Affirmave Acon P olicy United States Title IX and New Jersey Statutes 6:4 prohibit discriminaon against students and employees in public schools K-12. Whereas Title IX prohibits discriminaon based on sex, Title 6:4 goes further and prohibits it on the basis of race, color, creed, religion, sex, ancestry, naonal origin, or social or ec onomic s tatus.

Both tles require that all policies, procedures and pracces of the school district be non-discriminatory, and that there be no sex segregaon in courses, educaonal programs, or extracurricular acvies. No course, including but not limited to, physical educaon, health, industrial arts, business educaon, vocaonal courses, home economics, and music, shall be offered separately. If a student or member of the staff alleges a violaon of such regulaons, he or she may submit a grievance. The process begins by verbally nofying the Title IX Affirmave Acon Officer, High School Assistant Principal at 973-228-1200, of the alleged violaon within ten (10) days of its occurrence. A detailed descripon of the grievance procedure is available in each district school and in the Superintendent's Office. The Affirmave Acon Officer is available t o ans wer an y ques ons fr om the public c oncerning Title IX or Title 6:4 r egulaons.

10 Sexual Har assment Sexual harassment is conduct of a sexual nature that makes someone, male or female, uncomfortable or embarrassed. The conduct may include female to male, male to female, female t o f emale, and male t o male.

The Equal Employment Opportunity Commission (EEOC) expresses sexual harassment as sexual aenon tha t is: ● Unwelcomed and un wanted. ● Harmful t o a per son’s health and ability t o perf orm one’ s job. ● Illegal acc ording t o f ederal la w and also mos t s tate, c ounty and loc al la ws.

Students or staff who feel they are the object of sexual harassment should contact the Affirmave Acon Officer , the High School Assis tant Principal, 973-228-1200.

504 Commi ee The Rehabilitaon Act of 1973, secon 504 is a Federal Civil Rights statute which protects the rights of persons with disabilies. Secon 504 prohibits discriminaon against handicapped persons, including both students and staff members, by school districts receiving federal financial assistance. The West Essex Coordinator designated to handle inquiries regarding nondiscriminaon under Secon 504 is the Director of Guidance, West Essex High School, 973-228-1200 ext 220. Included in the U.S. Department of Educaon regulaons for secon 504 is the requirement that handicapped students receive a free and appropriate educaon (FAPE).

School districts have specific responsibilies under the Act, which include the responsibility to idenfy, evaluate and if the child is determined eligible under secon 504, to afford access to appropriate educ aonal ser vices.

Intervenon and R eferral Ser vices The educaonal mission is made more complex by the increased incidence, prevalence and intensity of problems students bring to school. Due to these at risk behaviors, the school provides a program of intervenon and referral services (I&RS) for general educaon students. Referrals to this commiee can be made by counselors, parents, or any other staff member with concerns about a specific student. The commiee will collecvely suggest appropriate intervenons t o be tried in the classr oom se ng.

11 Student Righ ts and R esponsibilies As students, you have a fundamental right to a free public educaon. Along with this right is the corresponding responsibility to join with other members of the school community in respecng one another .

You also have the right and responsibility to live by the rules of law and to equal protecon under the law. It is your obligaon to obey school regulaons and the school authories who enforce them. This responsibility relates to your conduct on school buses as well as in the building itself .

Grievances Official avenues for the expression and correcon of student concerns are available in this school district. Students may express their concerns through their elected representaves in the student g overnment, or dir ectly t o the principal, as outlined in Boar d of E ducaon policy #9130 .

The procedure will include a discussion of the problem and the interchange of views between students and the professional staff in order to resolve dissasfacon informally on a person-to-person basis as expediously as possible. When a contract with an employee conflicts with this policy , the c ontract will t ake pr ecedence. Whenever a student or parent/guardian has a complaint relang to the school district, the complainant should first aempt to resolve the dissasfacon informally with the party involved. If the complainant is not sasfied, the complainant should aempt to resolve the dissasfacon in formally with the s taff member ’s super visor and then the building principal. If not resolved to the complainant’s sasfacon, a wrien explanatory statement should be submied along with a wrien response from the staff member involved to the staff member’s supervisor and then to the building principal. The statement should include those items set forth in Policy 9130 . Any complainant who is dissasfied with the determinaon of the supervisor, and then of the principal, has the righ t t o appeal in wring t o the superin tendent.

Graduaon R equirements Minimum requirements for graduaon, as established by the State of New Jersey and the West Essex Regional Board of Educaon, states that all students in grades 9-12 must accumulate a total of 135 cr edits t o gr aduate including:

No student who has completed the requirements for graduaon shall be denied a diploma as a disciplinary measure, but he/she may be denied parcipaon in the graduaon ceremony if the student’s personal conduct so warrants. Such exclusion shall be regarded as a school suspension and shall be subject to the same procedures and guarantees of due process as suspension.

An educ aonally handic apped s tudent shall mee t all s tate and loc al high school gr aduaon requirements in or der t o r eceive a s tate endor sed high school diploma unless e xempted in the student’s Individualiz ed E ducaon Pr ogram (IEP) with the wri en appr oval of the chie f school administrator. The IEP shall be de veloped in acc ordance with N. J.A.C. 6:28-3.6 and shall specifically addr ess the gr aduaon r equirements and specif y which r equirements w ould qualif y the s tudent f or a s tate endor sed diploma.

