BOARD OF DIRECTORS North Kern Water Storage District Minutes of the Meeting of August 18, 2020

A Meeting of the Board of Directors of North Kern Water Storage District was held via teleconference (due to the rise in severity of COVID-19 and consistent with Executive Order N- 29-20 suspending provisions of the Brown Act) starting at 7:00 a.m., on August 18, 2020.

President Andrew declared a quorum was present and called the meeting to order. The following Directors were present: Kevin Andrew, Carole Fornoff, Mike Mendes, Joel Ackerknecht and Winn Glende. Others present: Richard Diamond (General Manager), Ram Venkatesan (Deputy General Manager), Marinelle Duarosan (Controller), Heather Williams (Operations Superintendent), Angel Ventura (Staff Engineer), Erica Celedon (Accounting Clerk I), Christy Castaneda (Administrative Assistant) of North Kern Water Storage District, Alan Doud (District Counsel - Young Wooldridge), Stephanie Hearn (GEI – Consulting Engineer). Guests included: George Cappello (Grimmway) and Geoff King (BHK).

President Andrew called the meeting to order at 7:05 a.m. and opened the floor for public comments. At this time there were none.

Board of Directors – (20-70) Upon motion of Director Fornoff, seconded by Director Glende and unanimously carried, to approve the minutes from the July 21, 2020 Regular Board meeting. (Ayes: Andrew, Ackerknecht, Mendes, Glende & Fornoff, Noes: None, Absent: None, Abstain: None)

General Manager Diamond addressed the District operation amidst Coronavirus/Covid-19 situation. He and District managers indicated office employees are primarily working from home and operations and maintenance work continues with employees working independently and following mandated guidelines. The District has also provided all employees with the proper PPE, latest Covid-19 information and training.

Watermaster – General Manager Diamond briefly touched on the written monthly report that Watermaster Munn submitted.

Operations Report – Operations Superintendent Williams reported on District operations stating that the District’s share of Isabella storage is estimated at 33,100 AF. Kern River natural inflow and outflow are averaging 210 cfs and 645 cfs, respectively.

The District’s Kern River demand is 125 cfs. Well production is averaging 260 cfs daily. The District has returned an estimated 4,175 AF of previously banked water to Delano-Earlimart ID, 3,854 AF to Kern Tulare WD and 1,805 AF to Southern San Joaquin MUD. Shafter-Wasco ID also received return water totaling 853 AF.

12 cfs of CRC produced water continues to be diverted to the Lerdo Canal. Califia Farms also continues to pump into the Lerdo Canal.

Financial Matters – (20-71) Upon motion of Director Fornoff, seconded by Director Ackerknecht and unanimously carried, to receive and file the Treasurer’s Report for the North Kern Water Storage District for the month of July as presented. (RR20-72) Upon motion of Director Fornoff, seconded by Director Ackerknecht and unanimously carried, to receive and file the Treasurer’s Report for the Rosedale Ranch Improvement District for the month of July as presented. (Ayes: Andrew, Ackerknecht, Mendes, Glende & Fornoff, Noes: None, Absent: None, Abstain: None)

The Financial Statement, Summary of Water Sales, Deposits and the Accounts Receivable report for the month of July were reviewed and accepted as presented.

(20-73) Upon motion of Director Glende, seconded by Director Mendes and unanimously carried, to approve for payment the Accounts Payable for the North Kern Water Storage District for the month of July as presented. (RR20-74) Upon motion of Director Fornoff, seconded by Director Ackerknecht and unanimously carried, to approve for payment the Accounts Payable for the Rosedale Ranch Improvement District for the month of July as presented. (Ayes: Andrew, Ackerknecht, Mendes, Glende & Fornoff, Noes: None, Absent: None, Abstain: None)

Consulting District Engineer – Stephanie Hearn reported: A. High-Speed Rail Authority: Ms. Hearn stated that GEI provided support for requests for information regarding the cost estimates for the 9-22 and 9-26 Canals.

B. Poso Creek RWMG: Minimal activity for the month. North Kern’s share of the $3.8 million Prop 1 grant award is $838,818. NK’s grant award is to continue lining the Calloway Canal and implement Phase 3 of the WDI project. GEI is focusing on looking for more grant opportunities.

