$850 retainer (+ 50% travel quote outside of WNY) due on signing of contract to reserve date; balance due 21 days prior to wedding date.
1. ENTIRE AGREEMENT: This agreement contains the entire understanding between Andy Buscemi / Buscemi Photography and THE CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to change or add to this agreement is to do so in writing, and providing the document is signed by all the relevant parties.
2. RESERVATION: This contract between Andy Buscemi / Buscemi Photography shall not become effective until it is signed, and the retainer has been paid. At the time the contract takes effect, Andy Buscemi / Buscemi Photography will reserve the date and time agreed upon and will not make other reservations or accept other clients for said date and time. THE CLIENT understands that the service provided by Andy Buscemi / Buscemi Photography is unique and for this reason, in the event THE CLIENT cancels the contract for any reason, including acts of God, all monies paid shall be retained by Andy Buscemi / Buscemi Photography in order to offset its loss of business.
3. CANCELLATION: Cancellation must be provided in writing to Andy Buscemi / Buscemi Photography. In the event that THE CLIENT cancels the wedding photography services from the signing of the contract through 9 months before the wedding ceremony takes place, THE CLIENT agrees to pay Buscemi Photography liquidated damages equivalent to the retainer. In the event that THE CLIENT cancels the wedding photography services 9-3 months before the wedding ceremony, THE CLIENT agrees to pay Buscemi Photography liquidated damages equivalent to 35% of the collection cost. In the event that THE CLIENT cancels the wedding photography services 3 months to 21 days prior to the wedding ceremony, THE CLIENT agrees to pay Buscemi Photography liquidated damages equivalent to 50% of the collection cost. In the event that THE CLIENT cancels the wedding photography services less than 21 days prior to the wedding ceremony, THE CLIENT shall be required to pay the full balance due.
4. RESCHEDULING: In the event THE CLIENT requests to reschedule their wedding date, THE CLIENT must pay a rescheduling fee equal to the retainer. However, in the event of governmental agencies issuing laws or policies that prevent the wedding to take place due to acts of God or Force Majeure events such as pandemics it will become necessary to reschedule and Andy Buscemi / Buscemi Photography will waive this fee for any date that Andy Buscemi / Buscemi Photography is available to reschedule. Upon written correspondence between THE CLIENT and Andy Buscemi / Buscemi Photography agreeing on a rescheduled date, this contract will remain in effect for the rescheduled date. THE CLIENT acknowledges that Andy Buscemi / Buscemi Photography may not be available for all requested dates. In this event, should THE CLIENT elect to reschedule on a date Andy Buscemi / Buscemi Photography is unavailable, the cancellation policy will take effect.
5. FINAL IMAGE DELIVERY: Following the wedding, Andy Buscemi / Buscemi Photography agrees to have all portions of final image delivery as described in each available collection above completed no later than four months following the wedding date assuming timely response from THE CLIENT regarding the selection of any photos / approval of book design. Images are selected and edited at Andy Buscemi / Buscemi Photography's discretion and delivered work will not include all images photographed. Andy Buscemi / Buscemi Photography reserves the creative right to edit and release only those deemed creditable as professional in quality and within Andy Buscemi / Buscemi Photography's artistic standards. THE CLIENT understands and agrees that wedding photographs on USB drive from the wedding ship with the wedding book and a $125 early delivery fee will apply should digital photographs be delivered prior to shipment with the wedding book. THE CLIENT understands and agrees that wedding book design must be completed within 3 months of receiving an initial wedding book design draft. Any lack of response in communication by THE CLIENT regarding wedding book design that totals up to 3 months may result in THE CLIENTS forfeit of a delivered wedding book or any reimbursed credit. THE CLIENT understands and agrees that the password protected online gallery is available for 3 months and that a $125 fee will apply should the online gallery be needed past this time.
6. COOPERATION: It is recommended that THE CLIENT schedule a pre-event consultation in person or over the phone before the wedding date to finalize the actual shooting times and locations. The parties agree to positive cooperation and communication for the best possible result within the definition of this assignment. Andy Buscemi / Buscemi Photography is not responsible for key individuals’ failure to be present or to cooperate during photography sessions. The bride and groom agree to set aside 1½ - 2 hours for photographs which does not include the time to drive from one location to another or a hired videographer that requires hands-on time to direct. Shooting should commence at the scheduled time and if this time is not provided, Andy Buscemi / Buscemi Photography, will not be held liable for failure to take desired photographs.
7. HOUSE RULES: The photographer is limited by the guidelines of the ceremony officiant or the reception site management. THE CLIENT agrees to accept the technical results of this imposition on the photographer. Negotiation with the officials for moderation of guidelines is THE CLIENT’S responsibility.
