Minutes of the City of Beaconsfield’s regular Municipal Council meeting, held at City Hall, 303 Beaconsfield Boulevard, Beaconsfield, Québec, on Monday, December 17, 2018, at 8 p.m.

WERE PRESENT: His Honour the Mayor Georges Bourelle and Councillors Dominique Godin, Karen Messier, Robert Mercuri, David Newell, Roger Moss, Al Gardner

1. OPENING OF MEETING

His Honour the Mayor calls the meeting to order.

2. AGENDA

2.1 Adoption of the agenda of the City of Beaconsfield's regular Council meeting of December 17, 2018

2018-12-464 It is moved by Councillor Robert Mercuri, seconded by Councillor David Newell and UNANIMOUSLY RESOLVED to adopt the agenda of the City of Beaconsfield's regular Council meeting of December 17, 2018, as presented.

Councillor Dominique Godin arrives after the adoption of item 2.1.

5. PUBLIC QUESTION PERIOD

Commandant Breton provides information regarding citizens’ security in Beaconsfield.

The City Clerk announces the beginning of the public question period.

His Honour the Mayor wishes Merry Christmas and Happy Holidays. He also reminds residents to be cautious while celebrating and to call Opération Nez Rouge if needed.

His Honour the Mayor mentions that one of the two recipients of the 2018 Nobel Peace Prize winner is Mr. Denis Mukwege, brother-in-law of Désiré Murumbi, environment inspector working for the City of Beaconsfield. He expresses his gratitude to Mr. Mukwege and extends his appreciation to his family.

His Honour the Mayor mentions the opening days of the various municipal services offered to the residents during the Holidays and he reiterates the emergency phone numbers.

A resident thanks Councillor Dominique Godin for her quick reply and attention given when a particular question was raised and addressed to her. She is also grateful for the lawn signs installed on properties and aiming to discourage speeding. She mentions the ASISTA Foundation and encourages the City of Beaconsfield participate to such initiative. Lastly, she applauds the plantation of additional trees.

A resident mentions an issue concerning salt unevenly spread on the sidewalks.

His Honour the Mayor indicates that he will look into it and follow-up.

A resident asks why the new condos on Elm Street are allowed to put lights on the soffit of the building whereas the By-law forbids to do so.

A resident asks why Council avoids providing an answer following an email sent on behalf of the Club 55 +.

Councillor Messier indicates that a formal reply has been given in a written form by email to everybody that contacted her. She adds that she even sent a second email requesting to postpone the scheduled meeting as the Director of culture and leisure, Mrs. Michele Janis, is on sick leave.

A resident asks if it is possible to have access to information concerning items 13.1, 60.1, 60.2.

His Honour the Mayor indicates that the information will available through access to information.

A resident indicated that he hand delivered a letter to the City Hall regarding the sound wall and no acknowledgement followed.

His Honour the Mayor indicates that Council does not acknowledge or answer all letters that are received.

20. CONTRACTS

20.1 Awarding of contract TP 2018-14 for the supply of a snow removal equipment on wheels for the sidewalks and pedestrian walkways to the lowest conforming bidder, J. René Lafond inc., in the amount of $130,244.73, all taxes and trade-in included

2018-12-466 It is moved by Councillor Roger Moss, seconded by Councillor Dominique Godin and UNANIMOUSLY RESOLVED to award contract TP 2018-14 for the supply of a snow removal equipment on wheels for sidewalks and pedestrian walkways to the lowest conforming bidder, J. René Lafond inc., in the amount of $130,244.73, all taxes and trade-in included; and

To authorize the Finance and Treasury Department to charge the expense to budget code 22-311-00-724. This expense is financed by the Working Fund and will be reimbursed in five (5) yearly instalments starting the year following the disbursement.