C. Grants for Projects: The District previously received notice that it was awarded an amount of $75,000 to fund the SCADA software and Land IQ ET improvements. The Bureau continues working on drafting a contract for this award. The District’s submittal of the $1.5 million grant proposal to the Bureau of Reclamation last March focused on additional lining of the Calloway Canal has also been awarded. The Bureau continues drafting a contract for this award.

D. Water Delivery Improvements: Ms. Hearn stated the Well Instrumentation project for SCADA has been broken down to three contracts: first, flow meters – procure and install; second, electrical – procure and install; third, plc’s. GEI continues to have weekly meetings with the District regarding this work (NK 613, 614 and 615). Budget and Personnel Committee –

Geoff King (District Auditor) addressed the board and gave a brief summary of the North Kern Water Storage District and Rosedale Ranch Improvement District Audited Financial Statements for 2019.

(20-75) Upon motion of Director Glende, seconded by Director Fornoff and unanimously carried, to approve the December 31, 2019 Audited Financial Statement of North Kern Water Storage District and Rosedale Ranch Improvement District and Independent Auditors Report as presented. (Ayes: Andrew, Ackerknecht, Mendes, Glende & Fornoff, Noes: None, Absent: None, Abstain: None)

Engineering Committee – (20-76) Upon motion of Director Ackerknecht, seconded by Director Mendes and unanimously carried, to approve the Second Amendment to Utility 1.0 with California Rail Builders for the High-Speed Rail CP-4 Project. (Ayes: Andrew, Ackerknecht, Mendes, Glende & Fornoff, Noes: None, Absent: None, Abstain: None)

(20-77) Upon motion of Director Glende, seconded by Director Ackerknecht and unanimously carried, to authorize the General Manager to execute Task order 20- 07 with GEI Consultants for the High Speed Rail CP-4 Project for a budget amount not-to-exceed $100,000. (Ayes: Andrew, Ackerknecht, Mendes, Glende & Fornoff, Noes: None, Absent: None, Abstain: None)

(20-79) Upon motion of Director Fornoff, seconded by Director Ackerknecht and unanimously carried, to approve Resolution No. 20-79 to authorize the General Manager or designee to execute grant related documents with the Department of Water Resources to concrete line the Calloway Canal and improve the District’s water delivery options. (Ayes: Andrew, Ackerknecht, Mendes, Glende & Fornoff, Noes: None, Absent: None, Abstain: None)

(20-78) Upon motion of Director Fornoff, seconded by Director Ackerknecht and unanimously carried, to authorize the General Manager to execute Task Order 20- 08 with GEI Consultants to prepare grant proposals to continue concrete lining the Calloway Canal for a budget amount not-to-exceed $10,000. (Ayes: Andrew, Ackerknecht, Mendes, Glende & Fornoff, Noes: None, Absent: None, Abstain: None)

Groundwater Ad Hoc Committee – General Manager Diamond gave a brief update on status.

Produced Water Ad Hoc Committee – General Manager Diamond stated Kennedy Jenks is doing work for the District and CRC regarding increased produced water flows to Rosedale spreading.

Isabella Dam Safety Modification Project- The September 2020 Situation Report is attached. The Phase II (dam) construction and blasting continues as an "essential project". They are continuing structural concrete work on the labyrinth weir spillway structure.

Runoff and Operations - I continue to be in discussions with DWR staff on getting the costs and what commitments are needed for the Kern River to participate in the Aerial Snow Observatory ("ASO") program. ASO aerially measures snow depth and uses algorithms from density measurements and remote sensors to estimate the volume of water in the basin. I have heard from other existing ASO measured watershed managers that DWR funding may not be available next year and Federal or local funding may be needed.

Attached are graphs of "March 1, 2020 to date Kern River Inflow, Outflow and Isabella Storage" and "Kern River Inflows and Chagoopa Plateau Sensor, Elevation: 10,300'. Absent unusual summer precipitation it appears that the peak runoff occurred on May 1 at 1,930 CFS and the reservoir storage peaked on May 31 at 227,876 acre-feet.

California Fires- There is a large fire, "SQF Complex" in the vicinity of the Forks of the Kern burning along the North Fork and Little Kern (map attached). This will impact the water quality of next year's runoff; however, given that it is upstream of Isabella It will not be as severe as water quality problem with fire scars downstream of Isabella. The US Forest Service has taken action to close all public access to national forests in California (notice attached).

Public Outreach -1 continue to respond to press and public inquiries during the month.

US Forest Service notice of forest closures. ISABEllA lAKl CA CONSTRUCTION U.S. ARMY CORPS OF ENGINEERS BUILDING STRONG.

