    2017 Senate Resolution 6 ENGROSSED RESOLUTION Relating to: honoring the University of Wisconsin−Green Bay women’s basketball team. Whereas, the Green Bay Phoenix women’s basketball team captured its 16th tournament championship in the last 21 seasons by defeating Wright State 62−44 in the championship game of the Horizon League Championship; and Whereas, the 29 wins by the Phoenix are the most wins since the 2012−13 season and the third time under Head Coach Kevin Borseth that the team has won 29 games or more in a season; and Whereas, senior Jessica Lindstrom was named to the All−Horizon League First Team, All−Defensive Team, and All−Academic Team and finished with an average of 15.3 points and 10.4 rebounds per game, making her the only player to average a double−double in the entire league; and Whereas, senior Allie LeClaire was named to the All−Horizon League Second Team and was the Horizon League Tournament MVP, redshirt junior Jen Wellnitz was awarded Defensive Player of the Year, and Karly Murphy earned a spot on the All−Freshman Team; and Whereas, Green Bay also won its 20th−consecutive regular−season conference championship and will be appearing in its 18th NCAA tournament; now, therefore, be it Resolved by the senate, That the members of the Wisconsin Senate hereby commend and congratulate the Green Bay Phoenix women’s basketball team on another very successful regular season and wish them the best of luck in the NCAA tournament; and, be it further Resolved, That the senate chief clerk shall provide copies of this resolution to Head Coach Kevin Borseth, his staff, each member of the team, and Athletic Director Charles Guthrie.

    Disability and Death Clauses in College Coaches’ Contracts By Martin J. Greenberg I. INTRODUCTION There is little in the literature about two clauses that have an enormous impact on the economics of college coaches’ contracts. They are the death and disability clauses. If either were to occur, subject to the dictates of the contract, it could mean a termination of the contractual obligations of the university and an end to the coaches’ income stream. If the coach dies, the contract and the obligations of the university thereunder normally terminate. Disability on the other hand is more complicated. What is the definition of disability, who determines disability, and how long is one able to be disabled before the contract terminates? These issues are not only perplexing, but need to be expressly addressed in the coaches’ contracts. The case of Terry Hoeppner (“Hoeppner”) is illustrative of the issues. Hoeppner was hired on December 17, 2004 as the head football coach at Indiana University, after having coached at Miami University in Ohio for six seasons, compiling a 48–25 record and taking the team to two consecutive bowl games in 2003 and 2004. 1 Hoeppner was hired in 2004 to rebuild Indiana’s floundering football program.2 He immediately nicknamed the Hoosiers’ home field “The Rock” and then had a limestone boulder added to Memorial Stadium to reinforce the message. 3 In two years at Indiana, he was 9–14. 4 On December 27, 2005, Hoeppner underwent surgery to remove a tumor from his right temple. 5 On September 12, 2006, he announced he would undergo a second surgery the next day 1 Terry Hoeppner: Timeline , 13WTHR Indianapolis, http://www.wthr.com/story/6679762/terry-hoeppner-timeline (last visited Jan.

WHEREAS, Coach Broderick Fobbs, in his third year at the university, led the Grambling State Tigers last year to an overall record of twelve and one, capping the season as 2016 SWAC Football Champions, defeating Alcorn State 27-20 in the title game, and as 2016 HBCU National Football champions, prevailing over North Carolina Central 10-9 in the Air Force Reserve Celebration Bowl; and WHEREAS, after a one-year stint serving as the wide receivers' coach with Southern Mississippi University in 2012, Fobbs returned to McNeese State University in 2013 for a sixth overall season as a member of the McNeese coaching staff as the tight ends' coach, having previously served there as co-offensive coordinator and wide receivers' coach; and also worked as an offensive graduate assistant at the University of Louisiana-Lafayette during the 2000-2001 season; and WHEREAS, as a high school player at Carroll High School in Monroe, he earned all-state and all-district honors in football and baseball, played in the state baseball and football all-star games and earned a scholarship to Grambling State University as a running back; and WHEREAS, under legendary GSU Head Football Coach Eddie Robinson, Coach Fobbs served as a two-time team captain for the Tigers and led the Southwestern Athletic Conference in yards per carry of 7.1 one season while gaining more than one thousand yards during his college football career; and WHEREAS, he was an honors student and earned his bachelor's degree from the university in 1997; and Page 1 of 2 SR NO.
