Attached please find copies of the documents that were originally submitted to the Sunshine Ordinance Task Force on November 19, 2019 in response to Sunshine Ordinance Comglaint No. 19111. As of January 17, 2020 all records requested by Mr. Petrelis had been provided to him and there are no additional records responsive to his request.

Please share with the Task Force the following detailed account of our communications with Mr. Petrelis and our completion of his request .

• On October 7, 2019, Mr, Petrel is requested the immediate disclosure of all of Supervisor Mandelman's calendar items from January 1 through October 7, 2019, and all texts and emails, sent or received, from September 1 through October 7, 2019 .

• On October 81 we responded to Mr. Petrelis' request informing him that, due to the voluminous and indiscriminate nature of the materials requested, we were unable to provide all responsive records immediately, but would respond further by October 21, 2019. The purpose of an immediate disclosure request is to expedite the City's response to a simple, routine, or otherwise readily answerable request. For more extensive or demanding requests, the maximum deadlines for responding to a request may apply (Admin. Code §67.25(a)) . • On October 9, in response to the previous communication, Mr. Petrel is responded that he was in receipt of our communication and that he requested the release of responsive records on a rolling basis. In accordance with Administrative Code, Sec. 67.25, public records may be provided as soon as reasonably possible on an incremental or rolling basis such that responsive records are produced as soon as possible by the end of the same business day that they are reviewed and collected . • On October 15, we responded asking Mr. Petrelis asking whether there were any specific search criteria that he would like to apply with regards to emails due to the voluminous nature of emails received by the Supervisor, and our office's need to manually review communications for applicable redactions and withholdings of personal, personnel, or privileged information. We also noted to Mr. Petrelis that his request for text messages raised a number of technical challenges regarding searching for and producing these records and that we would begin with emails and calendars. On October 16 and October 17, Mr. Petrel is provided a series of search terms . • On October 23, in response to Mr. Petrelis' request that responsive records, including calendar entries, be provided on a rolling basis, we provided Mr. Petrelis with calendar entries from January-March 2019. These records totaled 100 pages. In this communication we noted that Mr. Petrel is' request was voluminous and required the careful review of calendar items and communications individually for applicable redactions to personal, privileged, and/or personnel information. We informed him that our office was prioritizing his request working diligently to process his requests, and would provide additional responsive records on a rolling basis as soon as they are reviewed and available . • On October 30, in response to Mr. Petrelis' request that responsive records, including calendar entries, be provided on a rolling basis, we provided Mr. Petrelis with calendar entries from April-June 2019. These records totaled 155 pages. In this communication we again informed him that our office was prioritizing his request working diligently to process his requests, and would provide additional responsive records on a rolling basis as soon as they are reviewed and available . • On October 31, Mr. Petrelis acknowledged receipt of the release of responsive records sent by our office on October 30 . • On November 12, Mr. Petrelis again acknowledged the receipt of the release of responsive records sent by our office on October 30 and noted that this was the "second batch of calendar entries" our office had submitted . • On November 12, in response to Mr. Petrelis' request that responsive records, including calendar entries, be provided on a rolling basis, we provided Mr. Petrelis with calendar entries from July-October 7, 2019. These records totaled 134 pages. This completed Mr. Petrel is' request for all calendar items from January 1 through October 7, 2019. In this communication, we informed him that our office was prioritizing his request and would now be working diligently to process his requests for emails and text messages and would provide additional responsive records on a rolling basis as soon as they are reviewed and available . • On November 19, in response to Mr. Petrelis' requests that responsive records, including emails sent and received, be provided on a rolling basis, we provided Mr. Petrel is with all emails sent or received from September 1 through October 7, 2019 that included his provided search terms. These records totaled 491 pages. This completed Mr. Petrel is request for all emails sent or received from September 1 through October 7, 2019 that included his provided search terms . • On January 17, in response to Mr. Petrelis' request that responsive records, including text messages sent and received, be provided on a rolling basis, we provided Mr. Petrel is with all texts sent or received from September 1 through October 7, 2019 that included his provided search terms. These records totaled 89 pages. This completed Mr. Petrel is request for all text messages sent or received from September 1 through October 7, 2019 that included his provided search terms. • On January 28, Mr. Petrel is acknowledged receipt of the release of responsive records sent by our office on January 17.