20.2 Awarding of contract TP 2019-01 for the maintenance of municipal buildings' electrical systems for the year 2019 to the lowest conforming bidder, Denis Bourbonnais et Fils Inc., in the amount of $28,456.31, all taxes included

2018-12-467 It is moved by Councillor Karen Messier, seconded by Councillor David Newell and UNANIMOUSLY RESOLVED to award contract TP 2019-01 for the maintenance of municipal buildings' electrical systems for the year 2019 to the lowest conforming bidder, Denis Bourbonnais et Fils Inc., in the amount of $28,456.31, all taxes included; and

To authorize the Finance and Treasury Department to charge the expense to budget code 02-738-90-565, 02-198-00-565, 02-319-00-565, 02-725-20-565, 02-731-90-565, 02-719-00-565, 02-722-10-565, 02-723- 10-565.

20.5 Awarding of contract TP 2019-05 for the arboricultural work at an hourly rate for the year 2019 to the lowest conforming bidder, Service d'Arbres Primeau Inc., in the amount of $201,815.62, all taxes included

20.6 Mandate to the Union des municipalités du Québec (UMQ) with regard to the group for the purchase in common of liability insurance for skateboard parks, BMX park tracks and similar installations

2018-12-471 CONSIDERING that, according to section 29.9.1 of the Cities and Towns Act, the City of Beaconsfield wishes to join the Union des municipalités du Québec (UMQ) and its group for the purchase in common of liability insurance for skateboard parks, BMX park tracks and similar installations for the 2019-2024 period;

It is moved by Councillor Dominique Godin, seconded by Councillor Robert Mercuri and UNANIMOUSLY RESOLVED:

TO join, by the present, the group for the purchase, with the Union des municipalités du Québec (UMQ), in order to grant a contract with regard to liability insurance for insurance responsibility for skateboard parks, BMX park tracks and similar installations located in the municipality, for the period of May 1, 2019, until April 30, 2024;

TO authorize the Mayor and the City Clerk to sign, for and on behalf of the City of Beaconsfield, the agreement entitled "Entente de regroupement de municipalités au sein de l’Union des municipalités du Québec relativement à l’achat en commun d’assurances responsabilité pour les parcs de rouli-roulant, pistes de BMX et aménagements semblables", for the period of May 1, 2019, until April 30, 2024, submitted

and attached to the present herewith forming an integral part hereof as if it were cited in its entirety;

THAT the City of Beaconsfield accepts, according to the law, that a municipality that is not currently part of the group, may request, in the course of a contract, by resolution, its membership in this group provided that the UMQ authorizes it and that the municipality wishing to join the group undertakes to respect each and every one of the conditions set out in the tender specifications, at costs required by the UMQ and in the insurance contract and the mandate of the consultant, awarded accordingly. And that this union should not be done if it misrepresents the main elements of the call for tenders, the contract or the mandate in question.

20.7 Awarding of contract FT 2018-02 for bank services to the lowest conforming bidder, RBC Banque Royale, for the period of January 1, 2019, to December 31, 2021, with a renewal option for a two (2) year period

2018-12-472 CONSIDERING that the current agreement for banking services with RBC Banque Royale will end on December 31, 2018;

CONSIDERING that the Treasury Department asked tenders from all financial institutions that maintain a place of business in the City of Beaconsfield for banking services;

CONSIDERING that only RBC Banque Royale submitted a proposal for banking services;

CONSIDERING the analysis by the Director Finances and Treasury of the proposal received and the recommendation made;

It is moved by Councillor Roger Moss, seconded by Councillor Robert Mercuri and UNANIMOUSLY RESOLVED:

To award the contract for banking services for a period of three (3) years, from January 1, 2019, to December 31, 2021, with a renewal option of a two (2) year period, to RBC Banque Royale as the lowest conforming bidder with an advantageous offer for the City of Beaconsfield;

To authorize the Mayor and the Treasurer to sign for and on behalf of the City of Beaconsfield the new agreement for banking services and all related documents.

