Counter fraud and compliance Schedule 1 Sums to be disregarded in the calculation of earnings Schedule 2 Sums to be disregarded in the calculation of income other than earnings Schedule 3 Disabled child additional disregard Schedule 4 Capital to be disregarded 6 | P a g e Council tax support scheme Section 1 Details of support to be given to working age customers for the financial year 2021/2022 1.0 Introduction to the council tax support schemes 1.1 The following schemes have been adopted by the Council on 24th February 2021 in respect of the period 1st April 2021 – 31st March 2022 1.2 This document details how the schemes will operate for both working age customers and those working age customers who fall into the protected group and, in accordance with Section 13A of the Local Government Finance Act 1992, specifies who will be entitled to a reduction under the scheme, Council Tax Reduction Schemes (Prescribed Requirements) (England) Regulations 2012 and the Local Government Finance Act 1992 (as amended) and is effective from 1 April 2019 for a period of one financial year. 1.3 The scheme in respect of pension age applicants is defined by Central Government within the Council Tax Reduction Schemes (Prescribed Requirements) (England) Regulations 2012 and the Local Government Finance Act 1992 (as amended). The Council has no discretion in relation to the calculation of council tax support in respect of the pension age scheme other than the full disregard of war pension and war disablement pension and it is designed to provide broadly the same level of support provided within the previous (Council Tax Benefit) scheme. 1.4 Full details of the working age schemes of the authority are contained within this document from section 2 onwards. The authority is required to specify a scheme for working age and therefore this non-protected scheme only applies to a person who; a. has not attained the qualifying age for state pension credit; or b. has attained the qualifying age for state pension credit and he/she or their partner, is a person on income support or on an income-based job seekers allowance. 1.5 The scheme shall not apply to any applicant who is subject to immigration control under Section 115 of the Immigration and Asylum Act 1999 and non-economically active EEA nationals. 1.6 To obtain support the individual (or partner) must: a. have not attained the qualifying age for state pension credit; b. be liable to pay council tax in respect of a dwelling in which he is solely or mainly resident; c. is not deemed to be absent from the dwelling; d. not fall within a class of person prescribed for the purposes of paragraph 2(9) of Schedule 1A to the Local Government Finance Act 1992 and excluded from the authority’s scheme; e. be somebody in respect of whom a maximum council tax reduction amount can be calculated; f. not have capital savings above £10,000; g. be a person in respect of whom a day in which s/he is liable to pay council tax falls within a week in respect of which the person’s income falls into one of the income bands, and h. have made a valid application for support. 1.7 Applicants entitled to a maximum reduction under this scheme fall into the income band 1 percentage reduction. Applicants who fall into income band 1 are: 7 | P a g e applicants whose calculated weekly income, in accordance with this scheme, is within the income range for income band 1 or those in receipt of income support or income based jobseeker’s allowance.

Of cases we take to the Social Security Commissioner we have a 71% success rate th C2/18-19(DLA) : Dated 18 ​ July 2018 ​ The Tribunal disallowed entitlement to the lower rate care component for the ‘Main Meal Test’ because of the appellant’s ability to drive an automatic car. At the Hearing the appellant said “Some days I can’t drive”. Chief Commissioner Mullan concluded that the Tribunal were under an obligation to explore the appellant’s aforementioned statement in greater detail. It had a duty to explore the frequency of the days he could not drive. He should also have been questioned on why he could not drive on these days. These are unknown issues that the Tribunal had a duty to explore in greater detail before reaching its conclusions. Its failure to fulfil its inquisitorial role renders its decision erroneous in law.     S.I. 1996/207 Jobseeker’s Allowance Regulations 1996 Contents (SD634/96) The Social Security Legislation (Application) (No. 8) Order 1996 (SD634/96) was made on the 1 November 1996 and approved by Tynwald 18 February 1997. That Order applies the Jobseeker’s Allowance Regulations 1996 to the Island as set out in the Schedule to that Order.     The Council Tax Reduction Scheme (Bassetlaw District Council) People of Working Age 2021/22 1 The following document sets out the Council’s Council Tax Reduction Scheme which will be effective from 1st April 2021. This revised scheme replaces the 2020/21 Council Tax Reduction Scheme. The scheme is prescribed by section 10 of the Local Government Finance Act (LGFA) 2012 and must be approved by Full Council under regulation 67 of the 1992 LGFA, as amended by schedule 4 part 2 of the 2012 Act.     SUBMISSION TO THE COMMITTEE FOR SOCIAL DEVELOPMENT: WELFARE REFORM BILL INTRODUCTION The Law Centre’s submission to the Bill is set out in a clause by clause format as sought by the Committee. At this point, amendments to the Bill have not been drafted as we would prefer to receive a sense of the areas in which the Committee would like to receive possible amendments. Moreover, many of our comments relate to proposed regulations which will be drafted following the Bill. The Law Centre has considerable concerns about the implementation of major items contained in the Bill for example, the introduction of Universal Credit and Personal Independence Payment. Nonetheless, we start from the premise that there is neither the time, money or IT within Northern Ireland to devise an alternative social security system. As a result, our response is aimed at improving the proposals designed for Great Britain taking into account the specific circumstances and needs of Northern Ireland. The Welfare Reform Bill is in large measure an enabling Bill with much of the detail left to regulations. There are a number of critical issues being left to regulations including the essential details governing entitlement to housing credit within Universal Credit, the final level of earnings disregards for the various category of claimants on Universal Credit, the details of what exactly will be required of people in the all work related requirements, the rates of benefit payable, the details of daily living activities and daily mobility activities which will govern entitlement to Personal Independence Payment etc. We do want to flag up issues which we think require scrutiny by the Committee and further clarity from the Department.
