ENVIRONMENTAL AND SOCIAL COMMITMENT PLAN

1. The People’s Republic of China (hereinafter the Borrower) shall, and shall cause the Municipality and the Ningbo Municipality (hereinafter the Project Implementing Entities) to, implement the China Plastic Waste Reduction Project (the Project), with the involvement of entities at central, municipal and level as follows: (a) with respect to the activities implemented at the central level (National Part of the Project), the National Development and Reform Commission (NDRC) and the National Energy Conservation Center; (b) with respect to the activities implemented by Chongqing Municipality (Chongqing’s Part of the Project), the Chongqing Environment & Sanitation Group Co., Ltd. (ESG), Chongqing , Chongqing Nanzhou Urban Management Co., Ltd., , Wulong District Construction Investment Group, Chongqing Development Reform Commission, Chongqing Finance Bureau and others municipal and district/county entities; and (c) with respect to the activities implemented by Ningbo Municipality (Ningbo’s Part of the Project), Ningbo Dabashou Bio-Digital Technologies Co., Ltd., Ningbo Haijing Plastic Recycling Technology Co., Ltd., Ningbo City Construction Waste Recycling Technology Co., Ltd., Ningbo Qingyuan Water Environment Service Co., Ltd., Ningbo City Management Bureau Waste Segregation Center, Ningbo Development Reform Commission, Ningbo Finance Bureau and others municipal and district/county entities. The International Bank for Reconstruction and Development (hereinafter the Bank) has agreed to provide financing for the Project.

2. The Borrower shall, and shall cause the Project Implementing Entities to, implement material measures and actions so that the Project is implemented in accordance with the Environmental and Social Standards (ESSs). This Environmental and Social Commitment Plan (ESCP) sets out material measures and actions, any specific documents or plans, as well as the timing for each of these.

3. The Borrower shall, and shall cause the Project Implementing Entities to, also comply with the provisions of any other E&S documents required under the ESF and referred to in this ESCP, such as Environmental and Social Management Framework, Environmental Impact Assessment, Social Impact Assessment, Environmental and Social Audit Report, Environmental and Social Management Plan, Labor Management Procedure, Resettlement Framework, Resettlement Plan, Ethnic Minority Development Framework, Ethnic Minority Development Plan, Chance Find Procedure, Stakeholder Engagement Plan, Grievance Redress Mechanism, capacity training plan, etc. and the timelines specified in those E&S documents.

4. The Borrower and the Project Implementing Entities are responsible for compliance with all requirements of the ESCP even when implementation of specific measures and actions is conducted by the entity, agency or unit referenced in paragraph 1. above.

5. Implementation of the material measures and actions set out in this ESCP shall be monitored and reported to the Bank by the Borrower and/or the Project Implementing Entities as required by the ESCP and the conditions of the Loan Agreement and the respective Project Agreement, and the Bank will monitor and assess progress and completion of the material measures and actions throughout implementation of the Project.

6. As agreed by the Bank, the Borrower and the Project Implementing Entities, this ESCP may be revised from time to time during Project implementation, to reflect adaptive management of Project changes and unforeseen circumstances or in response to assessment of Project performance conducted under the ESCP itself. In such circumstances, the Borrower, through NDRC, and the Project Implementing Entities, through the respective Project Management Office, will agree to the changes with the Bank and will update the ESCP to reflect such changes. Agreement on changes to the ESCP shall be documented through the exchange of letters signed between the Bank and the Borrower, through NDRC, and the Project Implementing Entities, through the respective Project Management Office. A change only to Section A of the ESCP affecting only the National Part of the Project may be agreed in writing between the Bank and NDRC. A change only to Section B or C of the ESCP affecting only Chongqing’s Part of the Project or Ningbo’s Part of the Project may be agreed in writing between the Bank the relevant Project Implementing Entity, through its Project Management Office. The Borrower, through NDRC, and the Project Implementing Entities, through the respective Project Management Office, shall promptly disclose the updated ESCP.

Where Project changes, unforeseen circumstances, including changes to existing legislative framework, or Project performance result in changes to the risks and impacts during Project implementation, the Borrower and the Project Implementing Entities shall provide additional funds, if needed, to implement actions and measures to address such risks and impact, which may include occupational health and safety impacts, community health and safety, land acquisition and resettlement, not-in-my-backyard impacts.