20.8 Awarding of contract FT 2018-01 for the rental of seven (7) copiers/printers to the lowest conforming bidder, Solutions d'affaires Toshiba Tec inc., for a period of 60 months as of January 1, 2019, in the amount of $970.26 per month, all taxes included, plus user fees of $0.006 to 0.0085 per black-and-white copy and $0.048 to 0.0699 per colour copy

2018-12-473 Whereas the Treasurer proceeded by invitation to obtain tenders from three (3) suppliers for the location of seven (7) copiers/printers;

Whereas only one of the three (3) invited companies did submit a service offer;

Considering the Treasurer's recommendation that the offer received from Solutions d'affaires Toshiba Tec Canada inc., is advantageous for the City of Beaconsfield;

It is moved by Councillor Karen Messier, seconded by Councillor David Newell and UNANIMOUSLY RESOLVED:

To award the contract for the rental of seven (7) copiers/printers to the lowest conforming bidder, Solutions d'affaires Toshiba Tec Canada inc., for a period of 60 months as of January 1, 2019, in the amount of $970.26 per month, all taxes included, plus user fees of $0.006 to $0.0085 per black-and-white copy and $0.048 to $0,0699 per colour copy;

To request the Treasurer to foresee the necessary budgetary credit for the year 2019 to provide for the payment of this expense.

20.9 Authorization to purchase and to integrate the B-CITI Citizen Platform by Solutions B-CITI inc. for the amount of $17,246.25, all taxes included

2018-12-474 CONSIDERING the status of sole supplier according to Section 573.3 (2°) of the Cities and Towns Act;

It is moved by Councillor Dominique Godin, seconded by Councillor Robert Mercuri and UNANIMOUSLY RESOLVED:

To approve the purchase and integration of the B-CITI Citizen Platform by Solutions B-CITI inc. for the amount of $17,246.25, all taxes include

To approve the monthly fees of $3,449.25, all taxes included;

To approve the variable monthly fees associated to notifications, according to usage; and

To authorize the Finance and Treasury Department to charge theses expenses to budget code 02-145-00-415.

20.10 Additional expenditure to project 495-17-GC - Construction of a pumping station on Gables Court

2018-12-475 CONSIDERING resolution 2017-12-386 adopted at the Council meeting held on December 18, 2017, relating to the awarding of contract 495-17- GC for the construction of a pumping station on Gables Court to the lowest confirming bidder, Excavation Patrice Couture Inc., in the amount of $610,900, all taxes included;

CONSIDERING that unexpected work was needed during project execution;

It is moved by Councillor Karen Messier, seconded by Councillor Dominique Godin and UNANIMOUSLY RESOLVED:

TO authorize an additional expenditure for the amount of $55,868.42, all taxes included, for the unexpected work in project 495-17-GC - Construction of a pumping station on Gables Court;

To authorize the Finance and Treasury Department to charge the expense to budget code 22-415-00-711. To provide for the payment of this expenditure, Council transfers the necessary funds from its financed by tax revenues.

30. FINANCE AND TREASURY

30.1 Approval of the list of accounts payable as of December 17, 2018, and of the list of pre-authorized payments for the period of November 9, 2018, to November 18, 2018, and for the period of November 20, 2018, to December 6, 2018, for a total disbursement of $2,837,409.61

2018-12-476 Considering the lists submitted by the Treasurer regarding the payment of expenses for financial and investment activities;

It is moved by Councillor Karen Messier, seconded by Councillor Robert Mercuri and UNANIMOUSLY RESOLVED:

To approve the list of accounts payable as of December 17, 2018, regarding expenses for financial and investment activities totalling $1,322,315.11; and

To approve the list of pre-authorized payments from November 9, 2018, to November 18, 2018, and for the period of November 20, 2018, to December 6, 2018, totalling $1,138,019.31 and electronic payments, for the same period, of salaries paid to municipal employees and bank fees, totalling $377,075.19.

