HIGHWAYS ACT 1980 ACQUISITION OF LAND ACT 1981

THE A1 MOTORWAY (DISHFORTH TO BARTON SECTION) COMPULSORY PURCHASE ORDER (MP No 81) 2013

Notice is hereby given that the Secretary of State for Transport in exercise of his powers under the above Acts on 22nd October 2013 made with modifications the A1 Motorway (Dishforth to Barton Section) Compulsory Purchase Order (No MP 81) 2013.

The Order as made provides for the purchase for the purposes of:

a) the construction of the special roads in the Parishes of and Leeming Bar, Ainderby Mires with Holtby, with , Hackforth and Killerby (all in the District of Hambleton) and in the parishes of Appleton East and West, Catterick, Brough St Giles, Brompton-on-Swale, Moulton, Middleton Tyas and Barton (all in the District of ) in pursuance of the Motorway Scheme

b) the construction and improvement of highways and the provision of new means of access to premises in those parishes and districts in pursuance of the A1 Motorway (Dishforth to Barton Side Roads) Order 2013;

c) use by the Secretary of State for Transport in connection with the construction and improvement of highways and the execution of other works mentioned above; and

d) the mitigation of any adverse effects which the existence or use of the highways proposed to be constructed or improved will have on their surroundings, the land which is described in the Schedule to this Order and delineated and shown coloured pink on the plan and the rights described in that Schedule over the land described in it and delineated and coloured blue on the plan.

The Order as made becomes operative on the date on which this notice is first published; but a person aggrieved by the Order may, by application to the High Court within 6 weeks from that date, question its validity on the grounds that the authorisation granted by the Order is not empowered to be granted or that there has been a failure to comply with any relevant statutory requirement relating to the Order.

The Secretary of State published in draft a compulsory purchase order between Dishforth to Barton on 31 March 2006. The Secretary of State made in part the proposals, between Dishforth to Leeming, on 25 September 2008 and deferred the remaining proposals between Leeming and Barton.

The Secretary of State published further draft supplementary compulsory purchase orders on 23 May 2013 between Leeming and Scotch Corner and he now makes, as one order, those proposals including parts of the deferred 2006 proposals between Leeming and Scotch Corner. The Order as made includes minor modifications as agreed with land owners and the local highway authority and those changes agreed at the public inquiry held in October 2006.

The Secretary of State published a further draft supplementary compulsory purchase order on 18 July 2013 between Scotch Corner and Barton. These further proposals and the deferred 2006 proposals between Scotch Corner and Barton are still subject to the statutory processes.