Location & Description Isabella Lake Dam (consisting of a Main Dam, Auxiliary Dam and service spillway) is located about 40 miles northeast of Bakersfield in Kern County, California, and became fully operational in 1953. The Main Dam is located near the confluence of the north and south forks of the Kern River and the Auxiliary Dam is located about half a mile east of the Main Dam. The Main Dam is a 185-foot-high earth-fill dam, and the Auxiliary Dam is a 100-foot-high earth-fill dam. The service spillway is located between the two dams. The reservoir (Isabella Lake) has a gross storage capacity of 568,075 acre feet.

Advisory • USACE has established enhanced protocols to ensure the safety of our employees and our partners, and to take necessary precaution to prevent the spread of COVID-19. Due to the recent wildfires, USAGE is also monitoring the air quality and acting accordingly following the air quality index rating . • The Phase II Dams and Spillways contractor (Fiatiron/Dragados/Sukut Joint Venture, or FDS JV) continues construction activities. As a result, the site including Engineers Point is an active construction area and is off limits to the public. • Corps policy prohibits public operation of unmanned aircraft systems, such as drones, on or above federal lands and waters managed by USACE. The policy is intended to ensure critical infrastructure security and public safety.

Looking Ahead Next 30+ days) • Construction crews continue embanking on the Auxiliary Dam on the East and West sides of the Borel Canal. Structural concrete work continues on the labyrinth weir and emergency spillway. Blasting and excavation of the emergency spillway also continues as planned. • SR 155 continues to have one-lane traffic controlled by temporary traffic signals. There is a minor construction delay with this portion of the project and we now expect completion of SR155 by the end of the year. This does not, however, impact the overall DSMP project completion, which is still on schedule for 2022.

As a reminder, Highway Patrol officers continue to monitor the area for traffic violations. USACE will provide updates on any changes in traffic patterns or lane closures via public outreach, the monthly SITREP, and the Isabella Task Force engagements. Please help us ensure everyone's safety and obey all traffic signals and directions. • Site selection activities for the Visitor Center continue with an expected decision in the fall.

Current Lake Status (as of September 1, 2020) The current pool resides at 109,039 acre-feet, which is 30% of restricted pool, and an elevation of 2,549 feet-IPD . As part of our interim risk reduction measures, Isabella Lake has a restricted elevation of 2,589 feet·IPD (361 ,250 acre-feet). Current lake status can be viewed at https://go.usa.gov/xE2pX

Forest Service Temporarily Closes All National Forests in California

VALLEJO, Calif., September 9, 2020- Due to unprecedented and historic fire conditions throughout the state, the USDA Forest Service Pacific Southwest Region is announcing a temporary closure of an additional ten Nationa l Forests. meaning all eighteen National Forests in California are now closed. The closure of the additional ten forests will be effective at 5:00pm today. These additional forests include the Eldorado National Forest, Klamath National Forest, Lassen National Forest, Mendocino National Forest, Modoc National Forest, Six Rivers National Forest, Plumas National Forest, Shasta-Trinity National Forest, Tahoe National Forest, and Lake Tahoe Basin Management Unit. This decision will be re-evaluated daily as conditions change.

We had closed eight National Forests on Monday evening, Sept. 7, 2020. Explosive growth of fires throughout California during the day and late evening of Sept. 8th led to this updated decision.

"The number of large fires and extreme fire behavior we are seeing across the State is historic," said Regional Forester Randy Moore. "These temporary closures are necessary to protect the public and our firefighters, and we will keep them in place until conditions improve and we are confident t hat National Forest visitors can recreate safely. I ask all Californians and visitors to take these closures and evacuations seriously for their own safety and to allow our firefighters to focus on the mission of safely suppressing these fires."

The Forest Service thanks our partners and the public for their cooperation and understanding of this monumental fire threat. It is critical that all Californians and national forest visitors follow these important closures and restrictions for their own safety and the safety of our firefighters. Citizens with specific questions within their area may call their local forests for more information.

