Search Guidelines (revised 08/20/2010)

The following are minimum search requirements for issuance of insurance policies on residential . These minimum search requirements shall be supplemented by the Customer’s request and the Searcher’s knowledge of the area and experience

I. Residential Property-Residential condominium unit, platted lot, metes and bounds less than 25 acres

• Search back TWO bona fide Deeds and ONE Purchase Money Mortgage transaction to an institutional Lender, not an individual;

• If you are unable to locate two bona fide Deeds or one Purchase Money Mortgage transaction to an institutional lender , you must search further back in the to a maximum of 30 years, and a standard (30) year search will need to be provided;

• A “bona fide Deed” is a Deed that appears to be an arms length transaction between two unrelated people. If the Grantor or Grantee appear to be related or you have knowledge that there was no consideration (i.e., Quitclaim Deed, Affidavits, Deeds in Lieu of , Deed resulting from Dissolution of Marriage), you must search back to a prior bona fide Deed;

• Search taxes and assessments including homeowner’s or condominium assessments and other governmental charges such as municipal assessments in the county tax records;

• Search the records of the county recorder’s office within your search period for any , Mortgages, leases, including oil and gas leases, mineral rights, , UCC (5 years only), and other encumbrances affecting title to the property;

• Provide information on matters disclosed by Plat;

• Perform a ten year Judgment search and a twenty year search for the time period of limitations on Federal Judgments (20 years) and Federal Tax Liens (10 years) in the County Clerk’s office for: o the most recent Owner of record which is not a Trust and obtained title via a “bona fide” Deed, and all subsequent owners that have held title within the past 10 years o all unreleased Land Contract interests o all foreclosed parties found within our search parameters (or within the past 10 years, whichever is most recent; Foreclosure only);

• Search the Bankruptcy Court Clerk’s office for properties located in the same county as a Federal Bankruptcy Court: Allen, Floyd, Lake, Marion, St. Joseph, Tippecanoe, Vanderburgh, & Vigo Counties Only;

• Obtain all chain of title documents within your search period;

• You do not need to search the name of a proposed purchaser on a purchase transaction. Confirm with Customer that transaction is a purchase transaction before omitting the name search on a proposed purchaser;

• You may search forward from a prior ALTA 2006 Owners Policy, Homeowners Policy, Loan policy or reliable Commitment provided to you by customer, if you begin your search one year prior to the effective date. Please ask the underwriter if questioning reliability. However, you may not search forward from ALTA Short Form Residential loan policy, Junior Policy or Home Equity policy;

II. Residential Foreclosure Search/Pre-Foreclosure

• Same requirements as I. above;

III. Metes and Bounds more than 25 acres

• Standard thirty (30) year search;

IV. Post-Foreclosure Search-REO property

• Same requirements as I. above;

• Provide customer with a copy of foreclosure complaint, foreclosure judgment and sheriff’s deed;

V. Additional Requirements for Matters Disclosed by Search

A. Divorce: If your search discloses a dissolution of marriage or pending dissolution: a. Provide customer with a copy of the petition for dissolution, if pending b. If final decree entered, provide customer with a copy of the Dissolution Decree and Settlement Agreement, if applicable c. Provide customer with a copy of the chronological case summary of the divorce proceeding

B. Death: If your search discloses that one of the parties has died or an estate has been opened: a. Unsupervised estate: Provide customer with a copy of the Petition for Unsupervised Estate and Order Appointing Personal Representative of the Estate b. Supervised Estate: Provide customer with the same documents as in an Unsupervised Estate and Order Authorizing the Sale of the and Order Confirming the Sale if Sale prior to July 1, 2005. c. Heirship, Survivorship or Small Estate Transfer Affidavit: Provide customer with a copy of the affidavit vesting title in heirs and/or devisees

C. Bankruptcy: Provide customer with a copy of the recorded petition or Bankruptcy Case number

D. Mineral Rights or Oil and Gas Lease: Provide customer with a copy of the document transferring or reserving mineral rights or copy of the Oil and Gas Lease

E. Foreclosure: Depending on the status of the foreclosure, provide customer with a copy of the chronological case summary for the foreclosure proceeding, a copy of the foreclosure complaint and decree, a copy of the sheriff’s return of sale or order setting the foreclosure sale, and a copy of the Sheriff’s Deed