All these disbursements totalling $2,837,409.61 are drawn from the City's bank account at Royal Bank of Canada, Beaconsfield branch.

30.2 Transfer from free surplus as of September 30, 2018, to reserved fund

2018-12-477 CONSIDERING the recommendation by the Finance Committee to approve a distribution of the unappropriated surplus, as indicated in the minutes of the meeting held on November 26, 2018;

It is moved by Councillor Robert Mercuri, seconded by Councillor Roger Moss and UNANIMOUSLY RESOLVED that Council transfers from the unappropriated surplus as of September 30, 2018, $100,000 to Budget equilibrium reserve.

30.3 Approval of a $150 contribution to Beaconsfield-Kirkland Ringuette Association for the purchase of an advertisement in their Annual Tournament programme for the year 2019

2018-12-478 It is moved by Councillor Dominique Godin, seconded by Councillor David Newell and UNANIMOUSLY RESOLVED to approve a $150 contribution to Beaconsfield-Kirkland Ringuette Association for the purchase of an advertisement in their Annual Tournament programme for the year 2019; and

To authorize the Finance and Treasury Department to charge the expense to budget code 02-722-10-992.

30.4 Approval of a $500 contribution to Youth Symphony Orchestra for the year 2018

2018-12-479 It is moved by Councillor Dominique Godin, seconded by Councillor Robert Mercuri and UNANIMOUSLY RESOLVED to approve a $500 contribution to West Island Youth Symphony Orchestra for the year 2018; and

To authorize the Finance and Treasury Department to charge the expense to budget code 02-731-10-992.

30.5 Application for Financial assistance to the “Fonds municipal en action juridique” of the “Union des municipalités du Québec”

2018-12-480 WHEREAS on December 5, 2014, the “Assemblée nationale du Québec” has adopted the Act to foster the financial health and sustainability of municipal defined benefit pension plans (Act 15);

WHEREAS it is in the interest of all municipalities that pension plans be governed by a law so as to ensure their sustainability and to control their costs;

WHEREAS the purpose of this Act is to require the amendment of any defined benefit pension plan governed by the Supplemental Pension Plans Act (Chapter R-15.1) and established by a municipal body, as well as the “Régime de retraite des employés municipaux du Québec”, with a view to improving the plans’ financial health and ensuring their sustainability, as described under paragraph 1 of Act 15, is one that is of interest to all Québec municipalities;

WHEREAS on September 23, 2015, the Canadian Union of Public Employees, local section 128, certain employees along with other employees’ associations filed, against the “Procureure générale du Québec”, an amended motion to institute proceedings for a declaratory judgment, with a notice of intention to the “Procureure générale du Québec” ( Superior Court file number 500-17-086494-153);

WHEREAS the Cities of Beaconsfield, Dorval, Town of Mount Royal, Pointe-Claire and Sainte-Catherine (the Cities) are affected by this process as “mises en cause”;

WHEREAS, by this procedure, the applicants in particular ask for the Court to:

1- Declare Act 15 as invalid, ineffective and void, since it would contravene both section 2 d) of the “Canadian Charter” and section 3 of the “Quebec Charter”;

2- Order the “mises en cause” parties, among which are the cities mentioned in the preceding paragraph, to restore the parties to the “status quo ante”, including any and all pecuniary losses suffered by the applicants' pension plans retroactively to the date of coming into force of Act 15, with interest and additional indemnity;

3- Declare that any and all modifications to pension plans, which will have been negotiated and concluded under Act 15, or pursuant to regulations subsequently adopted further to such agreements, be declared as null and void;

WHEREAS issues raised by the Cities meet the interests of all Québec municipalities;

WHEREAS the Cities invested significant amounts to reach agreements within the framework of Act 15 and to implement their resulting effects;

WHEREAS a retroactive restoring order would result in major negative impacts for all Québec municipalities as a whole, namely: necessary modifications to administrative systems, renegotiation of collective agreements and reoccurrence of deficits in municipalities’ financial statements;

