keystone’s Section 52 Application.

15 Communications materials and tactics employed during consultation for the Cushing Expansion 16 included:

17 • Personal visits, meetings and consultations with leaders of directly affected RMs and 18 communities. Personal meetings will continue periodically as needed.

19 • Telephone calls to promote direct interaction, relationship building and effective issue 20 resolution.

21 • Project information sheets and follow up letters about the Keystone Pipeline, including 22 upcoming activities and the achievement of milestones.

23 • Fact sheets and/or brochures to educate stakeholders and address some basic issues and 24 concerns. For example, topical brochures were used to describe pipeline and pump station 25 construction, maintenance and operations.

26 • Maps to illustrate to stakeholders the pipeline route, the proposed locations for pump 27 stations and other associated infrastructure. TransCanada Keystone Pipeline GP Ltd. Cushing Expansion Application Section 9: Consultation Page 11 of 12

1 • A Newsletter (Keystone Connection), issued most recently in September/October 2007 2 and to be issued on a regular basis in the future as a tool to update stakeholders on the 3 Keystone Pipeline Project and Cushing Expansion.

4 • The Keystone toll- free telephone line, monitored to respond to inquiries and concerns.

5 The line has a voice-mail feature to allow inquiries at all hours, seven days a week 6 • The Keystone Project website, maintained and updated frequently to provide key 7 information and project materials. It also has a web-mail feature, providing stakeholders 8 with another tool to contact Keystone representatives with inquiries and concerns.

9 Table 9.1 lists the communications products provided during the consultation for the Cushing 10 Expansion. Copies of these materials are provided in Appendix 9-1.