As demonstrated above, our office complied with Mr. Petrel is' request and did so in good faith, with consultation with the Records and Projects Manager of the Board of Supervisors and the City Attorney's office to ensure no violations were committed. We have supplied Mr. Petrelis with 969 pages of responsive documents on a rolling basis per his request. Each of these documents require individual review by staff for applicable redactions or withholdings pursuant to CA Government Code 6254; Evidence Code sec. 952; Evidence Code sec. 954; Code of Civil Procedure 2018.030; Government Code 6254(c), Art. I, sec. 1; CA Const., Evidence Code sec. 1041; Evidence Code sec. 1040; Government Code sec. 6254(k); and/or Government Code sec. 6276.32.

I look forward to discussing this matter further with the Task Force on September 2nd.

As Leadersin the communities the Equity Program was designed to benefit, we understand that it is our shared responsibility to ensure we arerepresented equitably within this process. Thus: we have crafted aseries of suggestions and policy imperatives designed to truly fosterequity in the emerging cannabis market, these suggestions are attachedto this letter, as well as contact information for our organization. Wewish to conclude this letter with a question: one without leadingintent- or malice, but intended to highlight the stakes of thisemerging enterprise: If we cannot create an Equitable, Innovative andSustainable Cannabis Industry in San Francisco, where CAN we do it? Dear Task Force Members,

This letter responds to Sunshine Ordinance Complaint No 19111 filed by Mr. Michael Petrelis. Our office has worked diligently and in good faith to comply with the public records request made by Mr. Petrelis on October 7, 2019. We have provided timely responses and worked cooperatively with him to submit the records he has requested, and to date have provided him with many hundreds of pages of responsive documents.

Below is a detailed account of our communications with Mr. Petrelis and our efforts to accommodate his request. • On October 7, 2019, Mr. Petrelis requested the immediate disclosure of all of Supervisor Mandelman's calendar items from January 1 through October 7, 2019, and all texts and emails, sent or received, from September 1 through October 7, 2019. • On October 8, we responded to Mr. Petrelis' request informing him that, due to the voluminous and indiscriminate nature of the materials requested, we were unable to provide all responsive records immediately, but would respond further by October 21, 2019. The purpose of an immediate disclosure request is to expedite the City's response to a simple, routine, or otherwise readily answerable request. For more extensive or demanding requests, the maximum deadlines for responding to a request may apply (Admin. Code §67.25(a)). • On October 9, in response to the previous communication, Mr. Petrelis responded that he was in receipt of our communication and that he requested the release of responsive records on a rolling basis. In accordance with Administrative Code, Sec. 67.25, public records may be provided as soon as reasonably possible on an incremental or rolling basis such that responsive records are produced as soon as possible by the end of the same business day that they are reviewed and collected. • On October 15, we responded asking Mr. Petrelis asking whether there were any specific search criteria that he would like to apply with regards to emails due to the voluminous nature of emails received by the Supervisor, and our office's need to manually review communications for applicable redactions and withholdings of personal, personnel, or privileged information. We also noted to Mr. Petrelis that his request for text messages raised a number of technical challenges regarding searching for and producing these records and that we would begin with emails and calendars. • On October 16 and October 17, Mr. Petrelis provided a series of search terms. • On October 23, in response to Mr. Petrelis' request that responsive records, including calendar entries, be provided on a rolling basis, we provided Mr. Petrelis with calendar entries from January-March 2019. These records totaled 100 pages. In this communication we noted that Mr. Petrelis' request was voluminous and required the careful review of calendar items and communications individually for applicable redactions to personal, privileged, and/or personnel information. We informed him that our office was prioritizing his request working diligently to process his requests, and would provide additional responsive records on a rolling basis as soon as they are reviewed and available. • On October 30, in response to Mr. Petrelis' request that responsive records, including calendar entries, be provided on a rolling basis, we provided Mr. Petrelis with calendar entries from April-June 2019. These records totaled 155 pages. In this communication we again informed him that our office was prioritizing his request working diligently to process his requests, and would provide additional responsive records on a rolling basis as soon as they are reviewed and available. • On October 31, Mr. Petrelis acknowledged receipt of the release of responsive records sent by our office on October 30. • On November 12, Mr. Petrelis again acknowledged the receipt of the release of responsive records sent by our office on October 30 and noted that this was the "second batch of calendar entries" our office had submitted. • On November 12, in response to Mr. Petrelis' request that responsive records, including calendar entries, be provided on a rolling basis, we provided Mr. Petrelis with calendar entries from July-October 7, 2019. These records totaled 134 pages. This completed Mr. Petrelis' request for all calendar items from January 1 through October 7, 2019. In this communication, we informed him that our office was prioritizing his request and would now be working diligently to process his requests for emails and text messages and would provide additional responsive records on a rolling basis as soon as they are reviewed and available. • On November 19, in response to Mr. Petrelis' requests that responsive records, including emails sent and received, be provided on a rolling basis, we provided Mr. Petrelis with all emails sent or received from September 1 through October 7, 2019 that included his provided search terms. These records totaled 491 pages. This completed Mr. Petrelis request for all emails sent or received from September 1 through October 7, 2019 that included his provided search terms.