The Forest Service manages 18 National Forests in the Pacific Southwest Region, which encompasses over 20 million acres across California, and assists forest landowners in California, Hawaii and the U.S. Affiliated Pacific Islands. Operations

1. storage is currently 104,000 AF. The Natural Inflow is averaging 180 CFS and the Regulated Outflow is 290 CFS. The District’s share of storage is estimated to be 25,900 AF and receiving zero Kern River entitlement. The District is withdrawing an average of 75 CFS daily of Kern River supplies and pumping 225 CFS from our D/Wells. 2. DEID and SSJMUD continue to receive return water via the Friant. Total monthly August deliveries to DEID totaled 290 AF, KTWD 1,127 AF and SSJMUD 401 AF. To date, the District has returned an estimated 4,449 AF to DEID and 2,180 AF to SSJMUD. Deliveries to KTWD have ended totaling 5,000 AF. Return water to SWID has also ended totaling 942 AF. 3. Deliveries of BVWSD Banked water to Cawelo’s Sta. B continue into September. August deliveries totaled 1,615 AF. To date, 3,535 AF has been delivered. 4. An estimated 13 CFS of CRC produced water is being diverted daily into the Lerdo Canal. Califia continues with 1 CFS into the Lerdo.

Water Banking Project (GEI Project No. 1611224) Activity in August included coordination with team on an upcoming revised well list and finalizing memos for the District. Upcoming Deliverables: After receiving the final project well list, GEI will rerun modeled well capacities to prepare new water impacts modeling scenario, then run the Theis analytical model to evaluate water level impacts. High Speed Rail (GEI Project No. 1605740) A revision to the District’s agreement with HSR was recently completed. The revised agreement is to provide support through final design and construction management for the existing conflicts. In August, GEI continued providing design review support to the District on the 9-22 canal conflict by participating in status calls with the District and HSR. Additionally, GEI continued working with the District, YW, and ZC to prepare technical memorandums and exhibits as part of the 9-26 canal conflict. GEI also prepared and submitted reimbursement invoice package #34 on behalf of the District. Grant Application Support (GEI Project No. 2001514)

GEI provided support for the three awarded USBR grants in the review phase. Progress in August included: • 2019 Calloway Canal Lining and WDI, $1,500,000 o Correspondence with USBR about the agreement budget continued through most of August. At the end of the month, USBR sent the agreement to the District and GEI for review and signature. GEI reviewed the agreement and suggested several minor revisions. The final version of the agreement was signed by the District in early September and will be signed by USBR. The District is awaiting the Notice to Proceed from USBR before any ground disturbing work can take place. • 2020 Calloway Canal Lining and WDI, $1,500,000 o GEI continued to correspond with USBR regarding the budget review process. The agreement is expected to be ready for signature by mid-September. • 2020 Return Capacity Improvements, $750,000 o GEI continued to correspond with USBR regarding the budget review process. The agreement is expected to be ready for signature by mid-September. The DWR Prop 1 Poso Creek IRWM Grant is still in the review phase. NKWSD will serve as the Grantee, however costs are being incurred under a Poso Creek IRWM project number through Semitropic Water Storage District. In August, GEI continued to work with project sponsors to answer DWR’s questions and requests for documents. GEI is working with the District to submit an application to the funding opportunity under USBR’s Water and Energy Efficiency Grants (WEEG) Program. Applications are due September 17.

In December 2019, North Kern Water Storage District (North Kern) and Shafter-Wasco Irrigation District (SWID) jointly adopted their Management Area Plan (MAP) for inclusion in the Kern Groundwater Authority’s Groundwater Sustainability Plan (KGA GSP) to comply with California’s Sustainable Groundwater Management Act (SGMA). The KGA GSP and the MAPs for all its member agencies were submitted to the Department of Water Resources (DWR) in January 2020. Upon adoption and submittal of their respective plans, KGA and its member agencies have begun implementing these plans. This memo provides a review of SGMA implementation activities performed by and on behalf of North Kern for implementation during the period of May 2020 through August 2020.

Ongoing Communications and Coordination

As a member agency of KGA, North Kern participates in the KGA board meetings and stakeholder outreach meetings. These meetings, after the adoption and submittal of the GSP, were reduced from monthly to bi-monthly. As needed, the KGA convenes meetings with the managers of its member agencies.

Due to the state and county’s ongoing response to the COVID-19 pandemic, standing meetings have been cancelled, rescheduled as conference calls or video conferences, or reduced in frequency. North Kern held a Landowner Advisory Committee video conference in June 2020 as part of what was intended to be quarterly meetings with the stakeholder group. In this video conference, the District provided landowners an update on coordination activities within KGA, such as the first annual SGMA report and the KGA’s ongoing coordination with DWR on monitoring of land subsidence in the subbasin. Upcoming discussions within the KGA and the other Kern County GSAs will include the development of a coordinated Data Management System (DMS) for the entire subbasin’s use in housing and maintaining datasets required for analysis and reporting on performance in meeting SGMA sustainability goals.

