MINUTES OF THE PARISH COUNCIL MEETING HELD AT THE HEART VINEYARD AND BREWERY, POOL LANE AT 7.00 PM ON THURSDAY 17 JANUARY 2019

PRESENT: Councillors D Wood (chairman), E Gamble, M Gordon and C Spakouskas. Nine members of the public signed the attendance sheet. Also present were District Councillor Ann Myatt and the Clerk, Mr J Mackman.

19.001 – TO RECEIVE DECLARATIONS OF DISCLOSABLE PECUNIARY INTEREST (NOT PREVIOUSLY DECLARED) ON ANY MATTERS OF BUSINESS None.

19.002 - TO RECEIVE APOLOGIES FOR ABSENCE AND APPROVE REASONS FOR ABSENCE Apologies for absence were received and approved from Councillor Watters. Apologies were also received from County Councillor Andy Paraskos.

19.003 - TO CONFIRM THE MINUTES OF THE PARISH COUNCIL MEETING HELD ON 15 NOVEMBER 2018 The minutes of the meeting held on 15 November, having been circulated and read, were accepted and signed as a true record.

19.004 - TO CONFIRM THE MINUTES OF THE PARISH COUNCIL MEETING HELD ON 22 NOVEMBER 2018 The minutes of the meeting held on 22 November, having been circulated and read, were accepted and signed as a true record.

19.005 - TO CONFIRM THE MINUTES OF THE PARISH COUNCIL MEETING HELD ON 6 DECEMBER 2018 The minutes of the meeting held on 6 December, having been circulated and read, were accepted and signed as a true record.

19.006 - PUBLIC PARTICIPATION ON TOPICS CONTAINED IN THE AGENDA Residents raised points about the prelevance of dog poo on the Green and what the newly refurbished phone box will be used for.

19.007 - TO RECEIVE THE CLERK’S REPORT ON (a) The refurbishment of the phone box There was no news on this subject.

(b) Pool Lane and Green grips The Clerk confirmed that he had requested the County Council to recut the grips in Pool Land and the Green.

(c) Maintaining the area around the village sign The Clerk reported that Clive Broadley had agreed to maintain this area for the next year.

(d) The fence Nick Gaunt reported having spoken to the Commons Team at the Planning Inspectorate in Bristol who advise that a Section 38 permission does not apply to registered Village Greens unless they are under a Management Plan, which ours is not. The Clerk reported that he had asked the Borough Council’s Planning Department to send a representative to meet Councillors and let us know if the fence needs planning permission and, if it does, how to expedite the request. Councillors are to be advised of the date and time of a visit.

(e) Visitor car parking The Councillors discussed a reply received from the Harpins regarding parking and signage. It was agreed that they be thanked for offering to produce the signs. Mrs Harpin is to be asked if she would be willing to meet regarding car parking in general. (Action Clerk)

19.008 - FINANCE (a) To receive a financial statement The Clerk presented a detailed report showing the actual income and expenditure for the current financial year for the period to 17 January 2019. The report reflected the receipts and payments below. The bank balances at 17 January were:

(d) To agree to pay a proportion of the Clerk’s SLCC subscription It was agreed that the Parish Council would pay £19.44 towards the total of this year’s subscription of £175.00.

(e) To agree the Budget for 2019-20 and set the precept The Councillors considered the proposed budget that the Clerk had circulated prior to the meeting. The budget showed a deficit of £1,000. After a review of all the discretionary and non- discretionary items it was resolved to increase the precept to £9,000 for the financial year 2019- 20 so as to eliminate the deficit. The Clerk completed and signed the appropriate Harrogate Borough Council request form. The agreed budget is attached to these minutes.

19.009 – GREENS – (a) To agree the quotation for the tracks The quotation for repairing the tracks was accepted.

(b) To discuss the management of Buttery pond Councillor Wood is to obtain a quotation from Philliskirk for dredging the pond when it dries out again. (Action Councillor Wood)

(d) To discuss the reported dog fouling problem It was agreed that an email be sent round via Mike Turnham asking residents to make sure that they clean up after their dogs and not to let their dogs onto the Green unattended. Following a request by a resident it was also agreed that more "clean it up" signs be produced and offered to people who wanted to display a sign on their gates.

Installation of dormer window and balcony. Alterations to roof. Alterations to fenestration and external materials. Erection of porch, veranda and pergola. It was noted that, on the following application, approval had been given to a lateral reduction to give a 3m clearance from the property and chimney. The rest of the work requested had been refused. • Ref: - 18/04235/TPO - Lateral reduction to give clearance from the house (by 30%) and crown thin 1 Birch Tree T1 of Tree Preservation Order 26 2003 at 4 South View Pool Lane.

19.011 - TO AGREE THE FEE FOR THE FORGE HOUSE EASEMENT It was agreed to charge £1,000 for the easement. The Clerk is to tell the solicitors to expedite the work. (Action Clerk)

19.012 – TO DISCUSS ISSUES WITH THE INTERNET IN THE VILLAGE It was agreed to defer discussion on this subject.

19.013 - TO DISCUSS BURIAL GROUND MAINTENANCE The Clerk reported that Clive Broadley has agreed to maintain the Burial Ground for the next year.

19.014 - TO RECEIVE REPRESENTATIVES’ REPORTS None.

19.016 – TO NOTE FORTHCOMING MEETINGS None.

19.017 – TO RECEIVE DISTRICT AND COUNTY COUNCILLORS’ COMMENTS (IF PRESENT) District Councillor Ann Myatt reported that the Harrogate Draft Local Plan is now being inspected.

19.018 – TO CONSIDER MINOR MATTERS Following a complaint from a resident that the Harrogate Borough Council refuse lorry has to be driven on the Green to avoid being scratched by overgrowing vegetation it was agreed that the Clerk should write to the house owner and ask that they cut back their overgrowing vegetation. (Action Clerk)

19.019 - TO CONSIDER NEW ITEMS FOR THE NEXT AGENDA No new items. It was agreed to restore the non-urgent items which had not appeared on the agenda for the January meeting.

19.020 – TO AGREE THE DATE OF NEXT MEETING It was agreed that the next meeting of the Parish Council would be held at 7.00pm on Thursday 31st January at the Yorkshire Heart Vineyard and Brewery, Pool Lane specifically with the intention of considering recently received planning applications. The following meeting is to be held in the Barn behind the Alice Hawthorn at 7.00pm on Thursday 21st March 2019.
