Rusper Neighbourhood Plan 2018-2031

The Neighbourhood Planning (General) Regulations 2012 (as amended) - Regulation 16

Rusper Parish Council has prepared a Neighbourhood Development Plan (RNP). The Plan sets out a vision for the future of the parish and planning policies which will be used to determine planning applications locally. In accordance with Regulation 16 of the Neighbourhood Planning Regulations 2012 (as amended), the RNP and associated documents will go out to consultation (Monday 24 February to Monday 13 April 2020) for 7 weeks inviting representations on the draft submission plan, basic conditions statement, consultation statement and the Strategic Environmental Assessment (SEA) screening opinion. As set out in Legal & General (Strategic Land North Horsham) Limited (‘L&G’) representations to the Regulation 14 consultation, L&G support Rusper Parish Council in preparing their Neighbourhood Plan to shape and enhance forthcoming development within the Parish.

L&G welcome the identification of the strategic site Land North of Horsham in the emerging Neighbourhood Plan, as allocated in the Horsham District Planning Framework (2015), however, would request that the Site is clearly defined within the Neighbourhood Plan and a committed development site and included within Draft Policy RUS1 and the Policies Map. L&G are the master developer for Land North of Horsham, which is partially located within the south of the Parish boundary. Outline Planning Permission (‘OPP’) for development of this strategic site was granted in March 2018 (HDC reference: DC/16/1677):

Outline planning application with all matters reserved except access for a mixed use strategic development to include housing (up to 2,750 dwellings), business park (up to 46,450 m2), retail, community centre, leisure facilities, education facilities, public open space, landscaping and related infrastructure

L&G are in the process of implementing the OPP, with the Principle Access road works expected to begin in Q2 2020. In addition, a number of applications have been submitted relating to infrastructure to facilitate built development on Phase 1 of the OPP, which is mostly located outside the Rusper Parish Council boundary. Applications are also being prepared for servicing the new school campus site. The school campus land falls outside of L&G’s control.

We have reviewed the emerging Neighbourhood Plan policies (Rusper Neighbourhood Plan 2018-2031 Submission Plan) and make the following comments in relation to the relevant Land at North Horsham that falls within the Neighbourhood Plan area. In line with Draft Policy RUS6, the existing bridleway and public right of way will be retained and enhanced where possible. It is a key objective of the OPP to enhance connectivity through the entire Site, as such the paths within the Site will connect the wider network i.e. linking to Rusper and Horsham (Draft Policy RUS12). The proposals will seek to accord with the need to minimise the occurrence of light pollution in order to maintain countryside living (Draft Policy RUS11), this will be governed through submission of a sensitive light strategy as part of each Reserved Matters application, as required by regulatory condition attached to the OPP. As master developer L&G would also seek to ensure that built development is brought forward in accords with Draft Policy RUS3 (high quality design) and Draft Policy RUS5 (protecting, managing and enhancing green infrastructure and biodiversity and habitat connectivity).

In terms of Draft Policy RUS12, the S.106 attached to the OPP requires monitoring schemes to be submitted to WSCC for routes through Rusper Village, an identified Movement Route. Monitoring schemes are also required to be submitted for Langhurst Wood Road and on (non-Movement Routes), north of the OPP. The Monitoring Schemes were submitted to and approved by WSCC in February 2020 and a copy of the Schemes and initial traffic survey results have been shared with the Parish. If the future monitoring identifies an increase in traffic through Rusper, number plate recognition surveys will be undertaken to understand whether the traffic is a direct result of the development. If so, traffic calming measures will be implemented, the form and location of which would be developed with HDC, WSCC and the Parish.

It has also been agreed that the traffic flows on Faygate Lane (and Tower Road) (non-Movement Routes) will be monitored via the junction and approaches to inform the need for any junction improvements at the A264 junction through agreement with WSCC. Whilst it is acknowledged that the only specific Movement Route being surveyed is at Rusper Village, the locations at the junction and approaches at Faygate Lane, Langhurst Wood and Old Holbrook may inform increases on the other Movement Routes identified. It is considered that the proposed monitoring and subsequent mitigation measures would seek to achieve the traffic calming objectives (relating to this development) for the Parish and accord with the overall aim of the policy.

What improvements or modifications would you suggest?

As a proportion of the committed development land at North Horsham, benefiting from an allocation in the Horsham District Planning Framework and OPP, falls within the Rusper Neighbourhood Plan area it should be identified accordingly.

It is our view that in order for the Neighbourhood Plan to be consistent with Policy 4 ‘Strategic Policy: Settlement Expansion’ and Policy 15 ‘Strategic Policy: Housing Provision’ of the Horsham District Planning Framework there is a need to amend Draft Policy RUS1 ‘Spatial Plan’ to take into account the development site at North Horsham. The North Horsham development boundary should be included as a built-up area boundary on the Main Policy Map (Chapter 8 - page 33), please refer to the enclosed Plan for reference (drawing reference: 01666_SK_045 Rev.D1).

As recognised in the Neighbourhood Plan, Horsham District Council are undertaking a review of the Horsham District Planning Framework and whilst the Neighbourhood Plan seeks to commit to an early review, it is our view that in order to be consistent with local policy once the Local Plan Review is adopted the Neighbourhood Plan needs to include flexibility.

We recommend Draft Policy RUS1 is amended as follows (additional text shown in italics):

Policy RUS1: Spatial Plan

i) The Neighbourhood Plan defines the built-up area boundary for Rusper, as shown on the Policies Map, for the purpose of applying Policy 4 of the Horsham District Framework. Development proposals should conserve the open and tranquil character of the intervening landscape and its views at the following locations: SP1: , Crawley and SP2: Between Ifield and Ifieldwood

Proposals which would either individually or cumulatively, unacceptably harm or detract from the distinct landscape character and separation of these areas, as defined in the Policy Map, will not be supported.

ii) The Neighbourhood Plan defines the built-up area boundary for the strategic mixed use allocation at North Horsham, where it falls within the Neighbourhood Plan area, as shown on the Policies Map.

iii) In the event that Horsham District Council allocate land in the countryside for residential development in a future development plan, that land is considered by this policy to be within the built-up area boundary.

The supporting text for this policy should also be updated to include express reference to the allocation and planning permission and status as a committed development.

In regards to Draft Policy RUS12, L&G would expect ‘severe impact’ to be defined by the Neighbourhood Plan within the wording of the policy.

Draft Policy RUS13 sets out that proposed developer contributions will be sought for improvements to the existing highways infrastructure. ‘Entry gates’ are identified for the 13 entry points to the Parish (as identified on the Main Policy Map), two of these points are located within the boundary of the OPP, as such L&G request clarification on the scope of the proposed entry gates. Also, it is noted that Entry Gate 9 may conflict with the location of the proposed roundabout and we would request that the Parish review this to enable the entry gate to be suitably located and avoid the need for relocation, see Figure 1 below which sets out the suggested revised entry point:
