PART 1 - THE TRANSPORT CONTRACT

The transport contract entered into between the Carriers and the Passenger is governed by the following in descending order of importance: 1. Regulation (EC) no. 1371/2007 of the European Parliament and of the Council of 23 October 2007 on Rail Passengers’ Rights and obligations (“PRR”): http://eur- lex.europa.eu/LexUriServ 2. the Uniform Rules concerning the Contract of International Carriage of Passengers by Rail ("CIV"); 3. these IZY Thalys Terms and Conditions of Sale and Carriage; 4. the General Conditions of Carriage for Rail Passengers (GCC-CIV/PRR); these GCC- CIV/PRR were developed within the International Committee (CIT). Their contents may be viewed in French, English or German on the CIT website: www.cit-rail.org

Transfers between two stations, for example between two stations in the same metropolitan area, by a means of transport other than IZY Thalys (another railway undertaking, plane, bus, tram, underground, taxi, car, etc.) or on foot are not covered by the transport contract.

PART 2 - TRAVEL TICKETS

The transport contract is confirmed by one or more travel tickets issued on paper (Ticketless printed by the Passenger) or electronic (Mobile Ticket) media. Unless otherwise indicated, a travel ticket materialises the transport contract. Paper and electronic tickets provide proof, until demonstrated otherwise, of the existence and content of the transport contract. With respect to electronic travel tickets, this provision is only applicable if the Passenger can present the electronically recorded information, as specified in Article 2.4.1 hereof.

2.1 Acceptance of IZY Thalys Terms and Conditions of Sale and Carriage

By acquiring an IZY ticket by any means whatsoever and/or by using the IZY transport service, in any format, the Passenger unconditionally accepts the present IZY Thalys Terms and Conditions of Sale and Carriage.

2.2 Ticket reservations and conditions of use

To travel with IZY, Passengers must be in possession of ticket with a reservation, issued in Ticketless format: This travel ticket is nominative, personal and non-transferable.

The acquisition of a ticket is mandatory before the departure of the train. Passengers with a seat reservation (including folding seats) are obliged to take their place within 15 minutes after departure of the train from the original station for which the reservation was made, at the risk of losing the right to a seat and, if applicable, having the situation normalised in accordance with article 2.4 hereof.

If a Passenger boards an IZY train without a travel ticket booked for that train, s/he must immediately find the Train Manager to rectify the situation.

Seats are allocated by the Train Manager based on availability.

Travel tickets can only be used for a single trip on the date, in the origin-destination train and in the comfort class indicated.

When buying a ticket, the buyer must double-check that the price, dates, times, itinerary and origin-destination featured on the travel ticket, and that the names and forenames of all passengers, match their order.

2.2.1 Preamble Thalys International has created and manages a service for Passengers called Ticketless (hereinafter referred to as the “Service” or “Ticketless”). Any person requesting access to the Service is deemed to have unreservedly accepted the conditions of the said Service. They are an integral part of the IZY Terms and Conditions of Sale and Carriage.

2.2.2 Purpose of the Service Ticketless is a service that allows people who wish to make one or more trips on IZY trains to travel without (necessarily) requiring a physical travel ticket, subject to the terms and conditions set out below. The common name for Ticketless is a “virtual ticket”. It replaces traditional paper tickets. The underlying transport contract only exists in electronic form and information about the journey (Passenger name, date and time of travel, departure and arrival stations, comfort class, options, etc.) is recorded in an electronic format that can be consulted by various channels and inspected in accordance with the provisions of Article 2.4. below.

2.2.3 Conditions of access The Service is only accessible to Passengers who have made a reservation and paid the corresponding fare for the journey. A Ticketless reservation is nominative, personal and non- transferable.

2.2.4 Restrictions and scope IZY Ticketless services are only valid on IZY trains.

2.2.5 Booking confirmation An instant travel confirmation is sent by e-mail for all Ticketless purchases. This confirmation provides the Passenger with a record of all the information about the trip (Passenger name, date, time, train no., seat no., etc.). If required, in addition to the travel confirmation, the Passenger can also receive a purchase confirmation by e-mail.

If required, the Passenger can receive an e-mail containing information about any disruptions to the IZY service related to his or her trip. Passengers who provide their mobile telephone number at the time of booking will receive the following to their mobile phone prior to train departure: (i) a seat reminder SMS and (ii) as far as possible, information about IZY traffic disruptions. If requested, Passengers in possession of a smartphone can also download the IZY mobile application and use it to download their Ticketless containing the on-board identification barcode.

2.2.6 Responsibilities Neither THI Factory nor Thalys International can be held liable for any absence, delay, loss or wrong distribution of the e-mail/SMS or for their being sent to the wrong address, for any Service unavailability or malfunction, or for any telephone or Internet connection problems that may delay or prevent performance of the obligations for which they are responsible as part of the Ticketless service. Although THI Factory and Thalys International endeavour to check that all information communicated to Passengers is correct, THI Factory and Thalys International cannot be held liable for errors contained in the information or for any consequences thereof. THI Factory and Thalys International furthermore disclaim all liability for fraudulent use of a Ticketless.

2.3 Purchase and payment

2.3.1 Purchasing IZY travel tickets Except for special provisions, IZY travel tickets can be purchased by the Passenger via the following distribution channels:

• via the Internet on the site IZY.com, or directly or indirectly through the SNCF or SNCB affiliated online agencies which redirect to the site IZY.com. • via the mobile version of the site IZY.com and the mobile application IZY.

Administrative fees may be applied and they are payable by the Passenger.

Lost or stolen travel tickets will neither be replaced nor refunded.

Fares are available for sale two months before the date of departure. Sales close 30 minutes prior to the departure of the IZY train. For platform sales in a situation of immediate departure or on board, a surcharge may apply.

The purchase price of a travel ticket includes transport and, where applicable, specific services.

2.3.2 Online payment of the ticket

The ticket is exclusively purchased online and in euros via the distribution channels mentioned in article 2.3.1.

Accepted payment methods are credit cards and e-cards issued by the CB, Visa, Mastercard, Maestro and Bancontact networks (with the exception of certain specific cards). Payments as well as payment card data are encrypted.

IZY e-Vouchers are also accepted under the conditions and limits set out in article 2.3.4.

2.3.3 Using IZY compensation e-vouchers IZY e-Vouchers, valid for 12 months from their date of issue only on international IZY journeys, may only be used on the site IZY.com. Should a Passenger purchase a travel ticket with one (or more) IZY e-Vouchers: - the value of which is more than the price of the travel ticket in question, the difference will be lost (no reimbursement); - the value of which is less than the price of the travel ticket in question, the balance must be paid either by entering other IZY e-Vouchers or by bank card. A maximum of five (5) IZY e-Vouchers can be used per order.

2.4 Platform or on-board ticket inspection and management of irregular situations

1) Before boarding the train, during the filtering procedure and platform inspections, and/or for the entire duration of the journey, Passengers must be able to present their travel ticket and, where applicable, supporting documents related to the conditions of their journey (e.g. document proving entitlement to special fares, identity card, etc.).

Passengers are only authorised to travel if they have made a Ticketless booking and can present valid confirmation of the booking in their own name during inspection, that is: - a printed travel confirmation e-mail with the 2D barcode or A MobileTicket if the customer has downloaded the travel ticket to a mobile device

Only the digital record in the IZY information system is deemed to be irrefutable proof.

2) The possession and/or validity of travel tickets (including the supporting documents) is checked on the platform and/or on board by IZY personnel. If necessary, the identity of the Passenger may also be checked. Anyone, even in possession of a valid ticket, who contravenes the booking conditions and/or conditions of use of their ticket and/or whose behaviour may potentially threaten the safety of the train and/or the comfort of other Passengers may be refused access on- board the train or be removed from the train, without any right to a refund of the price of the ticket. On board, Passengers who are not in possession of a valid ticket (or who are not in possession of the supporting documents related to the journey) must report on their own initiative to the Train Manager, who will rectify the situation based on the reference fare for the comfort class in question, plus on-board charges of €20 (in cash or by bank card – cheques are not accepted). Failing immediate payment, the Passenger may be refused access on-board or be excluded from the train, without prejudice to the establishment of an Irregularity report as set forth below, with no compensation for the Passenger being admissible. In this instance, a fixed amount of €40 for administrative fees will be added to the surcharged boarding tariff as described above. Failing immediate payment by the Passenger of the sum requested, and/or in an obvious case of fraud, and/or in the event of behaviour likely to prejudice the safety of the train and/or the comfort of the Passengers, the Train Manager will establish an Irregularity report on presentation of a form of identity and will leave a copy with the Passenger. This Irregularity report may lead to additional charges and/or later court proceedings, without prejudice to any eventual damages which will remain the Passenger’s responsibility. In such cases, holders of an entitlement to special fares will also incur the risk of immediate withdrawal of their entitlement and of the document establishing this entitlement, and will be liable for payment of the administrative fees. In the event of a clear case of fraud during a Ticketless journey, any unused Ticketless will not be refunded. In the event whereby the Passenger has not paid on- board the sum required to rectify the situation, and does not make the payment within 15 days, either by bank transfer or by paying online at the following link: www.thalys.com/fine, supplementary charges of €150 will be claimed for a first reminder and, following a second reminder, the case file will be sent to a bailiff and/or a debt collection agency.

3) IZY Travellers are required to be present on the platform 30 minutes before the departure time of the train. If not, they may be refused access to the train.

2.5 Availability

Not all IZY trains offer the same travel options or the same number of seats for the different travel options. The lowest cost fares are available in limited quantities. It is therefore recommended that you purchase your ticket as early as possible, based on the fare conditions, to increase the probability of travelling at a preferential price.

2.6 Exchanges and refunds

IZY fares are non-exchangeable and non-refundable fares. Moreover, the Passenger has no right of withdrawal, in accordance with Article VI.53, 12° of the Belgian Code of Economic Law.

2.7 Liability of the carrier

2.7.1 Liability in case of physical injury to persons In the event of the death of or injury to a Passenger during the course of transport provision, THI factory is liable to the Passenger for the operation of the service carried out on the Belgian and French networks. The liability of THI Factory (specifically including causes for exemption) and the compensation payable by it under this provision, are governed by the provisions of part 11 of the GCC- CIV/PRR.

2.7.2 Liability in the event of damage to personal property In the event of the death of or injury to a Passenger, THI Factory is also liable for damage resulting from the total or partial loss of or damage to the personal effects with which the Passenger was travelling as hand luggage under the provisions of part 12 of the GCC-CIV/PRR.

2.7.3 Liability in the event of failure to observe timetables: policy in the event of delays, missed connections and cancellations

2.7.3.1 Compensation in the event of delays The maximum value of an IZY e-Voucher is €50. If applicable, the Passenger may receive several IZY e-Vouchers until the amount of compensation is reached.

The delay is calculated by taking into account the time difference between the time at which the Passenger should have arrived as indicated on the travel contract and the actual time of arrival.

In accordance with the PRR, for any delay of an IZY train equal to or greater than 60 minutes, the compensation offered to the Passenger is worth: - 25% of the ticket price for a delay equal to or greater than 60 minutes, - 50% of the ticket price for a delay equal to or greater than 120 minutes.

The compensation takes the form of IZY e-Vouchers that are valid for a period of 12 months from their date of issue. Passengers who wish to obtain monetary compensation will receive the same amounts, either by the same means of payment as the one used when purchasing the ticket, or by bank transfer to the IBAN provided by the Passenger, at the option of THI Factory.

Any application must be submitted using the contact form available online.

No compensation under the amount of €4 will be paid.

Passengers will not be entitled to any compensation if they were informed of the delay prior to ticket purchase or if, after continuation of the journey, the delay is less than 60 minutes on arrival at the destination station.

2.7.3.2 Rerouting and assistance Pursuant to article 32 RU CIV (specific legal regime of rail transport law on exonerating causes), also appended to the PRR, Carriers are not legally bound to reroute or assist Passengers, as defined by articles 16 and 18 PRR respectively, when the delay, missed connection or cancellation is due to one of the following causes: 1. circumstances beyond the control of the railway undertaking which the Carrier, despite having taken the care required in the particular circumstances of the case, could not avoid and the consequences of which it was unable to prevent, or 2. a Passenger error, or 3. behaviour of a third party which the Carrier, despite having taken the care required in the particular circumstances of the case, could not avoid and the consequences of which it was unable to prevent; another company using the same rail infrastructure is not considered to be a third party; the right of recourse is not affected.

2.8 Minors

For safety reasons, children under the age of 12 are not authorised to travel alone on board IZY trains. Permission to board IZY trains will therefore be categorically refused to children under the age of 12 travelling unaccompanied. Should the parents or legal guardians leave the child unaccompanied on the platform despite this, THI Factory will be forced to contact the Police, who alone are authorised to take the child under their care.

Children under the age of 12 are allowed to travel when accompanied by an adult or by a child aged between the ages of 12 and 18.

All minors (aged under 18) shall in all cases travel under the responsibility of their parents or legal guardians. This container is considered to be the Passenger’s hand luggage (see the definition of hand luggage in the paragraph "luggage"). Guide dogs for the blind also travel free of charge.

Dogs that are not transported in a container are only allowed on board after the purchase of a ticket at the “Animal” rate and if they travel on the Passenger’s lap or are kept on a lead on the floor of the carriage and are muzzled so that they do not bother those around them. At the request of another Passenger, the Train Manager may move an animal and its owner to another part of the train.

In the case of the absence of a booking, the carriage of said luggage will only be authorised subject to immediate payment of a surcharge of €30 to the Train Manager.

In the absence of payment of this luggage surcharge, the Passenger may be denied access on board the IZY train without the right to a refund of the travel fare.

Also, the bicycle must be in a flexible bag measuring at most 2m in length and which must completely cover all of the disassembled parts of the bicycle. PART 3 - The IZY Thalys RANGE OF FARES

3.1 Scope of application

The tickets are issued for the -Brussels route. IZY tickets are not valid in other international trains, including Thalys trains operated by THI Factory.

3.2 Options

IZY tickets are issued for two comfort classes, namely the Standard class and Standard XL class. As a reminder, IZY tickets are non-exchangeable and non-refundable.

1. Adult Standard This option gives an access right to the allocated seat in the carriages identified as "Standard".

2. Folding seat This option gives access to the folding seats located on the platforms between the carriages. These folding seats are numbered. Passengers are required to use the folding seat that has been assigned to them. Any change of seat will have to be carried out in agreement with the Train Manager as s/he passes through the train. These places are limited in comfort and are not recommended for people with reduced mobility, pregnant women, frail people, children under 12 years of age and the elderly. In any case, it is not possible to book this kind of seat at the KID fare (preferential fare for children under 12 years). However, and although we strongly recommend against it, you can nevertheless purchase a folding seat ticket for your child under 12 years of age at the adult fare, under your full responsibility.

3. KID (Children) This option is for children between the ages of 4 and 11 (on the day of travel) and for children under four for whom a seat is requested. Children under 12 must be accompanied by at least one person authorised to travel alone. Proof of age must be shown to the Train Manager on request. The KID fare is not valid for the folding seat and no guaranteed seat options. A ticket for a child at the applicable fare may nevertheless be purchased.

4. PASSENGERS IN WHEELCHAIRS This specific option is valid for people travelling with a wheelchair subject to the availability of places and gives access to a place suitable for travelling with a wheelchair that is located in carriage 1.

5. ACCOMPANYING PERSON This specific option is intended for a person accompanying a wheelchair passenger on presentation of documentation establishing the need for such a companion. This option is only valid for one companion in each case.

3.3 Additional paid options

3 paid options are on offer on IZY trains:

1. The option "Standard XL" gives access to specific seating. The allocated seats are wider and more comfortable than those on offer at the "Standard" fare and help to ensure greater Passenger comfort. No additional service is associated with this option, this seat or this position.

2. The SMS option gives the right to an information SMS sent prior to the trip. This SMS contains all the necessary information for travel; the train time and number, carriage, seat number and traffic information where applicable. It is specified that this SMS is for information only and it does not replace the travel ticket, which must in all cases be presented to the Train Manager before boarding the train.

3. The “Pet” option allows you to travel with a pet that does not travel in a container whose dimensions are 55 x 30 x 30 cm. Guide dogs for the blind are not subject to this option and travel free of charge. The transport of small dogs and other domestic animals in a container whose size does not exceed 55 x 30 x 30 cm is also free of charge. Dogs must be kept on a lead on the floor of the carriages and muzzled in such a way as not to disturb fellow travellers.

3.4 Children

Children aged under 4 (on the date of travel) can travel free of charge as long as a seat is not requested for them.

Children aged between 4 and 11 and younger children for whom a seat is booked pay the Thalys ticket fare based on the special KID price (see article 3.2.4).

3.5 Sale of travel tickets on the platform or on board the train

The “Standard" and "Kid" options can be purchased on board IZY trains. A supplement of €25 will be requested in addition to the reference fare.

3.6 Pricing and conditions

Ticket prices and other conditions are those communicated by the points of sale listed in Article 2.3. of these Terms and Conditions of Sale and Carriage at the time of requesting a fare.

No exchanges or refunds are possible.