As demonstrated above, Mr. Petrelis' allegations of violations to the Sunshine Ordinance (Sec 67.21) are without basis and untrue; our office complied with his request and did so in good faith, with consultation with the Records and Projects Manager of the Board of Supervisors and the City Attorney's office to ensure no violations were committed. To date, we have supplied Mr. Petrelis with 880 pages of responsive documents on a rolling basis per his request. Each of these documents require individual review by staff for applicable redactions or w ithholdings pursuant to CA Government Code 6254; Evidence Code sec. 952; Evidence Code sec. 954; Code of Civil Procedure 2018.030; Government Code 6254(c), Art. I, sec. 1; CA Const., Evidence Code sec. 1041; Evidence Code sec. 1040; Government Code sec. 6254(k); and/or Government Code sec. 6276.32.

Our communications with Mr. Petrelis, as well as the responsive records to his request that have been provided to date, are attached fo r your review.

Mr. Petrelis' request is expansive and burdensome - seeking thousands of pages of calendar entries, emails and text messages - and we have been working with Mr. Petrelis to release these records on a rolling basis and in a way that will allow the office to continue its routine functions in addition to processing this request. We will continue to work with Mr. Petrelis, as we have over the last six weeks, to complete the remainder of his request in a way that allows us to provide the records he seeks in good faith while minimizing the disruption to our office's public duties.

Mr. Petrelis' complaint is without merit and we request that the Task Force determine that our office has not committed any violation.

Figure 2 illustrates the vast majority of the $1 billion across the three bonds are for households earning less than 80% of Area Median Income (.A]).{[):

• The same 83% ($835 million) of the combined $1 billion in funds for public housing and low-income housing (including low-income housing for seniors and low-income residents in the Mission District) are for households earning 80% orless of AMI

• Between the Educator Housing andA.ffordable Housing Preservation main sub-categories, a significant portion - 7.8% ($79 million) - of the combined $1 billion in bonds is also reserved for households earning 80% orless of AMI.

• Excluding the DALP loans issue, 90.5% ($914 million) of the combined $1 billion in bonds are for households earning 80% or I ess of A]).{[, leaving those earning between 80% and 120% of AMI behind.

• Although the proposed 2019 Bond includes a $30 million category for Affordable Housing Preservation expected to produce a total of90 units, that category is for households earning 30% to 120% of A]).{[. It's not known how much of the $30 million will be preservation of units for very-low-income and low-income households earning 30% to 80% of A]).{[ vs. preservation of units for middle-income households earning between 80% to 120% of A]).{[, perhaps again leaving middle-income households behind.

Middle-Income Households Failed, Left Behind

Hartley replied to Supervisor Fewer on July 11: "We have failed t.o build affordable middle-income housing." That's who is being left behind. Hartley also testified that spending $100,000 more for a middle-income housing unit (other than for teachers) might deprive housing for the homeless. God forbid funding housing equity for middle-income households might impair housing for the homeless.

• Between 2007 and 2014 San Francisco produced a paltry 19% of the target for middle-income households earning between 80% and 1120% of .A]).{[-while producing 109% of the RHNA target for market-rate units for Above­ Moderate income households earning over 120% of A]).{[. Hartley also admitted on July 11: "Since 2014, the cio/ has produced 710 affordable middle-income units, 710." That is just 14.2% of the 5,000 middle-income units goal Mayor Lee had set for MOHCD. What an admission offailure!

