ATTENTION BREEDERS’ CUP HORSEMEN There are several IMPORTANT procedures for the 2021 Breeders’ Cup World Championships (BCWC) at Del Mar Racetrack that you should be aware of: Breeders’ Cup Condition of Entry As a condition of entry for any BCWC race, no horse (i) within six (6) months of the BCWC shall test positive in a BCL out-of-competition test sample for or have a veterinarian reported administration of any anabolic steroid, any bisphosphonate, or any other prohibited substance described under the Association of Racing Commissioners International (“ARCI”) prohibited substance list at ARCI-011-015 V.10.0 (Annex I) of ARCI’s Model Rules, and any horse in violation of this Condition (i) shall be ineligible to participate in the 2021 BCWC. Any horse nominated, pre-entered or entered to race is subject to blood, hair, or urine testing at any time. (ii) within thirty (30) days of the BCWC shall have been treated with extracorporeal shock wave therapy; and any horse in violation of this Condition (ii) shall be ineligible to participate in the 2021 BCWC. (iii) will have a positive finding of any medication or substance carrying a Category “A”, “B” or “C” penalty as designated in California Horse Racing Board Rule 1843.2 (Rev. 02/21) in a BCWC post-race test sample; and a positive finding for any of these medications or substances, as described above will lead to a disqualification of the horse, a redistribution of the purse and a suspension of the trainer for one year from competing in the next BCWC. 1. All runners MUST have a pre-race exam from their attending veterinarian stating that the horse is fit to compete (form on page 146). This form must be on file with the Breeders’ Cup Racing office prior to ENTRY at 10:00 am (PDT) on Monday, November 1. 2. After pre-entry on Monday, October 25, all runners MUST request permission for a timed workout from Breeders’ Cup on any of the Del Mar, Santa Anita, San Luis Rey and Los Alamitos surfaces and the runner must have a veterinary exam during the five days preceding the work. This request must be on file with the Breeders’ Cup Racing office 24 HOURS BEFORE the intended work. (form on page 147). 3. Per CHRB 1846.1 all runners MUST submit a 30-day veterinary treatment record to the CHRB official veterinarian. This treatment record should show the date of treatment and what medications were administered. This treatment record should be for the period of time 30 days prior to ENTRY day, Monday, November 1. This treatment record should be sent to the Official Veterinarian via email: ovsocaltb@ yahoo.com, or by submitting the form to the Official Veterinarian’s office (form on page 145). 4. No Lasix is permitted in the 48 hours preceding any races at Del Mar on Fri., Nov. 5 & Sat., Nov. 6. 5. Intra-articular corticosteroid treatments are prohibited within 14 days of racing. In addition, a horse may not enter if it has received an intra-articular injection of cortisone in the fetlock joints within the previous 30 days immediately preceding the race. All corticosteroids in a post-race test sample are prohibited. 6. Non-steroidal anti-inflammatory drugs (NSAIDs) are prohibited within 48 hours of a work or a race. There is no authorized threshold for NSAIDs. 7. There is no permitted threshold for Clenbuterol in California and its use is restricted. See pages 16-17 for further details. Horses shipping into California are advised to stop Clenbuterol treatments at a minimum of six weeks prior to race day. Pre-entry testing is available. 8. All trainers of horses entered to race on November 5 and 6, 2021 must have on file with the DMTC Racing Office, a signed Trainer’s agreement found on page 139-140. 2021 Horsemen’s Information Guide A1 DISCLAIMER RELATING TO COVID-19 AND OTHER INCIDENTS Breeders’ Cup Limited (BCL) and Del Mar Thoroughbred Club (DMTC) have put in place preventative measures to maintain the safety of all BCWC Attendees, including, without limitation, COVID-19 related measures such as hand washing and sanitizing, and face mask and social distancing measures (“COVID-19 Measures”); however, BCL/DMTC cannot guarantee that Attendee will not become infected with COVID-19. Attendee understands that the risk of becoming exposed to or infected by COVID-19 at the BCWC may result from the actions, omissions, or negligence of BCL/ DMTC and others. In addition, Attendee is warned and recognizes that participating in stabling, racing, training and related activities is inherently dangerous, and further recognizes that hazards and risks inherent in such activities may cause the injury, illness, or death, including specifically, but not limited to, the danger of being injured by horses, falling objects, and other Attendees as well as the danger of being exposed to or infected by COVID-19. By participating in such activities, Attendee assumes the risks associated therewith. In consideration of participating in stabling, racing, training and related activities associated with BCL/DMTC, Attendee hereby releases, waives against and discharges BCL/DMTC, to the fullest extent permitted under the law, from any claims, losses, obligations, costs and expenses arising from or due to personal injuries, illness, or property damages of any kind or description to the person, property or horses owned or controlled by Attendee occurring on the race track premises. Attendee agrees that all risk of loss, injury, illness, damage or destruction to persons or property, including but not limited to, the horses brought onto the race track premises by or at the direction of Attendee his agents or employees, arising from, due to, caused by, resulting from or in any way, directly or indirectly, related to any cause, including but not limited to accident, theft, fire or otherwise, whether or not caused by or contributed to by or related to any fault or negligence of BCL/DMTC or the condition of the race track premises, are assumed in full by Attendee, except as to acts or conditions caused by the intentional, willful, or reckless conduct of BCL/DMTC. Attendee agrees that the release and waiver and discharge provisions hereof are intended to be as broad and inclusive as permitted by the law. Attendee further agrees that the foregoing provisions hereof regarding such release and waiver and discharge shall not be deemed waived or affected in any way by the fact that BCL/DMTC does or does not, may or may not, in the future carry insurance coverage against claims where loss is caused by or resulting from damage or injury to property, persons and/or horses while competing on the race track, using the training tracks, stables, roads or any other facilities over the race track premises or in transit thereon. The foregoing waiver and release is given in consideration of BCL/DMTC permitting Attendee to participate in the BCWC. In consideration of BCL/DMTC permitting the Attendee to participate in or attend the BCWC, Attendee voluntarily assumes all risks of illness, injury, or death inherent in such activities, including those risks disclosed in the Horsemen’s Information Guide incorporated fully herein by this reference, and specifically including, but not limited to, the danger of being injured by horses, falling objects, and other Attendees as well as the danger of being exposed to or infected by COVID-19; furthermore, Attendee hereby releases, waives against and discharges BCL/DMTC, to the fullest extent permitted under the law, from and against any and all claims, losses, obligations, costs and expenses arising from or due to personal injuries, illness, death, or property damages related thereto.     Prat Falls Into Kentucky Derby Winner This is not merely the account of the agent. I have been texting with him and talking to him on the phone since January and following and chronicling every step of this, the ups and downs, as it happened. It is a behind the scenes look at a jockey and his agent's long arduous journey to the Derby and their pursuit of the Derby dream and finding the right mount, in this case a last-minute 65-1 shot. Every January, well before the roses are in bloom, jockeys and their agents begin the arduous and often times stressful task of finding the Kentucky Derby winner. It is a pressure-packed four months, first finding a horse early on, then hoping he’s good enough to continue on the Derby trail, then hoping he stays sound, then hoping the trainer sticks with them and doesn’t start shopping around for a bigger name jockey. All the while, the agent has to keep his eyes and ears open for potential back-up mounts just in case. He also has to maintain good relationships with all the trainers because you never know when he is going to have a live mount. Many times you will have two horses with equal talent, and if they go their separate ways you’re in good shape, letting the horses decide your Derby mount for you. But on some occasions they will wind up in the same race and that is when the agent starts having sleepless nights, not so much getting it right, but making sure he doesn’t get it wrong.