If an educaonally handicapped student aends a school other than that of the local school district, the student shall have a choice of the diploma from the district of residence or from the school which the student aends if the school is empowered to give a diploma. Fulfillment of the student’s IEP will qualify an educaonally handicapped student for an elementary diploma if elementary diplomas are granted by the district. Educaonally handicapped students shall have

14 opportunies to parcipate in graduaon exercises and related acvies on a nondiscriminatory basis.

Program Selecon With the assistance of their counselor, using the recommendaons provided by their classroom teachers, students will select their courses. Parents are encouraged to contact the counselor if they have any quesons regarding course selecon. A typical program consists of eight periods of instrucon, usually five academics, physical educaon and one or two elecves. Courses are offered based upon student enrollment. Under-enrolled courses may be cancelled prior to school opening. Students are required to select alternate elecve courses in priority order. District graduaon requirements may not fulfill all college entrance requirements. It is essenal that students review the specific entrance requirements for all colleges on their personal applicaon list. Selecve/compeve colleges recommend that students have 20+ academic courses. Dropping a course aer the Drop/Add period in September will result in a WP or WF on the student’s report card and permanent transcript. This will necessitate placement in a study hall. No mor e than one s tudy is permi ed.

**All schedule changes are dependen t on seat availability** It should be noted that a senior who withdraws from a course is placed in a unique posion. If a transcript for a senior has already been sent to a college or university such that the dropped course appeared on the official transcript as a course in progress, it will be necessary for the

16 college or university to be informed of that dropped course. The integrity of official transcripts mandates such acon. The Director of Guidance or the counselor will inform the college or university of this chang e in the s tudent’s pr ogram.

Doubling–up R estricon Students are not permied to “double-up.” This means any student who fails a prerequisite course may not take the next course in the curricular sequence unl the prerequisite course is passed. It is firmly believed that the restricons are in the best educaonal interests of the student.

Examinaons Raonale: Examinaons measure mastery in the content area and are posive in nature. They measure accountability, enhance producvity, and provide valuable experience for situaons encountered in higher educaon. Final examinaons are to be administered in both semester and full year courses. Students are required to sit for examinaons during the regularly scheduled examinaon period. Any request for changes by parents/students must be presented in wring with appr opriate documen taon t o the assis tant principal. Length: Mid-term, semester course examinaons are approximately 90 minutes in length. The exam schedule will be dis tributed prior t o e xam da tes. Content: In full-year subjects, the material covered in PBAs will stress the content of the second semester. It is noted, however, that in many disciplines the final examinaon will contain some material c overed in the fir st semes ter due t o the sequen al na ture of the c ourse c ontent. Exempons: Only seniors may be exempt from PBAs. Seniors will be exempt only if they have a B+ or be er each marking period and on the midt erm e xam.

Grading 1. Any student receiving failing grades in both the 3rd & 4th marking periods will fail the c ourse f or the y ear.

Guidance / Studen t Ser vices All students will have a Guidance Counselor assigned to assist them with their transion to the high school. All s tudents ar e assigned t o the same c ounselor f or all f our y ears.

Student Assis tance Counselor The district employs a Student Assistance counselor who is available to students who may require addional support. The Student Assistance counselor is a Licensed Cerfied Counselor trained to help students with a host of adolescent and family issues. All sessions are confidenal, and parents are welcomed to contact the Student Assistance Counselor should a concern arise. Students who are experiencing problems dealing with any form of substance abuse may in confidence c onsult with the Studen t Assis tance Counselor .

Desire f or Non-R elease of In formaon According to the No Child Le Behind Act, each local educaonal agency will provide armed forces recruiters access to names, addresses and telephone numbers of all secondary school students within the district. Should a parent not wish for this informaon to be released, wrien r equest mus t be pr ovided.

18 Home Ins trucon ( Policy # 2412 ) Home Instrucon is available for students who are confined to home for extended periods of me. To apply for this service, a parent must submit a physician’s note explaining the nature of the medical condion and the approximate me necessary for recuperaon. The parent should contact the child’s guidance counselor. Home instrucon must have approval from school physician. Home instrucon will only be provided to students whose medical documentaon indicates a lik elihood of a minimum tw o-(2) w eek ab sence.

Making Up W ork Make-up work should be completed as quickly as possible. All missed work should be completed in the amount of me EQUAL TO the me missed (a day for a day). This policy does not pert ain t o s tudents who ar e truan t or who cut class.

Academic In tegrity West Essex Regional advocates for high standards of intellectual honesty and conduct as the foundaon of our Academic Integrity Policy. In order to create an ethical learning environment, students must recognize that they are responsible for their choices. Their acons are a direct reflecon of themselv es, as w ell as the school c ommunity.

Preparedness f or Class Students are expected to be fully prepared with all materials in each and every class. This includes bringing a fully charged Chromebook to school on a daily basis. No extensions will be given t o a s tudent who is not pr epared f or class. All departmen tal policies f or la te w ork apply .

Dissecon Op t Out f or Studen ts The WERSD, therefore, declares unethical and unacceptable behavior as just cause for taking disciplinary acon. Students will be removed from the network for inappropriate use of computers. West Essex Regional School District offers students alternaves to animal dissecon in relevant coursework if their parents choose to opt them out of the animal dissecon porons of a parcular course. Dissecon is defined as “the manipulaon of properly preserved animals or animal parts for scienfic study, which includes incising and may be followed by inspecng, touching, and handling. ”

Dissecon is a direct, hands-on learning experience that reinforces the knowledge of animal systems including, but not limited to, the circulatory, respiratory and digesve systems. Dissecon allows teachers to acvely engage students in the lesson and reinforces the learning that has taken place in the classroom. Students are able to apply their knowledge and advance their in terest in the scien fic pr ocess.