Additional discussions and coordination have taken place between the districts with respect to monitoring and development of data to satisfy the reporting requirements of SGMA.

Semi-Annual Groundwater Conditions Reporting

As was confirmed in the first Annual SGMA Report, submitted April 1, 2020 by Todd Groundwater on behalf of the Kern County Subbasin, some of the Representative Monitoring Sites identified in the KGA GSP and its MAPs were changed. These changes were due to producing wells being destroyed and replaced, particularly wells identified as municipal supply wells. GEI coordinated with staff from the cities of Shafter and Wasco to select new Representative Monitoring Sites to replace those which were destroyed and replaced. This information was provided to KGA and Todd Groundwater to perform a “batch” upload of all new site information to DWR.

North Kern also provided data to KGA for inclusion in the Kern County Subbasin’s semi-annual groundwater conditions reporting. One of the requirements of SGMA is that by July 1st of each year, each basin provide updated information obtained from the monitoring of Representative Monitoring Sites described in the GSP(s) for the basin. In addition to data collected from District-owned and operated wells, GEI gathered data from the cities of Shafter and Wasco for submittal to DWR.

Groundwater Monitoring and Data Gaps

As identified and described in the Basin Setting section of the North Kern – SWID MAP, and in the Basin Setting of the KGA GSP, the continued monitoring of groundwater levels, water quality, and land subsidence are essential to quantifying the Kern County Subbasin’s performance in complying with SGMA. Data gaps identified in the Basin Setting and Monitoring Network sections of the KGA GSP are to be addressed by each district as specified in their MAPs.

North Kern and SWID jointly identified potential sites for dedicated groundwater monitoring wells. Two of these sites are in SWID and are currently being developed. One of these sites is in North Kern, in proximity to Rosedale Ranch. SWID is in the process of obtaining landowner access agreements for two new SGMA-compliant monitoring well sites.

Along with monitoring groundwater levels, the districts and the cities are also to collect and report on water quality for the constituents of concern identified in the MAP. For the North Kern – SWID MAP, the constituents of concern are TCP, nitrate, sodium, and chloride. The cities currently collect the data for their representative monitoring sites. However, in the interest of ensure that good standard practices are followed and that representative samples are collected, Standard Operating Procedures are being developed for the cities and the districts to use in gathering water quality data. A draft of these water quality sampling SOPs are available for District and city review, ahead of the groundwater level readings for fall 2020.

DISCUSSION:

At the August 18, 2020 meeting the Board authorized GEI Consultants (GEI) to prepare a grant application to the Bureau of Reclamation (“Bureau”) under the Water and Energy Efficiency Grants for Fiscal Year 2021 to concrete line the Calloway canal from 7th Standard Road to the 8-1 back up weir.

Exhibit “A” is the required resolution authorizing the General Manager to submit a grant application and enter into an agreement (if approved) with the Bureau of Reclamation for grant funding.

WHEREAS, North Kern Water Storage District partnered with several neighboring water districts and formulated the Poso Creek Integrated Regional Water Management Plan (Plan), adopted in July 2007 and updated in 2014 and 2019 by each of the districts for their collective area; and

WHEREAS, District staff, in conjunction with surrounding water districts, communities, and stakeholders, has formulated a plan of improvements; and

WHEREAS, the Plan identified regional projects that, once implemented, would improve the water management of the Region and the ability for North Kern to regulate water supplies available to the district; and

WHEREAS, the Plan promotes a regional recharge, reduction of overdraft, and operation changes in responding to reductions in water supply reliability to the region; and

WHEREAS, District staff has formulated a project improvement, referred to as Calloway Canal Lining: 7th Standard Road to 8-1Backup Weir, which has the support of surrounding water districts and communities; and would be funded by a combination of North Kern Water Storage District funds and grant funds; and

WHERAS, water will be conserved by lining improvements made to the Calloway Canal; and

WHEREAS, the United States Bureau of Reclamation is currently soliciting proposals for grant funding assistance under their WaterSMART Grants: Water and Energy Efficiency Grants for Fiscal Year 2021 (Funding Opportunity No BOR-DO-21-F001); and

WHEREAS, District staff has formulated a grant proposal to line a portion of the Calloway Canal.

NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the North Kern Water Storage District as follows: a. The District’s Manager, Richard Diamond, and Deputy General Manager, Ram Venkatesan, are hereby authorized and directed to submit the grant application and are authorized to enter into an agreement with Reclamation on behalf of North Kern Water Storage District for grant funding under Reclamation’s WaterSMART Grants: Water and Energy Efficiency Grants.

b. The District’s Board of Directors has reviewed and supports the submission of a grant application to Reclamation entitled Calloway Canal Lining: 7th Standard to 8-1Backup Weir.

DISCUSSION:

As indicated at prior Board meetings, about a third of District’s existing well field consists of wells that were constructed in the 1950’s. Staff presented a well replacement plan to the Board earlier this year that involves replacement of 16 of those 1950 vintage wells over the next few years.

One of the wells that is planned to be replaced this year is well 88-00-47. The District currently has 20’x50’ easement for the existing well and staff requested Bidart Trust (“Bidart”) (the landowner adjacent to well 88-00-47) provide an easement (20’x50’) to construct the replacement well about 100’ away from the old well (See Exhibit “A”).

Bidart agreed to provide well easement for the replacement well and in exchange asked the District quitclaim the easement for the old well location. Exhibit B is the easement for the replacement well from Bidart to North Kern and Exhibit C is the quitclaim of the old well easement to Bidart from North Kern.

Staff requests Board approval to execute the above-mentioned documents.

(a) Grantee shall install the above-described well and related pump equipment (collectively the "Facilities") in a good and workmanlike manner, and in so doing shall comply with all applicable laws, rules and regulations.

(b) All buried Facilities shall be installed at a minimum depth of 24 inches. Grantee shall promptly and properly backfill all excavations made by or for Grantee on the Property.

(c) All Facilities as installed shall include all appropriate safety measures and safety devices, both at the time of installation and at such future times as normal safety precautions and applicable laws, rules and regulations may require.

(d) Grantee shall promptly pay any and all taxes, assessments, or other charges of any kind which may be levied upon or related to the Easement, the Facilities, or the exercise of any of the rights and privileges herein granted.

(e) Grantee shall reimburse Grantor for any and all damages sustained to Grantor's crops, fences, buildings, or other property which may be caused by or in any way related to the exercise of any of the rights herein granted.

(f) Grantee shall from time to time and at its own cost and expense install such safety devices and make such other improvements to the Facilities as shall be reasonably necessary to keep the Facilities at all times safe and in compliance with all applicable laws, rules and regulations.

(g) Grantee, at its sole cost and expense, shall maintain the Facilities in good condition and repair and shall at all times keep such Facilities in compliance with all applicable laws, rules and regulations, including, without limitation, all laws, rules and regulations relating to hazardous substances and environmental protection.

“Approve an agreement with Provost & Pritchard Consulting Group and Task Order 20-09 with GEI Consultants for the preparation of information and materials and facilitation of a Proposition 218 Election for Rosedale Ranch Improvement District in the respective amounts of $85,000 and $20,000.”

DISCUSSION:

The Rosedale Ranch ID (RRID) Management Area of the North Kern WSD–Shafter Wasco ID (SWID) “Management Area Plan” (MAP) under the Sustainable Groundwater Management Act describes various “projects” and “management actions” to achieve sustainability in RRID. Current financing authority for RRID is not sufficient to fund the proposed projects and actions, and an election under “Proposition 218” is necessary to provide additional necessary funding authority. In parallel with completing the “SGMA Planning Report” for RRID, staff has been in discussions with both GEI Consultants and Provost & Pritchard Consulting Group (P&P) regarding the Prop 218 process for RRID. This process will require the refinement of proposed projects as a basis for developing more precise cost estimates (the basis for necessary financing authority), and facilitating the Prop 218 election process. P&P manages the “7th Standard Annex Area” for SWID, has delineated projects to assist the annex area in reaching sustainability, and last year facilitated a successful Prop 218 election to provide project funding. Based on this work/expertise staff requested a proposal from P&P to assist North Kern with the RRID Prop 218 election (Exhibit “A”). The proposal includes facilitation of the Prop 218 process and assistance with project and cost refinement tasks (Feasibility Level Analysis). GEI has previously evaluated potential sites for the expansion of groundwater recharge in the “old District” of North Kern, and based on this work/expertise, staff has instructed GEI to initiate the evaluation of potential recharge sites in RRID, including the evaluation of required canal capacity Rosedale Ranch Improvement District Committee Approve Contract with Provost & Pritchard Consulting Group and Task Order with GEI Consultants for Proposition 218 Election September 15, 2020 Page 2 of 2

Dear Richard:

Thank you for the opportunity to submit this proposal to provide engineering services for the subject project. This proposal discusses our understanding of the project, recommends a scope of services together with associated fees, deliverables and approximate schedules, sets forth our assumptions and discusses other services that may be of interest as the project proceeds.