WHEREAS staggering additional disbursements would be required from municipalities should they be ordered to restore the “status quo ante” situation, as it existed prior to Act 15;

WHEREAS the Cities targeted 3 main underlying issues supporting their theory of the case and of their filed defence pleas as these 3 issues apply, one or the other, or altogether to the vast majority of Québec municipalities:

1- The pension plan (PP) implemented in the municipality has never been the object of negotiations (“ex-gratia plan”);

2- Act 15 does not substantially impact the elements of the City PP and the PP may all the same be the object of adjustments out of the scope of Act 15, which does not compromise freedom of association;

3- In certain cases, Act 15 is even beneficial for employee associations and their members;

WHEREAS the efficient and relevant presentation of these 3 main issues support and strengthen positions defended by the “Procureure générale du Québec”;

WHEREAS important retroactive disbursements may be required from Cities for the financing of Pension Plans since January 1, 2014, should the effects of Act 15 be repealed;

WHEREAS the Cities, until now, have supported a significant burden for having incurred, since the beginning of the legal proceedings, an important human and financial resources investment;

WHEREAS the significant increase in legal and actuarial costs that are necessary to continue an efficient defence of the Cities’ positions before the Court, tends to discourage them from maintaining their participation in this process, even though the “Procureure générale du Québec” admitted that the legal arguments, as submitted by the Cities, will contribute to obtain a favourable decision in this case, which would then be beneficial for all Québec municipalities;

WHEREAS the Cities recognize the major effort made by the “Union des municipalités du Québec (UMQ)” in this matter, as part of its proactive intervention;

WHEREAS it is in the interest of all municipalities that the Cities can continue their participation in the ongoing judicial process, in order to have the opportunity to present their arguments before the Court, which arguments are intended to consolidate the investments already made and the position taken by the “Union des municipalités du Québec (UMQ)” in this matter;

WHEREAS the Cities, while supporting the general position taken by the “Union des municipalités du Québec (UMQ)”, can submit distinct and precise elements that are related to the interest of all Québec municipalities;

WHEREAS the financial assistance requested by the Cities, under Part 1 of the “fonds”, is necessary to enable them to assert their positions without imposing an undue burden solely on their own taxpayers;

It is moved by Councillor David Newell, seconded by Councillor Roger Moss and UNANIMOUSLY RESOLVED:

TO authorize, for the reasons stated in the preamble, the presentation of an application, by the City of Beaconsfield, for financial assistance in the amount of $10,000 from the “Fonds municipal en action juridique” de l’Union des municipalités du Québec (UMQ)”, which application is attached herewith; and

TO authorize the Director General to sign and present this application, for and on behalf of the City of Beaconsfield.

30.6 Authorization to proceed with budgetary transfers

2018-12-481 CONSIDERING SECTION 13 of By-law BEAC-029 entitled "By-law regarding budget control and monitoring";

It is moved by Councillor Roger Moss, seconded by Councillor Robert Mercuri and UNANIMOUSLY RESOLVED to authorize the Treasurer to proceed with the budgetary transfers proposed for 2018.

45. URBAN PLANNING

45.1 Request for a permit for the construction of a main building located at 20 Woodland

2018-12-487 CONSIDERING THAT a permit application was filed for the construction of a main building located at 20 Woodland;

CONSIDERING THAT By-law BEAC-098 regarding Site Planning and Architectural Integration Programmes indicates objectives and criteria to fulfill for this type of permit application;

CONSIDERING THAT the Planning Advisory Committee has considered the plans and documents accompanying the permit application at the October 24, 2018, meeting and is of the opinion that the applicable objectives and criteria are respected;

CONSIDERING the Planning Advisory Committee's recommendation to APPROVE the issuance of a permit for the construction of a main building located at 20 Woodland;