Alternaves to animal dissecon may include: computer programs, Internet simulaons, plasc models, videotapes, video dissecons, and charts. Alternaves to animal dissecon techniques are available in biological science classes that incorporate dissecon exercises. Alternave to dissecon techniques are designed to provide the student, through means other than dissecon, with knowledge similar to that expected to be gained by other students in the course who perf orm, parcipa te in, or ob serve the dissecon.

Students whose parents choose to opt them out of animal dissecon exercises are given informaon on specific acvies and resources to use as their alternave technique. These students are also provided assistance with alternave to dissecon techniques. Students are responsible for all required learning and assessments that take place in the classroom regardless of their decision t o dissect.

Pupil R ecords The Board of Educaon believes that informaon about individual pupils must be compiled and maintained in the interest of the pupil's educaonal welfare and advancement. The Board will strive to balance the pupil’s right to privacy against the district’s need to collect, retain, and use informaon about individual pupils and groups of pupils. The Board authorizes the establishment and maintenance of pupil files that include only those records mandated by law, rules of the State Board of Educaon, and authorized administrave direcve and those records permied by this Board. No liability shall be aached to any member, officer, or employee of this Boar d f or the furnishing of pupil r ecords in acc ordance with la w and rules.

The Superintendent shall prepare, present to the Board for approval, and distribute regulaons that implement this policy and conform to applicable state and federal law and rules of the State Boar d of E ducaon.

Noficaon of Righ ts Parent(s) or legal guardian(s) and adult pupils shall annually be nofied in wring of their rights regarding pupil records, including the right to prohibit the release of directory informaon. Copies of applicable federal and state laws, Board policy, and administrave regulaons governing pupil records will be made available to parent(s) or legal guardian(s) and adult pupils on r equest.

When the language of the parent(s) or legal guardian(s) or adult pupil is not English or the parent(s) or legal guardian(s) or adult pupil is deaf, the Superintendent shall, whenever possible, provide in terpretaon in the dominan t languag e or assis t in securing an in terpreter.

Due Pr ocess If consent to release pupil record informaon is refused by a parent(s) or legal guardian(s), the district shall instute due process hearing procedures as indicated in Policy and Regulaon No. 2460.

Content of R ecords Mandated records include the pupil's personal descripve data, daily aendance records, progress reports, and physical health records; records required for disabled pupils; and all other records required by the State Board of Educaon. Any school records with HIV idenfying informaon will be maintained in accordance with the standards set forth in N.J.S.A. 26:5C. Permied records include observaons and rangs by professional staff members acng within

21 the scope of their professional dues, samples of pupil work, informaon obtained from professionally acceptable standard instruments of measurement, educaonally relevant informaon provided by a parent(s) or legal guardian(s) or adult pupil concerning achievements and other school acvies that the parent(s) or legal guardian(s) or pupil wishes to make part of the pupil’s record, extra-curricular acvies and achievements, rank in class, academic honors earned, and wrien evidence of compliance with the requirements of this policy for noficaon and c onsent.

In all cases, informaon in pupil records must be educaonally relevant, objecve, and based on the first-hand observaon or personal knowledge of the originator. No record may be made or kept of a pupil’ s r eligious or polic al a ffiliaon or of an y indic aon of a pupil’ s illegimacy .

The Board will describe annually at a public meeng the pupil records that professional employees ha ve been authoriz ed t o c ollect and main tain.

Collecon and Main tenance of R ecords A single, central file will be compiled for each pupil and will be maintained in the office of the school to which the pupil has been assigned or, in the case of pupils assigned to a school or program outside the district, in the office of the child study team. If any record regarding a pupil is required to be kept outside that file, a notaon of its existence and locaon must be kept in the cen tral file.

The Superintendent shall be responsible for the security of pupil records and shall designate appropriate custodians of the records. The Superintendent shall ensure that all persons collecng or using personally idenfiable informaon are trained regarding the confidenality of personally idenfiable informaon. The Superintendent shall maintain for public informaon a current list of the names and posions of the employees within the school district who may have access t o per sonally iden fiable in formaon. Parent(s) or legal guardian(s) or adult pupils shall be informed when personally idenfiable informaon collected, maintained or used is no longer needed to provide educaonal services to the child.

The Superintendent shall require the destrucon of informaon when no longer needed to provide educaonal services at the request of the parent(s) or legal guardian(s) accept for the pupil’s name, date of birth, sex, address, telephone number, grades, aendance record, classes aended, grade level completed, year completed, name of parent(s) or legal guardian(s) and cizenship s tatus.

The Superintendent shall request the school records of a transferred pupil within two weeks of the pupil’ s enr ollment and shall ob tain pr oper iden ficaon of ne w pupils.

Computerized R ecords Pupil records stored electronically in a computerized system must be protected by programmed security blocks and safeguards that ensure both access to the full record by authorized persons and complete security against access by unauthorized persons. An updated hard copy of pupil records will also be main tained and will be subject t o all the r estricons of la w and this policy .

Access t o R ecords Access to pupil records will be available only to the pupil’s parent(s) or legal guardian(s), the adult pupil, appropriate school personnel acng in the educaonal interest of the pupil, and such other s as ma y be permi ed access b y rules of the St ate Boar d of E ducaon.

Every parent, except as prohibited by federal and state law, shall have access to records and informaon pertaining to his/her unemancipated child whether or not the child resides with the parent, unless that access is found by the court to be not in the best interest of the child or the access is found by the court to be sought for the purpose of causing detriment to the other parent.