8. COPYRIGHTS: The photographs, digital negatives or prints produced by Andy Buscemi / Buscemi Photography are protected by U.S. Copyright Law (all rights reserved) and Andy Buscemi / Buscemi Photography retains the copyright to all photos and images produced. Upon final payment by THE CLIENT, limited copyright release of the resulting images will be provided to THE CLIENT under which THE CLIENT may reproduce any physical image prints for personal use. THE CLIENT may also reproduce and distribute images via online distribution but agrees to use the watermarked version of the images identifying that the image was produced by Andy Buscemi / Buscemi Photography. Prior to an event where THE CLIENT intends to publish photographs or use photographs commercially, THE CLIENT must first obtain additional usage rights from Andy Buscemi / Buscemi Photography.
9. MODEL RELEASE: THE CLIENT hereby assigns and grants Andy Buscemi / Buscemi Photography and its legal representatives and assigns the irrevocable and unrestricted right to use and publish photographs of THE CLIENT or in which THE CLIENT may be included for editorial, trade, display, website and internet promotion, photographic contests, advertising, photography books, photography instructional books, or any other purpose (except pornographic or defamatory) in any manner and medium; and to alter the same without restriction. THE CLIENT hereby releases Andy Buscemi / Buscemi Photography and its legal representatives and assigns from all claims and liability relating to said photographs.
10. EXCLUSIVITY / GUEST PHOTOGRAPHY: It is understood that Andy Buscemi / Buscemi Photography will act as the exclusive wedding photographer. Andy Buscemi / Buscemi Photography reserves the right to bring one assistant in addition to any 2nd photographer with discretion. The scheduled photography time is for the exclusive use of Andy Buscemi / Buscemi Photography. Due to time constraints and the need for subjects to pay full attention to the shoot, it is requested that guest photography be done at a separate time from the professional photography session.
11. PAYMENT: THE CLIENT agrees that the retainer is required at the time of contract acceptance and the remaining balance is due at least 21 days prior to the wedding date or the contract may be terminated without liability to Andy Buscemi / Buscemi Photography.
12. PERFORMANCE / LIMIT OF LIABILITY: The performance of this contract on behalf of Andy Buscemi / Buscemi Photography shall be contingent upon any and all acts of God, including but not limited to flood, fire, warfare, government laws or regulations, electrical failure, epidemics, pandemics, strikes by suppliers, and/or any conditions beyond its control.
Andy Buscemi / Buscemi Photography declares that every effort will be made to provide high quality photographic services and will make every effort possible to capture any requested photographs. However, because a wedding is an uncontrolled event, Andy Buscemi / Buscemi Photography cannot guarantee delivery of any specifically requested image(s). Andy Buscemi / Buscemi Photography will not be held liable for the finished product or incomplete coverage in the event of any acts of God and / or time restrictions, policies, laws, regulations or constraints placed on Andy Buscemi / Buscemi Photography by THE CLIENT, government, wedding guests, vendors, planners, venues, ceremony, parks, hotels or any other entity associated with THE CLIENT’s wedding.
In the unlikely event of severe medical conditions, acts of God, or force majeure events it may be necessary to retain an alternative photographer. Andy Buscemi / Buscemi Photography will make every effort to secure a replacement professional photographer able and willing to fulfill this contract. If such a situation should occur and an alternative photographer is not found, liability is limited to the return of payments received less the cost of any fees incurred, including administrative fees, travel fees, or any other services already fulfilled, including the engagement session.
Andy Buscemi / Buscemi Photography takes the utmost care with respect to exposure, transportation and processing of photographs; including using professional-grade equipment and professional-grade backup equipment. However, in the unlikely event of THE CLIENT’S photographs being lost, stolen or destroyed for reasons within or beyond Andy Buscemi / Buscemi Photography control, liability is limited to the return of all payments received less the cost of any fees incurred, including administrative fees, travel fees, or any other services already fulfilled, including the engagement session. The limit of liability shall not exceed the contract price stated herein. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.
13. EVENT LOCATIONS: While Andy Buscemi / Buscemi Photography may offer THE CLIENT suggestions for locations to shoot wedding day portraits, it is THE CLIENT'S responsibility to secure all locations, including any reservation fees required to use a particular location or venue. THE CLIENT is also responsible of informing Andy Buscemi / Buscemi photography of any venue / location that requires liability insurance information be provided.
14. EVENT FOOD SERVICE: A meal is required (including any 2nd photographer) if hired for more than 6 hours in length. If a meal is not provided Andy Buscemi / Buscemi Photography photographers may leave the event for up to 60 minutes plus travel time to the nearest location for a meal without coverage at the wedding.
15. LONG-TERM AVAILIBILITY OF IMAGES: Andy Buscemi / Buscemi Photography will maintain all photography of the event for at least six months, after which Andy Buscemi / Buscemi Photography will not be responsible for retaining digital images or digital negatives from the wedding. After final image delivery has been completed, THE CLIENT is then responsible for maintaining and backing up all prints and digital images received.
16. SEVERABILITY: If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.
17. AMENDMENTS: This contract has been freely negotiated and shall be recognized as the entirety of the agreement. Only those changes or modifications specifically placed in writing, attached, dated and signed by THE CLIENT and Andy Buscemi / Buscemi Photography at the time of acceptance of this contract shall be recognized as amendments to this contract.