• Of the 46,471 housing units constructed in San Francisco between 2001 and2018, 73.5% percent was for constructing 34, 169 market-rate housing units. All other household income levels split the remaining 26.5%, producing just 12,302 units. The 2,722 Moderate-Income units produced during that 18-year period represent 22% of the total 12,302 Affordable Housing units produced, but represent just 5.9% of the 46,471 total units. Obviously, the 2, 722 Moderate-Income units for households earning 80% to 120% of AMI do not in any way represent equity across RHNA production goals.

• The 2015 Bond spending mirrored the inequity of funding very-low-income and low-income housing production mirrored by RHNA actual production, and not funding middle-income housing production

Leading up to placing the $600 million Affordable Housing Bond on the November 2019 ballot, a new word cropped up: "equity," which MOHCD rolled out as a new tag line between March and June 2019 that reads: "Funding Housing Equity in San Francisco."

There's a lot of new talk about equity for seniors, equity for teachers and educators, equity for the homeless, equity for homeless transitional-age youth, equity for veterans, equity for low-income households, equity in the number of units constructed with two- or three-bedrooms to accommodate families, and equity for housing developments in underserved neighborhoods.

Back in reality land, left out of the equity conversations is the lack of equity for middle-income rental households for those other than teachers. After all, just 39 middle-income rental units for non-teachers ::fMiddle-Income Housing Equity. And "equity" for various vulnerable populations (explored in my full article) didn't happen in the 2015 Bond spending, either.

The elephant in the room that Supervisor Sandra Lee Fewer and MOHCD are ignoring is that middle-income rental housing production is being left behind, and failed, unless you are a teacher eligible for the Francis Scott Key Annex project.

Given the multiple problems described in this article, Vote NO on Prop A in November.

April 6 2019 - 1 :43 p.m . -A man was walking two small dogs down Market Street near Noe, one dog on leash and the other unleashed and roaming about several feet behind the man and his leashed dog. c March 26 2019 -A man had his dog loose on Sanchez near Dorland St.

March 24 2019 - 4:03 p.m. - On my way out of the gym at 2301 Market Street I first encountered an off-leash black Lab and then an off-leash standard poodle, all at the corner of Market and Noe.

March 24, 2019 - 3 ·09 pm - On my way into the gym at 2301 Market Street I had to pass a man, on a busy sidewalk, with two really large dogs off leash on the comer of Market and Noe.

March 21 2019 - 3·04 pm -A large dog was lying on the MUNI island at the end of the line on 17th Street at Castro. It was off leash and, though there were people around, it was unclear who the dog might be with.

March 18 2019 - 2:37 p.m. -An unleashed, unattended dog was lying on the sidewalk at the comer of Market Street at 16th. I'd never seen anything quite like this in San Francisco in that no one was anywhere near the dog or paying attention to it. Video available.

March 17 2019 - 2·04 pm - The man from 334 Noe Street was again outside the building with his dog off leash on the sidewalk in front of the building, obliging any human being using the sidewalk to encounter his off-leash dog.

March 16, 2019 - 2·55 pm - Two men standing by the parked cars on Sanchez between Dorland and 18th Street were letting two small dogs run around loose on the sidewalk near where I live.

March 14 2019 - 11-54 pm -A dog that I've seen unleashed in the neighborhood many times, with different humans and different leashed dogs, was again off leash on Noe near 17th Street with a man who had one other leashed dog with him. March 9 2019 - 3-57 pm. -A unleashed small white poodle was loose on the comer of Noe and 17th Streets, in front of the grocery store there.

March 8 2019 - 1 :48 p.m. - On Market Street near Kearny, not far from the Walgreen's on that block, a large dog (a German Shepherd mix?) was completely loose and wandering unattended on the sidewalk. Eventually, the dog headed towards a man walking down the sidewalk at some distance - a man who may have been the owner but who never once looked back to check on the animal.

March 7 2019 - 12: 00 p.m . -A woman with her medium-sized, leashed dog at the comer of Sanchez and 16th Streets suddenly, for no discernible reason, unfastened the dog and let it continue down the sidewalk unleashed.

March 7 2019 - 10:57 am. -A man was shuffling around his parked car on Noe at Ford Street - perhaps the owner of the two dogs unattended on the sidewalk at the comer there, one leashed to a fence and the other unleashed and ambling about.

March 3 2019 - 4:48 p.m. - Two men were walking down Noe Street towards Ford Street, each with a dog (one small, one large) on a leash. After turning onto Ford, the man with the large dog unleashed the dog and allowed it to wander down the sidewalk far ahead of the men.