A pupil’s parent(s), guardian(s) or legal custodian(s) may peon the court to have a parent’s access to the pupil’s records limited. The Board shall nofy the parent(s) or legal guardian(s) or adult pupil within five days of the date the order is obtained or evidence of the order is received that the r equest f or access is denied. The parent(s) or legal guardian(s) or adult pupil may appeal the denial to the court that issued the or der.

The Board is permied access to pupil records only through the Superintendent and when this occurs; the Superintendent shall delete the name of the student or other idenfying informaon prior to review or discussion with the Board of Educaon. Secretarial and clerical personnel are permied access to pupil records only to the extent necessary in the performance of their r esponsibilies, under the dir ect super vision of t eaching s taff member s.

Copies of pupil records may be made by those permied access to them at the fee established for the r eproducon of public r ecords in P olicy No. 8310.

A request for access to the record or reproducon of any of its contents must be granted or denied within ten days but no later than twenty-four hours prior to any hearing or review to which the requested record is pernent. No record shall be altered or destroyed between the me the wri en r equest is made and the r ecord is r eviewed.

23 Informaon in a pupil’s record may be released by a teaching staff member to the pupil, minor or adult, and to other appropriate persons in an emergency and for the purpose of protecng the health and sa fety of the pupil or other per sons.

A pupil’s records will be sent to the New Jersey School District to which the pupil transfers within ten days of the new district's verificaon of the transfer, in accordance with State Board rules.

All informaon in the pupil’s record related to disciplinary acon taken against the pupil by the district will also be sent to the receiving district without the consent of the parent or adult pupil pursuant to N.J.S.A. 18A:36-19a and N.J.S.A. 18A:36-25.1. The records of a pupil who transfers to a private school or to a school outside New Jersey will be sent to the new school only on the wrien permission of the par ent(s) or leg al guar dian(s) or adult pupil.

Directory In formaon The Board designates as pupil "directory informaon" a pupil’s name, address, telephone number, grade level, date and place of birth, dates of enrollment, parcipaon in officially recognized acvies and sports, awards received, previous school districts aended, the height and weight of members of district athlec teams and other, similarly nonintrusive specific informaon.

Directory informaon for all pupils in the district may be released without specific permission, except when such r elease is pr ohibited b y a par ent(s) or leg al guar dian(s) or adult pupil.

A district that receives funds under ESEA is required to provide, on request by a military recruiter or an instuon of higher educaon, access to the names, addresses and telephone lisngs for all secondary pupils. However, parent(s), legal guardian(s) and/or the adult pupil may r equest tha t such in formaon not be r eleased without prior wri en par ental c onsent.

Parent(s) or legal guardian(s) or adult pupils shall be provided with a ten day period to submit a wrien statement to the chief school administrator, or designee, to prohibit the instuon from including any and all types of informaon about the pupil in any informaon directory before allowing access to such directory and school facilies to educaonal, occupaonal and military recruiters.

24 Appeal of R ecord A parent(s) or legal guardian(s) or adult pupil may challenge the pupil’s record and may request the addion of material or comments or the deleon of material from the record. The parent(s) or legal guardian(s) or adult pupil may request a stay of disclosure pending final determinaon of any such challenge. An appeal must be made in wring to the Superintendent, who shall aempt t o r esolve the issue within t en da ys.

The issue may be further appealed, within ten days of the Superintendent's determinaon, to the Commissioner of Educaon or the Board of Educaon. Any appeal made to the Board will be determined within twenty days and aer opportunity has been offered for a hearing. A record of the appeal will be made part of the pupil’ s r ecord.

A parent(s) or legal guardian(s) or adult pupil may place a statement in the record, which will be maintained with the contested poron of the record and will be disclosed whenever the contested poron is disclosed.

Review, T ransfer, Pr eservaon, and Des trucon The records of currently enrolled pupils will be reviewed annually by appropriate teaching staff members, and permied records that are detrimental or no longer educaonally relevant must be deleted, except that no informaon shall be deleted from the record of a classified pupil without prior noce t o the par ent(s) or leg al guar dian(s) or adult pupil.

No record shall be kept of any such deleon or the materials deleted. Mandated informaon no longer necessary for the provision of educaonal services may also be destroyed, provided the parent(s) or legal guardian(s) or adult pupil has given wrien consent to the destrucon or reasonable efforts to nofy the parent(s) or legal guardian(s) or adult pupil and secure consent have been unsuccess ful.

When a pupil is no longer enrolled in this district, those records mandated by rules of the State Board of Educaon will be preserved in perpetuity. All other records will be destroyed, except that the pupil profile form, with aachments, of a pupil evaluated by Special Review Assessment will be retained for one year aer the pupil’s class graduates. The parent(s) or legal guardian(s) or adult pupil will be nofied in wring that the mandated educaonal informaon is being r eleased t o public schools wher e the pupil is no w enr olled or in tends t o enr oll. In addion, the parent(s) or legal guardian(s) or adult pupil will be nofied in wring that a copy of the enre pupil record will be provided upon request. No addions will be made to the pupil’s r ecord without the wri en c onsent of the par ent(s) or leg al guar dian(s) or adult pupil.

25 ATTENDANCE

Regular aendance by all students in the public schools of the State of New Jersey is a well-established, long standing state policy (NJSA 18A-38: 25, 26) that has been repeatedly upheld by the courts of the state as well as by the Supreme Court of the United States. The school cannot teach students who are not present. The enre process of educaon requires regular connuity of instrucon, classroom parcipaon, learning experiences, and study in order t o r each the g oal of ma ximum educ aonal bene fits f or each individual s tudent. The West Essex Regional Board of Educaon accepts responsibility in requiring all students to be regular in a endance and as a r esult has adop ted the f ollowing policy dealing with a endance.