Project Understanding We understand that the North Kern Water Storage District (District) is requesting a review of current District assessment rates for Rosedale Ranch Improvement District (RRID). The District is also requesting recommendations for future assessments for administration, operations, maintenance, and water tolls to meet the needs of the District. Additionally, the District is requesting assistance with finalizing the District’s capital improvement program for RRID. P&P will utilize District reports such as past operation budgets, financial audits, capital improvement budgets, and engineering studies to prepare an Engineering Report consistent with Proposition 218 standards that will make a recommendation for future per-acre basis assessments. In addition, new analyses of capital improvements, capacities and water availability will be performed by others for P&P to review and include in the Prop 218 Engineer’s Report.

Scope of Services Our proposed scope of work for this project is described below:

Feasibility Level Analysis (FEAS) • Review budgets, audits, reports, and studies including the RRID Management Area of the North Kern County Groundwater Sustainability Plan (GSP) Chapter of Kern Groundwater Authority (KGA) GSP. • Review, coordinate and refine cost estimates and benefits from studies underway by GEI for Sustainable Groundwater Management Act (SGMA) Projects and Management Actions. • Investigate and develop water supply and conveyance programs internally and with neighboring Districts. • Assist GEI in preparing report for recommended capital improvement plan.

Detachment Plan (DETP) • Develop plan with City of Bakersfield for detachment of lands from North Kern that have undergone conversion of Ag land to urban residential. • Prepare high level mapping of lands to be detached.

Prop 218 Engineers Report and Election Assistance (ER) • Prepare forecast of RRID costs and revenue requirements, analyze assessment rates, and obtain input from District Staff and possible advisory committee regarding proposed rates. • Prepare draft of Prop. 218 Engineer’s Report and review with District staff and legal counsel. • Prepare final Report and present to advisory committee and board. • Prepare ballots, notice, and assessment roll. • Mail ballots to landowners. • Conduct public hearing, count ballots and certify election.

Professional Fees Provost & Pritchard Consulting Group will perform the services on a time and materials basis, in accordance with our Standard Fee Schedule in effect at the time services are rendered. These fees will be invoiced monthly as they are accrued, and our total fees, including reimbursable expenses, will not exceed our estimate of $85,000 without additional authorization.

Schedule Once we receive an executed copy of this Proposal together with the signed Consultant Services Agreement, and are authorized to proceed, we can coordinate the Feasibility level analysis immediately. In contemplation of completing the Prop 218 process for the 2022 tax year, the County would require the assessment roles and rates be provided by June 2021. This drives the overall schedule leaving approximately 8 months to complete all tasks. It is anticipated that within the first three months that the District, GEI, and P&P, will complete the Capital Improvement Plan and water supply availability analysis Once the District accepts the Capital Improvement Plan, the Prop 218 Engineer’s Report will take approximately 6 to 8 weeks for initial submittal. Some overlap may be needed to meet the target date. Once the District accepts the Engineer’s Report the ballot mailing, public hearing, and certification of the election will take approximately 3 months.

PROFESSIONAL SERVICES AGREEMENT EXHIBIT A – SCOPE OF WORK FOR ENGINEERING SERVICES

TASK ORDER NO. 09-2020 ROSEDALE RANCH GROUNDWATER RECHARGE INFORMATION STUDY

This Task Order defines a Scope of Services, Schedule, and Budget for work to be completed by GEI Consultants, Inc., (GEI) for North Kern Water Storage District (NKWSD, North Kern, District) per the terms and conditions of the Professional Services Agreement dated November 16, 2017, except as amended herein.