February 28 2019 - 12:19 p.m. -A man had his dog off leash and rambling about on the grassy border of City Hall. Video available.

February 27 2019 - 6:16 p.m. -A woman had two large dogs she was walking in the twilight on Ford Street, one on leash and one off leash. I told her the off-leash dog was supposed to be on leash at all times as well. Making up some rule of her own, she stated that the dog was within ten feet of her, and I recited to her the law that requires a leash no longer than eight feet as I pulled out my cell phone to take a photo of her off­ leash dog relieving itself in someone's little fenced-off "garden" around a three - but was put on the defensive when her leashed dog began lunging and barking at me. She brought the leashed dog under control, but never made any attempt to leash the other dog.

February 15 2019 - 5:59 p.m . - Two different people, coming from opposite directions, had small dogs off leash on the sidewalk in front of the Everett School on Church Street between 16th and 17th.

February 14 2019 - 1 :59 p.m. -A man had his dog off leash outside on the sidewalk in front of his apparent residence on Sanchez Street between Ford and 18th as the man attended to some housework.

February 14 2019 - 1 :33 p.m. -A loose, unattended dog was bounding up the sidewalk on Church Street between 18th and 17th - its presumed owner at least 20 feet behind it.

February 9 2019 - J ·50 pm - Two men were walking a large, muscular on leash at 17th and Noe Streets. As I started to cross 17th from the opposite direction, the man with the leash in his hand unleashed the dog at the collar. I told them the dog was supposed to be leashed at all times and was, of course, ignored. Video available.

February 5 2019 - 2·24 pm. -A man had his small dog off leash at the comer of 17th and Sanchez Streets.

January 23 2019 - 1 :16 p.m. -A small dog was running around loose on Market Street near Third Street, presumably with a woman who was walking far ahead of the dog and only periodically looking back at it. January 20 2019 - 4·24 pm - Man was crossing the street at Valencia and Duboce with a large dog (yellow Lab?) off leash.

January 17 2019 - 11 :58 am. - The man from 2 Ford Street again had his dog off leash on the sidewalk, down several yards from where the man stood talking to somebody, his back to his dog. I had to cross the street in order to avoid the unattended, unleashed dog.

Ianuary 3, 2019 - 1 ·24 pm - Outside City Hall, on the Grove Street side, a woman had two unleashed dogs roaming about freely on the grass there. A uniformed man with the Sheriffs Department waved to her in a familiar way - nothing said about the dogs. Video available (does not include the uniformed man).

January 2 2019- 3:44 p.m. -An off-leash dog was crossing Polk Street at Market­ possible with a man walking a couple of steps ahead of the dog (there were also other people crossing the intersection).

December 13 201 8 - 2:40 pm -A large dog was on the outbound J Church streetcar that I caught at Van Ness Station. It appeared to be with a young woman, but its leash was being held by no one and just trailed on the floor. Video available.

December 13 201 8 - 2·29 pm -A man on Polk Street between and Hayes Street and City Hall had a small dog off leash.

December 8 2018 - 10:47 am. - A dog is off leash and under no control by anyone on 17th near Noe Street. Video available.

December 7, 2018 - 6-30 pm - In the dark, someone had a small dog off leash at Church and 17th Streets. A few minutes later, someone else has their dog off leash in the dark on the block of Sanchez Street where I live.

December 4 2018 - 4:45 p.m. -As I exited City Hall following this afternoon's vicious and dangerous dog hearing, a large, off-leash dog (black Lab mix?) was roaming freely about, unattended, on the south side of the building. A person wearing some kind of white mask or scarf over his/her face eventually came to fetch the dog but did not leash it. Video available. Thx for the call today. Time well spent I think. Pursuant to our conversation on neighborhood policing and beat cops I ran into our two officers at 6 pm tonight on my way to meet a friend. I followed them for a couple of blocks and watched them engage with the homeless in front of Starbucks, and prevent a guy from walking into traffic. They were doing exactly what we want our police to be doing. I introduced myself to them both (young guys). Wish I had their names. Perhaps you can find them. Mentioned you and my role in the neighborhood. They said they are on the Castro beat all day. Anyway, lest you think all we do is complain, some fine young officers with the correct balance of safety and community. I'll try to find them again and send you their names. They deserve recognition.

Can you let us know of some possible times for an in-person meeting? Once we settle on a scope of work, budget, and timeline we can get Rick under contract in short order.