Absenteeism and Loss of Cr edit Excessive absenteeism shall be defined as the accumulaon of more than 16 class absences in a full year course or more than 7 class absences in a semester course, and 4 class absences in Health class. All ab sences will be c ounted as une xcused e xcept: 1. Designated r eligious holida ys as appr oved b y the St ate Boar d of E ducaon. 2. Death in the immedia te f amily. 3. Personal illness which is verified in wring by the aending physician submied within 3 da ys of the ab sence 4. Two c ollege visits during junior y ear and tw o c ollege visits during senior y ear. 5. Absence V erificaon Specialized notes are required, i.e., college visits, driver’s license, doctor visit, religious observance, funer al, e tc. F orging not es is a suspendable off ense. Absences should be c alled in to the High School A endance Office (973-228-1200 e xt. 1235).

Student Responsibility – A note explaining the reason for the absence is to be submied to the aendance office secr etary no la ter than the thir d (3) da y f ollowing the s tudent’s r eturn.

Parent Responsibility – Parents should nofy the school by telephone on the morning of the student’s absence. Addionally, parents/guardians must also send a note explaining the reason for the ab sence the f ollowing da y.

Tardiness The Board of Educaon believes that promptness is an important element of school aendance. Students who are late to school or class miss essenal porons of the instruconal program and may create disrupons in the academic process for themselves and other students. Tardiness is recognized as being unavoidable at mes. Therefore, tardiness to school or to class will be permied f our mes be fore disciplinar y pr ocedures will be in voked b y the Assis tant Principal.

Late t o Fir st Block A student tardy to First Block, is one who is not inside his/her class before the 7:42 bell starts to ring. A warning bell rings at 7:37 a.m. Late to a class (block 1 - 6) is any student entering the classroom subsequent to the bell indicang the start of the period. Late to school, or classes, frequently results in loss of instruconal me and may have a decided effect on the academic achievement of the student. In an effort to insll in students a respect for educaon, develop punctuality, and demonstrate a wholesome work ethic, the following guidelines have been implemented:

1. Students who are tardy to First Block must report to the aendance office to sign in and will be issued a late pass. No student should enter first period class late without a late pass once class has begun. Students will be issued a warning at five incidents of tardiness, General Detenon at ten incidents, E-DASH at fieen incidents, and Saturday Detenon a t tw enty inciden ts of t ardiness.

2. Students who are tardy to classes (blocks 2 – 6) are subject to classroom rules and teacher detenons for the first four incidents of tardiness. Five incidents of tardiness will result in a General Detenon. Ten incidents of tardiness will result in an E-DASH. Fieen incidents of tardiness will result in a Saturday Detenon. The Assistant Principal may also issue Social Probaon (all extracurricular acvies and parking privileges prohibited).

Late Arriv al The Parent/Guardian shall submit a wrien noficaon of a late arrival to the Aendance Office. The note must include the reason for the student’s late arrival and a statement of why it was necessary to delay the student’s arrival at school. The student will then be issued a late slip and pr oceeds t o his/her assigned class and pr esent the not e t o the t eacher.

Early Check out A student who wishes to check out of school early must be signed out by a parent/ guardian or a per son on their emer gency c ontact lis t in Genesis. NO EX CEPTIONS Forging not es is a suspendable off ense.

A parent/guardian phone call to the aendance office confirming the early dismissal on the morning of the early dismissal is also required. (973-228-1200 ext. 235). At the me of check-out, the person transporng the student will meet the student in the Aendance Office to complete the check-out procedure. Students who are being dismissed early from the Nurse’s office must be signed out by a parent/guardian. Any student, regardless of age, must follow the check-out procedure. If the check-out procedure is not followed, the student may be suspended.

Pre-exisng c ondions At the beginning of the school year a parent/guardian should nofy the Assistant Principal’s office with a leer containing any pre-exisng condions of the student that might affect aendance or the s tudent’s ability t o r eport t o school on me.

CODE OF C ONDUCT / DISCIPLINE

Board Reg.5600 : Lack of knowledge of the school rules will not be accepted as an excuse for breaking the school rules .

BE IT ENACTED by the Senate and General Assembly of the State of New Jersey Secon 18A:37-2 (amended). Any pupil who is guilty of connued and willful disobedience, or of open defiance of the authority of any teacher or person having authority over him (or her), or of the habitual use of profanity or obscene language, or who shall cut, deface or otherwise injure any school property, shall be liable t o punishmen t and t o suspension or e xpulsion from school.

The general rules of the school have been formulated to promote operaon of the school in a manner beneficial to all students. It is expected that each student be familiar with the informaon in this handbook concerning the rules. This handbook cites penales for certain

29 types of misbehavior and for violaons of specific rules. It must be recognized, however, that all acts of misbehavior cannot be nearly catalogued and characterized into specific terms with specific penales wri en f or e very off ense which ma y occur .

Each disciplinary maer or incident will be treated individually. Disciplinary sancons are given at the discreon of the Assistant Principal. All discipline is progressive. Repeated offenses yield incr easing c onsequences.

Teacher detenon will be assigned for infracons within the classroom. The teacher will nofy the student and assign the detenon, at earliest, for the next day. Failure to report to a teacher detenon is a r eassignment of g eneral de tenon b y the Assis tant Principal.

General detenon is a period of approximately one hour, from 2:40-3:35, in a designated classroom, T uesday, W ednesday or Thur sday.

E-DASH (Extended Detenon aer School Hours) may be assigned for one or mulple days. E-DASH is fr om 2:45 - 5:00, T uesday, W ednesday or Thur sday in a designa ted r oom.

Saturday detenon will be held from 8:00 a.m. to 11:00 a.m. in a designated classroom. Students are required to be prompt and bring school-related work with them such as homework, study materials or reading material. Once dismissed, students are to leave the building immedia tely.

Suspension will temporarily preclude a student from taking advantage of all school acvies. The student must remain away from the school grounds and school events unl the day aer the suspension t erminates.

Social probaon prohibits a student from aending certain school-related funcons, including designated e xtracurricular acvies, senior ser vice and parking privileg es if applic able.

ELECTRONIC C OMMUNICATIONS BETWEEN TE ACHING STAFF MEMBER S AND S TUDENTS (POLICY #3283 )

The Board of Educaon recognizes electronic communicaons and the use of social media outlets create new opons for extending and enhancing the educaonal program of the school district. Electronic communicaons and the use of social media can help students and teaching staff members communicate regarding: quesons during non-school hours regarding homework or other assignments; scheduling issues for school-related co-curricular and interscholasc athlec acvies; school work to be completed during a student’s extended absence; distance learning opportunies; and other professional communicaons that can enhance teaching and learning opportunies between teaching staff members and students. However, the Board of Educaon recognizes teaching staff members can be vulnerable in electronic c ommunicaons with s tudents.

In accordance with the provisions of N.J.S.A. 18A:36-40, the Board of Educaon adopts this Policy to provide guidance and direcon to teaching staff members to prevent improper electronic c ommunicaons be tween t eaching s taff member s and s tudents.

The Commissioner of Educaon and arbitrators, appointed by the Commissioner, have determined inappropriate conduct may determine a teaching staff member unfit to discharge the dues and funcons of their posion. Improper electronic communicaons by teaching staff member s ma y be de termined t o be inappr opriate c onduct.

For the purposes of this Policy, “electronic communicaon” means a communicaon transmied by means of an electronic device including, but not limited to, a telephone, cellular telephone, computer, computer network, personal data assistant, or pager. “Electronic communicaons” include, but are not limited to, e-mails, text messages, instant messages, and communicaons made by means of an Internet website, including social media and social networking w ebsites.

For the purposes of this Policy, “professional responsibility” means a teaching staff member’s responsibilies regarding co-curricular, athlec coaching, and any other instruconal or

36 non-instruconal responsibilies assigned to the teaching staff member by the administraon or Boar d of E ducaon.

For the purposes of this Policy, “improper electronic communicaons” means an electronic communicaon be tween a t eaching s taff member and an y s tudent of the school dis trict when:

1. The content of the communicaon is inappropriate as defined in this Policy; and/or

2. The manner in which the electronic communicaon is made is not in accordance with acceptable protocols for electronic communicaons between a teaching staff member and a s tudent as de fined in this P olicy.

Inappropriate content of an electronic communicaon between a teaching staff member and a student includes, but is not limit ed t o:

1. Communicaons of a sexual nature, sexually oriented humor or language, sexual advances, or c ontent with a se xual o vertone;

2. Communicaons involving the use, encouraging the use, or promong or advocang the use of alcohol or tobacco, the illegal use of prescripon drugs or controlled dang erous sub stances, illeg al g ambling, or other illeg al acvies;

3. Communicaons regarding the teaching staff member’s or student’s past or current r omanc r elaonships;

4. Communicaons which include the use of profanies, obscene language, lewd comments, or pornogr aphy;

5. Communicaons tha t ar e har assing, in midang, or bullying;

6. Communicaons requesng or trying to establish a personal relaonship with a student be yond the t eaching s taff member ’s pr ofessional r esponsibilies;

7. Communicaons related to personal or confidenal informaon regarding another school s taff member or s tudent; and

8. Communicaons between the teaching staff member and a student that the Commissioner of Educaon or an arbitrator would determine to be inappropriate in determining the teaching staff member is unfit to discharge the dues and funcons of their posion.

The following acceptable protocols for all electronic communicaons between a teaching staff member and a s tudent shall be f ollowed:

1. E-Mail Electronic Communicaons Between a Teaching Staff Member and a Student

a. All e-mails between a teaching staff member and a student must be sent or received through the school district’s email system. The content of all e-mails between a teaching staff member and a student shall be limited to the s taff member ’s pr ofessional r esponsibilies r egarding the s tudent.

b. A teaching staff member shall not provide their personal email address to any student. If a student sends an email to a teaching staff member’s personal email address, the staff member shall respond to the email through the school district email system and inform the student his/her personal email address shall not be used for any electronic communicaon be tween the t eaching s taff member and the s tudent.

c. A teaching staff member’s school district email account is subject to review by authorized school district officials. Therefore, a teaching staff member shall have no expectaon of privacy on the school district’s email s ystem.

2. Cellular Telephone Electronic Communicaons Between a Teaching Staff Member and a Studen t

a. Communicaons between a teaching staff member and a student via a personal cellular t elephone shall be pr ohibited. (1) However, a teaching staff member may, with prior approval of the Principal or designee, communicate with a student using their personal cellular telephone if the need to communicate is directly related to the teaching staff member’s professional responsibilies for a specific purpose such as a field trip, athlec event, co-curricular acvity, etc. Any such approval for cellular telephone communicaons shall not extend beyond the specific field trip, athlec event, co-curricular acvity, etc. approved by the Principal or designee.

