RESIDENTIAL solar Financing Strategic and legal support in the residential solar space The solar energy MARKET is rapidly expanding. Having the right counsel can be a competitive advantage. The new wave of solar power is on the residential rooftop, using the third-party solar lease or power purchase agreement model, shifting high upfront capital costs from homeowners to third-party investors. U.S. RESIDENTIAL SOLAR PV FINANCING: The Vendor, Installer and Financier Landscape, 2013-2016, Shayle Kann, Vice President, Research | GTM Research Third-party financing of solar PV has become the predominant business model in some of the largest residential markets in the U.S.; today, third-party financed residential installations comprise greater than 50% of new capacity in California, Arizona, Colorado and Massachusetts, with the model gaining greater market share in other states such as Connecticut, Delaware, Maryland, New Jersey, New York, Oregon, Texas, Vermont, and Washington. Prior to 2010, there were few residential third-party ownership (TPO) vendors. SolarCity and Sunrun pioneered the residential third- party financing model, closely followed by Sungevity. SunPower entered not long after, offering residential leases through its enviable dealer network. Today, we count at least ten major TPO companies operating, and a number of others still getting off the ground. Each company has a unique business model; some have an in-house solar renewable energy credit (SREC) trading business, while others offer energy management services such as energy audits in addition to solar installations. TechSurveillance Solar Leasing and Solar PPA Programs: The Increase in Residential Photovoltaic Solar Deployment NOVEMBER 2013 This article explores the basic business model and solar leasing program offered by SolarCity*—the largest, vertically-integrated, and only publicly traded solar leasing company at this time. It will compare leasing programs to the traditional method of purchasing a solar system outright, describe how SolarCity makes money, and break down the elements driving profits, such as high retail power rates, declining costs, tax credits, and net metering rules. Finally, this article will make a few suggestions to electric cooperatives on how to deal with the threat of loss of kWh sales and possible advantages of third-party partnerships. INTRODUCTION The solar industry has benefited for years from state and utility incentives, federal investment tax credit (ITC), accelerated depreciation, and generous net metering laws. In the latest quarterly report published by GTM Research and the Solar Energy Industries Association (www.seia.org/research-resources/us-solar-market-insight-q1-2013), PV solar installations totaled 723 MW in Q1 2013, up 33 percent over Q1 2012, giving the U.S. a PV solar operating capacity of 7,962 MW—a 60 percent increase from two years ago. Despite the likelihood that these incentives will be less valuable over the coming years, GTM/SEIA forecast a strong 30 percent annual growth rate in solar installations through 2016 (see Figure 1). * There are a number of companies offering solar leasing across the United States, including Citizenre, BrightGrid, Sun Run, Vivint, SunEdison, and SunPower. Each company’s offerings vary based on geographic operations, target consumers, length of lease, and business model. -

Washington, DC 20500 Dear President Obama, As solar power installers, manufacturers, designers, aggregators, product suppliers, and consultants, we welcome the U.S. Environmental Protection Agency’s Clean Power Plan, the first-ever federal limits on carbon pollution from power plants. Power plants account for 40 percent of America’s carbon pollution. The solar industry offers a wide range of technologies to generate energy pollution-free from the sun and reduce the need for polluting sources of energy. This plan is a critical step toward transforming our energy system to one that protects our health and environment, and that of our children. As state and community leaders begin to seek effective measures to reach these goals, we wish to underscore the tremendous potential of solar energy in cutting carbon pollution. At the White House Solar Summit in April 2014, you highlighted that every four minutes, another American home or business goes solar. As the nation’s fastest growing source of renewable energy, solar can play a major role in meeting our nation’s energy and environmental challenges. Solar energy already provides enough pollution-free electricity to displace 18 billion pounds of coal, and could be a game-changer in a well-crafted Clean Power Plan. With 143,000 Americans employed in the solar industry in more than 6,100 businesses across the nation, we stand by Gina McCarthy’s remarks that “we have never—nor will we ever—have to choose between a healthy economy and a healthy environment.” The rate of job growth in the solar industry is unmatched by any other sector in the nation. -

Overview The 2017 Sustainable Energy in America Factbook marks the fifth year that BCSE and BNEF have collaborated to document the transformation of the US energy system and the growing contributions of sustainable energy technologies. In the past five years, these contributions have been significant, including: • The addition of 76 gigawatts (GW) of renewable energy generating capacity, and 39GW of natural gas-fired capacity. Renewables (inclusive of large hydro) and natural gas now meet half of US power demand, up from only 38% in 2011. • A 10% improvement in US energy productivity, meaning the US economy is using 10% less energy to power each unit of growth. • A 4% drop in average retail electricity prices in real terms. In New York, Texas, and Florida, prices have fallen over 10% in that time. • A 12% jump in total gas production, and a 79% surge in shale gas extraction since 2011. • A 12% improvement in vehicle fuel economy, propelled by federal fuel efficiency standards.