CONSIDERING THAT the Planning Advisory Committee has considered the plans and documents submitted with the permit application at the November 28, 2018, meeting and is of the opinion that the objective to propose sustainable, quality architecture is not respected because the criteria aiming to have a building inspired by the dominant architectural styles on that stretch of street is not fulfilled. Moreover, the objective to propose a building with harmonious shapes and volumes is not respected because the criterion on the architectural treatment that mitigates the differences in height and volume and number of stories with neighbouring buildings is not fulfilled;

2018-12-504 CONSIDERING THAT the City of Beaconsfield wishes to apply for financial aid within the programme PRIMEAU aiming to rehabilitate municipal infrastructure for drinking water and wastewater;

CONSIDERING THAT the City took note of the "Guide sur le programme PRIMEAU" and must respect its conditions that apply to the City:

WHEREAS, should the Ministry of Municipal Affairs and Housing reject the financial aid request, the request itself does not amount to a commitment by the City to carry out the project;

It is moved by Councillor Dominique Godin, seconded by Councillor Roger Moss and UNANIMOUSLY RESOLVED:

THAT the Council of the City of Beaconsfield authorizes Mr. André Gervais, Section Chief - projects, to request financial aid from the Ministry of Municipal Affairs and Housing within Volet 2 of the programme PRIMEAU with regard to the rehabilitation of 1,912 linear metres of sanitary sewers;

THAT the City commits to respect all the conditions in the Guide PRIMEAU that applies to the City;

THAT the City commits to pay its share of ongoing eligible costs and operating costs associated to its project within the programme PRIMEAU;

THAT the City confirms to assume all the non-eligible costs and the cost overruns associated to its project within the programme PRIMEAU;

THAT Council authorizes the deposit of the financial aid request within the programme PRIMEAU;

60.7 Authorization to install six (6) temporary classrooms on Saint-Rémi elementary school’s lot located at 16 Neveu, for a two (2)-year period starting July 1, 2019

2018-12-505 WHEREAS the Commission scolaire Marguerite-Bourgeoys has submitted a request accompanied by an explanatory note as well as a plan of the exact dimensions of six temporary classes for Saint-Rémi elementary school;

WHEREAS the increase in the number of students enrolled at Saint-Rémi elementary school creates a problem of overcrowding resulting in the filing of an application for an expansion of Saint-Rémi elementary school to the Minister of Education and Higher Education;

WHEREAS this request must be addressed in scope of the Québec Investment Plan for the years 2019 to 2029;

WHEREAS the Commission scolaire must respond to an urgent need of temporary classes for the beginning of the school year in 2019;

WHEREAS the six (6) temporary classes will be located in a manner that they will be less visible from the street;

WHEREAS the type of temporary classes will be house-class which demonstrates an architectural style that is in respect with its environment;

70. AGGLOMERATION COUNCIL

70.1 Mayor’s report on the decisions made by the Agglomeration Council at its meeting of November 22, 2018

His Honour the Mayor indicates that he has nothing relevant to report regarding the last Agglomeration meeting. However, the Mayor points out that the Association of Suburban Municipalities (ASM) has recently voiced its opinion regarding the social tariff for public transit proposed by Montréal Mayor, Valérie Plante. The transportation commission of the Communauté métropolitaine de Montréal (CMM) is expected to deliver a report about financing options for public transit in February. However, the 15 Mayors of the demerged municipalities have stated that other priorities should first be addressed before considering the implementation of social tariff, such as adequate transit in the west and east of the Agglomeration, and that it should be a provincial responsibility, through Revenu Québec, to offer a tax credit in order to reduce the cost of public transit for people needing a financial contribution.

70.2 Orientations of Council on the matters to be considered at the Agglomeration Council

2018-12-506 WHEREAS the Mayor of a related municipality is required to vote upon Agglomeration Council agenda items, in accordance with the orientations obtained from the Municipal Council;