3. Text Messaging Electronic Communicaons Between Teaching Staff Members and Studen ts

a. Text messaging communicaons between a teaching staff member and an individual s tudent ar e pr ohibited.

(1) However, a teaching staff member may, with prior approval of the Principal or designee, text message students provided the need to text message is directly related to the teaching staff member’s professional responsibilies with a class or co-curricular acvity. Any such text message must be sent to every student in the class or every member of the co-curricular acvity. Any such approval for text messaging shall not extend beyond the class or acvity approved by the Principal or designee.

4. Social Networking Websites and other Internet-Based Social Media Electronic Communicaons Be tween T eaching St aff Member s and a Studen t

a. A teaching staff member is prohibited from communicang with any student through the teaching staff member’s personal social networking website or other Internet-based website. Communicaons on personal website are not acceptable between a teaching staff member and a student. b. If a teaching staff member has a student(s) as a “friend” on their personal social networking website or other Internet-based social media website they must permanently remove them from their list of contacts upon board adop on of this P olicy. c. Communicaon between a teaching staff member and a student through social networking websites or other Internet-based social media websites is only permied provided the website has been approved by the Principal or designee and all communicaons or publicaons using such websites are available to every student in the class; every member of the co-curricular acvity and their parents; and the Principal or designee Reporng R esponsibilies.

A teaching staff member and student may be exempt from the provisions outlined in this Policy if a teaching staff member and student are relaves. The teaching staff member and the student’s parent shall submit noficaon to the Principal of the student’s school of their family relaonship and their e xempon fr om the pr ovisions outlined in this P olicy.

The provisions of this Policy shall be applicable at all mes while the teaching staff member is employed in the school district and at all mes the student is enrolled in the school district, including holida y and summer br eaks.

39 Harassment, In midaon and Bullying (P olicy # 5512 )

"Harassment, inmidaon or bullying" means any gesture, any wrien, verbal or physical act, or any electronic communicaon whether it be a single incident or a series of incidents, that is reasonably perceived as being movated either by any actual or perceived characterisc, such as race, color, religion, ancestry, naonal origin, gender, sexual orientaon, gender identy and expression, mental, physical or sensory disability, or any other disnguishing characterisc, that takes place on school property, at any school-sponsored funcon, on a school bus, or off school grounds as provided by Secon 16 of the An-Bullying Rights Act which substanally disrupts or interferes with the or derly oper aon of the school or righ ts of other s tudents and tha t: 1. A reasonable person should know, under the circumstances, will have the effect of physically or emoonally harming a student or damaging the student’s property, or placing a student in reasonable fear of physical or emoonal harm to his person or damage t o his pr operty; 2. Has the e ffect of insulng or demeaning an y s tudent or gr oup of s tudents; or 3. Creates a hosle educaonal environment for the student by interfering with a student’s educaon or by severely or pervasively causing physical or emoonal harm to the student.

Consequences and Pr oper R emedial Acon

Incidents of violence or vulg arity will ha ve an immedia te c onsequence. These inciden ts will also be reported to the An-Bullying Specialist for invesgaon. Confirmed cases of bullying, harassment and inmidaon are subject to further discipline. Any reported incidents of bullying, harassment or inmidaon will be referred to the An-Bullying Specialist for invesgaon.

40 Alcohol/Dangerous Sub stances #5530 The Board of Educaon recognizes that a pupil’s use of harmful substances seriously impedes that pupil’s educaon, and threatens the welfare of the enre school community. The Board of Educaon is commied to the prevenon of substance abuse and the rehabilitaon of substance abusers by educaonal means, but will take all necessary steps to protect the school community from harm, and from exposure to harmful substances. Accordingly, the Board of Educaon has established a comprehensive policy, and comprehensive substance abuse prevenon, intervenon, and treatment referral programs in the schools of this district. The complete Substance Abuse Policy #5530 is predicated on mandatory statutes adopted in the State of New Jersey. The policy can be accessed on the district website, and copies of the policy are also a vailable in the Office of the Superin tendent of Schools. A pupil who uses, possesses, or distributes, a substance as defined in N.J.S.A. 18A:40A-9 on or off school property, while under the jurisdicon of West Essex Regional School District personnel will be subject to discipline. Discipline will be graded to the severity of the offense, and will include suspension or e xpulsion. In compliance with N.J.S.A. 18A:40A-12, the following procedures will be adhered to when a student is suspected of potenally being under the influence of a substance. The Principal or his/her designee shall immediately nofy the parent/guardian, and the Superintendent of Schools, and arrange for the immediate medical examinaon of the pupil by a medical doctor, selected by the parent/guardian. The medical examinaon must include a mandatory drug screen perf ormed b y a licensed t esng f acility.

Discipline

1. Any violaon of Board rules prohibing the use, possession and/or distribuon of an illegal substance is a serious offense, and any pupil who violates a substance abuse rule will be disciplined accordingly. Discipline will be graded to the severity of the offense. Any student disciplined under the substance abuse policy will be required to produce a clean non-dilute, non-adulterated urine sample; complete a medical examinaon that indicates the student is able to resume regular school aendance; and must complete a full chemical dependency evaluaon at a state cerfied facility before resuming regular school aendance. Students must connue to test clean, and remain in good standing with the f acilies pr ogram in or der t o c onnue r egular school a endance.