As defined in the District’s joint Management Area Plan and the KGA GSP, North Kern is considering direct groundwater recharge opportunities within a portion of Rosedale Ranch. In this regard, there is a potential funding partnership opportunity through the Natural Resource Conservation Service (NRCS) which may assist with project development and implementation. This particular funding opportunity includes direct recharge and conveyance infrastructure. While this is not a grant program, any capital investment the District makes as a lead partner funding commitment, can be leveraged for future NRCS funds to your growers and other beneficiaries in the area to apply for an EQIP funding grant. Accordingly, this Task Order is focused on identification of potential sites for the development of spreading basins and on improvements to the Rosedale Ranch distribution system which may be necessary to convey water to the spreading basins.

SCOPE OF SERVICES

A prefeasibility-level study is proposed, conducted as a desktop analysis of existing data, with the following objectives: identify potential recharge sites; and identify distribution system improvements that may be necessary to convey recharge water to those sites. It is noted that field investigations, which would be included in a feasibility-level study, are not included in this initial scope of work. The proposed scope of work is set forth following in three generalized tasks.

Project management services will include conducting a project kick-off meeting to align the project team with their tasks, budgets and due dates. Throughout the project, PM activities will include routine project communication to keep the project on-track with requirements and expectations; monitoring schedule and budget; reviewing and issuing monthly invoices; and preparing progress summaries for the board report. As requested, updates will also be provided during routinely scheduled meetings with District Management.

Task 2: Data Analysis and Interpretation

Compile available data and identify potential recharge sites using a tiered ranking system. Tier 1 sites will have the highest potential for recharge whereas Tier 4 sites are not recommended for further study. Using GIS, soil rating indexes will be overlain with land uses to refine the study area(s) and identify locations that would most feasibly support/be available for a recharge project. Lastly, proximity to existing district infrastructure will be evaluated to select up to six recommended sites. The project approach is defined by three subtasks: data collection and literature review; geohydrologic evaluation; and engineering evaluation.

Data Collection and Literature Review

Information and data to be used to identify potential recharge sites will be collected from various public sources, as defined in the following bullet points.

• NRCS, Soil Agricultural Groundwater Banking Index (SAGBI), and Land IQ’s Groundwater Recharge Suitability Index datasets.

• Existing published studies and reports on subsurface geology.

• Groundwater contours, gradient (upgradient or downgradient to the majority of the District), and topographic maps of the study area.

• Land use GIS files.

• Infiltration rates from relevant, existing groundwater recharge projects.

Geohydrologic Evaluation

A GIS-based analysis will be performed to aid in the initial screening of collected data. Figures will be created based on the various soil indices datasets to show the areas with highest potential infiltration rates and segregated into a tiered ranking system. Land uses, topography, and groundwater contours will then be overlain to further refine the potential suitability of sites for recharge projects. Regional infiltration data will be used to support a

2 preliminary estimate of infiltration rates. Based on this analysis, up to six sites will be recommended for further study with preference given to sites proximate to district infrastructure and having a suitable depth to water, relatively flat topography, and apparent permeable soils. The selected sites will be compared with existing infrastructure to identify necessary extensions and potential alignments.

Engineering Evaluation:

In addition to the evaluation of potential recharge capacity, data provided by the District will be used to determine the total conveyance capacities and average use, as well as evaluate potential available capacity to deliver water to the potential recharge sites. The results of the engineering evaluation will provide the District with sufficient information to identify potential infrastructure improvement projects and estimate the scope of improvements at a reconnaissance level.

Task 3: Technical Memorandum and Presentation

The principal deliverable of this study will be a summary of findings and recommendations. At a minimum, the summary will address locations of potential groundwater recharge sites, distribution system improvements, and applicability of the NRCS funding program. The purpose of this prefeasibility-level analysis is to provide direction for future studies; accordingly, recommendations will be included in this regard.

If requested, the study results and recommendations will be presented to the District and Board of Directors.

Assumptions:

The District will provide all information on existing infrastructure, including total capacity and average capacity used. This study is strictly a desktop analysis using available data.

SCHEDULE

GEI’s staff are available to begin the study upon notification to proceed from the District. Our anticipated completion date for a draft report for District review is October 16, 2020. The presentation of study results and recommendations is anticipated for the regularly scheduled Board of Directors meeting on November 17, 2020. Final draft of the Report is anticipated by November 30, 2020. This Task Order will terminate on December 31, 2021, unless extended by amendment.

BUDGET

Billing for all work completed under this Task Order will be in accordance with the terms of the Professional Services Agreement, dated November 16, 2017, with labor billed at 3.05 times labor rate, and expenses billed at 5% above cost. Based on the Scope of Work

3 previously described, we suggest authorizing $20,000 budget.
