Republican legislators in North Dakota are taking a pro-active – and constitutional – step to push back against unconstitutional executive orders coming out of the Biden administration, and they are doing so with the power of the US Constitution in their corner. A new bill introduced in the North Dakota State Legislature (HB1164), would instruct the state’s Attorney General to review the constitutionality of each of the executive orders issued by Joe Biden. Under the proposed law, should the North Dakota Attorney General find that any executive orders are unlawful – or unconstitutional, the executive order would be “nullified,† it would prohibit any state, county, or local agency – or publicly funded organization – from enforcing the order(s). The North Dakota legislature is a biennial legislature and both the houses sit for only 80 days in odd-numbered years. Therefore a Legislative Council operates to oversee legislative affairs in the interim periods. North Dakota Legislative Assembly Website. Inside North Dakota State Legislature. USLegal Home. System. In voting to support the bill, Cory is a lot like her party, but a little less like her closest GOP neighbors. Counting House votes from 16 legislative districts running along North Dakota’s urban border with Minnesota — stretching from Grand Forks to Fargo to Wahpeton — the bill was defeated 21-11. Nine of those votes against the bill were Republicans — and those nine make up the majority of GOP representatives statewide who broke with their party and opposed HB 1298. Emily O'Brien (Photo provided by North Dakota Legislative Council). 4 / 4.