This one-me payment per year covers all sports, clubs and co-curricular acvies for the enre school year. There will be a one-me fee of $100 for any high school student in grades 9 through 12 wishing to parcipate and $75 for any middle school student in grades 7 and 8. To be eligible for athlec compeon during the first semester (September 1 to January 31) of the 10th grade or higher, or the second year of aendance in the secondary school or beyond, a pupil must have passed 25% of the credits (30) required by the State of New Jersey for gr aduaon (120), during the immedia tely pr eceding ac ademic y ear.

2. To be eligible for athlec compeon during the second semester (Feb. 1 to June 30) of the 9th grade or higher, a pupil must have passed the equivalent of 12 ½ % of the credits (15) required by New Jersey for graduaon (120) at the close of the preceding semester (Jan. 31). Full-year courses shall be equated as one-half of the total credits to be gained for the full year to determine cr edits passed during the immedia tely pr eceding semes ter.

All students must be in school prior to the start of Block 3 (9:45 a.m.) to parcipate in school-related acvies tha t da y.

Students who are dismissed early must remain in school unl the conclusion of Block 4 (12:35 p.m.) to parcipate in school-related acvies that day. NJSIAA St eroid T esng P olicy In Execuve Order 72, issued December 20, 2005, Governor Richard Codey directed the New Jersey Department of Educaon to work in conjuncon with the New Jersey State Interscholasc Athlec Associaon (NJSIAA) to develop and implement a program of random tesng f or s teroids, of t eams and individuals qualif ying f or championship g ames.

Any student-athlete who possesses, distributes, ingests or otherwise uses any of the banned substances on the aached page, without wrien prescripon by a fully-licensed physician, as recognized by the American Medical Associaon, to treat a medical condion, violates the NJSIAA’s sportsmanship rule, and is subject to NJSIAA penales, including ineligibility from compeon. The NJSIAA will test certain randomly selected individuals and teams that qualify for a state championship tournament or state championship compeon for banned substances. The results of all tests shall be considered confidenal and shall only be disclosed

9. Student vehicles are subject to search if there is reasonable suspicion to believe that drugs, alcohol, tobacco or stolen property is present in the vehicle. If illegal or stolen property is found, the o wner of the v ehicle will f ace disciplinar y and/ or leg al c onsequences.

Transportaon Bus transportaon is provided for all students. Bus schedules are sent out each year. Missing a bus is not an e xcuse f or t ardiness.

Late buses are provided only on Tuesdays, Wednesdays and Thursdays for students aending aer-school acvies. The buses lea ve the bus loading ar ea a t 3:50 p.m. and 5:15 p.m.

Dress Code Students are expected to be clean and well-groomed in their appearance. Students are expected to avoid extremes in appearance that are so disrupve or distracng that the reacon of other students results in behavioral control problems. Dress or grooming that jeopardizes the health or safety of the student or of other students or is hazardous to school property will not be permi ed.

The student dress code stresses neatness and cleanliness more than any standard of conformity; therefore, any student reporng to school or any school funcon in what is

47 considered inappropriate dress is to be sent, or reported, to the Assistant Principal's office. If the student is in violaon of the dress code, appropriate acon will be taken. If a student does not comply with the school dress code, his/her parent/guardian will be contacted to bring a change of clothes. Lockers Lockers are assigned and maintained by the Maintenance Department and are the property of West Esse x High School; therefore, the y ar e subject t o sear ch b y school officials.

Each student in the school has his/her own locker. Students should not share lockers or combinaons.

Lockers should be locked at all mes. The school assumes no liability for arcles missing from lockers. Studen ts ar e r esponsible f or pr oviding their o wn lock f or ph ysical educ aon class.

All physical examinaon forms should be returned on the student’s first day of school. All new students to West Essex Regional School District shall present his/her immunizaon record to the school nurse upon enrollment. A physical examinaon shall be presented to the school nurse within 30 da ys upon enr olling in to school (N. J.A.C. 6A:16-2.2, (h),2.i)

Student-athletes requiring an athlec physical must have their examinaon completed by their own private physician. An examinaon of each candidate for a school athlec squad or team shall be conducted within 365 days prior to the first pracce session with examinaons being made available by the school physician for those students who do not have a medical home. The Health History Update Quesonnaire may be submied for each candidate whose medical examinaon was completed more than 90 days prior to the first pracce session shall provide a health history update of medical problems experienced since the last medical examinaon. Screening for auditory acuity shall be conducted on all 11t h grade students pursuant to N.J.S.A. 18A:40-4.3 4. Screenings will be conducted by the school physician, school nurse, physical educaon instructor, or other school per sonnel pr operly tr ained. 6. Medicaons: R equirement and Guidelines Before any medicaon, prescripve or over-the counter, can be administered to a student by the school nur se, the f ollowing in formaon mus t be pr ovided:

1. Wrien Physician’s Statement: The physician must provide a wrien statement, which clearly idenfies the medicaon, its purpose, the dosage, and the mes when it is t o be t aken.

2. Signed Parental/Guardian Authorizaon: The parent/guardian must complete and sign a District Consent Form which authorizes the school nurse to administer the medicaon.

3. Original Label and Container: The medicaon must be in its original container with the original label. Upon request, some pharmacies will give two labeled boles, one for school and the other f or home.

4. Medicaon will be k ept locked in the Nur se’s Office.

5. The school physician, cerfied school nurse or a non-cerfied school nurse, substute school nurse employed by the District, the student’s parent or legal guardian or the student who is approved to self-administered in accordance to N.J.S.A.18A:40-12.3 and 12.4, and school employees who have been trained and designated by the cerfied school nurse to administer epinephrine in an emergency in pur suant t o N. J.S.A. 18A:40-12.5 &12.6 .
